F. PUBLIC COMMENT:
1. Larry Rhoades commented on the item on the March 19, 2024 agenda— Discussion regarding appointment or election of City Clerk position – what happened at the last meeting was total harassment. The Clerk has been here for 35 years. She was elected by the people and you put her down big time and I think it was totally uncalled for.
Agenda Item #I1
2. Dave Livingstone’s comments – I want to express my thoughts on the last Council meeting and discussion of the City Clerk position. The last Council meeting appeared to veer off course from normal staff member issues when bringing up and discussing the City Clerk position and specifically Janice. In the past any staff members performance issues have been discussed in private with the individual and City leadership. Councilmembers questioning and criticizing staff performance in public, is inconsiderate, disrespectful, shameful and low class and certainly not confidential. Ms. Traverso has been a long-time staff member who has worked at City Hall for decades and appears to be trustworthy and responsive to City residents. Her decades of reliable service in the City should be respected and valued as an important contributor to the good of Ione. My concern is not the business side of this issue, but how this confidential issue was raised. Maybe Ione should carry on the historical tradition of having a free and independent voice within City Hall. This just may ensure the possibility of silencing any future threats and targeting or harassment from City officials. It is not a good look for the City and our reputation has suffered.
3. Gary Thomas asked if the Council took any action on Public Employee Appointment under Closed Session. It was reported that there was no report out of Closed Session. Mayor LaFayne commented that Public Employee appointment is the next item on the agenda.
4. Tommy Quinn – Two Things:
• I have a real problem with the driving in this town and would like the Police Department to focus more on traffic and noise.
• Missed the discussion regarding the City Clerk position being appointed or elected. You guys always seem to find something to pick on, you both are bullies and I am tired of it. This City has spent far too much money and we e need to find far better things to do with the money instead of spending it on this stuff—like fixing up the town. I think one of the guys has a severe conflict of interest and the other person just doesn’t pay attention.
5. Jim Scully commented that unfortunately, I was here last week and I agree with the statement that this is harassment--my opinion-- but it may be a pattern. Look at the case filed August 9, 2022 – CV12691, Lori McGraw, it is a retaliation in violation of Labor Code 1102.5. Hanken bitterly aggressively screamed at the plaintiff as he exited the Council Chambers, witnessed by Councilmember Epperson and several staff members. Not only was Hanken’s behavior allowed to continue, the other two Councilmembers, Dominic Atlan, Diane Wratten, and Sophia Meyer also began treating plaintiff improperly and with the same level of disrespect as Hanken. This is part of an ongoing complaint. It was then announced that Atlan and Wratten voted with no grounds or substantiated reasons to terminate plaintiff from all employment. Then although the City Council was not obligated to offer her prior position as Finance Manager, they voted again in violation of the Brown Act and approved an offer to move her back to Finance.
Agenda Item #I1
Ms. McGraw was then falsely accused of committing a theft of public funds.
This is totally in line with what we are seeing now.

3. Resolution No. 2024-* Approving Task Orders with West Yost – Mayor LaFayne pulled this item for discussion. There is no staff report attached to the resolution and it is my understand that our City Engineer, Jonathan Mitchell, Willdan has not seen any of this work, so I would like to pull it back to staff.
City Attorney, Andy Pinasco explained that the Willdan’s agreement encompasses all the scope for City Engineer and West Yost is a special engineer specializing in Wastewater. It is my understanding that West Yost has not coordinated with the City Engineer Department with regard to the approaches that they are presenting to the Council. Our City Engineer reached out and had an issue with the approach to this item
Jonathan Mitchell explained that the goal here is to collaborate with the consultant, work together as a team with West Yost to understand what the financial and planning impacts are and what the range of scope options that could come before Council and present the associated costs, as well as the priority of other projects and financial impacts to the City. My intent would be to prioritize this and move it forward.
Moved by Vice Mayor Wratten, seconded by Councilmember Mitchell and carried to have a staff report in conjunction with West Yost and have our City Engineer come back at the next meeting or as soon as possible going through these items and have Jonathan address any issues he would have with these or any other recommendations.

Larry Rhoades you can go on the website and find a drawing of anything and I don’t think we should pay another engineer to double check their work. I guarantee that I can call three people to double check their work and wouldn’t need an engineer to check it.

SUBJECT: IONE HOUSING ELEMENT ANNUAL PROGRESS REPORT 2023
INFORMATIONAL REPORT
Ione Housing Element Annual Progress Report has been filed with the California Department of Housing and Community Development and the Governor’s Office of Planning and Research.
BACKGROUND
Local jurisdictions are required to submit a Housing Element Annual Report (APR) to the Governor’s office of Planning and Research (OPR) and the Department of Housing and Community Development (HCD) by April 1 of each year. The report provides information to the State and the public on the implementation of the Housing Element and progress towards our Regional Housing Needs Allocation numbers.
APR’s must be presented to the local legislative body for its review and acceptance, usually as a consent or discussion item on a regular meeting agenda.
The Planning Commission reviewed the report at their May 14, 2024 and had no substantive comments.
DISCUSSION
Staff prepared the Ione Housing Element APR for the year 2023 and submitted the document to OPR and HCD on April 23, 2024. Staff transitions caused a delay in the submittal. Additionally, as a result of the adoption of thee 6th Cycle Housing Element in 2023, the housing program section of the report was significantly updated from the 2022 report. Since this Housing Element has recently been adopted none of the programs listed have been implemented. However, the Countywide Housing Work Group has been established and held its first meeting on May 13, 2024. At that meeting a workplan was established and as staff availability and budget are available, programs will be implemented throughout the Housing Cycle.
The APR is attached for City Council review. Staff can send in amendments to OPR and HCD should the City Council have substantive changes.

The Fiscal impact will be determined by the decision of the City Council and is summarized below.
Waterstone, LLC (contract signed 6.30.2023 with James Water Services Co) Current Contract
$46,750.00/monthly, $561,000/annually with annual CPI increase of 4% per contract = $583,444 Recommendation of Staff
Direction to staff to pursue Option #1 or Option #2
Option #1
Direct staff to bring back amended contract with Waterstone, LLC for the negotiated Price of $38,000/monthly, $456,000/annually with an annual CPI increase not to exceed 4%.
Savings = $127,440.00 over current contract with 4% CPI increase.
Option #2
Direct staff to bring plant operations in house with the hiring of 3 full time staff with an annual personnel budget of approximately $420,000.
Savings - $163,444.00 over current contract with 4% CPI increase.
BACKGROUND:
On May 31, 2023, staff issued an RFP for potential contractors to provide, Wastewater Treatment Plant Contract Operations, Sewer Collection System Maintenance & Tertiary Plant Contract Operations.
Subsequently, a tour of the plant was completed on June 7, 2023 where four potential contractors toured the plants. The City received three proposals on June 15, 2023. On June 19, 2023, the City conducted interviews with the three potential contractors.
James Waste Service was selected (lowest bid) at a monthly cost of $46,750 and $561,000 annual cost for one year and included an escalator based on the CPI (4% max) beyond the first year of operations.
The contract was signed on June 30th and was modelled after the previous contract with PERC. It includes an option of extensions for three-year periods. This allowed for a year's time to evaluate the current state of the wastewater plants as well as adjust to operational issues in partnership with James Water Service.

TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ANDY PINASCO, CITY ATTORNEY
SUBJECT: CONSIDER SUBMITTING A MEASURE TO THE VOTERS OF THE CITY OF IONE AT NOVEMBER 5, 2024, MUNICIPAL ELECTION AS
TO WHETHER THE OFFICE OF CITY CLERK SHOULD BE CHANGED
FROM ELECTED TO APPOINTED
RECOMMENDED ACTION:
No recommendation from City Staff.
OPTIONS:
1. The City Council may adopt the proposed resolution, calling a general municipal election for the submission of a proposed ballot measure to change the position of City Clerk from an elected position to an appointed position, and requesting that the Amador County Board of Supervisors consolidate the general municipal election with the statewide general election to be conducted on November 5, 2024.
2. The City Council may choose to reject the proposed resolution.
3. The City Council may continue the item and request additional information and analysis from staff. Since the City must adopt the resolution one hundred thirteen (113) days prior to the election, the resolution must be transmitted to the Amador County Registrar by July 15, 2024.
FISCAL IMPACT:
The fiscal impact associated with submitting the ballot measure to the voters will depend on the costs the County will incur to conduct the election, since the City must reimburse the County for the costs of conducting the election.
BACKGROUND:
At the March 19, 2024, Ione City Council Regular Meeting, the Council directed the City Attorney to bring back an item for the full Council to consider submitting a Measure to the voters of the City of Ione asking whether the City Clerk should be an appointed position.
DISCUSSION:
I. Requirement for Cities to Have City Clerk
The City of Ione is a general law city, and therefore derives its municipal powers from laws enacted by the state legislature. California Government Code section 36501, originally adopted in 1949, requires that the government of each general law city include the offices of City Clerk, City Clerk, along with the City Council, Chief of Police, and Fire Chief.
II. Selection of City Clerk in General Law Cities
Under state law, the position of City Clerk is elective with a four-year term but may be made appointive on approval of the voters at a regular municipal or special election. Currently, the position of the City of Ione’s City Clerk is an elected office. The only qualifications in State law for elected City Clerks is that they must be at least 18 years of age and registered voters of the City. The City is prohibited from establishing any additional requirements.
If the office of clerk is appointed, the City Council makes the appointment unless that power is vested in the City Manager by Ordinance.
III. Compensation
The compensation of the City Clerk may be set by the City Council or by initiative. Currently, the City Clerk is compensated by an annual stipend of $26,400 per year with no benefits.
IV. Process to Change from Elected to Appointed City Clerk California Government Code section 36508 provides that the City Council may place a question on the ballot whether the City Clerk should be appointive offices. By statute, the specific question on the ballot would read:
“Shall the office city clerk be appointive?”
If the voters should approve the measure, the City Council would be empowered to appoint the City Clerk upon expiration of their current terms. Under Government Code section 36510, the City Council may, at a later date, adopt an ordinance vesting in the City Manager the authority to appoint the City Clerk. The appointed City Clerk will serve at the pleasure of the City Council.
If the majority of voters vote “no” on the question then the position will remain elected, and the City cannot submit another ballot measure regarding the appointment of the City Clerk for at least eleven (11) months. The City Council must hold an election to fill the City Clerk position at the end of each term.
California Elections Code section 9222 provides that the City Council can submit an initiative measure to the voters without petition. To be placed on the ballot, the Council must adopt and transmit a resolution to the County Elections Official by July 15, 2024 for the November 5, 2024, municipal election. In addition to placing the question on the ballot, the required resolution should also authorize arguments in favor and authorize the City Attorney to prepare an impartial analysis.
