E. PUBLIC COMMENT:

Larry Rhoades, commented:
• City of lone 2015-2016 Audit prepared by Larry Bain, CPA stated there was a receivable from JTS Communities for traffic fees in the amount of $504,000.

Councilmember Atlan commented that the $504,000 for traffic fees were deferred for 10 years in 2005 and became due in 2016. We tried to collect the debt, but JTS Communities filed bankruptcy and the auditor stated that it was not the debt of the current developer. Councilmember Wratten commented that this was a pass- through expense due to the Amador County Transportation Commission.

David Anderson commented:
• Hope the City can give me that same consideration and respond to my Public Comment
• Submitted a Public Record Request on April 7, 2022, asking for the following documents: 1) The authority to utilize McClatchy Company, LLC as the adjudicated newspaper of general circulation for legal notices published for the City of lone; and 2) The bid results for capital purchases (i.e. vehicles) submitted within the last 90 days. I have not received a reply. Mr. Anderson referred the Council to Government Code Section 6042 Obligation to advertise in the nearest newspaper of general circulation; Government Code 6250 Public Records Act and Government Code makes the violation of Government Code Section 6042 a personal liability to each of you.

Jeff Gold commented on previous employment of Interim City Manager Michael Rock. Mr.

Gold asked the Council if they were aware of these miss deeds of Mr. Rock prior to his employment with the City, and if they asked for full disclosure on why he was dismissed from his public service appointments from other cities.

Patrice Prest, asked for an update on the Landscape Committee that was supposed to be formed to look at the landscaping needs for Castle Oaks (median and frontage). Michael Rock commented that he sent an email to Patrice Prest on April 12, 2022, explaining where the City is at in the process. Hope to have the redesign within the next month or two.

H. REGULAR AGENDA:

5. Discuss and Consider approval of Resolution No. 2022-09, a Censure regarding Actions of Councilmember Rhoades.

1. Councilmember Rhoades was found by an independent investigator to have participated in threatening staff with termination because of his dislike of that person in May of 2019, and was subsequently asked to participate in trainings and conform his behavior to the standards of an elected official in the City of lone

2. Councilmember Rhoades has continued in a pattern of direct and indirect harassing behavior towards employees of the City of lone over the past two years, substantiated by another independent investigation received by the City of lone on or about February 7, 2022, whereby it was found that Councilmember Rhoades participated in discourteous, offensive, or abrasive conduct or language toward employees, including but not limited to being complicit in excluding employees from their workspace, disconnecting their telephones, excluding staff from meetings, and accusing staff of not being qualified for their positions.

3. Councilmember Rhoades in April of 2021 took it upon himself to use City equipment, without permission, to replace a pipe in the retention pond which subsequently raised the water level in a pond in Howard Park creating a substantial risk of harm to the health, safety and welfare of the citizens of lone should a 100-year flood event occur.

4. Councilmember Rhoades knew or should have known that authorized work on the Train Depot Park was being done in violation of public contracting code, including the building of a bathroom facility without acquiring the appropriate permits or utilizing the appropriate public comment process.

5. Councilmember Rhoades knew or should have known that non-employee immediate family were in possession of the City Credit Card in violation of City Policy and were using it in violation of that policy.

Councilmember Rhoades response:

1. I had nothing to do with him not being in City Hall. All personnel, along with my help worked in City Hall re-organizing the building department room and city hall. There was no room for many people to be in that room to begin with, plus Todd's office is at the maintenance yard with his employees.

2. Lori wanted more than one bid as any good Manager would request. I contacted some local contractors in the City to also be able to put in a bid. No company in City limits or out of city limits can do work in the city without a City of lone Business License. She did OK the bid and had it repaired.

3. The mastication project at Howard Park was done by the lone Fire Department. It was done in part for fuel reduction and school shooter environment and flood/drainage issues. The requested funding from the Buena Vista Community Fund (which I am board member on, but recused myself on that vote). The Fire Department, Ken Mackey got a bid from a local company and they did the work.

The Motherlode Little League score boards were funding by the local state prison, and installed by Motherlode Little League. I did however donate my trencher, fuel and time to dig the electrical conduit trenches for them as a donation from me.

The pond at Howard Park was built around 20 years ago and the penstock (leveling pipe) was damaged had not been maintained and or repaired in the past. The pond is Amador Water Agency's lone revisors' drain pond. So instead of the water being put to use, it was just flowing out of Howard Park and being wasted. Also, I notified Fish and Wildlife and Amador Water Agency of this repair and they both thanked me for fixing the ponds penstock so it would again retain the water that it was originally designed for. There is nothing illegal about maintaining a pond.

I personally called the CRWQCB and invited them to do a surprise sight visit with the city manager at the time. I have many years of experience working with Regional and have a very good working relationship with them for over 25 years. I have personally worked at the lone wastewater plant for over a year and was the superintendent of the general contract company that did the last upgrades to it. So, I am extremely experienced with the lone wastewater plant. Myself and the past manager were working with Regional to correct all the violations that have been accumulating over the years such as the cease and desist orders and cleanup and abatement orders on the sight. We were working together with them to bring it back into legal status as for many years lone has been ignoring them.

4. I have nothing to do with this and no nothing about this topic.

5. The failing new infrastructures in the City are in part due to bad inspections and I believe it will open up the City to litigation in the near future. This is not only my opinion. This has been brought up many times by other inspectors and contracts and developers.

6. Lori and myself did not create any hostile work environment. It was actually the opposite. The only hostile work environment left was Todd threatening his public works employees to file complaints about the city manager. This was witnessed by people in the community. (I will give a name if needed). The only two people that left when Lori became manager was the admin assistant as she was applying for a state position for many months and got a better paying job. And the second one left (I will give the name if needed) due the Harassment that she was receiving from another person in city hall. It was not Laurie.

I was not found guilty of anything.

Mr. David Anderson, Point of Information: The current published City agenda (5-19- 22) regarding Agenda #5 states: "Pursuant to the direction provided by a majority of the Councilmembers at the meeting of April 5, 2022, a resolution of censure against Councilmember Stacy Rhoades has been drafted by staff and placed on the agenda".

A review of the April 5, 2022, agenda does not indicate any agenda item related to an action against Stacy Rhoades. There are no items identified in either the open session or closed session agenda that indicated that a discussion about a censure occurred.

Who made the motion authorizing staff to prepare a resolution to censure, who made the second and how did the individual councilmembers vote.

Sophia Meyer, City Attorney: The item was Anticipated Litigation item with regard to the investigation that was done by an employee. The direction that was given to staff does not require a vote in Closed Session. The direction was to bring forth a resolution regarding censure of the vote on this particular item which will happen today in open public. The April 5, 2022, minutes are not published yet, but Mayor Epperson, Council- Members Atlan and Wratten were present and Vice Mayor Plamondon was on Zoom.

Councilmember Rhoades was recused from Closed Session on that item because it had to do with an investigation.

Mayor Epperson announced that he will allow two minutes for each speaker under this item.

The following speakers spoke in opposition to the proposed censure against Councilmember Rhoades:
• Mr. Greg Morris
• Steven Fredrick
• Larry Rhoades
Helen Wilson

Joaquin Kelly
Steve Alviso
David Anderson
Matt Westbrook
Jim Scully
Dana Calhoun
Matt Dolezal
Marvin Vicini
• Lloyd Oneto

1. Councilmember Rhoades has continued in a pattern of direct and indirect harassing behavior towards employees of the City of lone over the past two years, substantiated by another independent investigation received by the City of lone on or about February 7, 2022, whereby it was found that Councilmember Rhoades participated in discourteous, offensive, or abrasive conduct or language toward employees, including, but not limited to, being complicit in excluding employees from their workspace, disconnecting their telephones, excluding staff from meetings, and accusing staff of not being qualified for their positions.

PLANNING COMMISSION

STAFF REPORT

SALTFORNI
DATE: June 8, 2021
TO: HONORABLE PLANNING COMMISSION
FROM: APRIL WOODEN, CITY PLANNER
SUBJECT: (REVISED) SITE PLAN REVIEW - CASTLE OAKS ENTRY SIGN General Plan Designation: RL Low Density Residential
Zoning: PD Planned Development - Castle Oaks
Current Use: Vacant structure and undeveloped land
STAFF RECOMMENDED ACTION:

Staff recommends that the Planning Commission:

1. Receive the staff report;

2. Open the Public Hearing and take public comment; and

3. Adopt a Resolution Approving the Site Plan Review for the Castle Oaks Entry Sign.

BACKGROUND:

The applicant, Jasmine Gomez, is requesting approval of a revised site plan review permit for the placement of one (1) freestanding pylon sign with an electric message display board at 1000 Castle Oaks Drive, at the entryway to Castle Oaks Golf Club and residential development. This project was previously approved at a different location on the existing site. The proposed sign is 93.65 square feet in size and 18 feet in height, an addition of 4 feet from what was previously approved. Generally, no special planning permit or entitlement is required for sign permits that are consistent with the standards of the zoning code. However, certain signs may require site plan review, variance, or other permits or entitlements at the recommendation of the designated approving authority as specified in Chapter 17.10 - Permit and Entitlements. This project will require approval of a Caltrans permit.

Planning Commission Staff Report Castle Oaks Entry Sign at 1000 Castle Oaks Drive June 8. 2021 Page 1 of 3 1 E Main St, Ione, CA 95640
ANALYSIS:

The proposed project consists of the development of one (1) freestanding pylon sign with an electronic message display board within the center median of the Castle Oaks Golf Club entryway. The proposed sign is designed to use colors and materials complementary to the natural surroundings of the vicinity and be designed in a way that is not visually intrusive to drivers along State Highway 104. The leg decoration of the poles consists of neutrally- painted, fractured stone veneer. They are capped with fabricated, extruded aluminum edges. The stone veneer includes materials and colors complementary to the stone used as part of existing facilities within the golf course. The central electronic message board includes a multi-colored LED display intended to advertise the golf course and its associated facilities and services. The property owner will also allow other local businesses, the City, and local service groups to advertise public events/fundraisers. The proposed sign will be double-sided providing views from both directions on State Highway 104. The proposed sign is 93.65 square feet in size and 18 feet in height.

Section 17.42.070 - General Development, Maintenance, and Removal provisions of the city's sign ordinance regulates the construction, maintenance height, and setback of proposed signage. The proposed project is consistent with these standards. All transformers, equipment, programmers, and other related items as part of the proposed sign are screened and/or painted to be concealed within the sign.

Section 17.42.080 - Design Standards of the city's sign ordinance regulate the architectural style, color, material and relationship to other structures of proposed signage. The proposed sign will be compatible with the style and character of the existing improvements upon the lot and lots adjacent to the site. The proposed colors are harmonious and complementary to the colors of the structures near which it is to be located. The sign materials maintain moderate, attractive, and compatible styling so as not to conflict or distract from the architectural character of the area.

Section 17.42.090 - Allowed Permanent On-Site standards of the city's sign ordinance states that one (1) freestanding pylon sign is allowed per frontage and must not exceed one-hundred (100) square feet in sign area, a height of Thirty-five (35) feet, and must maintain a setback from the public Right-of-Way by fifteen (15) feet. The proposed project is consistent with these development standards.

Section 17.10.090 - Site Plan Review of the Ione Zoning Code requires approval of a site plan review permit for this project. The proposed project will be beneficial to the City and will provide necessary identification and signage that is aesthetically complementary to the golf course, residential development and immediate surrounding area.

Consequently, staff recommends the approval of the site plan review permit with the following conditions:

1. All incorporated lighting shall have underground utility service.

2. The electronic message board as part of the sign complies with all necessary standards identified in section 17.42.080(a)(7) - Sign Illumination of the City's Zoning Code.

Planning Commission Staff Report Castle Oaks Entry Sign June 8, 2021 Page 2 of 3

3. The electronic message board as part of the sign be programmed so that the message does not change more than once every four seconds, as per section

17.42.080(b)(4) - Freestanding Signs of the City's Zoning Code.

SUBJECT: Authorize the Interim City Manager to Release an RFP for a new City Website RECOMMENDED ACTION:

Authorize the Interim City Manager to release a Request for Proposal (RFP) for website redesign, development, implementation, hosting and ongoing maintenance for the City of lone.

FISCAL IMPACT:

Funding for the City's website redesign, development and hosting is requested in the Final Draft FY 2022/23 Budget and is in the Citywide Services Budget Unit - Account Code 1111-94-6214.

BACKGROUND:

The City's current website was developed in 2014 and is currently hosted by Siteground. Recently the City's website host performed a routine update that rendered the City's website nearly non- functional. Staff is no longer able to edit pages, upload content on the majority of web pages, or utilize most features on the website. At this time, staff is only able to upload meeting agenda packets.

Redesigning the website offers a unique opportunity to add important information and capabilities missing from the current website. For instance, effortless integration of the City website content with all major Social Media outlets, intuitive navigation and content organization, and accessibility of the website across all major browsers, operating systems and devices are just a few of the modern standards on today's municipal websites. Additionally, updating the City's website with pervasive opportunities for residents, visitors, and businesses to engage with City Hall through the website is one of several steps in economic development and sustainability.

Upon finalization of the technical details of the RFP, staff is recommending Council authorize the Interim City Manager to release the RFP at the earliest possible opportunity in order to expedite the process of getting a new website for the City of lone.
