Andy Aguilera - I have been going to meetings for over 50 years and I have never seen a City Manager, Attorney, City Councilman, Mayor, Police Department or any City employees in open session talk about an elected officer and City paid officer. I think it was against the law. It would probably be a good thing if the Mayor would step down and let the Vice Mayor take over.
Carlo Sgroi, Police Department Sergeant, commented that I appreciate everyone here plus the Council, and City Manager. Wastewater Treatment presentation was great including Ken Mackey who helped. Thanked John Alfred, Police Chief for bringing the Police Department to the technology to where we need to be. Very happy to work for this department and look forward to the new office.

These recordings provide an accurate and comprehensive backup of City Council deliberations and citizen discussions.
I. REGULAR AGENDA:
1. Amador County Regional Transportation Plan 2024 Update and Mitigated Negative Declaration – Susan Peters, City Planner explained that the proposed update is made up of a description of the RTP planning process, existing conditions, alternatives, policies, actions and a financial plan. This update of the RTP shows a significant change in projects planning and funding strategy. The focus of funding has shifted from project planning and funding strategy. The focus of funding has shifted from projects that address congestion to projects that rehabilitate and repair existing infrastructure. This shift is a result of the ACTC board placing greater attention on the need to rehabilitate the County’s failing roadway infrastructure. The RTP improvement plan has been broken into three “tiers” with the following descriptions:
• Tier I (fully funded) represents projects for which full funding is considered reasonable available based on the four (4) revenue projections. • Tier II (unfunded) represents projects for which no funding is committed, but funding could be made available within 20 years, if additional sources of revenue are received/created.
• Tier III (SHOPP Candidate list) represents projects that are located on the State Highway System and are the responsibility of Caltrans. However, a Agenda Item #I1
“fair-share” contribution could be set aside but cannot be reasonable expected within 20 years.
Currently, the City of Ione does not have any projects on Tier I—all of Ione projects have been pushed to Tier III, which currently has no funding.
Ione needs to look at how we are planning for future improvements and roads in the City. We have a WIRIS project and need to look at breaking that into chunks because ACTC is not going to go for projects that will require massive regional funding and take generations to build.
The Planning Commission reviewed the RTP and MND at their June 11, 2024 meeting and requested that staff ask the ACTC to include more accurate population numbers for the City. The RTP assumes an overall population decrease for Amador County but the City of Ione continues to grow with several more housing units in the development process. This increased growth and the associated impacts should be addressed in the RTP and MND. With some of the funds from the LEAP Grant, the City will be looking at projects that we need to do when development picks up again.
Public Comments:
Gary Thomas - need to get the large trucks out of downtown.
Larry Rhoades – before the prison, we had 4,000 cars per day going through Ione and after the prison, we have 8,000 car per day. We have asked Mule Creek Prison to change their hours so there will not be a conflict with the schools.
Sue Nemeth – Asked if it would beneficial to put together an action committee to assist with the process of getting the desires of Ione documented and help work through this process of this transportation dilemma that we seem to be in. Add to Future Agenda Items at the end of the meeting.
2. Adopt Resolution No. 2024-13 Senate Bill 1 (SB1) Road Maintenance Project for Fiscal Year 2024-2025 – Jodi Steneck, Finance Manager explained that the Fiscal Year projects planned to be funded with Road Maintenance Rehabilitation Account revenues includes the section of West Marlette Street listed herein.
Treatment to the street listed in this resolution is anticipated to extend the useful life of these streets receiving slurry seal. The project is anticipated to be constructed in the 2024-25 Fiscal Year.
Public Comments:
Larry Rhoades – wished the City had used COVID funds to repair West Marlette.
Agenda Item #I1
Jonathan Mitchell – would like to adopt the resolution and give us the flexibility to come back with estimates.
Moved to adopt Resolution No. 2024-13 adopting a list of projects for Fiscal Year 2024-25 funded by the Road Repair and Accountability Act of 2017 (SB 1).

3. Adopt Resolution No. 2024-15 Approving the Fiscal Year 2024-2025 Budget – Jodi Steneck, Finance Manager reviewed with the Council and public the 2024- 2025 Operating Budget. After discussion by Council, it was moved by Councilmember Atlan, seconded by Vice Mayor Wratten and carried to adopt Resolution No. 2024-15 approving the 2024-2025 Budget.

4. Discussion and Possible Action Regarding Portable Camera Trailer Lease – John Alfred, Police Chief commented that the City has had an increase in vandalism at Howard Park in the restrooms near the skate park. At the direction of the City Manager, we looked at the feasibility of a camera system in Howard Park but decided due to the lack of infrastructure this option would be too expensive and considerable money to maintain. We looked at the possibility of a mobile camera trailer with integrated wifi and power. This option is the most cost effective and the unit can be moved throughout the City and deployed as needed.
Moved by Vice Mayor Wratten, seconded by Councilmember Atlan and carried to enter into an agreement with WCCTV to lease a camera trailer for one year with funding from the COPS Grant.
AYES: LaFayne, Wratten, Atlan, Mitchell, Rhoades
NOES: None
ABSENT: None
ABSTAIN: None
5. American Rescue Plan Act (ARPA) Fund Update – Jodi Steneck, Finance Manager explained that the City of Ione received $3,074,472 in ARPA Funds.
Total expenses reported to US Department of Treasury were $634,834.81. An additional expense of $141,515 was spent for plumbing repairs and renovation of City Hall in 2022. The current ARPA fund balance is $1,208,518.
The final rule from the U.S. Treasury offers a standard allowance for revenue loss of up to $10 million, allowing recipients to select between the standard amount of revenue loss or complete a full revenue loss calculation. The City of Ione chose Agenda Item #I1
to take the standard allowance and therefore, our filing with the US Department of the Treasury is final and no additional report is necessary. The ARPA fund balance can be used as the City choses.
Vice Mayor Wratten asked Jodi Steneck to check if reimbursement was received from an insurance claim for both the renovation of City Hall and emergency fencing repairs at WWTP.
Mayor LaFayne commented that she was disappointed that none of these funds went to the people of Ione. Nothing went to any programs to help families during this time—we could have done something and maybe we still can. I would like something done with the remainder of the ARPA funds go to the community and to help City with their infrastructure.
J. REPORTS AND COMMUNICATIONS FROM CITY ATTORNEY:
• Clarified a mis-statement that he made in regards to Measure L. The question asked, “when can the appointment process take place in the event the measure passes. I made the statement that it could happen in 2024.
However, because the Clerk is on the ballot, the law states that you can change the Clerk to an appointed position after the expiration of the current term 2024-2028. If the event that nobody runs for Clerk in 2024, then that would allow you to appoint a Clerk.
K. REPORTS AND COMMUNICATIONS FROM CITY MANAGER:
• Mr. Lee has talked to the County regarding annexing part of Brickyard Road into the City. Ken Mackey, Fire Chief explained the reasons why:
-It would provide an emergency access road in the event of brush fire -It would serve as an evacuation zone for the City and provide another avenue to get out and provides access to Highway 104 and 124. -In the General Plan it calls that area “the triangle”. It not only serves the industrial growth for the City, but it is a huge safety environment for us.
Please think about the safety for the City. It is an old road, but is very well needed road for people to travel for emergency escape routes. • ACUSD included the Second Access Road on their next agenda for approval and hopeful that the School District will approve it.
• Met with Chris Strong, EcoUrban, he will be sending a monthly update on the Castle Oaks Landscape progress.
• The City received a check from Castle Oaks for $19,000 regarding the money they owed us and we should receive another check for $6,200 for 2023.
L. COUNCIL COMMENTS/COMMITTEE REPORTS/FUTURE AGENDA

Agenda Item #I4
DATE: AUGUST 6, 2024
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: JODI STENECK, FINANCE MANAGER
SUBJECT: SEWER DELINQUENCIES
RECOMMENDED ACTION:
Adopt Resolution No. 2024-19, A Resolution of the City Council of the City of Ione authorizing placement of delinquent unpaid sewer service charges on the Amador County Tax Roll for Fiscal Year 2024-25.
FISCAL IMPACT:
Placing delinquent sewer services charges on the Amador County Tax Roll allows the City to collect these fees to fund sewer operations and mitigate any uncollectible accounts.
BACKGROUND:
Each year, the City of Ione places a levy of delinquent sewer service charges with Amador County to be collected as a lien on the property owner’s tax assessment. This is in accordance with Municipal Code Title 13 – Public Services, Article II – Sewer Service Charges and Rates, Chapter 13.56 – Collection on Tax Roll. In addition, a $50.00 per parcel administration fee was established by City of Ione in accordance with Municipal Code Title 13 – Public Services, Article II – Sewer Service Charges and Rates, Chapter 13.52 – Billing and Collection to defray costs associated with the collection process. The fee is assessed on all accounts remaining in arrears following the final payment date as listed on the demand letter.
In order to have the levy placed on the upcoming tax roll, Amador County Auditor-Controller’s Office requires a signed agreement, information and certification forms, resolution approving levy, list of parcel numbers with levy amount to be submitted to their office by August 10, 2023.

Agenda Item #I5
DATE: AUGUST 6, 2024
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: SHAYNE MORGAN, CFD CONSULTANT
SUBJECT: RESOLUTIONS NO’S 2024-20, 2024-21 AND 2024-22 OF THE CITY
COUNCIL OF THE CITY OF IONE, ACTING IN ITS CAPACITY AS THE
LEGISLATIVE BODY OF THE COMMUNITY FACILITIES DISTRICT
NOS. 2005-2, 2006-1 and 2009-3 OF THE CITY OF IONE AUTHORIZING THE LEVY OF SPECIAL TAXES FOR FISCAL YEAR 2024-2025
RECOMMENDED ACTION:
That the City Council:
• Approve Resolution No. 2024-20 of the City Council of the City of Ione, acting in its capacity as the legislative body of the Community Facilities District No. 2005-2 of the City of Ione (Edgebrook and Castle Oaks Phase II) authorizing the levy of special taxes for fiscal year 2024-2025.
• Approve Resolution No. 2024-21 of the City Council of the City of Ione, acting in its capacity as the legislative body of the Community Facilities District No. 2006-1 of the City of Ione (Wildflower-Public Safety Services) authorizing the levy of special taxes for fiscal year 2024-2025.
• Approve Resolution No. 2024-22 of the City Council of the City of Ione, acting in its capacity as the legislative body of the Community Facilities District No. 2009-3 of the City of Ione (Castle Oaks Phase II) authorizing the levy of special taxes for fiscal year 2024-2025.
SOURCE OF FUNDING:
Special tax levy pursuant to Section 53340 of the Government Code and Ordinance Nos. 392, 427 and 428 respectively.
DISCUSSION:
There are various annual reporting requirements with different reporting dates related to the City of Ione Community Facilities District Nos. 2005-1, 2005-2, 2006-1 and 2009-3 (CFD Nos. 2005- 1, 2005-2, 2006-1 and 2009-3). The requirements include, among other items, City Council approval of the “Annual Levy of Special Tax” resolutions authorizing the levy of special taxes within CFD Nos. 2005-1, 2005-2, 2006-1 and 2009-3. The annual levy is necessary to pay debt service on the outstanding bonds and to pay for certain public services. Approval is due each year prior to the County of Amador’s August 10th deadline for the inclusion of such special taxes on the consolidated property tax bills pursuant to Government Code Section 43340 of the MelloRoos Community Facilities Act of 1982 (the Act), or in the case of direct billing, at a different time or in a different manner if necessary to meet its financial obligations.
CFD No. 2005-1 was established on February 22, 2005 and the special taxes were for facilities.
CFD No. 2005-1 encompassed 211 residential homes and the golf course clubhouse. The CFD No. 2005-1 Special Tax Bonds had a final maturity of September 1, 2016. Accordingly, parcels within CFD No. 2005-1 are no longer subject to the levy of special taxes. Furthermore, a notice of cessation of the special tax for CFD No. 2005-1 has been recorded with Amador County evidencing that the special tax lien imposed on the parcels within CFD No. 2005-1 has been extinguished.
CFD No. 2005-2 was established on June 6, 2006 and there are three improvement areas. They are: Improvement Area No. 1, Improvement Area No. 2 and Improvement Area No. 3. Each Improvement Area has a facilities special tax (Special Tax A) and a services special tax (Special Tax B).
Improvement Area No. 1 encompasses approximately 34.8 acres and contains 140 residential units. BACKGROUND:
In response to wastewater and associated recycled water management, planning and regulatory compliance needs, the City authorized professional engineering services according to the below summary table with timeline:
Authorization Date Description Authorization
Amount
June 20, 2023
Title 22 Report, West Yost (WY) Task
Order (TO) #1 $152,100.
General On-Call Support, WY TO#2 $25,000.
September 6, 2023

Instrumentation & Controls $49,800.
Interconnect Preliminary Analysis, WY
TO#3 $49,987.
November 8, 2023 Sewer Use Ordinance, WY TO#5 $23,100.
On September 5, 2023, Council also approved WY TO#4 – Services Related to Cease & Desist Recission for authorization in the amount of $49,500. Authorization has not yet been provided to West Yost for these services, initially due to a desire to preserve funds for other related needs, however it is recommended that this task be authorized at this time to support response to subsequent correspondence from the Regional Board and as an action item associated with the meeting held with the Board on July 16, 2024.
Permitted production, distribution or use of recycled water requires engineering reports prepared in compliance with California Code of Regulations, Title 22, Division 4, Chapter 3 (Uniform Statewide Recycling Criteria). To operate consistent with Title 22 requirements and in accordance with the Title 22 Reporting completed as part of WY Task Order 1 & 1A, updates to the Castle Oaks Water Reclamation Facility (COWRF) infrastructure and the development and implementation of Best Management Practices (BMPs) for the use of recycled water at the Golf Course are required. Accordingly, the below table shows initial cost estimates associated with remaining key elements of Title 22 compliance:
Required Tasks Initial Cost Proposal Estimates
TO#7 - Development of Golf Course BMPs consistent
with permitting requirements for the use of Recycled
Water.
$38,439. (April 2024)
Updates to instrumentation & controls at the COWRF
for near-term Title 22 compliance of critical systems.
$250,000. (lower estimate contract
approved, Waterstone, $179,028,
7/18/2024)
TO#8 - Long-term capital assessment, planning and
design associated with local and regional needs, and
COWRF operational effectiveness.
$450,608. (April 2024), with
construction cost approximated at
$1,305,000.
During the April, 2024 Council Meeting, staff was directed to review funding source and financial impacts relative to project scopes. Based on this review, staff evaluated funding and critical-path requirements for the improvements. The funding source identified during project development was the American Rescue Plan Act (ARPA). Accordingly, during the June 18, 2024 Council Meeting, staff presented ARPA fund details as an informational item. Following this presentation alternative project(s) were presented for consideration for the use of ARPA funds.
The scope for TO#8 included condition assessment, design, engineering during bidding, and engineering services during construction. Portions of the proposed improvements to the control systems at the COWRF require integration with controls at the Wastewater Treatment Plant (WWTP) with associated regional impacts, and integration with regional partners for both project development and funding. Staff’s recommendation is move forward with the required analysis (shown as Task 2 of TO#8), allowing time for concurrent discussions with the Board.
Based on the outcome from that portion of the scope we can then formulate next steps for review by Council. This approach is consistent with the recommendation and direction from the June 24, 2024 Wastewater Committee Meeting. West Yost has already completed some initial work on TO#8, TO#7 and the on-call proposal which we look to reimburse if the recommended action is taken.
Operational Capital Improvement Projects (CIP) Required to Maintain Existing Sewer Service (Discussion related to Recommended Action #4, adoption of CIP List). As part of the active study to evaluate current sewer service operation costs, and associated rates paid by residents, we must identify required maintenance and rehabilitation projects required to maintain existing level of service. The below projects have been identified:
CAPITAL IMPROVEMENT PROJECT LIST IDENTIFIED IN RECOMMENDED ACTION ITEM #4 FOR ADOPTION
Sewer Maintenance & Rehabilitation Project Estimated Cost Associated with Existing Services, Ratepayer
WWTP Headworks and IPS Replacement $4,913,465.
Rehabilitation and Required Update of Electrical &
Equipment at WWTP
$1,273,444.
COWRF Rehabilitation of Unit Processes & SCADA $4,837,704. (may be reduced by outside funding)
Required Permitting and Planning Studies $1,109,602.
As the recommended Wastewater task orders scope is being completed, this will result in refinement and amendments to the required project list and costs. The City continues to work to identify additional grants or other funding to reduce the costs passed on to the rate payers as permitted.
FISCAL IMPACT:
Title 22 work associated with the COWRF is anticipated to be funded from the Tertiary Fund Balance, and the General On-Call is anticipated to be primarily funded from Wastewater account funds, or as appropriate based on task-specific requests.
Sewer Maintenance and Rehabilitation CIP Project costs are being developed into a rate-nexus study for ratepayer funding of the appropriate share of project costs.

City of Ione
Ione, CA 95640
SUBJECT: Proposal for Engineering Services – Recission of Cease-and-Desist Order R5-2014-0157 Dear Amy:
West Yost appreciates the opportunity to present the City of Ione (City) with this letter proposal for engineering services to assist the City in rescinding and replacing Cease-and-Desist Order (CDO) R5-2014-0157, which was issued by the Central Valley Regional Water Quality Control Board (Regional Board) for the City of Ione Wastewater Treatment Plant (WWTP). WWTP discharges are currently regulated under the following discharge permits:
• Waste Discharge Requirements (WDRs), Order No. R5-2013-0022-001 which is based on outdated conditions and plans.
• Cease-and-Desist Order (CDO), Order No. R5-014-0157 which is an enforcement action taken by the Regional Board related to discharge of secondary effluent in percolation ponds at the WWTP that caused elevated iron and manganese concentrations in nearby groundwater, and the potential for seepage of iron and manganese into Sutter Creek Based on upgrades at the WWTP and analysis of groundwater monitoring data, the existing CDO is no longer defensible and there is reasonable cause to request recission of the CDO and adoption of a new CDO that reflects the current conditions and knowledge of the facility and its potential to cause impacts to groundwater. Regulation under a revised CDO in line with current operating conditions would allow the City to have additional time to define the appropriate regulatory strategy for the WWTP. The Scope of Work and Fee Estimate provided in this proposal are for support in rescinding the CDO and developing reasonable requirements for an updated CDO.
The remainder of this proposal is organized around the following sections:
• Project Understanding
• Major Assumptions
• Scope of Work
• Estimated Fee
• Schedule

PROJECT UNDERSTANDING
This section presents our team’s understanding and approach to requesting recission of the CDO and adoption of a new CDO by the Regional Board. The following actions were required by the CDO:
• Construct facility improvements that will effectively stop the mechanisms that result in the mobilization and discharge of iron and manganese in violation of the Groundwater Limitations of the 2013 WDRs;
• Effectively stop any indirect discharge (seepage) of polluted groundwater to Sutter Creek; and • Bring the facility into compliance with the 2013 WDRs.
The CDO requirements were based on predicted changes in iron and manganese groundwater concentrations developed with an imprecise understanding of iron and manganese biogeochemistry at the site. Since the CDO was issued in 2014, iron concentrations have generally decreased to within acceptable levels, but manganese concentrations have not followed predicted decreases. WWTP upgrades since the CDO was issued have addressed the discharge that resulted in noncompliance with WDRs, however bringing the facility into compliance as defined in the WDRs and existing CDO is not a practical requirement as detailed in the following sections. A request to rescind the CDO will be presented to the Regional Board along with recommendations for a replacement CDO that consider completed facility upgrades, improved understanding of groundwater conditions at the site, and additional monitoring data to establish the effects of natural processes on groundwater iron and manganese concentrations at the site.
Cease and Desist Order
This proposal includes tasks to assist the City with preparing a request to the Regional Board to rescind the CDO and recommendations for adopting a new CDO.
Review of the Existing CDO
The existing CDO was issued in 2014 and set a timeline for achieving annual specific concentrations of iron and manganese from 2015 to 2017 in the following monitoring wells (MW): MW-2, MW-2A, MW-3, MW3A. Iron concentrations decreased in all MWs and have remained in compliance with the WDR Groundwater Limitation of 300 µg/L in MWs 2 and 3. Iron concentrations in MWs 2A and 3A, which are screened at shallower intervals, seasonally exceed 300 µg/L. Manganese concentrations in all MWs have persisted above the WDR Groundwater Limitation of 50 µg/L and prevented the City from achieving full compliance with the CDO and WDRs. Since the City did not meet required Constituent Concentration Limits outlined in the CDO by 30 October 2017, the City was required to perform facility upgrades at the WWTP that included excavating sludge from the bottoms of Ponds 1-5 and adding HDPE lining, which occurred in 2019. Since completion of sludge excavation and pond lining there has been little or no effect on iron and manganese concentrations measured at MWs 2, 2A, 3, and 3A.

Process to Rescind and Replace CDO R5-014-0157
West Yost submitted Technical Memorandum: Assessment of Wastewater Treatment Plant to the City on May 12, 2023. This document outlined work that has already been performed to document groundwater iron and manganese concentrations and the rationale for rescinding and replacing the current CDO. West Yost will document the work already performed in a draft request to the Regional Board to rescind and replace the CDO. Prior to formal submission of the request to rescind and replace the CDO, West Yost and City staff will meet with the Regional Board to discuss the request. Based on Regional Board feedback, West Yost will then prepare a formal request on behalf of the City to rescind and replace the CDO, including proposed water quality objectives and monitoring requirements for the Regional Board’s consideration in developing a new CDO. Regional Board staff are expected to provide a 30-day review period for the updated CDO.
Based on West Yost’s experience working with Central Valley dischargers, it is expected that the CDO will be rescinded and replaced with a new CDO without protest. If outside parties do comment on the CDO, there may be a need to work with Regional Board staff to craft an appropriate response and/or there could be a formal hearing by the Regional Board related to rescission and replacement request. Work related to addressing such a protest may include preparing supplemental information to support the City with their contest of the permit, preparing responses to other parties that have contested the permit, and preparation of these materials for presentation at the Regional Board hearing. The current proposal does not include support specifically related to addressing potential protests. However, tasks are included for as-needed support services that could potentially accommodate such support.
MAJOR ASSUMPTIONS
Major assumptions pertinent to more than one task of this project are detailed below:
• West Yost will rely on the support from City’s legal counsel, Somach Simmons and Dunn (SSD), should the need arise, for regulatory support services. SSD support will be provided directly to the City and no fee for legal counsel is included as part of the budget for this proposal.
• The City will be responsible for completing any sampling needed to achieve the objectives of the tasks outlined in the scope of services, and the City will contract directly with a certified laboratory for completing any necessary analytical efforts.
SCOPE OF SERVICES
The following scope of services defines anticipated efforts related to developing a request to the Regional Board for recission and replacement of the CDO with a new CDO that reflects updated and improved understanding of WWTP operations and site-specific conditions. As described further below, the key tasks necessary to perform this scope of services are as follows:
• Task 1 Project Management and Meetings
• Task 2 Rescind and Replace CDO R5-2014-0157
• Task 3 Regional Board Meetings
• Task 4 As-needed CDO Adoption Support

N-M-C-IONE-LP
Task 1. Project Management and Meetings
This task includes project management related activities, including project initiation, general project coordination, and development and review of project invoices. Under this task, brief descriptions of services performed will be developed and included with monthly invoices.
This task also includes a kickoff meeting to discuss the scope of services, data needed by West Yost to complete the scope of services, and any specific concerns City staff have. West Yost will develop a draft agenda for the meeting and provide a follow-up email with agreed-upon action items. West Yost will also facilitate one additional coordination meeting with the City.
In addition, to ensure continued achievement of consistently high-quality work products, and in accordance with the West Yost Quality Assurance/Quality Control (QA/QC) policy, a West Yost staff member at the Principal Engineer level or higher will review significant work products. This task includes coordination of these QA/QC efforts.
Task 1 Assumptions
• Project duration will be approximately twelve months.
Task 1 Deliverables
• West Yost will prepare monthly invoices and descriptions of services performed in PDF format. • West Yost will prepare a draft meeting agenda in MS Word format prior to the Kickoff Meeting. • West Yost will provide an email summarizing action items from meetings within one week of each meeting.
Task 2. Request for Rescission and Replacement of CDO R5-2014-0157 West Yost will prepare documents and recommendations to submit to the Regional Board to request rescinding and replacing the CDO. A request to the Regional Board to rescind the CDO will be supported primarily by documenting data and analysis provided to the City in Technical Memorandum: Assessment of Wastewater Treatment Plant on May 12, 2023. West Yost will also prepare recommendations to aid the Regional Board in developing a new CDO.
Task 2.1 Coordination with City Legal Consul
West Yost will coordinate with the City’s legal counsel, Somach Simmons and Dunn (SSD) to develop a common understanding of the likely appropriate regulatory framework related to the City’s groundwater discharge and its potential impacts to Sutter Creek.
Task 2.2 Perform a Site Visit to Site a New Monitoring Well West Yost will perform a site visit to determine the location of a proposed additional monitoring well that is both upgradient of the WWTP and within the influence of surface-groundwater interactions with Sutter Creek. Future water level and quality monitoring at this monitoring well will establish what, if any, impact natural recharge from Sutter Creek has on background iron and manganese concentrations in groundwater.
Amy Gendry
August 18, 2023
N-M-C-IONE-LP
Task 2.3 Prepare a Request to the Regional Board to Rescind and Replace the CDO West Yost will prepare an analysis that summarizes the justifications for rescinding and replacing the CDO.
This analysis will specifically address the following findings:
• Previous expected concentration changes for iron and manganese require revision based on the best available science and site information;
• Iron and manganese groundwater concentrations in the background monitoring wells (MW-1 and MW-1A) are not likely representative of background concentrations in the influence of Sutter Creek; and
• The groundwater limitations in the CDO are no longer justifiable.
West Yost will present this analysis to Regional Board staff under Task 3. Following this meeting, West Yost will draft a request letter to the Regional Board to rescind and replace the CDO.
In the request to the Regional Board to rescind and replace the CDO, West Yost will document changes in groundwater quality before and after lining of WWTP Ponds 1 through 5 and develop recommendations for revised concentration limits for iron and manganese in groundwater based on maintaining current conditions. The request will also include a conceptual plan for a recommended location for a new monitoring well upgradient of the WWTP and in the influence of Sutter Creek. West Yost will also develop a proposed timeline for installation of the new monitoring well and completing an assessment of the naturally occurring influences on iron and manganese in local groundwater. .
A draft request letter will be submitted to the City for review. Following review, West Yost will facilitate a discussion with City and the City’s legal counsel to discuss the draft document. A final request will be developed the incorporates City comments.
Task 2 Assumptions
• West Yost will perform one site visit to the WWTP.
Task 2 Deliverables
• West Yost will prepare a draft and final request to the Regional Board to rescind and replace the CDO.
Task 3. Regional Board Meetings
West Yost will facilitate two meetings with City and Regional Board staff to discuss the rescission and replacement of the CDO. These meetings are as follows:
• Meeting No. 1: Present a proposed findings related to rescission and replacement of the CDO to confirm Regional Board expectations for the request. • Meeting No. 2: Present and discuss the formal request after submission to the Regional Board.
Prior to each meeting, West Yost will develop draft meeting agendas and presentation slides, as needed.
Following each meeting, West Yost will develop meeting minutes to document key decisions made and action items.
Amy Gendry
August 18, 2023
N-M-C-IONE-LP
Task 3 Assumptions

Task 3 Deliverables
• West Yost will prepare draft meeting agendas in MS Word format prior to each meeting. • West Yost will provide PowerPoint slides for each meeting. • West Yost will prepare meeting minutes with action items in PDF format within one week of each meeting.
• West Yost will coordinate additional deliverables for this task with City staff if and when services are requested.
Task 4. As-Needed CDO Adoption Support
Following Regional Board review of the request to rescind and replace the CDO, West Yost will be available to the City to provide as-needed support related to adoption of the new CDO and/or implementation of the provisions in the revised CDO. The types of support may include but are not limited to:
• Developing responses to Regional Board requests;
• Participation in meetings with Regional Board staff;
• Reviewing draft CDO documents;
• Additional site evaluation and preparation of a workplan to install additional MWs to assess naturally occurring dissolved iron and manganese in groundwater near Sutter Creek; and • Analysis of water quality data to ensure compliance with a revised CDO.
The specific work efforts and deliverables under this task cannot reasonably be determined at this time, so the associated fee estimate presented in this letter proposal is based on a nominal effort. The scope of work under this task will be limited to work that has been required by the City and can be completed within the available budget. All work will be performed on a time and materials basis, and monthly invoices will detail the efforts and costs. Depending on the level of effort required, a scope and budget amendment may be necessary in the future. If the estimated fee is not expended in the timeframe anticipated for this scope of work, it may also be directed toward the completion of other efforts.
Task 4 Assumptions
• The budget for Task 4 will be used on an as-needed basis. • Work performed under this task is limited to the assigned budget.
Task 4 Deliverables
• West Yost will be coordinated with the City staff if services are requested.
ESTIMATED FEE
The estimated fee for each of the tasks described above and total estimated fee are shown in Table 1.
