DATE: APRIL 18, 2023
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: AMY GEDNEY, ACTING CITY MANAGER
SUBJECT: POLICE CHIEF COMPENSATION
RECOMMENDED ACTION:
Adopt Resolution 2023-* of the City Council of the City of lone establishing compensation and benefits for the Chief of Police pursuant to municipal code section 2.08.060(b).
FISCAL IMPACT:
If approved, a budget adjustment will be completed to adjust for the deferred compensation change.
BACKGROUND:
John Alfred was appointed to the office of Chief of Police (Chief) effective July 3, 2022.
Historical practice sets the Chief's compensation and benefits by resolution per lone Municipal Code section 2.08.060.
The resolution is the product of negotiations and is acceptable to the Chief. The Chief will be subject to the employee handbook adopted by the Council and portions of the Police MOU where appropriate.
DISCUSSION:
The Chief of Police position is an integral and vital part of the organization. As noted, Chief Alfred has been working in this position since July 3, 2022 without the formal Employment Agreement in place. After a review of the salary schedules and employee benefits, I am also recommending that the deferred compensation be increased to $1,000 per month. This will not have the residual employment costs attached to the salary such as PERS, and other taxes.

PLANNING COMMISSION
STAFF REPORT
ALIFORNI
DATE: April 11, 2023
TO: Honorable Planning Commission
FROM: Beth Thompson and Jeff Setterlund, City Planning
SUBJECT: Housing Element Annual Progress Report - 2022
STAFF RECOMMENDED ACTION
Staff recommends that the Planning Commission:
1. Receive the staff report and presentation on the Housing Element Annual Progress Report;
2. Take public comment; and
3. Provide comments on the Housing Element Annual Progress Report.
DISCUSSION:
Each jurisdiction (city council or board of supervisors) must prepare an annual progress report (APR) on the jurisdiction's status and progress in implementing its housing element using forms and definitions adopted by the California Department of Housing and Community Development (HCD). (Government Code Section 65400.)
The APR attached as Exhibit A presents information regarding building permits that have been issued and finalized in 2022 and the City's efforts to implement its Housing Element. No new development project applications were received or processed in 2022. While the City's 2022 building permits for new dwelling units will be counted toward the City's 6" Cycle Regional Housing Needs Allocation (RHNA), the State Department of Housing and Community Development (HCD) has not yet updated the APR form to include the City's 6t Cycle RHNA.
Table B is automatically updated based on information entered by the City regarding building permits issued and City staff cannot update the information in Table B. HCD has indicated that the template will be updated, so staff anticipates that Table B for the 2023 APR will correctly identify the City's progress toward the 6t Cycle RHNA.
No action from the Planning Commission is requested for the APR. Following the Planning Commission's input, the APR will be brought to the City Council for consideration.
PLANNING COMMISSION RECOMMENDATION
Staff recommends the Planning Commission receive public comment on the APR, and provide staff with comments and, if any, recommended revisions regarding the APR.

Dear Mr. Hold:
This letter is in response to the March 30, 2023, Notice of Violation, NOV. On page 3 of the notice of violation, you noted four (4) immediate action items to be addressed. The NOV requested a response no later than May 1, 2023. Below is the response to the immediate action items.
Item 1: This letter will serve as the City's response to the NOV. In response to the control berm (town field), the City will begin work to build the berm up to 3 feet high starting June 1, 2023 (barring major wet weather). We anticipate that the project will be completed by June 30, 2023.
The repair will include correcting any burrows in the existing berm and building it up to prevent any further tailwater spills.
Item 2: The City has identified the owner of the "Town Field" as the Jackson Rancheria. The City will be working with the new owner to ensure that Form 200 is completed and sent to the Central Valley Regional Water Quality Control Board. The City will review the forms and make sure the information is accurate.
Item 3: The rills in the berm of Pond 7 have been repaired. Photos of the repair are attached to this response.
Item 4: The City will attach the requested documents to this response. The City realizes that there may be incomplete or inadequate documents and will be working on updating all of the requested documents. Once the SOPs are updated, the City will send them to the Central Valley Regional Water Quality Control Board.
As noted, we are working to get this issue resolved in a timely manner. We understand the issues and are working diligently to correct the matter. Should you have additional questions, please do not hesitate to contact me.

NOTICE OF VIOLATION AND INSPECTION REPORT, CITY OF IONE
WASTEWATER TREATMENT PLANT, AMADOR COUNTY
The City of lone's Wastewater Treatment Facility (WWTF) discharge is regulated by the Central Valley Regional Water Quality Control Board (Regional Board) under Waste Discharge Requirements (WDRs) R5-2013-0022-001 and the associated Revised Monitoring and Reporting Program R5-2013-0022 REV1 (MRP) for the treatment and disposal of domestic wastewater. The facility has also been issued a Cease and Desist Order 2014-0157 (DO) to address groundwater impacts, and Cleanup and Abatement Order R5-2019-0702 (CAO) for the removal of wastewater sludge stockpiled on site, and the associated impacts. All of these Orders are still active.
Site Inspection Report
On 19 January 2023 Board staff performed a site inspection. The inspection was in response to complaint stating that tailwater' was leaving the site and reaching surface water. This was a focused inspection, and there were observed violations of the WDRs for the features inspected. Central Valley Water Board staff had additional areas of concern. A copy of the inspection report and photo log is attached, which has additional information.
Violations: The proper operation and management land application areas (LAAs) is regulated by the WDRs. Compliance with the WDRs for this activity includes the distribution of treated wastewater (undisinfected secondary effluent), as well as the control and containment of all excess applied treated wastewater and stormwater on the land application areas (LAAs). At the time of the inspection Central Valley Water Board staff observed a large amount of tailwater pooled along the tailwater control berm on the southeast and south borders of the lone wastewater treatment facility LAAs designated the "Town Field". " Further into the inspection Central Valley Water Board staff observed that the tailwater return vault was underwater and the valve was shut off. The Discharger was knowingly not

complying with conditions of the WDRs nor implementing their best management practice of returning excess tailwater back to the plant. Central Valley Water Board staff also inspected the tailwater control berm, which had been breached and failed in numerous places along the southwest and southern borders of the Town Field. On the southeastern border of the Town Field discharging tailwater was leaving the LAA and flooding the adjacent pastureland to the west of the Town Field. The pastureland has received a substantial volume of tailwater overtime as evident by an incised drainage channel that has eroded into the top surface of the pastureland. As a result, tailwater was flowing uncontrolled from the area of the tailwater control valve (the lowest part of the Town Field) across the LAA boundary eastward and draining into Sutter Creek. In addition, along the southern border of Town Field, discharging tailwater was also observed leaving the property and reaching an unnamed creek to the south of Town Field. The unnamed creek also flows into Sutter Creek.
Undermining of the tailwater control berm is another issue. Central Valley Water Board staff observed animal burrows along the entire tailwater control berm. The numerous animal burrows along on both sides of the berm. Many burrows were flooded, which saturated the berm. Upwelling and flowing water was observed in many burrows on the other side of the tailwater control berm, outside the permitted boundary of the Town Field.
Again, this inspection was conducted in response to a complaint. During the inspection of the Town Field, including the tailwater control and return systems, the following violations of the WDR conditions were confirmed:
"Discharge Prohibition A. 1: Discharge of wastes to surface waters or surface water drainage courses is prohibited."
"Discharge Prohibition A.6: Discharge of waste at a location or in a manner different from that described in the Findings is prohibited." "Discharge Specification B.3: The discharge shall remain within the permitted waste treatment/containment structures and land application areas at all times." "Discharge Specification B.5: Excluding the water recycling LAAs, all treatment, storage, and disposal systems shall be designed, constructed, operated, and maintained to prevent inundation or washout due to floods with a 100-year return frequency."
"Land Application Specification F.4: Any irrigation runoff (tailwater) shall be confined to the LAAs or collected and recycled at the LAAs, and shall not enter any surface water drainage course or storm water drainage system." "Water Recycling Specification G.9: The LAAs shall be inspected as frequently as necessary to comply with Monitoring and Reporting Program R5-2013-0022 and to ensure continuous compliance with the requirements of this Order." City of lone WWTP
Amador County - 3- 30 March 2023
"Water Recycling Specification G.12: All storm water runoff from the LAAs shall be captured and recycled for irrigation or allowed to percolate within the use areas."
Additionally, it should be noted that WDRs Land Application Specification F.6 states:
"Discharge of effluent to any LAA not having a fully functional tailwater/runoff control system is prohibited." Therefore, in order to comply with the WDRs, no effluent may be applied to the Town Field until the observed tailwater/runoff control issues are sure is of pering pairs need ra dresser a rail ale ere s ystem Is not operatina.
an interim measure. Until those issues are corrected, effluent should be applied on the field, as stated in the WDRs.
Areas of Concern
1. The deep rill observed on the inside of northeast corner of pond 7 berm needs to be repaired. If it was caused by pump discharge or some artificial source measure should be taken in the feature to prevent rilling on the pond berms.
2. It was called to Board staff's attention during the inspection that the Town Field is not owned by the City, but by Jackson Rancheria. Jackson Rancheria is not named in the current WDRs.
Immediate Actions
To address the violations and areas of concern described in this NOV, the following items need to be addressed by the City of lone, no later than 1 May 2023.
Item 1: In accordance with WDRs Land Application Specification F.6, the City of lone must provide within a week of this Notice of Violation a written response that explains how it will comply with WDRs. Please address the issues identified in this NOV in the response, as well as a timeline for addressing the issues. Until the system has been returned to compliance with the WDRs, a weekly email, submitted by Friday C.O.B. shall be sent to Kenny Croyle that explains which proposed actions were completed that week. If holding the water in either Pond 6 or Pond 7 is part of the City of lone's plan, then provide an accurate freeboard level in Pond 6 and Pond 7 in the weekly status email.
Item 2: The City of lone should review the WDRs for those named in the requirements.
For those accepting wastewater, treating wastewater and/or applying to their field that are not named in the WDRs shall file a Form 200 (see attached). Prior to submittal, The Central Valley Water Board requests that the City of lone review the document prior to submittal to assure that it accurately names all property owners, operators, and contract operators for the treatment facility and land application areas.
City of lone WWTP
Amador County - 4 - 30 March 2023
Item 3: Submit photo evidence that all the rills within the berm of Pond 7 have been repaired. If the repairs are not complete, provide an explanation as well as a date when the rills will be repaired. The Central Valley Water Board expects the Discharger to make their best effort to complete the repair as soon as possible. If the repairs extend beyond 1 May 2023, then the weekly status update email shall include a statement regarding the progress of the repair.
Item 4: Provide a copy of the SOPs, workplans, and/or management plans that are used by the City of lone to ensure the land application areas are operated and maintained in compliance with relevant WDR requirements for land application.
If you have questions or would like to meet to discuss the issues raised in this letter, please contact Kenny Croyle at [email protected] or (916) 464-4676.

INSPECTION REPORT
CENTRAL VALLEY REGIONAL WATER QUALITY CONTROL BOARD
DISCHARGER: City of lone
LOCATION & COUNTY: 1600 West Marlette Street, lone, Amador County CONTACT(S): Brett Moroz (Contract Operator), PERC Water Corporation INSPECTION DATE: 19 January 2023
INSPECTED BY: Kenny Croyle, Central Valley Water Board
ACCOMPANIED BY: Howard Hold, CVRWQCB, and Todd Waklee, City of lone INTRODUCTION: This was a compliance inspection of the wastewater treatment system and land application areas for the City of lone. The treatment and disposal system consists of headworks, treatment ponds, effluent storage/percolation ponds, and land application (LAA) sprayfields. The Central Valley Water Board regulates the facility under Waste Discharge Requirements (WDRs) Order R5-2013-0022-001. The inspection was performed in response to complaint stating that tailwater' was leaving the site and reaching surface water.
OBSERVATIONS AND COMMENTS: The weather was cool and dry. Central Valley Water Board staff met with Brett Moroz and Todd Waklee, representatives of the City of lone at the treatment plant.
Mr. Moroz and Mr. Waklee, chose to stay at the plant while Central Valley Water Board staff conducted their inspection.
Gates, Fences, and Nuisance Conditions:
Fences enclosed the water treatment facility, including area around the pond the land application area. Warning signs were posted on the fence at the front of the facility. Additional signs were present on the fences of the land application areas (LAAs) which inaccurately stated that recycled water was in use (Photo 20). The gate was locked when we arrived. No odors were observed beyond the fenced areas.
Staff's observations of the Treatment Plant: The treatment plant consisted of a simple headworks (photo 1) and four treatment ponds with paddle and floating aerators (photos 2 and 3). Pond 5 is a lined effluent storage pond with an aerator, which was operating at the time of inspection (Photo 4).
Ponds 6 and 7 are unlined percolation ponds with no aeration. Ponds 1-5 were at approximately 2 feet of freeboard, while Pond 6 had 3.5 feet and Pond 7 was nearly empty (photos 4-6). A deep rill was observed on the inside of northeast corner of pond 7 berm (photo 7). The catchment area on top of berm does not appear large enough to produce enough runoff to create a rill this large. The is rill likely formed by artificial flow and should be repaired.
No disinfection process was occurring onsite.
Staff's observations of the Land Application Areas:
The City Field had no ponded water (photo 21).
" Tailwater, for this site, consists of undisinfected wastewater placed onto a land application area for disposal.

The Town Field had a large amount of tailwater pooled along the tailwater control berm on the southeast and south borders of the LAA (photos 8-18). The tailwater return vault was underwater and the valve was shut off (photo 10). The tailwater control berm had been breached and failed in numerous places along the southwest and southern borders of the LAA. On the southeastern border of the Town Field discharging tailwater was leaving the property and flooding the pastureland to the west of the Town Field. The pastureland has a drainage that heads from just on the other side of the fence from the tailwater control valve (the lowest part of the field) east to Sutter Creek (photos 11-14, 17-19).
Along the southern border, discharging tailwater was leaving the property, crossing under a fence, and reaching a creek to the south of the of the Town Field. The creek eventually drains to Sutter Creek (photos 15 and 16).
Another issue is the tailwater control berm being undermined by animal burrows. Central Valley Water Board Staff observed animal burrows along the entire tailwater control berm, on both sides, which undermine the berm's stability and purpose. Many burrows were flooded within the Town Field, and upwelling water was observed flowing from burrows on the other side of the tailwater control berm, outside the Town Field boundary (photo 16). A small amount of run on was also observed coming from the property immediately west of the Town Field, although the flow volume appeared to be very small compared to the amount of tailwater being released from the breaches in the tailwater control berm.
Central Valley Water Board Staff conveyed these concerns to Mr. Moroz upon completion of the inspection and informed him an inspection report would be sent out in the near future.
SUMMARY.
Board staff observed the following violations:
1. The discharge of tailwater offsite is a violation of several Discharge Prohibitions and Land Application Specifications of the WDRs. Per the WDRs, no discharge of effluent to the Town Field can occur until the tailwater controls are operational, and the animal burrows are addressed.
Further, Board staff had the following areas of concern:
1. The deep rill observed on the inside of northeast corner of pond 7 berm needs to be repaired.
If it was caused by pump discharge or some artificial source measure should be taken in the feature to prevent rilling on the pond berms.
2. It was called to Board staff's attention during the inspection that the Town Field is not owned by the City of lone, but by Jackson Rancheria. A Form 200 needs to be filed to document the correct ownership of the parcel.

INTRODUCTION
This application package constitutes a Report of Waste Discharge (ROWD) pursuant to California Water Code Section 13260. Section 13260 states that persons discharging or proposing to discharge waste that could affect the quality of the waters of the State, other than into a community sewer system, shall file a ROWD containing information which may be required by the appropriate Regional Water Quality Control Board (RWQCB).
This package is to be used to start the application process for all waste discharge requirements (WDRs) and National Pollutant Discharge Elimination System (NPDES) permits* issued by a RWQCB except:
1. Those landfill facilities that must use a joint Solid Waste Facility Permit Application Form, California Integrated Waste Management Board Form E-1-77; and
2. General WDRs or general NPDES permits that use a Notice of Intent to comply or specify the use of an alternative application form designed for that permit.
This application package contains:
1. Application/General Information Form for WDRs and NPDES Permits [Form 200 (10/97)].
2. Application/General Information Instructions.
Instructions
Instructions are provided to assist you with completion of the application. If you are unable to find the answers to your questions or need assistance with the completion of the application package, please contact your RWQCB representative. The RWQCBs strongly recommend that you make initial telephone or personal contact with RWQCB regulatory staff to discuss a proposed new discharge before submitting your application.
The RWQCB representative will be able to answer procedural and annual fee related questions that you may have. (See map and telephone numbers inside of application cover.)
All dischargers regulated under WDRs and NDES permits must pay an annual fee, except dairies, which pay a filing fee only. The RWQCB will notify you of your annual fee based on an evaluation of your proposed discharge. Please do NOT submit a check for your first annual fee or filing fee until requested to do so by a RWQCB representative. Dischargers applying for reissuance (renewal) of an existing NPDES permit or update of an existing WDR will be billed through the annual fee billing system and are therefore requested NOT to submit a check with their application. Checks should be made payable to the State Water Resources Control Board.

California Environmental Protection Agency
Bill of Rights for Environmental Permit Applicants
California Environmental Protection Agency (Cal/EPA) recognizes that many complex issues must be addressed when pursuing reforms of environmental permits and that significant challenges remain. We have initiated reforms and intend to continue the effort to make environmental permitting more efficient, less costly, and to ensure that those seeking permits receive timely responses from the boards and departments of the Cal/EPA. To further this goal, Cal/EPA endorses the following precepts that form the basis of a permit applicant's "Bill of Rights."
1. Permit applicants have the right to assistance in understanding regulatory and permit requirements. All Cal/EPA programs maintain an Ombudsman to work directly with applicants. Permit Assistance Centers located throughout California have permit specialists from all the State, regional, and local agencies to identify permit requirements and assist in permit processing.
2. Permit applicants have the right to know the projected fees for review of applications, how any costs will be determined and billed, and procedures for resolving any disputes over fee billings.
3. Permit applicants have the right of access to complete and clearly written guidance documents that explain the regulatory requirements. Agencies must publish a list of all information required in a permit application and of criteria used to determine whether the submitted information is adequate.
4. Permit applicants have the right of timely completeness determinations for their applications. In general, agencies notify the applicant within 30 days of any deficiencies or determine that the application is complete. California Environmental Quality Act (CEQA) and public hearing requests may require additional information.
5. Permit applicants have the right to know exactly how their applications are deficient and what further information is needed to make their applications complete.
Pursuant to California Government code Section 65944, after an application is accepted as complete, an agency may not request any new or additional information that was not specified in the original application.
6. Permit applicants have the right of a timely decision on their permit application. The agencies are required to establish time limits for permit reviews.
7. Permit applicants have the right to appeal permit review time limits by statute or administratively that have been violated without good cause. For state environmental agencies, appeals are made directly to the Cal/EPA Secretary or to a specific board.
For local environmental agencies, appeals are generally made to the local governing board or, under certain circumstances, to Cal/EPA. Through this appeal, applicants may obtain a set date for a decision on their permit and, in some cases, a refund of all application fees (ask boards and departments for details).
8. Permit applicants have the right to work with a single lead agency where multiple environmental approvals are needed. For multiple permits, all agency actions can be consolidated under a lead agency. For site remediation, all applicable laws can be administered through a single agency.
9. Permit applicants have the right to know who will be reviewing their application and the time required to complete the full review process.
Agenda Item # J3
DATE: APRIL 18, 2023
TO: THE HONORABLE MAYOR RHOADES AND MEMBERS OF THE CITY
COUNCIL
FROM: AMY GEDNEY, ACTING CITY MANAGER
SUBJECT: 2023-2024 BUDGET AND FINANCE COMMITTEE
RECOMMENDED ACTION:
Establish an Ad Hoc subcommittee for the development of the 2023-2024 Annual Operating Budget with an appointee from each Council member along with Councilmembers Mitchell and LaFayne.
FISCAL IMPACT:
There is no fiscal impact associated with this item.
BACKGROUND:
Various committees are established at the beginning of each calendar year. The Mayor appoints Councilmembers to serve on said committees. Among the many functions of the Finance Committee is to oversee the development of one of the most important documents that the City adopts, the Annual Operating Budget. Although a standing meeting date has not been established, the Finance Committee is considered a standing committee as opposed to an ad hoc committee. The difference is Standing committees are formed for matters that demand constant attention and are of continuing vital concern to the City. Ad hoc committees are formed for handling one-time special projects.
DISCUSSION:
Councilmembers Mitchell and LaFayne have been appointed to the Finance Committee and both have expressed an interest in appointing additional members of the community to be a part of that budget process. Staff believes this would be prudent and reached out to Councilmembers to determine if they had appointees they would like to select to serve on this committee; however, in an effort to move this forward since we are beginning to undertake the budget process, I should have requested approval of the City Council first. An ad hoc Budget Committee would benefit the City in several ways. First, as new Councilmembers, understanding the Budget in great detail is a significant task. The Committee recommends to the full Council approval of the Budget after careful scrutiny and a thorough understanding and review of how the Budget is created. As a result, the added review and community input would assist in that review for both staff and Councilmembers Mitchell and LaFayne. Additionally, detailed questions can be more readily addressed at an Ad Hoc meeting.
Finally, staff recommends that this Budget Committee would be an ad hoc committee with appointees from each Council member whose sole purpose would be to assist in developing the 2023-2024 Annual Operating Budget.
