Artie Fields, City Manager presented the Staff Report dated June 28, 2022.
Yakema Decatur, Deputy to the City Manager/Housing Protection Deputy Director, presented an oral report on the City of Inglewood's Short Term Rental (STR) Regulations.
She defined an STR and how STRs are primarily booked. She also stated that approximately 500 STRs in the City of Inglewood account for over 800 listings. As of June 15, 2022, 326 warning notices were mailed to those identified as operating an unpermitted STR . Ms. Decatur reviewed the purpose and stated the department intended to create an enforcement structure to maintain the residential neighborhood's tranquility, character, and integrity. At the same time, long-term Inglewood residents would be allowed to supplement their household income by benefiting from the city's desirability as a sports entertainment destination center. She also outlined the proposed policies for STRs hosted and unhosted, and vacation rental qualifications.
Council Member Morales inquired about the vacation rental, and asked does it apply to the whole house that the host is residing in?
Ms. Decatur informed Council Member Morales that it does.
Council Member Morales also inquired if the person must have lived in residence, been an Inglewood resident for ten years, and owned a separate home for a year .
Ms. Decatur stated and owned their primary residence for five years.
Council Member Morales asked if a person has owned a home for less than five years, but they ’re renting it from a duplex or a room in their home, are they okay.
Ms. Decatur stated yes, they are. She also stated she believed the proposal for duplexes, triplexes, and fourplexes kept the intention of the City Council when considering the mom-and-pop owners. It allowed them to make an additional income, especially with the impacts of the pandemic and not receiving rent .
Mayor Butts stated that the C ity gives people who o wn smaller apartment buildings the same opportunity as people who own single-family residences.
Ms. Decatur reiterated that duplexes, triplexes, and fourplexes owners ’ must reside on the property and have at least one vacant unity to operate as a vacation rental.
M ayor Butts commented that an owner couldn ’t be an LLC or live in another city and operate an STR as a business. He also stated the C ity is trying as best as possible to preserve housing access for people who want to reside in Inglewood, enabling those who live in the c ity to conduct the STR s. Finally, he stated that the C ity does not wish for companies to buy properties, making them STRs and eroding the housing stock. The Mayor asked Yakema if he was correct.
Ms. Decatur stated the Mayor was correct with his comment. She also stated that vacation rentals are limited to 90 days per calendar year. If an owner uses an S TR platform, they must pay the C ity the Transient Occupancy Tax (TOT) of 15.5%. Additionally, she added that the onus would be on the owner to ensure it was done.
June 28, 2022
4 Ms. Decatur reviewed the Registration Requirements and stated that every host that desired to obtain an STR permit must file an application with the city of Inglewood. They must also remit the annual registration fee, adhere to the rules and regulations set forth in the City of Inglewood's STR Ordinance, renew annually, and maintain an active STR permit and residential rental business tax certificate. Additionally, Ms. Decatur reviewed the Regulations and Prohibitions. She stated accessory dwelling units (ADUs) , and properties with five or more units on a parcel are not eligible to operate as an STR. She also stated that there are no party houses, and STRs remain subject to restrictions and limitations pursuant to the Homeowners Association's covenants, conditions, and restrictions. She further stated that STRs operating in permit parking districts would only be allowed one parking permit per booking for off-street parking.
Mayor Butts commented and clarified the term “ party houses, ” stating the term covers being rented out for an event.
Ms. Decatur reiterated that an owner of properties that have two or more units on a parcel must and are required to register with the Housing Protection Department. All registration fees and penalties must be paid before issuing an STR application. She discussed the hosting platforms and host responsibilities. She stated that STR hosts and platforms, such as Air BNB, VRBO, etc., are prohibited from advertising without a valid STR permit. In addition, they must remove any listings for STR from its platform upon notification by the City of the violation. She also stated that they are responsible for collecting and rem itting TOT and comply with all C ity TOT requirements. Ms. Decatur further emphasized that host platforms must disclose each short-term or vacation rental listing in the c ity monthly , along with the names of the person responsible for each listing, the address of each such listing, the length of stay for each such listing, and the price paid for each stay.. She further stated that the host must provide a code of conduct to all guests that include relevant information addressing behavior, safety, and security .
Ms. Decatur outlined the enforcement and stated that any action by an STR host or owner that is an infraction is punishable pursuant to Government Code 3 6900. She also stated that the C ity may issue and serve administrative subpoenas as necessary to obtain specific information regarding STR or vacation rental listings located in the city. Additionally, Ms.
Decatur stated any STR host who violates any provisions set forth in the STR Ordinance may be subject to administrative fines and penalties. Ms. Decatur thanked Sharon Kioke, Finance Director, who assisted her in composing a preliminary fee justification table. She reviewed the compiled fee table and stated the first table consisted of the different departments that would help process the permit applications; the second table estimated the money required to administer the program. The third table shows the total cost based on the number of STRs. She further stated that for 500 STRs, the total fee would be $854.25; for 750 STRs, the cost would be $724.18; and for 1,000 STRs, the price would be $659.15. She also stated that she believed it was proposed that the fees be reduced in the Interim because a comprehensive fee study was coming up. Finally, she proposed reducing the fees to $500 for hosted STRs and $600 for unhosted STRs.
Mayor Butts stated the Council would take that into consideration.
Ms. Decatur gave residents the contact information for any questions or concerns.
After further discussion, Ms. Decatur recommended making amendments to the Ordinance, which included: Section 8 -139, which is general regulation that states that the STR Host must reside at the dwelling unit for at least the last 365 consecutive days, and “ must be an owner ” also be included in that section ; Section 8-141, authorization and host responsibilities states accept and agree that the validity of an STR permit is predicated upon obtaining and maintain a valid STR business tax certificate, and she requested that it reads “ predicated upon obtaining and maintaining a valid residential rental business tax certificate. ”
Mayor Butts recommended to add and be cu rrent on the remittance of the C ity ’s TOTs for the operation of business.

Ms. Decatur inquired about the fees that are written in Resolution No. 22-101, and asked for direction from Council.
Mayor Butts agreed and addressed the issue of unhosted vacation rentals. He reiterated that the owners must have been Inglewood residents for ten years, owned their home for five years, and owned the proposed vacation rental for one year. Finally, he stated this would be a challenging requirement to fulfill.
Council Member Padilla stated he thought the Council was discussing the fees.
Mayor Butts stated he wanted to discuss Ordinance No. 22-12 and asked whether the Council wishes to have unhosted vacation rentals. He stated that several people spoke and felt they wouldn ’t want to live in their neighborhood with a vacation rental home, and he wanted the Council to make a conscious decision.
Council Member Morales stated that he was motivated by people living in Inglewood for several years and still residing in the city; they saved and bought a second home and used it as an STR. He also stated that was enough motivation to protect the neighborhood where they owned their second home.
Council Member Padilla stated that as long as the C ity had regulations and guidelines, people had to adhere to them. Otherwise, they would lose that opportunity. He also stated that if people don ’t do what they ’re supposed to do as a part of the C ity ’s regulations, they will lose the right to be unhosted.
Mayor Butts reiterated they would get shut down if people didn ’t follow the regulations and guidelines. He asked if the Council wanted to allow someone that owns two properties to take one of them off the market for permanent housing.
Council Member Morales stated he believed the C ity should still restrict owners for 90 days and understood the fear that the housing and the community could lose their integrity. In addition, he said he understood how it could negatively affect the neighbors, so he recommended people invest and live in Inglewood.

PUBLIC REMARKS. Mayor Butts inquired if there were any persons present who wished to address the City Council on any matter connected with City business not elsewhere considered on the Agenda.
Jim Cartel spoke in opposition to Ordinance No. 22-12. He stated that he was not an Inglewood resident but has owned the property since 2008. He also stated that he rents some of his property to long-term tenants and a portion as STR, which has allowed him to subsidize the rent of the long-term tenants. Mr. Cartel further stated that he believed it was ridiculous to stop people that are not Inglewood residents from operating unhosted STRs. Additionally, he added that STRs weren ’t the reason for rent increases and felt it was due to gentrification, such as the building of SoFi, and the Forum. Finally, he proposed that the Council look into developing a policy that owners of properties in Inglewood who have long-term renters on the property would find beneficial.
There being no further business to be presented, Mayor Butts thanked Sharon Kioke, Assistant Finance Director, and Captain Marie DiBernardo for staying the duration of the City Council Meeting, and adjourned the meeting at the hour of 5:40 p.m.
Approved this _____ day of ________ , 2022.
