F. PUBLIC COMMENT:
Larry Rhoades commented on Amador Court Case 22CV12824. The Central Valley Regional Quality Board has identified concerns with the quality of Mule Creek Prison Water including the presence of VOC's in their prison discharge. This was identified in 2018 and today the prison water remains unsolved. On October 21, 2021 the Regional Board ordered additional monitoring and reporting requests from VOC for all parties including cities, ARSA, flows into the Tertiary Plant and CDCR.
Jim Scully provided a memo from the Department of Correction and Rehabilitation in response to a Public Records Request dated October 5, 2023. Dominic Atlan is not employed or contracted with CDCR but rather the Prison Industry Authority (PIA).
Inadequate Industrial Waste Stream Treatment/Management--the current wastewater treatment plant is designed and operated to effectively treat domestic waste, but not the industrial waste stream generated by the various documented industries operating within the prison. These Prison Industry Authority (A.K.A. Cal PIA) industrial operations include meat packing, laundry, sewing, garment assembly, coffee roasting and lunch packaging. Mr. Atlan does work for PIA, which is the source of the contaminants in the water. Since Mr. Atlan is an employee of PIA, I strongly suggest he be removed from the Wastewater Committee and replaced by someone else.
Mitzi Windley--it doesn't seem like there is a public comment after the Council meets or speaks. Councilmember Atlan commented that it is a "circus" and it was a circus. Everybody has the right to their opinion and speak. The Mayor just kept hitting the gavel and telling everybody they were out of order. We elected you, so I am just making sure I am not mistaken. After each item on the agenda there will be a time for Public Comment, and did you know that you have the right to re-open Public Comment.
G. INFORMATION ITEMS: None
H. CONSENT CALENDAR:
It was moved by Councilmember Atlan, seconded by Vice Mayor Wratten and carried to approve the following:
1. Warrants - June 4, 2024 - Mayor LaFayne had some clarifying questions on the warrants for the Finance Manager.
2. Approve Opposition Letters to SB 1037 and AB 1886 and Authorize the Mayor to Sign
DISCUSSION ITEMS:
For the record: Action minutes provide the necessary documentation of City Council action. For those desiring to hear the full discussions on each item, they can request a copy of the recording of the meeting. These recordings provide an accurate and comprehensive backup of City Council deliberations and citizen discussions.
I. REGULAR AGENDA:
1. Approve a Memorial Bench for the Owens Family and the lone Memorial Garden for the Shearer Family - Salina Mitchell, Recreation Coordinator explained that the City is working to establish a Memorial Tree and Bench Program to be amended to the existing Adopt-A-Park Program.
Mayor LaFayne commented that there was some confusion as to the documents that are in the agenda packet. There was discussion with the City Manager and Mr.
Atlan prior to the Park & Recreation Commission meeting that this was going changed before it was presented to Council. Mr. Atlan, Council representative for the Parks and Recreation Commission commented that the decision of the Commission was that the Owens Family and the Shearer Family can pick any bench they want and the medal bench in the packet is to be used for the program moving forward.
At this time, staff is requesting approval of the lone Memorial Garden. The costs for the garden will be covered by donations and volunteers. Chad Simmons Landscaping will donate their time, the plants and the rocks for the garden. The maintenance of the garden will be done by volunteers and members close to the Shearer family. The water used to keep the garden will come from a 2" water line, steaming from an existing 4" irrigation pipe already in place by the Castle Oaks Golf Club.
Mayor LaFayne commented that she put together an informal policy that the City could adopt so it would be a streamline process for someone who wanted a memorial bench and gave it to the former Interim City Manager. I never asked for a wooden bench for the Owens Family. Thomas Borge has offered to pay for the installation, all of the materials and labor. Jonathan Mitchell, Willdan did the plans for free.
Moved by Vice Mayor Wratten, seconded by Councilmember Atlan and carried to approve a bench for the Owens Family and the Ione Memorial Garden for the Shearer Family.
AYES: LaFayne, Wratten, Atlan, Mitchell, Rhoades
NOES: None
ABSENT: None
ABSTAIN: None
2. Adoption of Resolution No. 2024-13 Senate Bill 1 (SB1) Road Maintenance Project for f Y2024-2025 - Jodi Steneck, Finance Manager presented the Council with a list of what streets should be included in a street rehabilitation program for 2024-2025. After discussion, the Council would like the City Engineer to review the list of streets and his recommendations on which roads are the worst or where you can get your most value for the money; and also, the fund balance in the Gas Tax Money and SB1 at the next meeting. Vice Mayor Wratten that the City Engineer look at the Pavement Management Plan since the last one was done in Larry Rhoades, West Marlette is caving in and hoped the City would use ARPA funds for the repairs.
3. Discussion regarding the Process to Amend the Duties and/or Compensation for the City Clerk - Andy Pinasco, City Attorney commented that General Law cities are required to have a City Clerk. The elected City Clerk is an independent voice in City Hall. The City Attorney then reviewed with Council and the public the duties of the current City Clerk and also, the mandated duties as required by California State Law. Fundamentally, the City cannot remove from the City Clerk the statutory duties identified in California Law. However, just as the City Council has the authority to assign additional duties the City Clerk by ordinance, it also has the authority to remove those duties by repealing or amending the same ordinance. If the City were to repeal Section 2.08.050 of the IMC, the City Clerk's duties would revert back to only those required by the Sate Law. Notwithstanding the Council's authority to set the City Clerk's compensation, the City Council is not authorized to set the compensation for a City Clerk at such a low level that no competent person would agree to serve.
Larry Rhoades, it was not her fault that the Clerk was not doing some of her duties, they were taken away by the former Interim City Manager.
Kelly Traverso, I am confused why you are lowering the City Clerk's pay when she is doing a good job with so little pay and replace her with someone else. It does not make any sense moving forward.
Staci Mitchell, I am here to support Janice. After listening to all the duties that she is doing, she deserves twice the amount she is making. You cannot take our votes away-- that is something that really bothers me. I just don't see why you want to do that to her.
Arlene Dutschke, is the goal to lower the salary or compensation for the City Clerk- don't understand why this is on the agenda. If there is a motion on the floor, then it is more easily debated and understood by the public.
Bailey Mitchell, I am Jack Mitchell's daughter. For full transparency, these are my words and not his. I am here to support Janice and also like to speak to the continuous and unprofessional anganistict behavior of our Mayor. At the last Council meeting, our Mayor continually blocked other Councilmembers to speak on items that were outlined on the agenda and made condescending remarks to the public continuously yelling "out of order" to any person who did not have her same opinion, or personal agenda. This is not the first meeting that the Mayor has led, that left the public disrespected and has actively created division among the Council, staff and the public. As Mayor you set the decorum and run the meeting in a professional and respectful manner. Yet, time and time again you have shown that you are incapable. You berating Janice at the last meeting over office hours is beyond disrespectful-she does not control office hours. You berating her over office hours was nothing but a personal attack Janice and. In light of the Mayor's behavior, I believe it is the City Council and the voting public best interest to remove Alison LaFayne as our Mayor, and appoint Diane Wratten as Mayor. My vote is to keep the City Clerk as an elected position with oversight by the public and not this Council. The respect you give is the respect you will receive.
Mitzi Windley in the past we knew what the discussion was and then the public would speak. I don't even know for sure what is on the agenda. Mayor LaFayne stated that we don't write the agenda, the agenda is written for us. We can give direction on what we would like on the agenda.
Sue Nemeth, Am I hearing you correctly that the Council does not have control over the agenda, but the City Clerk prepares the agenda. Mayor LaFayne commented that the agenda is put together by the Mayor, City Manager and staff. I am saying that the verbiage on the agenda and was poorly written and it should reflect the 2025 Election.
Jamie Armstrong, I looked to see what the recommended action was-there was no recommended action from and that where the confusion is. I commend you for doing the City Clerk duties for $27,000.
Councilmember Atlan stated that this item agenda was very confusing. At no time has there been any intention of cutting Janice's pay or voting her out of office prior to her term being up. At the next election when the City Clerk takes office that will reflect whatever changes we make. This is not about Janice, but just the City Clerk. I would like the next City Clerk to get paid $200 per month and have minimal duties.
Vice Mayor Wratten, we at no point were going to put this in place for the current City Clerk. The goal is to bring the City Clerk back to the State Mandated requirements, and bring these duties into a position that is managed and monitored by the City Manager.
Having no oversight on the duties of the City Clerk makes it difficult for the City to function properly.
Andy Pinasco commented that this is a political decision and I do not feel that it was my place to make a recommendation to an elected body. My intent was not to have a recommendation but to provide the process where you have the authority under the law.
Gary Thomas I understand the dynamics here for support for Janice and the City Clerk.
The Council may consider Rosenberg Rules, which the public might better understand.
Jim Scully, I heard more than once that this is not about Janice, but the next City Clerk.
What is the rush now, shelve it until the next four years.
Teresa Mitchell, the three Councilmember said this is not personal, but made it personal by not allowing people to speak and cutting them off:
Moved by Councilmember Atlan, seconded by Vice Mayor Wratten to bring back an ordinance adjusting the duties at the next meeting. Motion did not carry.
AYES: Wratten, Atlan

4. Consider Submitting a Measure to the Voters of the City at November 5, 2024, Municipal Election as to Whether the Office of City Clerk should be Changed from Elected to Appointed - Andy Pinasco, City Attorney explained that at the March 19, 2024 Council meeting, the Council directed me to bring back an item for the full Council to consider submitting a Measure to the voters of the City asking whether the City Clerk should be an appointed position. The estimate provided by the Amador County Registrar is a range of $4,600 to $8,600 to place a measure on the November 5, 2024 ballot.
Jim Scully, heard two Councilmembers say this item is poorly written. I request, the following wording be added on the ballot, "Shall be elected by the voters or appointed by the Council". I think this was done in anger. I do appreciate the positive direction one Councilmember has shown tonight.
Moved by Vice Mayor Wratten, seconded by Councilmember Atlan and carried to consider submitting a Measure to the voters of the City of lone at November 5, 2024, Municipal Election as to whether the office of the City Clerk should be changed from Elected to Appointed, and adopt Resolution No. 2024 - 14.

SUBJECT: HOWARD PARK AND EB HALL FEE SCHEDULE UPDATE
RECOMMENDED ACTION:
Recommend approval of the Howard Park and EB Hall Fee Schedule Update.
FISCAL IMPACT:
Updating the Howard Park and EB Hall Fee Schedule will provide minimal fiscal gain. The fee increases are very minimal but will help off-set the rising costs associated with maintenance of the facilities and grounds.
BACKGROUND:
Howard Park is used by not only the entire County of Amador, but also surrounding areas such as Lodi, Stockton, etc. The rental of EB Hall is very popular for Quinceaneras, fund raisers, large gatherings, etc. The City has not increased, or updated fees for this facility in at least six years.
With continually rising costs for maintenance, supplies and other resources, Staff feels it's a good time to minimally increase fees and streamline the Fee Schedule.
DISCUSSION:
At the May 28t* meeting of the Parks & Recreation Commission, they recommended the approval of the City Council of the Howard Park and EB Hall Fee Schedule Update. Given that the fee structure has not been updated in years and costs to maintain the facilities keep rising there is a need for a slight increase. The increase will be minimal and will still provide a much valued recourse to our community well under the going rates of other similar facilities.
Staff recommends that we increase the fees to rent EB Hall by a total of $105. We also recommend increasing the fee for the Amphitheater/Stage from $10 to $100. The outdoor area referred to as the "Beer Garden" has always been rented along with the hall but since it is such a popular area, we suggest renting it independently of the Hall for a fee of $195. We have also had many requests to rent the grassy area near the Hall, referred to as "Picnic Hill" and the Skate Park so Staff also recommends renting those areas out as well for a fee of $100 per area. This increase is minimal and will open up the possibilities for facility use at Howard Park.
In the past years one of the parties that have rented the Hall is the organization that holds the annual "Party to Pardee" fundraiser event. This event is huge with over 3,000 attendees annually and completely takes over the park. With the charge for each area being separate from the EB Hall rental, the City has an opportunity to charge large scale events a little more. Currently they are only being charged for the EB Hall rental and a $1 per car "parking fee". Because it is almost impossible to determine how many cars are parked, we propose changing the wording of this fee from a "parking fee" to an "attendee fee". This fee can be used towards to maintenance and improvements of the roads and parking within the Howard Park facility.
In addition to the few proposed increases, Staff has changed some wording and made the overall Fee Schedule easier to read and understand by combining language regarding deposits, etc. from several lines to one-line item. Copies of the old Fee Schedule, as well as the proposed Updated Fee Schedule are attached.

TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: SALINA MITCHELL, RECREATION COORDINATOR
SUBJECT: ETERNAL FLAME TOWER AT VETERANS MEMORIAL PARK
RECOMMENDED ACTION:
Recommend approval of the installation of an eternal flame tower at Veterans Memorial Park.
FISCAL IMPACT:
Minimal to no fiscal impacts are associated with this project. The project may require the guidance and/or assistance of Public Works for the installation of the propane. All costs will be paid for and/or reimbursed by the Veterans Memorial Foundation.
BACKGROUND:
The Ione Veterans Memorial Park, located at Preston Avenue and Main Street, was founded by the Ornsby Family in 2011. The foundation also hosts the annual Walk for the Troops fundraiser, which is a community favorite. All maintenance and improvements to the park are accomplished by funds donated and volunteers organized by the foundation.
DISCUSSION:
At the May 28"* meeting of the Parks & Recreation Commission, they recommended the approval of the City Council of the addition of an eternal flame to the existing Veterans Memorial Park. Jake Herfel has been hired as the project manager, and he has put together a comprehensive set of plans and specs for the flame. The calcs have been prepared and stamped by a structural engineer. All work shall be done under permit issued by the City. The only component of the project yet to be finalized is the source of the natural gas needed to fuel the flame. There are two options; one being that the bank allows the foundation to run a splitter that allows just enough gas to run the flame. Unfortunately, this does not seem to be a viable option at this time. Option two, the City line would need to be tapped into, with the help and guidance of the Public Works Division. Either way, the amount of gas needed is so minimal it will most likely not increase the gas bill, but the foundation is happy to pay for any and all associated costs.
The tower will be placed behind the wall of names and will rise above it with a continual flame.
As there are very minimal fiscal impacts, we ask that the City Council approve the addition of the eternal flame to the existing monument. Robyn Ornsby and Jake Herfel are here tonight to answer any additional questions Council may have.
