CITY OF IONE COUNCIL MEETING MINUTES
Meeting of February 7, 2023
Mayor Rhoades called meeting to order at 6:00 PM
A. ROLL CALL:

Present: Stacy Rhoades, Mayor
Jack Mitchell, Vice Mayor
Dominic Atlan, Councilmember
Alison LaFayne, Councilmember
Diane Wratten, Councilmember
Staff: Michael Rock, City Manager
Dave Prentice, City Attorney (6:10 p.m.)

Beth Thompson, City Planner
B. PLEDGE OF ALLEGIANCE:

Mayor Rhoades led the Pledge of Allegiance.

C. CLOSED SESSION: (Dave Prentice-Public Comment will be taken on both of Closed Sessions at the end of the meeting when the second Closed Session begins).

Councilmembers can comment at this time.

Councilmember Atlan Comments:
• A special meeting was called on Friday, February 3, 2023 for the evaluation of the City Manager. The Council was not polled before noticing the meeting (which is the normal procedure) and two of the Councilmembers were not available and the meeting was cancelled. Why weren't normal procedures followed? Normally, Closed Session is at the end of the meeting--why wasn't this item included with the Closed Session Items at the end of the meeting? • Typically, for a City Manager Evaluation, we are given evaluation forms in advance and we were not given any forms. Where are the evaluation forms? Councilmember Wratten Comments:
• The City Manager's employment contract clearly states that his evaluation is done annually at the anniversary of his employment. This is not September, 2023, so to be performing a Performance Evaluation at this point in time is violating his employment contract.

Council adjourned to Closed Session at this time to discuss the following:

Public Employee Performance Evaluation - City Manager - Government Code 54957.6
Council returned from Closed Session at 6:44 p.m. Mayor Rhoades announced that after a lengthy conversation, the City Manager has agreed to leave. Mayor Rhoades announced that John Alfred, Police Chief will be Acting City Manager.

Please hire a new Building Inspector to get that house shut down-| have lived with this for almost five years.

4. Steve Alviso - Asked the Council to move forward with the Community Facilities District - Standing Committee meetings so we can find out where the Public Safety CFD assessments are being spent, how it can possibly be reduced and possibly spread the cost throughout the town.

5. Michael Politi - Addressed the Council on the lack of Planning Commission Meeting for the past two years-only four meetings last year. Hope we take a different course and start recognizing the Commission. One example is the purchase of 17 E. Main Street without Planning Commission input.

• Allow low barrier navigation centers (a specific type of emergency shelter) as a permitted use in zones that allow multifamily and mixed uses, Allow emergency shelters as an ancillary use to churches and religious uses, and Specific that transitional and supportive housing are allowed submitted to the restrictions applicable to a dwelling unit of the same type in the same zone, except where required to be permitted by right under State Law.

Mayor Rhoades opened the Public Hearing:

Tommy Quinn, I would be very careful about houses in neighborhoods for transitional housing without a lot of support from the entities that put them there.

Dave Livingstone, asked if these amendments are mandated by State Law and if so, the Council should review these amendments and find out exactly what the State is forcing the City to do.

Michael Politi, when the Planning Commission voted on these amendments, it was mentioned that the sewer is 105% over capacity and any more building is putting more pressure on this issue without dealing what is there.

After comments by the public, Mayor Rhoades closed the Public Hearing. It was moved by Vice Mayor Mitchell, seconded by Councilmember Atlan and carried to introduce and waive the First Reading by Substitution of Title Only Ordinance No. 531 - Amending the lone Municipal Code, Title 17 Zoning, including Table 17.22.030-1, Table 17.24.030-1, Section 17.116.050, and Chapter 17.310 (Allowed Use Definitions).

C. PUBLIC COMMENT ON ITEMS 1 AND 2.

Jim Scully commented at this point as crazy as it may sound, the most cost effective move you can do to solve your new Manager problem, is to go back to Lori McGraw and ask if she would take the job. A lot of advantages. Legal complications that you know about and don't need to go on about that. As far as those who are worried about the DA, I challenge everyone of you to read that complaint, it has absolutely nothing approaching probable cause, he has nothing, he is blowing smoke and don't think he is blowing smoke, he is blowing hot air. Everyone read that complaint, there is nothing in there.

Making Progress
• CivicPlus has begun the process of creating the new City Website design. On December 12th, we received a "mock-up" from the company of what they are aiming the site to look like. This update will include many new features which will make it user friendly for the public and easier for the City to get information out in a timely manner.
• On November 1st, the City entered an agreement with Dellavalle Labs to monitor our groundwater. They will give quarterly reports on the water quality and consult with the City on how to improve it.
> We have been in the process of flying multiple employment opportunity advertisements for various positions. We have closed the openings on the following jobs:
• Administrative Analyst
• Maintenance Worker
Our selections for these positions will begin their employment with the City in January 2023. We are thrilled to add these well-qualified additions to our team. • The City is currently reviewing the necessary steps that will need to be taken in order to change our monthly sewer billing to quarterly billing. We are expecting to follow through with this process in the earlier months of 2023.

Upcoming Priorities
Report Period 10/01/2022 - 12/31/2022
• The City will be releasing an RFP for the Train Depot Construction Project. The bid closing date is Monday, February 6th at 2:00 P.M. Once received, the staff will begin analyzing the bids to award the contract to the bidder with the best interest of the City. • A current high priority for the City of lone is recruiting a Building Official/Code Enforcement Officer. This has been a tricky process but we are hopeful that we will find the right fit soon.
> We would like to start giving the public access to the new City website within the first half of 2023. Designated staff will sit in on a training scheduled for Tuesday, March 14th to learn the basics of running and editing the site.
• At the very end of December, the State was hit by "atmospheric storms." This resulted in a State of Emergency being declared by the Governor and therefore the City has been working with FEMA and CalOES to assess the damages and assist in the recovery process.

OF IONE
City of lone's
LIFORN
Evalynn Bishop Hall Fee Waiver Policy

1. PURPOSE
The purpose of the City of lone's fee waiver policy is to establish fiscally responsible guidelines to equitably evaluate and consider fee waiver requests for one-time events or temporary use of the Evalynn Bishop Hall (EB Hall). These guidelines establish parameters for waiving EB Hall use fees for community-wide events and activities which benefit the public. For purposes of this policy, the term "fee waiver" is the granting of a reduction OR dismissal of a required fee normally charged for the use of EB Hall.

2. POLICY
The City of lone recognizes the value of working with and supporting organizations to provide services and programs that benefit the lone community. Charging fees is a standard practice when individuals, private groups, government or non-profit groups wish to reserve and exclusively utilize public facilities.

Fees charged for programs and facility usage help cover the cost of providing such services and maintaining facilities. This policy is established for determining when applicable City fees established by the City of lone's Master Fee Schedule may be waived.

Scheduling and use of facilities and events are subject to availability and do not have preference over City programs and activities or previous commitments. The policy is effective to the extent a fee waiver can be considered without negatively impacting the City of lone's budget of current operations.

3. ELIGIBILITY
Fees may be waived when such action is determined by the City of lone to be in the best interest of the City of lone, our residents, and the service applicant. Eligible organizations include the following:

1. Verifiable non-profit organizations
a. A fee waiver may be approved for eligible non-profit organizations, including organizations with a non-profit fiscal agent, that is tax-exempt under section 501(c)3 of the Internal Revenue Code
b. Fundraisers or charities may be eligible ONLY if the funds received directly benefit City-owned facilities and/or programs (i.e. lone Picnic Association, lone Veterans Memorial Park, lone Business and Community Association, Rotary Club, Native Sons, etc.).

2. Intergovernmental Cooperation
a. Fees may be waived for events or temporary uses when the applicant is another government agency and the use is related to the performance of its normal functions and is a benefit to lone residents.
1| Page

3. City of lone/Co-Sponsor Events
a. Fees may be waived for events and programs that are sponsored or co- sponsored by the City. The organization/agency requesting sponsorship by the City has a 501(c)3 status, the program must benefit the lone community, and no event fees shall be charged. Appropriate recognition as Sponsor or Co-Sponsor of the event or program is provided for the City of lone on all promotional materials and at the event or program. All resources provided by the City in sponsorship of the event (fee waiver or in-kind service) must be provided for within the Department's current budget allocations without a reduction or increase of services or costs.

4. ELIGIBLE AND INELIGIBLE USES
• Application fees, certain permit fees, and/or facility use/rental fees may be eligible to be waived through this policy.
• Fee waivers are available for a variety of events including sporting, cultural, general, and major community events, as long as the event meets the criteria set forth in this policy. • Organizations can apply for this fee waiver once within a 12-month period.

The following fees cannot be waived under this Policy:
• Staffing or labor costs (i.e. overtime for staff working outside of normal operations), security costs, utility reimbursements costs, deposits for damages to facilities, refuse removal cost, custodial costs, maintenance costs and other applicable department costs • Insurance or other fees as required by the City and/or ordinance • Liquor license, food permits and health permits
• City of lone business license fees
The following projects and events are not eligible:
• Organizations based outside City of lone (unless demonstrated benefits are primarily to the residents of lone)
• Activities primarily of a fundraising or charitable nature unless the funds directly benefit City-owned facilities and/or programs
• Events or activities that are not open to the public
• Events that are political in nature or by individuals seeking political office or elected officials for the purpose of an election campaign
• Religious organizations seeking space or facilities for religious services • Commercial or Corporate events
• Family or social gatherings
Events that provide no community benefit
• Trainings that charge for participation
• Projects or organizations who have failed to fulfill their obligations during previous events or activities for which City rental fees were waived or reduced • Events scheduled that would conflict with already planned events

5. PROCEDURES
2| Page

• Description of event and proposed impact on community • Event or program demonstrates a general public benefit to lone residents • Event or program is open to entire public at no charge Marking and outreach plan is clearly articulated
• The proposed event or program will have no significant impact on the facilities or department activities, the applicant will provide volunteer services and materials to mitigate any impacts created by the event, or that the impacts are adequately offset by the public benefit by the program or event
• Required Resources and Budget
• Level of and reason for fee waiver request (above what is approved via the Master Fee Schedule
• Organization budget provided
• The organization must submit their policy showing that they do not deny participants/players due to their inability to pay registration or participation fees • The imposition of fees would create a financial hardship on the organization or would have a detrimental effect upon the services provided to the public

7. FEE WAIVER APPLICATION SCHEDULE
In order to fully support the success of your event, the City of lone asks that organizations submit the Fee Waiver Application and all applicable documents by the dates outlined in the schedule below. This schedule provides both City staff and organizations sufficient time to adequately plan for events. It also ensures that the EB Hall Rental Application is routed to internal and external departments/entities with sufficient time and allows for staff to review all required documents well in advance of scheduled events. *Requests may be denied if organizations fail to meet these deadlines.

RECOMMENDED ACTION:

Accept Cost/Benefit Analysis of Waste Water Operation and Discuss and Make a Recommendation to City Staff for Management of WWTP and Tertiary Plant.

FISCAL IMPACT:

There is currently no fiscal impact associated with this item.

BACKGROUND:

Since July 1, 2009 the City of lone has contracted with PERC Water Corporation for the Operation and maintenance of the City's Wastewater Treatment Facility, Tertiary Treatment Facility and Sewer Collection System. The City is currently in an agreement with PERC that was entered into on July 1, 2013 with a term of four years and three two-year extensions. The City is currently on the last two-year extension which is set to expire on June 30, 2023.

At the direction of the City Council, City staff worked with Willdan Engineering to create a Cost/Benefit Analysis. The Cost/Benefit Analysis presents a comparison of what it would likely cost to have City staff maintain the WWTP compared to prior year costs of PERC maintaining it.

If Council requests a Request for Proposal for WWTP management, one can be provided by next Council meeting.

12 TECHNICAL MEMORANDUM
To: Mayor and City Council

City Engineer
City of lone Wastewater Treatment Plant and

Facility Staffing - Cost-Benefit Analysis
Introduction
The City of lone City Council requested a cost-benefit analysis to evaluate the cost/benefit, advantages, disadvantages, and risks of the following alternatives for continuing operation of the lone Waste Water Treatment Plant (WWTP) and Tertiary Plant under two scenarios:

A. Continue outsourcing wastewater operations to a private firm (private contractor); or B. Hire City staff to perform all operation and management functions.

Background
The City of lone (City) is the owner of a publicly owned wastewater treatment plant, known as the WWTP. The City provides sewer collection, wastewater treatment and recycled water for the residential, commercial and industrial users within its service area.

Permission to discharge effluent from the WWTP by the State of California under Waste Discharge Requirements (WDRs) Order No. R5-2013-0022-001 for the City's WWTP were last reissued on September 28, 2012 by the Central Valley Regional Water Quality Control Board (CVRWQCB).

The WWTP is sited on approximately 28 acres located at 1600 Marlette Street in lone, California. The WWTP is approximately 1.6 miles southeast of the intersection of State Route 1045 Mile Drive and approximately 1.6 miles southwest of the intersection of State Route 104 and State Route 124.

Although Waste Discharge Requirements (WDRs) Order 95-125 allows an average dry weather flow up to 1.2 MGD, the 2011 Cease and Desist Order (CDO) restricts flows into the treatment facility and disposal ponds based on a June 2009 Master Plan and March 2010 Report of Waste Discharge (RWD). The 2011 CDO contains the following interim flow limits:
a. Influent flows to the wastewater treatment plant shall not exceed 0.55 MGD as a monthly average dry weather flow.
b. Total effluent flows to the percolation/evaporation ponds shall not exceed .075 MGD as a monthly average flow for any calendar month.
13 The average monthly daily flow is 1.2 MGD for the Tertiary Plant.

The WWTP treatment process consists of an influent lift station, preliminary treatment (coarse and fine mechanical screening and grit removal), flow equalization, membrane bioreactors for secondary and tertiary treatment, and ultraviolet disinfection. Return activated sludge is treated at two of three aerobic digesters (one aerobic digester is for redundancy) after being thickened at two thickeners. Solids extracted from the aerobic digesters are dewatered by a screw press. Final solids meet the United States Environmental Protection agency (U.S. EPA) Class B reuse standards.

The City has utilized contract services for operation of the WWTP since 2009. The plant was originally constructed as one wastewater and one tertiary plant.

On July 1, 2009, the City entered into a contract with PERC Water, for operation of the WWTP, Castle Oaks Water Reclamation Plant (COWRP) and the Sewer Collection System. The Agreement is now in its final year, and expires on June 30, 2023.

Research and Methodology
As part of our research for this Analysis, City staff compiled and reviewed a number of data sources including those listed below (and also listed in References):

A. Asset Management Service Agreement between PERC Water and the City B. Resolution No. 2021-28 "A Resolution Approving the FY 2021/22 Operating and Capital Budgets: Salary Schedule" C. Salary Survey of regional public agencies operating wastewater and/or water treatment facilities D. Staff's review of the Agreement with PERC indicates the following major points as summarized below:

Term: The Agreement term commenced on July 1, 2009, and expires on June 30, 2023. • Compensation: Payable in equal monthly installments and subject to automatic CPI adjustments. In the event the parties are unable to agree to extend the term of the Collection Maintenance Contract, a Service fee would be applied to subsequent years during the Term of the Agreement. The current total cost is $407,387. • Facility Safety Defects: Contractor identifies and City pays. • Capital Improvements: City solely responsible for all Capital Improvement expenditures.

Permits: City to obtain and maintain all permits.
• Maintenance and Repair Costs: Perform and/or facilitate all necessary repair and maintenance to the WWTP process equipment and infrastructure. PERC will be responsible for any labor costs associated with repair and maintenance with the exception of any outside contractors necessary for maintenance. The WWTP has an annual maintenance budget of $30,000 which will be spent only on materials or outside contractors. PERC will provide the City with a monthly accounting of all expenditures from this budget and, if remaining budget is left at the end of each fiscal year, PERC agrees to split and cost savings with the City of lone.
• The same maintenance and repair costs apply to the Tertiary Plant (COWRP) except the annual budget is $20,000.

Staffing Guarantee: One Grade IV Operator as Chief Plant Operator who will provide oversight and management for all Facility operations.
14 Provide and supervise staff to operate, maintain and/or monitor the Facilities such that Facilities are staffed five days per week, 8 hours per day. Provide on-call staffing for after- hours response to all emergencies with respect to the Facility.

Perform daily and weekly inspections of the Facility as required by any applicable permit or license.

Provide ongoing training for the Facility's staff as needed.

Operate the Facility in accordance with applicable law. . Assist with the completion of annual reports, quarterly reports, compliance status reports, and wastewater discharge reports for the Facility, as needed, of all which will be submitted to the City Manager for approval prior to submission.

Provide a monthly Total Asset Management report for the Facility to be presented during the monthly operations review meeting with the City Manager and other staff. City Manager may determine a meeting schedule less than once per month at his/her discretion.

Develop and manage a CIP and annual financial budget for the Facility and review the CIP and annual budget with City Manager.

Assist Owner's wastewater consultant in developing a report of Waste Discharge for the Facility.
. Review and update current reporting procedures for spills and overflows related to the Facility.

Manager and supervise vendors and service providers for the Facility.

Facilitate Community Outreach Program.

Create and keep current Standard Operating Procedures (SOP) for the Facility.

Assist the Owner and Owner's Engineers on compliance issues, permit issues, cease and desist orders and Regional Water Quality Control Board (RWQCB) communication with respect to the Facility.

Attend City Council Meetings with respect to matters related to the Facility.

Monitoring and Reporting: Agreement includes arrangement of sample collection and analysis of any parameters required for regulatory compliance. Maintenance and calibration of monitoring equipment and log of operations are included in agreement.

City pays for outsourced analytical testing.

Termination: Agreement includes termination provision of 60 days in writing.

Conclusions from review of Agreement:

Insurance premiums would range from $30,000 to $40,000 annually. As an example, South San Luis Obispo County Sanitation District paid $29,554 in 2017 for facility insurance, and the Agreement states the contractor pays $38,533 for insurance.

City pays for all chemicals, and utilities (gas, electricity, trash, biosolids disposal). • City pays for monitoring program analytical costs.

As permitholder for the WDRs, City is still ultimately responsible for providing safe wastewater treatment and operations and compliance with applicable federal and state laws and water quality standards.
15 • Tuition Reimbursement: Changed from $2,500 to $1,000 per fiscal year. • Temporary suspension of sick leave incentive and vacation/comp buyback programs. • Safety glass allowance: $200 every two years.
• Safety boots allowance: $225 annually.
• Certificates and License: Initial examination and renewal of certificates for wastewater from operators in training to Grade IV. Estimate: $2,000 to 3,000 annually. • Uniform Allowance: Up to $477 per year.

Current WWTP/COWRP Contract Operations Staff
PERC currently staffs the WWTP/COWRP with 3 full-time operator positions dedicated to WWTP/COWRP operations, as listed by position and grade level:
• Plant Supervisor/Chief Plant Operator (Grade IV)
• Lead Operator/Operations Supervisor (Operator III
• Operator (Grade II)
In addition, PERC does provide some management oversight; however, it is unknown the type and number of position(s), or amount of time the firm's senior management team devotes either part- or full-time to operations.

Job Description Data and Analysis
City staff researched, compiled and examined various job classifications appropriate for our WWTP based upon similarly situated and comparable public wastewater agencies in Amador, El Dorado, and Sacramento counties, and a sanitation district based in Sonora. In order to make an "apples to apples" comparison possible for this analysis, staff utilized two primary sources of salary data:

Salary information obtained from City or Sanitation District websites under their human resources page that included job descriptions and salary ranges or salary schedules from FY 2021/22.

Data included in this Cost Benefit Analysis and Technical Memorandum is based on a compilation of data assembled by agency staff and outside agency representatives to provide an overview for comparison purposes based on the best information made publicly available at the time of assembling this report. No guarantees are provided regarding the accuracy of the data and statements included in this report or provided by others. It is the intent that the data included is acceptable to the purposes of comparing fundamental operating conditions between contract and city-staff operations. Some assumptions have been made based on the differences in operational structure and facility details. Staff continues to coordinate to further understand details related to the comparable operations and will continue to provide updates to Council as requested.

Qualitative Evaluation of Advantages and Disadvantages of City vs. Private Contractor Staffing In staffing any public works facility, whether it is privately or publicly operated, there are a number of other factors that may come into consideration besides conducting a strict staffing cost comparison.

Therefore, City staff has requested MKN evaluate the following alternatives for operating the WRF:

A. Continue with contract operation
B. Transition from contract operation to City staff operation C. Sell the assets to a private entity who would operate, manage, and maintain the WRF (Privatization)
Under each scenario below, MKN lists the City's advantages and disadvantages with bullet points, and, alternatively, we list some of the private contractor's advantages and disadvantages. Note, these bulleted lists are not meant to be exhaustive (and may be viewed as subjective), but they can provide the City more insight on some other potential intangible factors beyond cost in staffing a public works facility.

1. Contract Operation
The City would continue using a contract operator (Veolia or other) who would be responsible for day to day operation and maintenance, including compliance with permits. City Council may decide to continue working with Veolia or to issue a Request for Proposal (RFP) to solicit other contractors as well. Advantages and disadvantages of this approach are summarized on the next page:

Advantages:
• City owns the WRF and can control selection of contract operator and budgeting and planning of capital improvements.
• City is not responsible for interviewing, hiring, and day-to-day personnel management at the WRF.
• If a staff member is on vacation, sick leave, or terminates employment, contract operator is responsible for staffing the facility (not the City).
• If WRF is not in compliance with permit, contract operator may have or share professional responsibility with City depending on cause.

Disadvantages:
• City owns the WRF and is ultimately responsible for permit compliance.

Maintenance and repairs may be deferred, and capital improvement projects may not be identified.
• Contract operation is typically more expensive than City operation because contract operators must make a profit.
• City has less control over hiring and termination of individual staff.

2. Transition from Contract Operation to City Staff Operation | 12
City would hire a contractor or consultant to serve as the Chief Plant Operator (CPO) for a period of up to 6 months. The CPO would manage the transition and would continue as contract CPO until a new staff CPO is hired. City would ultimately hire and staff all positions at the WRF including CPO, shift supervisors, staff operators, and maintenance workers. Advantages and disadvantages of this approach are summarized below:

Advantages:
• Contract CPO support can be implemented as a temporary measure or longer-term contract until a City CPO is hired
• City owns the WRF and can control selection of contract operator, operations staff, and budgeting and planning of capital improvements.
• Public agency staff are typically evaluated and rewarded for perceived "ownership" over their responsibilities and City facilities. Private entity staff are typically evaluated under different criteria, including profitability and efficiency, which may not be to the City's benefit.

Disadvantages:
• City owns the WRF and is ultimately responsible for permit compliance. • Contract CPO position is an added expense outside City staffing and plant operation. • Personnel management (hiring, discipline, union interaction) of public employees can be challenging.

3. Privatization
The City would sell some or all wastewater and/or water assets (including the WRF and possibly other facilities such as the wastewater collection system) to a private contractor who owns & manages the facilities. The City's residents will pay the contractor directly for utility service or pay the City who then pays the contractor. All plant maintenance and capital improvements are budgeted, managed, and directed by the contractor. Customer rates and utility operation for private companies are regulated by the California Public Utilities Commission (PUC) This is very similar to the City's initial contract with Santa Paula Water, LLC, for design, construction, operation, and financing of the WRF.

Advantages:
• City is not responsible for permit compliance.
• Contractor manages and plans all capital improvements. City has no liability. • City is not responsible for interviewing, hiring, and day-to-day personnel management at the WRF.
• If WRF is not in compliance with permit, contractor has full responsibility.

Disadvantages:
• City Council will lose control of rate setting process, which will require approval by the PUC.

This is a lengthy process compared to municipal rate setting procedures under Proposition 113
218. However, City staff and elected officials will bear the brunt of any opposition to rate increases.
• City no longer owns the WRF and cannot directly control selection of contract operator and budgeting and planning of capital improvements.
• Contract operation and management (including project management and implementation of capital improvements) is typically more expensive than City operation and management because contract operators must make a profit.
• Public agency staff are typically evaluated and rewarded for perceived "ownership" over their responsibilities and City facilities. Private entity staff are typically evaluated under different criteria, including profitability and efficiency, which may not be to the City's benefit.

Conclusions
MKN has reviewed all the Agreements, and contracts provided by the City, in conjunction with the data and information compiled and shown in Attachment 1 and Tables 1-4, and arrives at the following conclusions:

From Table 2 the total salary cost including benefits will range from an average annual salary of $565,941 to a comparison average high of $615,182. The comparison average high value was used as the most conservative or costly salary scenario. The difference or savings to the City compared to the total 2019/2020 SPWRF operations contract ranges from $376,885 to $509,717 depending on the salary scenario.

From Table 3 (which now includes a 0.5 management position) the total salary cost including benefits will range from an average annual salary of $677,892 to a comparison average high of $728,184. The comparison average high value was used as the most conservative or costly salary scenario. The difference or savings to the City compared to the total 2019/2020 SPWRF operations contract ranges from $263,883 to $429,944 depending on the salary scenario.

From Table 4 (which does not include a management position) the total salary cost including benefits for the five (5.0) positions currently being utilized at the SPWRF will range from an average annual salary of $556,565 to a comparison average high of $628,311. The comparison average high value was used as the most conservative or costly salary scenario. The difference or savings to the City compared to the total 2019/2020 SPWRF operations Agreement ranges from $363,756 to $506,065 depending on the salary scenario.

Additional assumptions:
. City assumes landscaping maintenance and mosquito abatement in infiltration basins through current public works operations.
• City provides 24 hour/7 day a week facility operation including response to alerts and emergencies through current public work operations.
. Operators would be still required to prepare and submit Compliance Report, consistent with other public agencies and sanitation districts.

Additional cost factors not yet incorporated:

City cost will now include the following:
$50,000 annual repair and maintenance cost.
• Equivalent facility insurance at approximately $40,000 annually. • $10,000 for On Call Pay.

Overtime pay calculated at approximately $800 a week, $3200 a month or $38,400 annually. Rounded to $40,000.

Additional employee costs under SEIU Contract: Safety glasses, uniform, and boot allowances, license and certification and tuition reimbursements for 5 full-time positions estimated at approximately $20,000 annually.

Total of above additional annual cost factors = $160,000.

Overall conclusion: In all comparative cost scenarios presented in Tables 2-4, including using the most conservative or average high comparative salary values, and factoring in approximately $160,000 of additional costs there is significant cost saving (perhaps tens of thousands of dollars) to be realized for the City vs. the total cost scheduled to be paid under the existing Agreement with the current private operations contractor. Therefore, it is clearly more cost effective for the City to assume and provide staffing and oversight of the SPWRF operations. In addition, the qualitative evaluation of advantages and disadvantages also indicates more advantages than disadvantages for City to have operational control of the SPWRF.

Recommendation
MKN recommends the City explore transitioning from contract to City staff operation of the WRF based on the analysis provided above. Next steps include conferring with the City's Risk Manager, Human Resources, Finance, and Legal Support to confirm costs for insurance premiums, staff salaries and benefits, and the major assumptions stated herein.

If City staff operation is pursued, the City should allow for a transition period, and develop and implement a transition plan. It is assumed transition efforts could include up to 180 days of full-time contract operation beginning before the Agreement expires in April 2021, as well as technical support to develop the transition plan and review manuals, plans, and operating procedures. As part of this transition, the City would proposed to contract with the current operator (Veolia) on a month to month basis until the transition is complete.

This transition plan should allow the City sufficient time to hire operations staff with the necessary wastewater experience, qualifications and grade certifications to assume overall operation and management of the SPWRF.
