5. Notable Cases
On July 3rd, between 10:00 p.m. and 2:00 a.m. on July 4th, the City of Ione experienced several vandalisms. The Ione Police Department conducted an investigation and identified two juveniles involved. One suspect is from the Sonora area and is currently on probation. The second suspect was visiting from the State of Oregon. Officers are in contact with Tuolumne County Probation. Due to the overall cost of the damage, the suspects will be charged with felony vandalism. The estimated damage is $1690, and one victim lost approximately $5000 in revenue because of vandalism. The police department is working in conjunction with Amador County juvenile probation for
prosecution of the responsible juveniles.
On 7/9/24, officers responded to the rear of the Ione Plaza market for an individual passed out on a bench. Officers arrived on the scene and contacted Alan Smith, who was uncooperative and intoxicated. Smith fought with two Ione Police Officers and was eventually taken into custody. Smith was arrested and charged with 69 (a) P.C. – Obstruct/resist executive officer, 243 (c) (2) P.C. – Battery on a peace officer, 647 (f) P.C. – Public intoxication, and148 (a) (1) P.C. – resisting arrest. On 7/15/24, officers responded to Chevron on the report of a robbery that occurred on 7/13/24. Officers reviewed surveillance camera footage and started an investigation. The victim of the robbery was uncooperative and did not want to pursue charges.
During the investigation, officers identified the suspect and accomplice during the robbery. The suspect is a juvenile from out of the area. In conjunction with the Amador County District Attorney’s Office, the following charges have been filed with the district attorney for prosecution. 211 P.C. – robbery, 242 P.C. – battery, 32 P.C. – accessory, and 148 (a) (1) P.C. – obstructing a peace officer.

Fire personnel attempted to detain the suspect, but he fled down the creek bed, leaving behind personal property. Officers canvassed the area but were unable to locate the suspect. Officers collected the property and booked it into the evidence room. Later in the day, fire personnel observed the suspect in the area of Welch Lane. Ione police officers contacted Douglas Wagner, who was identified as the suspect by Chief Mackey. Officers took Douglas into custody and booked him in the Amador County Jail for 451 (c) P.C. – Arson and two counts of 148 (a) (1) P.C. resisting public officer.

TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: KEN A. MACKEY – DEPARTMENT OF PUBLIC WORKS – INTERIM SUBJECT: REQUEST OF COUNCIL TO FOLLOW UP ON THE CASTLE OAKS
LANDSCAPE AND IRRIGATION
RECOMMENDED ACTION:
Allow contractor to complete phase #3 and have the council approve the additional equipment items listed that were missing or broken, and give direction on replacing the sprinklers in Phase 3 west side to a drip system to save watering cost and reduce the weeds.
FISCAL IMPACT:
Continued per the agreement of the contract with EcoUrban Designs.
BACKGROUND:
Direction was given to the City Manager for a follow-up on the status of the landscaping project due to complaints from the public.
DISCUSSION:
In the future, more time could be given for the public input if needed on the design, keeping in mind that we are also under new regulations by the State of California and the Amador Water Agency on water conservation and landscaping, which has an affect on what can be put in these areas now.

DATE: AUGUST 14, 2024
TO: GEORGE LEE, CITY MANAGER
FROM: KEN MACKEY, INTERIM PUBLIC WORKS SUPERINTENDENT
This is a follow up to the on-site meeting that I had today with Chris Strong from Eco Urban Designs, Inc. at the entrance medium of the Castle Oaks Subdivision between Highway 104 continuing south west to Braeburn Way. (An approx. 90,000 sq. ft project overall) I discussed several concerns that were pointed out regarding the project. a) Public didn't give input, now it’s too late – The contractor explained it was an approved plan worked out between the former City Manager, Planner, and himself. b) Outside on the highway side is not maintained – The contractor explained that the irrigation systems on the outside was broken and not watering the vegetation, and most of the problem is from the trees and vegetation on the west side of the wall that is on private property, consisting of dead trees and plants, grass. Approximate upgrades to the system will take $5,000 worth of parts.
Three locations were observed by me on site in the commercial property with leaks that caused the water pressure problems to occur and failures at watering the plants, these areas were at the valves that we thought at first it was caused by the disc from the weed abatement, but during there (EcoUrban) repairs, it was clear that the lack of maintenance on the valves were broken by tree roots. When this property is built on or sold, this system will need to be disclosed to the owner to avoid it being torn out.
c) Do you have enough staff (3) to handle the project and ongoing maintenance – The contractor advised that he does have enough, the issue in the beginning they had a lot to do in removing the old vegetation and irrigation systems and install all of the new project, and once it is installed it will be an easy maintenance system for the crew, for what was agreed to.
He advised that the City Engineer worked with them and approved any alterations to some of the plants and the tree/bark and made two visits on site.
Phase #1 Thursday 03-28-24
Phase #2 Tuesday 08-06-24 Final inspection
Observation – Inspections on site:
Phase# 1:
I compared the original approved drawing to the on-site finished work and found only a few items were different (Example: a decreased in the amount of Monkey flower- was planted which is a drought resistant plant in the decorative boxes) and three additional trees. • The irrigation system was modified from the old sprinklers to the drip system working off of 3 sprinkler valves in the medium island area and 2 valves that operated the outside areas, all are working properly now after the damaged water lines in the commercial lot (Empty lot) were fixed which corrected the lack of pressure in the system that caused some of the concerns of the project and types of plants or dying trees.
• When the project was started many trees that were dead previous to this contract had been pulled out by unknown persons and wholes were left in the ground and portions of the irrigation system were damaged, all of this was unseen at the time but has been fixed, which did cause unexpected delays.
The South side of the project along the River Run sub division wall was planted by the developer and is not part of the landscaping project and is maintained by the River run development not Eco Urban.
Phase #2:
The second island or phase was slightly altered and approved by the engineer. a) Dead tree was removed on the east end of the island
b) All of the existing trees were healthy and left in place, and the modification was made to surround each with a 10 x 15 ft box area of bark instead of all rock in the island, with a drip system.
c) The electrical system to the sprinkler was corrected to operate the drip system. d) The vegetation along the wall on the north/west side had not been created at the time of contract but Eco Urban took on the clean-up of the weeds due to it making the area look bad which would reflect on the appearance of their project. This area needs to be maintained by the developer or HOA but Eco Urban is willing to continue to maintain it.
Phase #3:
This area is still under construction and is going well. a) Missing/stolen irrigation timer box is a major issue – that will need to be address, they will need approval to purchase the new solar power control box that was not missing prior to the original maintenance contract, approximate cost $2,000.
The west side of the street is not part of the project, but is in need of irrigation modification to give better growth and reduce both maintenance and water costs.
Replace the 260 sprinkler heads with 7ft spacing with a drip system CONCLUSION:
After meeting on site and seeing the progress and the approved drawing, with the approved modifications by the City Engineer, it appears the landscaping and irrigation project is being completed as per the agreement.
Unknown or unseen issues that have come up have been reported and after approval to fix have been corrected, with the exception of the items previously listed, (such as the highway side or the stolen control box)
I found that with all the information provided to me, that the contractor has done the work required and was approved in phase #1 & #2 by the city engineer, and phase #3 will be completed soon and will be ready for final inspection by the engineer.
We will need to address the outer areas of the street that run along the wall of the sub divisions for continued maintenance and upgrades to the sprinklers for water saving and cost reduction if this falls onto the city.
