F. PUBLIC COMMENT:

Gary Thomas, Amador Water Agency, District 2 Director - Invited Council and City Manager to the Amador County Water Infrastructure Government Leader Mixer on June 19, 2024 from 5:30 p.m. to 7:30 p.m. at the American Legion Hall.

Larry Rhoades - read a letter from the Regional Water Quality Control Board dated October 6, 2023 - "Inadequate Industrial Waste Stream Treatment/Manager - the current wastewater treatment plant is designed and operated to effectively treat domestic waste, but not the industrial waste stream generated by the various documented industries operating within the prison. These Cal PIA industrial operations include meat packing, laundry, sewing and garment assembly, coffee roasting and lunch packing. There are several vocational training facilities on-site that generate industrial wastewater, including, janitorial training, welding and fabrication, vehicle maintenance, warehouse operations; and building maintenance which includes painting, carpentry, heating, ventilation, and Air Conditioning maintenance, and mechanical maintenance products. Data provided in CDCR's monitoring reports include that volatile organic compounds (VOC's) have been detected in the plant's effluent, effluent storage reservoir, and groundwater underlying the storage reservoir and land applications areas." Jim Scully - commented on the October 6, 2023 letter from the Regional Water Quality Control Board, "The actual volume of industrial wastewater flow from the specific operations in unknown. These two Cal PIA industrial operations alone generate industrial waste stream volume that generates a significant volume of wastewater entering the onsite treatment plant. To properly treat all the constituents and ensure reliability of the treatment plant, the updated ROWD required by this order must propose to address the industrial and domestic waste streams by either segregating and treating the streams separately with the appropriate technology or upgrading the existing wastewater treatment train to treat for all constituents in the combined waste stream."
Tommy Quinn:
• The sound from the gun range at CalFire is causing issues for my dog. I want to know who is going to stand up for this town and take on these State entities. It is not only CalFire that uses the gun range, but the Sheriff's Department, City of Jackson, City of lone and other entities.

I. REGULAR AGENDA:

1. Operations Contract for Wastewater Services - City Manager, George Lee explained that on June 30, 2023, the City signed a one-year contract with James Water Services Company for:
• $46,750/monthly - $561,000 annually with an annual CPI increase of 4% per contract = $583,444
Staff is asking for direction from staff on the following:

Option #1:
• Direct staff to bring back amended contract with Waterstone, LLC the negotiated price of $38,000 monthly, $456,000 annually with an annual CPI increase not to exceed 4%. Savings: $127,440 over contract with an annual CPI increase not to exceed 4%.

Option #2:

Direct staff to bring plant operations in house with the hiring of 3 full time staff with an annual personnel budget of approximately $420,000.

Savings: $163,444.00 over current contract with 4% CPI increase.

Public Comment:

Kathy Stone, commented that we have a vested interest in Ione. Would like everyone to come out and tour the plant. It is looking immaculate and running great. We are exceeding expectations for the golf course. We are anxious to do the upgrades and is in the process of pricing the repairs.

Andy Aguilera commented he hopes the City keeps Waterstone because they are doing a good job-everything looks nice and clean.

Agenda Item #I1
After discussion by Council, it was moved by Vice Mayor Wratten, seconded by Mayor LaFayne and carried to approve the City Manager to enter into negotiations/discussions and draw up a contract with the new agreements (Option #1).

AYES: LaFayne, Wratten, Atlan, Mitchell, Rhoades
NOES: None
ABSENT: None
ABSTAIN: None

2. Consider Submitting a Measure to the Voters of the City of lone at November 5, 2024, Municipal Election as to whether the Office of the City Clerk should be changed from Elected to Appointed Official - City Attorney Andy Pinasco outlined the process to change the elected Clerk to an appointed Clerk-the City Council may place a question on the ballot whether the City Clerk should be an appointive office.

If the voters should approve the measure, the City Council would be empowered to appoint the City Clerk upon expiration of their current term. Under Government Code Section 36510, the City Council may, at a later date, adopt an ordinance vesting in the City Manager the authority to appoint the City Clerk. The appointed City Clerk will serve at the pleasure of the City Council.

If the majority of voters vote "no" on the question, then the position will remain elected, and the City cannot submit another ballot measure regarding the appointment of the City Clerk for at least eleven (11) months. The City Council must hold an election to fill the City Clerk position at the end of each term.

Public Comment:

Mitzi Windley -1 do not understand why you wanting to be appointed rather than elected. I think we should have the free will to elect just like you are elected and want to know why you want to appoint someone and not leave it as elected. We are not allowed to answer you under public comment.

Jody Maita - strongly encourage the Council to leave the Clerk as an elected position. It has been that way for some time, I don't feel comfortable with an appointed position because sometime personalities and agendas can come along the way and influence decisions, so let the people of lone decide.

Andy Aguilera who would appoint that position. The wrong person can get his friend in there and then we would be in a mess. What happens if the appointed clerk and the elected clerk wins-—what happens? If the appointed position wins and the clerk winsthe appointed clerk would trump the elected clerk.

Larry Rhoades - the three Councilmembers want to get the control of the clerk. She knows so much about the City, she has been longer than any of you and has done more for the City that any of you. This is crazy.

Agenda Item #I1
Gary Thomas - leave it the way it is. It has been going well for a long time. I know that it is not the person in it, this is about the job that is being done.

You must look at the person that is in it and say that there is some good that comes out of longevity. I can remember times when we had questions, and Janice's experience and knowledge goes way back, and the historical knowledge of what happened in this community is paramount for a lot of things. She has served well the citizens of lone even as temporary City Administrator, and has done a good job. The citizens of lone get to figure out who they want for City Clerk the same way they vote you people in.

Jim Scully - don't want to bore you by repeating what was previously said, but virtually every syllable that these people have said goes for me three times. I object to the wording, "shall this be an elected position or appointed." I would like words "elected by the people and then appointed by the Council" be added for clarification. Do not do this it is moronic.

After discussion by Mayor LaFayne, Vice Mayor Wratten and Councilmember Atlan, they recommended that this item be continued and brought back with the additional information as previously requested, the analysis from staff; and the additional cost for adding the Measure to the General Election.

K. REPORTS AND COMMUNICATIONS FROM CITY ATTORNEY: None
L. REPORTS AND COMMUNICATIONS FROM CITY MANAGER:
• All of the funds in the various accounts have been moved to Money Market Account and the City is now receiving 4.5% interest per month- on average the City will receive $45,000 per month in interest or $573,000 per year.

PUBLIC EMPLOYEE PERFORMANCE EVALUATION
Title: City Manager
Public Comment:

Larry Rhoades--funny you are evaluating the City Manager in 6 weeks when usually it is 3 months. He just made us money.

Mitzi Windley--this is the first City Manager that cares about our community and is part of our community. It is nice to have someone who truly cares about this community because we have never had that before.

Andy Aguilera--the City Manager is making us money—-it has been a long time since the City has made money. Mr. Lee is a very smart man, he knows finance. He is going to go by the law. Please keep Mr. Lee.

Kathy Stone—-since Mr. Lee started it has been a pleasure working with him and he has been very proactive on the Wastewater Treatment Plant. Very knowledgable and hard negotiator but he has been a pleasure to work with.

Justin Gradnados --I had a pump break down and Mr. Lee got the pump ordered and installed the next day. Mr. Lee is very easy to communicate with.

Jody Maita—I think the Council is making a big mistake if you make any changes at this point. I feel like this was a personal thing, because it is very unusual that evaluations are given at 45 days.

Council convened to Closed Session at 7:52 p.m. and reconvened to Open Session at 8:50 p.m. Mayor LaFayne reported that there is no reportable action.

K. ADJOURNMENT:

Moved by Councilmember Mitchell, seconded by Vice Mayor Wratten to adjourn at 8:50 p.m.

OF TONE

CITY OF IONE
IONE, (4 95640)
Agenda Item #I.3
DATE: JULY 2, 2024
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: JODI STENECK, FINANCE MANAGER
SUBJECT: ADOPT RESOLUTION NO. 2024-16 APPROVING THE ANNUAL APPROPRIATIONS LIMIT FOR FISCAL YEAR 2024-25
RECOMMENDED ACTION:
• Adopt the attached resolution approving the annual appropriations limit for Fiscal Year 2024-25.

FISCAL IMPACT: None
BACKGROUND:

The appropriations limit was approved by California voters in November 1979 as Proposition 4 (the Gann Initiative) and added to the California State Constitution as Article XIII B. In 1980, the State Legislature added Division 9 (commencing with Section 7900) to Title I of the Government Code to implement Article XIII B. This legislation required the governing body of each local jurisdiction in California to establish an appropriations limit (also referred to as the Gann Limit) on or before June 30 of each year for the following fiscal year. The appropriations limit is based on actual appropriations during the FY 1986-87 and adjusted each year using population and inflation adjustment factors.

DISCUSSION:

In May of 2024, the California State Department of Finance (DOF) notified the local jurisdictions of the population and price data for use in the appropriations limit calculation for Fiscal Year (FY) 2024/25. Based on said documentation from the DOF, the percentage change in population for the City of Ione is -0.06%. The per capita personal income change for FY 2024-25 is 3.62% over prior year. In the calculation of the annual limit, the prior year's appropriation limit is adjusted using the percentage change in population and the per capita personal income change, see attached calculations. The 2024-25 calculated appropriations limit for June 30, 2025 is $5,851.252.

Brickyard Road is essential for emergency access into the southern portion of the city's wildland threat zone, this area is a direct threat to the Wildflower subdivision and Howard Park.

With the extension of Foothill Blvd from Highway 104 to Brickyard Road, and the addition in the near future of the secondary access for Busses and Emergency service vehicles only from the back side of lone Elementary School to Foothill, Brickyard Rd serves as one of our primary emergency escape routes for lone Elementary School who at peak times has over 600 persons in attendance, along with the entire Wildflower subdivision and future Gold Village development.

Not only does Brickyard Rd provide an additional emergency evacuation route for our citizens, and as found out in other cities experiencing fires, the more evacuation routes available the quicker and more organized the evacuation takes place, which allows emergency vehicles to quickly get to the incident.

By annexing Brickyard Rd into the city, and keeping the road open, it will allow access for the emergency services to the wild land threat, and access to the recreation railroad in case of medical incidents, but also to the law enforcement agencies to address trespassers and other legal issues in the areas that directly affect our city.

The current road condition needs repair, but with Brickyard road being part of our evacuation routes, Grant monies are available to assist with the resurfacing and upgrades.

With the annex of the roadway it will also give the city the ability to work with the property owners to remove brush and vegetation along the shoulder and adjacent areas that currently are a lower priority for the county, but a direct problem for our community.

This annexation is also positive for our future growth of the city in the southern portion. This road is already in place vs having to go through multiple layers of permits, reports and studies and the application process with Cal Trans.

It is the recommendation of staff that the council approve the acceptance and annexation of Brickyard Rd "The Triangle" into the city limits of the City of lone for the purpose of public safety and evacuation routes along with the future of our city.
