RE: SB 1037 (Wiener) Planning and zoning: housing element: enforcement Notice of Opposition
Dear Assemblyman Flora,
The City of lone regretfully must oppose measure SB 1037 (Wiener), which would allow the Attorney General to take legal action against a city and seek fines up to $50K a month for failure to adopt a compliant housing element or if the city does not follow state laws that require ministerial approval of certain housing projects.

Under existing law cities can be subject to significant fines and penalties for violating certain housing laws. However, before fines are imposed, a city has the ability to correct the action. Additionally, enhanced fines are not imposed unless the city fails to follow a court's order or acts in bad faith.

Unfortunately, as currently drafted, SB 1037 does not provide an opportunity for cities to correct an honest mistake or address a genuine difference in interpreting the law. Even those jurisdictions acting in good faith could be subject to significant fines and be required to pay the Attorney General for all costs investigating and prosecuting the action, including expert witness fees and attorney's fees.

While the City of lone has not had significant issues with submitting and obtaining approval of its Housing Element, the process to obtain approval is oftentimes difficult, unclear, time consuming, and costly. The burden of the current approval process is magnified in smaller, rural, and historically disadvantaged communities without resources to navigate the approval process and which often requires using the specialized expertise of costly consultants.

Instead of creating new fines and penalties, lawmakers and the Department of Housing and Community Development should provide cities with clear guidance and technical assistance to help them finalize their housing elements and put those plans to work so much-needed housing construction can occur.

For these reasons, the City of lone must oppose SB 1037. If you have any questions, do not hesitate to contact George Lee, City Manager, at [email protected] or 209-274- 2412.

RE: AB 1886 (Alvarez) Housing Element Law: Substantial Compliance Notice of Opposition (As of April 1, 2024)
Dear Senator Alvarado-Gil,
The City of lone regretfully must oppose measure AB 1886 (Alvarez), because it turns its back to a fundamental provision of housing element law: A city may disagree with HCD; explain why its housing element is in substantial compliance with the law; and then adopt that housing element which is thereafter considered "in substantial compliance with housing element law."
For decades, cities have worked with HCD to draft housing plans that accommodate their fair share of housing at all income levels. These extensive and complex plans can take years to develop, include public involvement and engagement, and environmental review. Cities go to great lengths to ensure that their housing element substantially complies with the law, even if HCD disagrees. Current law acknowledges this fact by allowing cities to "self-certify" their housing element or take the issue to court and have a judge make the final determination of substantial compliance.

AB 1886 encourages "builder's remedy" projects by eliminating self-certification for the purpose of what it means to have a housing element "in substantial compliance with the law." The "builder's remedy" allows a developer to choose any site other than a site that is identified for very low-, low-, or moderate-income housing, and construct a project that is inconsistent with both the city's general plan and zoning. AB 1886 facilitates such projects for those cities that have a good faith disagreement based in substantial evidence.

The City of lone believes that AB 1886 is counterproductive. What is really needed is for HCD to partner with cities to provide meaningful direction that helps them finalize their housing elements and put those plans to work so that much needed housing construction can occur. For these reasons, the City of lone must oppose AB 1886 (Alvarez). If you have any questions, do not hesitate to contact George Lee, City Manager, at [email protected] or 209-274-2412.

CITY OF IONE
IONE, CA 95640
LIFORN
Agenda Item J.I.

DATE: JUNE 4, 2024
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: SALINA MITCHELL, RECREATION COORDINATOR
SUBJECT: APPROVE A MEMORIAL BENCH FOR THE OWENS FAMILY AND

THE IONE MEMORIAL GARDEN FOR THE SHEARER FAMILY
RECOMMENDED ACTION:

Approve the following by minute action:

1. Approve the Owens Family memorial bench in Howard Park.

2. Approve the installation of a memorial garden surrounding the Corey Shearer memorial bench in the Castle Oaks Subdivision.

FISCAL IMPACT:

Fiscal impact is yet to be determined but will be minimal.

BACKGROUND:

The City is working to establish a Memorial Tree & Bench Program to be amended to the existing Adopt-A-Park Program. A community member can request a memorial tree or bench by submitting an application at City Hall and paying all associated fees. City staff will then order and place the tree or bench in one of the pre-determined areas at either Howard Park, or, if established, the lone Memorial Garden.

Staff has selected a bench that fits our overall needs in terms of quality, maintenance, durability, aesthetics and cost. Staff is still working to decide on a few specific trees as well. The trees and bench that are chosen will be used by all applicants. The idea is to streamline the process to eliminate the need for lengthy discussion each time an application is received. This Program has yet to be finalized, but the bench specifications are attached There are currently two families that have requested a memorial bench for their loved ones, and in an effort to keep them from waiting, Staff is requesting that the Commission approve moving forward with both projects.

DISCUSSION:

Mayor LaFayne has requested that a memorial bench for the Owens Family be placed near the pond at Howard Park. Chief Alfred has agreed that the lone Police Foundation will cover the costs for the Owens memorial bench. Specs and plans for the bench chosen by staff have been reviewed and approved by our City Engineer. The Mayor is requesting that a different bench, a wood bench, be used instead.

At this time, Staff is requesting, with approval from the Parks & Recreation Commission, that this specific project move forward using either bench. This should not result in any further cost to the City
Lisa Vicari, on behalf of the Shearer Family, has previously obtained approval by City Council to place a memorial bench for Corey Shearer in a vacant lot owned by the City in the Castle Oaks Subdivision. The bench has since been installed. At this time, Lisa is requesting that Council approve the lone Memorial Garden surrounding the newly installed bench. This will serve as a second location where local community members can place a memorial bench or tree for loved ones. This will also be a nice community garden where people can feel free to plant and make improvements in the future.

At this time, Staff is requesting approval of the lone Memorial Garden. The costs for the garden Will be covered by donations and volunteers. Chad Simmons Landscaping will donate their time, the plants and the rocks for the garden. The intention is that future memorial plants and trees will be placed in the garden to fill it in. The maintenance of the garden will be done by volunteers and members close to the Shearer family.

Staff is requesting a monthly maintenance plan be put in place by the Shearer family to ensure routine maintenance takes place. The water used to keep the garden will come from a 2" water line, steaming from an existing 4" irrigation pipe already in place by the Castle Oaks Golf Club.

The overall impact to City Staff is minimal. A permit will be required to tie into this water line.

We need to get approval for a 2" water line to run from the Castle Oaks golf course to the memorial garden area. There is already an existing 4" pipe in place that runs under Castle Oaks drive. Once we hook up the line, Chad Simmons Landscaping will donate their time, plants, and rocks to improve the area around the bench area. In the future, we would like to continue with landscaping and natural trails in this blighted area, where individuals can donate a drought-tolerant plant with a small plaque to dedicate to a loved one. We have volunteers that are willing to dedicate their time to maintain this area.

SUBJECT: ADOPT RESOLUTION 2023-13 SENATE BILL 1 (SB1) ROAD MAINTENANCE PROJECT FOR FY 24-25
RECOMMENDED ACTION:

1. Provide input on street projects where SB-1 monies are to be used.

2. Take public comment and direct staff to make any changes, if necessary.

3. Adopt the attached resolution approving the streets to use SB-1 funds on and direct staff to proceed with submitting the 2024/2025 Road Maintenance and Rehabilitation Account (RMRA) project list to the state for approval.

FISCAL IMPACT:

The proposed project will be funded with SB-1 revenues. The SB-1 monies will be used specifically for repair/maintenance of the streets listed herein. In accordance with state's regulations for SB-1 funding, cities must submit a list of streets that the monies will be spent on. As the project bid documents are completed, further refinement of the overall project budget will be done and submitted to the Council for approval prior to proceeding.

BACKGROUND:

Senate Bill 1 (SB-1) was approved in 2017 by the Governor. This bill provides new revenues for road maintenance projects within the City. According to the State's most recent projections, for Fiscal Year 2024-25, the City is projected to receive approximately $226,492 in revenues from SB-1.

Regulations contained within SB-1 require that projects funded with SB-1 monies need to specifically provide a list of streets where the money will be spent as approved by the City Council. Once approved, paperwork must be submitted to the state for approval by July 1, 2024.

Local Streets and Roads Funding Eligibility Overview
Prior to receiving an apportionment of Road Maintenance and Rehabilitation Account (RMRA) funds from the California State Controller in a fiscal year, a city or county must submit to the Commission an adopted list of projects proposed to be funded with these funds by July 1" each year. All projects proposed to receive the fiscal year funding must be adopted by resolution by the applicable city council or county board of supervisors at a regular public meeting each fiscal year [Streets and Highways Code (SHC) Section 2034(a)(1)].

FORNI
Staff has presented the Council with a list of streets from the City's Pavement Management Program (PMP) that was completed in 2015 that show streets that need treatment and/or maintenance. A copy of the list is attached to this staff report.

The list of streets shown on the list includes streets that have a Pavement Condition Index (PCI) of less than 70. This includes street treatments that include slurry sealing and asphalt overlays.

Staff is asking for input from the Council on what streets should be included in a street rehabilitation project for 2024-25.

Input from both the Council and the public at this meeting will be included in the attached resolution. An executed copy of this resolution must be sent to the State to fulfill eligibility requirements per the regulations associated with SB-1 funding.

This is the same list that the Council approved last year; however, due to a number of issues including staff turnover in all departments, no projects were completed in FY 2022-23 or 2023-

24. This year's estimate for RMRA funds is $226,492. The City's total estimate for gas tax funding for fiscal year 2024-2025 is $496,929.

WHEREAS, SB-1 included accountability and transparency provisions that will ensure the residents of our City are aware of the projects proposed for funding in our community and which projects have been competed each fiscal year; and WHEREAS, the City must include a list of all projects proposed to receive funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB-1, in the City budget, which must include a description and the location of each proposed project, a proposed schedule for the project's completion, and the estimated useful life of the improvement; and WHEREAS, the City will receive an estimated $226,492 in RMRA funding in Fiscal Year 2024-25 from SB-1; and
WHEREAS, this is the seventh year in which the City is receiving SB-1 funding and will enable the City to continue essential road maintenance and rehabilitation projects, safety improvements, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB-1; and
WHEREAS, the City has undergone a public process to ensure public input into our community's pavement rehabilitation project list; and
WHEREAS, the City used the City's Pavement Management Program to develop the SB- 1 project list to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the City's priorities for transportation investment; and WHEREAS, the funding from SB-1 in FY 2024-25 will help the City maintain and rehabilitate a portion of West Marlette Street in FY 2024-25 and dozens of similar projects into the future; and
WHEREAS, the rehabilitation of a portion of West Marlette Street will include slurry sealing and/or milling the existing paving and placement of new pavement and other Complete Streets components (if needed); and

CITT OF IONE
IONE, (4 95640)
LIFORE
DATE: June 4, 2024
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Andy Pinasco, City Attorney
SUBJECT: Amendment of the Duties and Compensation of the City Clerk RECOMMENDED ACTION:

No recommendation from City Staff.

FISCAL IMPACT:

Charges for publication of ordinance and any impacts to compensation for Clerk services.

BACKGROUND:

At the March 19, 2024, Lone City. Council Regular Meeting, the Council directed the City Attorney to analyze whether it would be lawful for the Council to amend the duties of its City Clerk to more closely conform to those prescribed by California law, and how Clerk compensation is determined.

DISCUSSION:

DUTIES OF THE CITY CLERK
California State law sets forth the basic duties a city clerk must fulfill in their role. These duties include:
• Keeping the City's financial records and publishing the City's financial reports as required by the State Controller and State law;
• (The Council may reassign these responsibilities to a Director of Finance) • Keeping minutes of City Council and Board of Equalization meetings; • Keeping the City's Book of Ordinances;
• Acting as the Ex Officio Assessor, unless the City has provided for otherwise; • Acting as the custodian of the City seal;
• Appointing deputy city clerks, if necessary;
• Administering oaths or affirmations and taking and certifying affidavits and depositions pertaining to City affairs;
• Acts as the Elections Official for the City, unless the Council designates another person; and
• Acts as the compliance officer for federal, state, and local statutes (such as the Political Reform Act, the Brown Act, and the Public Records Act).

In addition, State law also permits the City to assign any additional duties to the City Clerk as are prescribed by ordinance. Pursuant to that authority, the City adopted Section 2.08.050 of the lone Municipal Code ('IMC"). This section prescribes the duties of the City Clerk, some of which duties are redundant with those required by State law. The duties listed in Section 2.08.050 that would be considered "additional" to those required by State law are as follows:
• Serve as executive secretary to the mayor and city council. • Records city council direction to the various departments during city council meetings and ensures appropriate follow-up, including processing council agreements, and handling legal advertising.
• Coordinating bid openings, as well as receive and open bid documents; and follow-up with notices to proceed, insurance and bonds.
• Keeping a book of resolutions of the City.
• Preparing agendas for Council Meetings, in conjunction with the City Manager, and coordinates the preparation and distribution of agenda packets. • Performs clerk duties for the Planning Commission, including preparation of the agendas and taking minutes.
• Oversee and supervise all public records requests.
• Ensuring City contracts and other legal documents are signed and recorded. • Serving as liaison for the City Clerk's office with other departments, outside agencies, and the general public, negotiating and resolving sensitive and controversial issues. • Overseeing and managing the City's records management program. • Assuming responsibility for business licenses and renewals.

Fundamentally, the City cannot remove from the City Clerk the statutory duties identified in California law. However, just as the City Council has the authority to assign additional duties to the City Clerk by ordinance, it also has the authority to remove those duties by repealing or amending that same ordinance. If the City were to repeal Section 2.08.050 of the IMC, the City Clerk's duties would revert back to only those required by State law.

CITY CLERK COMPENSATION
Government Code section 36517 provides that the City Clerk shall receive, at stated times, a compensation fixed by ordinance or resolution. The reference to "compensation fixed by ordinance or resolution" clearly establishes that City Council fixes the compensation, as only the City Council, as the legislative body of the City, has the authority to fix such compensation for the Clerk.

Notwithstanding the Council's authority to set the City Clerk's compensation, the City Council is not authorized to set the compensation for a City Clerk at such a low level that no competent person would agree to serve.

Currently, the City Clerk is compensated by an annual stipend of $26,400 per year with no benefits.

CITY OF IONE
IONE, (1 95640) Agenda Item J.4.

DATE: June 4, 2024
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Andy Pinasco, City Attorney
SUBJECT: Consider Submitting a Measure to the Voters of the City of lone at November 5, 2024, Municipal Election as to Whether the Office of City Clerk Should be Changed from Elected to Appointed
RECOMMENDED ACTION:

No recommendation from City Staff.

OPTIONS:

1. The City Council may adopt the proposed resolution, calling a general municipal election for the submission of a proposed ballot measure to change the position of City Clerk from an elected position to an appointed position, and requesting that the Amador County Board of Supervisors consolidate the general municipal election with the statewide general election to be conducted on November 5, 2024.

The City Council may choose to reject the proposed resolution.

3. The City Council may continue the item and request additional information and analysis from staff. Since the City must adopt the resolution one hundred thirteen (113) days prior to the election, the resolution must be transmitted to the Amador County Registrar by July 15, 2024.

FISCAL IMPACT:

The fiscal impact associated with submitting the ballot measure to the voters will depend on the costs the County will incur to conduct the election, since the City must reimburse the County for the costs of conducting the election. The estimate provided by the Amador County Registrar is a range of $4,600 to $8,600 to place a measure on the November 2024 ballot.

BACKGROUND:

At the March 19, 2024, Ione City Council Regular Meeting, the Council directed the City Attorney to bring back an item for the full Council to consider submitting a Measure to the voters of the City of lone asking whether the City Clerk should be an appointed position.

DISCUSSION:

Requirement for Cities to Have City Clerk
The City of lone is a general law city, and therefore derives its municipal powers from laws enacted by the state legislature. California Government Code section 36501, originally adopted in 1949, requires that the government of each general law city include the offices of City Clerk, City Clerk, along with the City Council, Chief of Police, and Fire Chief.

II. Selection of City Clerk in General Law Cities
Under state law, the position of City Clerk is elective with a four-year term but may be made appointive on approval of the voters at a regular municipal or special election. Currently, the position of the City of lone's City Clerk is an elected office. The only qualifications in State law for elected City Clerks is that they must be at least 18 years of age and registered voters of the City. The City is prohibited from establishing any additional requirements.

If the office of clerk is appointed, the City Council makes the appointment unless that power is vested in the City Manager by Ordinance.

III. Compensation
The compensation of the City Clerk may be set by the City Council or by initiative. Currently, the City Clerk is compensated by an annual stipend of $26,400 per year and no benefits.

IV. Process to Change from Elected to Appointed City Clerk California Government Code section 36508 provides that the City Council may place a question on the ballot whether the City Clerk should be appointive offices. By statute, the specific question on the ballot would read:
"Shall the office of city clerk be appointive?"
If the voters should approve the measure, the City Council would be empowered to appoint the City Clerk upon expiration of their current terms. Under Government Code section 36510, the City Council may, at a later date, adopt an ordinance vesting in the City Manager the authority to appoint the City Clerk. The appointed City Clerk will serve at the pleasure of the City Council.

If the majority of voters vote "no" on the question then the position will remain elected, and the City cannot submit another ballot measure regarding the appointment of the City Clerk for at least eleven (11) months. The City Council must hold an election to fill the City Clerk position at the end of each term.

California Elections Code section 9222 provides that the City Council can submit an initiative measure to the voters without petition. To be placed on the ballot, the Council must adopt and transmit a resolution to the County Elections Official by July 15, 2024 for the November 5, 2024, municipal election. In addition to placing the question on the ballot, the required resolution should also authorize arguments in favor and authorize the City Attorney to prepare an impartial analysis.
