C. PUBLIC COMMENT:

Julie, Wildflower resident made the following comments:
• I see political signs for Rhoades and Mitchell. If either is re-elected, I hope they can act in a professional manner and work with the Mayor and other colleagues.

City Manager Lee, I found your response to the Mayor interesting. The Mayor and Vice Mayor know they need to be in compliance when asking for contracts and not task orders.
• I am glad that the Closed Session is happening last. To have the public wait around is not considerate to us.
• I would like to see productive outcomes for all topics and issues concerning its citizens.
• The Council is supposed to be a voice for all its citizens and the needs of the community not for loyal friends or kickbacks. Let's work together to make this a great town.
• Would like to see the following for Howard Park:
- Like to see all the dead trees removed
- Like to see smooth surfaces for all the picnic tables - Like to see the dog poop station moved next to the track • Tommy Quinn - would like to see Police presence at all Council meetings because of the incident that happened at the August 6, 2024 Dominic Atlan.

Public Comment:

Larry Rhoades-would like to know the cost before you vote on property.

Andy Aguilera, I would hope that you let the public know what is going on at the Golf Course, if it is going to close.

Patrice Prest, if the Golf Course closes, it would be catastrophic for the residents who live around the golf course. It would be helpful if we were somewhere in the loop.

Mayor LaFayne - we all understand how frustrated everyone is—we cannot discuss the negotiations at this time. We are doing as much as we can and we want to stay on top of this. We are having a Special Meeting because we do see the urgency in this.

Susan Priest - I would like to know if the City has a contingency plan.

Nadine Bush - The residents would appreciate any information and clarity.

Council convened to Closed Session at this time to discuss the following:

Mr. Jim Rooney, Amador County Assessor reported the following:

Total assessed values in Amador County for 2024-2025 Tax Year was 3.57% Total assessed values for lone for 2024-2025 Tax Year was 5.97% John Alfred, Police Chief presented John "Johnny" Stewart with a Certificate of Appreciation for his service to the lone Police Department and citizens of lone on July 25, 2024 for his assistance on a police call.

F. PUBLIC COMMENT:

Stephanie Anderson commented that Alison LaFayne had a lease with the City lone to run the Arena at Howard Park. In reviewing the lease, I found that the Alison LaFayne owes the City $33,998.92. It concerns me because we are small town and was wondering if anyone is working with her to pay the bill.

Larry Rhoades, awhile back you talked about contractors and liability for the City.

Every contractor has to have a bond. If it is the person I think you are talking about, this person dumped gravel in 1984 and 1997 to help raise the levee—he did it on his own; and now the City wants to condemn this person.

1. Warrants - August 6, 2024: Mayor LaFayne pulled the Warrants from the Consent Calendar for discussion. Mayor LaFayne reported that the City received correspondence from Weber, Ghio & Associates today and submitted their final bill. It was moved by Vice Mayor Wratten, seconded by Councilmember Rhoades and carried to pay the Warrants and to add to the Warrants the outstanding invoices received today from Weber, Ghio & Associates.

1. Presentation by Jake Herfel on Rotary Club Parking Project at Howard Park - The Parking Project will be a three-way project-Rotary Club ($20,000), lone Business and Community Association ($20,000) and Axios Homes. The project will be done mainly by volunteers; and we do not know the exact cost of the project. Rough draft of the project was presented by Jake Herfel. • This project will create parking for ninety plus cars. • Vehicles will enter through the horse arena entrance and exit through the arena and the main Howard Park entrance.
• We will install 2-36 inch 40 feet long culverts to match the ones in the park and ones crossing Highway 124.
• The parking will parallel Highway 124 with a setback of 20 feet from the City fence.
• The new parking lot will be 80 feet wide and about 450 feet long. • We will need to remove some small trees and a large one, but final plan approved by the City may change.
• May need to bring in some fill dirt, and the entire lot will be covered by 3 ½ to 4 inches of road base.

Mr. Tom Borge, Axios Homes would be willing to donate and I think we can makeup the difference so there would be no cost to the City. We would love to help the Rotary Club accomplish their goals and we would like to also support the Business Association. Our equipment is on site finishing the road from the Elementary School and Unit #1.

Mr. Jonathan Mitchell, City Engineer we have prioritized this project to complete it before the rainy season. There are additional requirements that are triggered when we enter into the rainy season for a construction project. I received a memo from our Environmental Specialist stating that she is confident that we can move forward from an environmental standpoint on this project. That review included CEQA as well as a determination from California Fish and Wildlife, as well as required permits on the Federal level. From an engineering staff and our environmental resource team, I can recommend this project move forward without delay.

David Livingstone, thanks to Mr. Borge for offering the equipment for this Project, and a tremendous piece of gratitude to the City.

Gary Thomas, I think George Lee, City Manager should be the point of contact when there is discussion with Caltrans regarding the entrance to Howard Park.

Vice Mayor Wratten, I am concerned we do not have anything in writing, approved and signed off for a project like this. Andy Pinasco, City Attorney, my understanding from staff is that they are still working through this. Moving forward would be bringing back any sort of determinations. If there are not any determinations needed by Council, direction to staff would be appropriate and they can move forward under the City Manager. In the event that the Council does have to make some formal determination, project related, then it would be brought back to Council.

2. Discussion/Action on Assignment of Franchise Agreement from ACES (Amador County Environmental Services) to Delta Container Corp./Republic Services - Andy Pinasco, City Attorney commented that on July 17, 2024, the City received a letter from ACES Waste Services, Inc. seeking the City's consent to assign the Amended and Restated Franchise Agreement for Solid Waste Collection, Disposal and Recycling Services under Article M - Assignment to Republic Services because of proposed sale. After discussion by Council, it was moved by Vice Mayor Wratten, seconded by Councilmember Mitchell and carried to adopt Resolution No. 2024-26 Authorizing Assignment of the Amended and Restated Franchise Agreement for Solid Waste Collection, Disposal and Recycling Services.

3. Report on Castle Oaks Entrance Landscaping - Work Completed v. Contract- Ken Mackey met with Chris Strong, EcoUrban Designs, Inc. regarding the entrance medium to the Castle Oaks Subdivision between Highway 104 continuing southwest to Braeburn Way approximately 90,000 sq. ft. project overall).

After meeting on site and seeing the progress and the approved drawing, with the approved modifications by the City Engineer, it appears the landscaping and irrigation project is being completed as per the agreement. Unknown or unseen issues that have come up have been reported and after approval to fix have been corrected, with the exception of the items previously listed, (such as the highway side or the stolen control box).

I have found that with all the information provided to me, that the contractor has done the work required and was approved in Phase #1 and #2 by the City inspection by the Engineer. We will need to address the outer areas of the street that run along the wall of the subdivisions for continued maintenance and upgrades to the sprinklers for water saving and cost reduction if this falls onto the City Engineer clarified that his scope on this has been limited to the capital construction project only and it was primarily focused around generating the scope and fee portions of the contract. Not related to the ongoing operations and maintenance so I do not have knowledge of the maintenance activities. I have completed a recent review of Phase 2 of the capital portion of the project.

Vice Mayor Wratten - the original maintenance contract was extended when the Council approved the rehab project at the same time. Mayor LaFayne - hearing the comments tonight, it looks like there is a maintenance issue rather than the work that has been done under the Capital Construction Project.

Andy Pinasco, City Attorney agreed to work with the City Manager to see if there is an enforceable contract. If there is not, then we would need direction from Council to put together an RFP, and bring it back at the next Council meeting.

J. REPORTS AND COMMUNICATIONS FROM CITY ATTORNEY: None
K. REPORTS AND COMMUNICATIONS FROM CITY MANAGER:

Jodi Steneck, Finance Report:
• First Treasurer's Report in Information Items. The monthly interest for July, 2024 was $72,332 ($20,000 from LAIF). The same time last year the interest was $1,135.

I. REGULAR AGENDA:

1. Adoption of Resolution No. 2024-28 Approving a No-Parking Segment and Designated Crosswalk at Foothill Blvd. - Jonathan Mitchell, City Engineer - At the request of the City Council, Willdan has undertaken and completed a technical review of the traffic and parking concerns expressed by Council along a segment of Foothill Bld. between Morning Glory Circle Encroachments and Sage Court.

Based on findings of the field review and community engagement, a multi-phased improvement project is recommended.

Establish a No-Parking Zone along the west side of Foothill Blvd. between Morning Glory Circle (southern encroachment) and Lupine Drive. • Establish pedestrian crossing across Foothill Blvd. at Lupine Drive, through the installation of a ladder crosswalk connecting the existing pedestrian ramp at the southeast corner of the intersection, normal to traffic, to the west side of Foothill Blvd.

The City approved the Agreement on a trial basis for the months of March - June, 2024. This agreement is up for renewal for the 2024/2025 Fiscal Year. 3. Purchase of Groomer for Ed Hughes Memorial Arena - In May of 2022, the City took over the maintenance of the arena and no longer had the use of the Black Widow groomer. The City owns a spring tooth harrow which is more a "drag" than a groomer. The current footing in the area has a high clay content that packs easily. An arena groomer with hydraulics is best suited to work the ground. A "drag" works best on soft footing that does not pack down. After discussion, it was moved by it was moved by Councilmember Atlan, seconded by Vice Mayor Wratten and carried to purchase the Black Widow Groomer - $7,200 with the stipulation that it will work with the tractor.

4. Update on Rotary Parking Lot Project - After Mr. Herfel's presentation at the August 20* meeting, Thomas Borge, developer of the Wildflower Project, offered his equipment to clean the ditch and level the parking area at no cost to the City. Since the equipment was going to be at Howard Park, the Arena Ad Committee reached out to Mr. Borge regarding the east end of the ditch, creating more parking at the hillside, expanding the arena pad and adding dirt to the holding pen. City Council gave direction to staff to move forward with the project due to the short window of opportunity to complete the work. The City Manager, City Engineer and interim Public Works Director have been in communication and the project is moving forward. The hillside dirt moving started on Thursday August 22, 2024. The hillside is to be cut 40 to 60 feet and will be used as needed in Howard Park. Thomas will remove all debris and leftover dirt from the project.

Mr. Thomas Borge commented that Axios Homes has joined the lone Business and Community Association and lone Rotary Club to guarantee that their project would happen without funds from the City. We will be done with grading at the end of next week. In the next couple of weeks, we will be excavating for the conduit for future park lighting piping, and working on the ditch in the next couple of weeks. We will be cutting a ditch for water to cut across the Park.

Axios Homes remains committed to community and will be installing crosswalks and no parking signs at our expense.

F. PUBLIC COMMENT:

Larry Rhoades, I attended a recent Sewer Meeting and there was nothing on the agenda regarding the Regional Water Board issuing work order requires the City to determine which facility has the capacity to handle the respect waste streams.

Larry Caputo, thanked the Council and City Manager for the job you have done on the negotiations on the Golf Course and keeping it open.

Jim Scully, came across an article that was presented to the City September 4, 2024 regarding the City Town Field being on line and eliminating Ponds 6 and 7 in the summer months. We will be using them in the Winter months when the natural ground water is higher than the clay bowl mobilizing the contaminated water to mushroom out at a much lower level, which has a much higher chance of contaminating wells. Current data does not support a finding that Ponds 6 and 7 are causing on going impacts. Current data that is not in this report at all. Consider this a Public Records Request.

Tommy Quinn, would like the crosswalks downtown be re-painted because it is a safety hazard. Vice Mayor Wratten suggested having Caltrans attend a future Council meeting for an update on the recent overlay on Highway 104 and Highway 124.

Michelle Gallagher, Amador County Code Enforcement Officer informed the Council of a Recycling Community Event on Friday, November 1, 2024 at Pioneer Park and River Pines at the RIP Lot.

Jim Hawkins, St. Andrews Lane commented on the 6 feet weeds behind his home that are located on Lot A, which is owned by the City.

I. REGULAR AGENDA:

1. Streambed Alteration Agreement Amendment-Biologist Requirement- This requirement came up during the recent Creek Committee Meeting. Krystal Acrieto, Vice Chairman of the Creek Committee - We have an existing Streambed Alteration Agreement with CDFW expiring in 2026, and amended last year to expand the footprint. However, in order to actually do work in the Creek you have a designated Biologist on file approved by CDFW. The motion made by the Creek Committee was to direct staff to reach out to the City Engineer about a designated biologist and check to see if there is an option through CalFire or any other authority we might have from the public safety perspective in terms of maintenance of the levees.

Jonathan Mitchell, City Engineer we do have a Biologist on staff, but we partner with local Biologists from Calaveras County and we can look at some contracting mechanisms to make that happen. Biologist has to be on site whenever project work is happening.

Direction was given to staff to coordinate with City Engineer and his partners to get a Biologist as long as it is within the City Manager's funding authority.

Councilmember Rhoades commented that I have managed Streambed Alteration Permits and the best thing about doing a City is Fish and Wildlife finds the Biologist.

2. Creek Cleaning Resources and Grant Options - Krystal Arcierto, some of the things we talked about are longer term in the event that we are not able to get a Biologist and move forward with Creek cleaning. We talked about the Urban Streams Restoration Program that offers grant for City's that have Creeks running through their City. We have reached to the Department of Water Resources to figure out what Grant options are available. We will be discussing this at an upcoming meeting to prepare us for next year. Mayor LaFayne would like to have updates from the various Committees at Council meetings.

3. Authorize Staff to Proceed with RFQ for Howard Park (CIP) - Vice Mayor Wratten commented that what is needed is a Request for Quotes or a Request for Information. Mayor LaFayne commented that a Traffic Study or any Environmental Impact Report was not a part of the RFQ, which is needed because of the damage being done by the cars when more than one event is happening at the same time.

Andy Pinasco, City Attorney suggested that defining the scope will help the City Manager than what we call the document.

Dan Traxler, Chairman, Park & Recreation Commission would like to see the parking situation addressed sooner than later. Also, I would like any recommendation by the Council be brought to the Park & Recreation Commission first.

Moved by Vice Mayor Wratten, seconded by Councilmember Atlan and carried to give the City Manager authority to create and distribute an Request for Information for Howard Park CIP.

4. Re-appoint Fern Day and Appoint Victor Leznik to the Park and Recreation Commission - George Lee, City Manager commented that two appointments were up on the Park & Recreation Commission, Fern Day and Demi Wright.

Three applications were received by the deadline, Fern Day, Demi Wright and Victor Leznik. The applications were reviewed by Mayor LaFayne and Councilmember Dominic Atlan. The decision was made to re-appoint Fern Day and appoint Victor Leznik to the Park & Recreation Commission.

Demi Wright expressed here gratitude to the Council for allowing her to serve as a Commissioner on the Park & Recreation Commission. While I do not think my work is done, but will be cheering from the sidelines. I learned my term was up when I happened to look at tonight's agenda. A simple acknowledgment of my services would have been appreciated. I hope the Mayor will consider a more thoughtful process of transitions like this—a simple acknowledgment of my services would have been appreciated. I wish the new appointee well and hope the work we started continues with dedication and care. I remain committed to the well-being of our City and Parks, and hope in the future that all volunteers feel valued and respected.

Jody Maita would like to know whose decision it is when it is time to re-appoint.

There seems to be a pattern here, it happened to the Creek Committee that worked very hard for some time and felt disc to the point that they resigned.

Larry Rhoades asked why Demi Wright's letter was not in the agenda packet along with the other two that were received. Staff was directed to include letters from Fern Day and Victor Leznik.

Moved by Vice Mayor Wratten, seconded by Councilmember Atlan and carried to appoint Fern Day and Victor Leznik to the Park & Recreation Commission.

Brickyard wui 2.0.pdf; Brickyard Rd - Annex into the City of lone; Good Morning Sir:

This is a follow-up to our staff meeting yesterday regarding Brick Yard Rd.

I am 100% in favor of the city accepting Brickyard Rd for multiple reasons Brickyard road was offered to us by the county as far back as the early 2000 and was accepted but not followed up on, this roadway serves multiple purposes to the city for safety reasons. 1) Secondary means or emergency access and escape for the Wild flower subdivision also Howard park (Evacuation route) and lone Elem school 2) Emergency access alternate route for traffic diversion in the event that Highway 124 is blocked - which occurs for multiple reasons.
3) Wild land Fire emergency access to all Wild land threat areas to the south end of the city. 4) Emergency medical access to the Train tracks - with the increased recreational use, we need access to these areas.
5) Provides better access to law enforcement to assure the areas are not being used by trespassers on the private property that cause a direct threat to the city during the wild fire season.

The city 2023 general plan refers to this area as the "Triangle" Fig 3.1 3.2 The city need to accept this as part of the overall annex to the city limits for future growth and development, with the roads already in place vs having to go through multiple layers or reports and studies and then applications to Cal Trans for Highway access etc.

For the roadway upgrades and maintenance there are grants available to provide for emergency access evacuation routes that will assist us in continuing our safety plan for our community to assure that we provide the most options to our citizens, and the responders. ** If the council is concerned about the current condition of the road past Foothill Blvd, an option of the installation of gates could be explored at Buena Vista Rd and just South of Foothill Blvd for authorized personnel only, and EMERGENCY fire road and EVACUATION ROUTE until the area is development.

Agenda Item #J3
DATE: NOVEMBER 19, 2024
TO: THE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: SALINA MITCHELL, RECREATION COORDINATOR
SUBJECT: THE ADDITION OF BASKETBALL COURTS AT PERRY EARL PARK AND NECESSARY BUDGET APPROPRIATION.

RECOMMENDED ACTION:

Recommend City Council approve the addition of basketball courts at Perry Earl Park.

Recommend City Council approve the most responsive and responsible bid received for this project from All Sport America.

Recommend City Council approve the necessary budget appropriation of $120,000 from the Parks and Recreation Capital Improvement Fund, or Parks Impact Fund.

FISCAL IMPACT:

Some time ago a donation in the amount of twenty thousand dollars ($20,000) was made by Mule Creek Prison, for the addition of basketball courts at Perry Earl Park. The fiscal impact to the City will be the total cost of the proposal chosen, minus the twenty-thousand-dollar ($20,000) donation. The fiscal impact to the City shall not exceed one hundred thousand dollars ($100,000).

BACKGROUND:

In past years the concept of adding basketball courts to the vacant lot, owned by the City, adjacent to Perry Earl Park has been discussed. At some point Mule Creek Prison donated twenty thousand dollars towards this project and the money has been sitting ever since. Mule Creek Prison has indicated that they would be willing to donate more in the future if they see that the City uses the money already donated for the purpose in which it was intended. Staff feels it is important to move forward with this project not only to utilize the donated funds but also to provide much needed recreation within walking distance to the kids on that side of town who can't walk safely to Howard Park.

In August, it was decided that it would save time and money to receive proposals for this project from design/build firms rather than going out to bid for engineering & design services then again for construction. It is our hope that we can move this project forward in a timely manner with an anticipated completion in Spring of 2025. The possibility of including pickleball courts into this design was discussed and was included in the original proposals received, but due to the size of the area and in proximity to the street it has since been decided against. We are moving forward with basketball court only.

After much discussion, the project was finally approved for recommendation to the City Council by the Parks & Recreation Commission at the September 24t meeting.

DISCUSSION:

Staff received two design/build proposals for this project. One proposal was from All Sport America and the other from KYA. The bids were submitted with different dimensions and at much different price points. The lot is large enough to house anything from a small half court to a large high school full size court. Overall the All Sport America bid came in significantly lower than the KYA bid. Because the bid from All Sport America was for a much smaller court I asked them to provide me with numbers for a slightly larger court to give us options. Staff recommends that if we are going to spend the time and money to make this happen the larger court is the preferred option.

We also requested additional alternative items be added into the bid such as finishing the sidewalk from the park to the next residence along the street and fencing around the perimeter.

All Sport America is the contractor that built the basketball courts at Howard Park, and they work with other local contractors for concrete, fencing, etc. The numbers below reflect fencing from local contractor Gideon Fencing. The bids received do not include the brushing that would need to be done around the perimeter of the lot. In speaking with Fire and Public Works staff it was decided best to cut down the bushes between the park and the new basketball courts to about 6', with an opening for a gate as well as a line of sight from the park itself. We also intend to plant new trees and bushes along the back and side of the new court to help with noise reduction for the residents on both sides. These costs are not included in the bids received. Staff hopes to find someone local that can provide this work for reasonable cost. We anticipate this costing approximately ten thousand dollars ($10,000).

Small Court of 30' x 60' (1,800 square feet) = $62,300
Larger Court 40' x 60° (2,400 square feet) = $79,850
Finishing sidewalk = $4,500
Estimated Brushing Costs = $10,000
Fencing/small court (galvanized chain link) = $15,250 or (black vinyl chain link) = $17,900 Fencing/larger court (galvanized chain link) = $20,850 or (black vinyl chain link) = $21,850 In summary;
Small Court (30' x 60') with sidewalk, estimated brushing and more expensive fencing = $94,700.

Large Court (40' X 60') with sidewalk, estimated brushing and more expensive fencing = $116,200.

Taking into consideration both court options, both fencing options, continuing the sidewalk and the estimated costs for brushing, as well as the donation in the amount of $20,000, the total burden to the Parks & Recreation Capital Improvement budget shall not exceed $100,000.

We can do a 40' x 60' court, with (2) basketball hoops for $79,850. This is still an optimal size and I'm helping out a bit on the price because I do appreciate the work we've gotten from the city of lone in the past.

This is how it would lay out. We will have to go through the design/color selection process. Below are the color options

DATE: NOVEMBER 19, 2024
TO: THE MAYOR AND MEMBERS OF CITY COUNCIL
FROM: SALINA MITCHELL, RECREATION COORDINATOR
SUBJECT: PURCHASE OF SAND FOR ED HUGHES MEMORIAL ARENA AND

NECESSARY BUDGET APPROPRIATION
RECOMMENDED ACTION:

Recommend City Council approve the purchase of sand for the Ed Hughes Memorial Arena.

Recommend City Council approve the necessary budget appropriation in an amount not-to- exceed ten thousand dollars ($10,000).

FISCAL IMPACT:

The overall fiscal impact associated with the purchase of sand for the Arena is not-to-exceed ten thousand dollars ($10,000). Funds should be allocated from the Parks & Recreation Capital Improvement Fund, or Parks Impact Fund.

BACKGROUND:

The Ed Hughes Memorial Arena located at Howard Park, is one of the only covered arenas in all of Amador County and surrounding areas. The Arena has the capacity and potential to host many events year-round. Typically, the rainy seasons are busiest at the arena so maintenance and upkeep is most important during this time of year.

In May of 2022 the City took over the maintenance of the Arena and is currently exploring options as to the best way to manage the Arena moving forward. Over the summer an Ad-Hoc Arena Committee was formed to assist us until a manager is hired, or lessee is in place. The first order of business for the Committee is to help us prepare for and hire an Arena Manager, or Lessee to take over all Arena events, maintenance, etc. The second order of business is to help assess the immediate needs of the Arena.

DISCUSSION:

The Ad-Hoc Ed Hughes Memorial Arena Committee met here with our Parks & Rec Commission on October 10t for a special meeting. In that meeting the Committee provided much input as to the best way to manage the Arena moving forward. One of the suggestions they have made is that we need more sand in the Arena overall but specifically the warm up and holding areas. The Committee have suggested that this is a necessity no matter how we end up managing the arena. There are many other wish list items but the sand is needed to effectively use the Arena at all.

It has been estimated that we need eight hundred and fourteen (814) yards of number two (#2) washed sand. This equals an estimated thirty-two (32) truck-loads, at seven dollars ($7) per yard and an additional one hundred dollars ($100) per load delivery. This equals a total of eight thousand, eight hundred and ninety-eight dollars ($8,898). This of course is an estimate and could cost even more if we have to source the sand from out of town.

We can most likely get enough volunteers to spread the sand saving us costs for labor. A few members of the public have commented that we may be able to get the sand donated by the local quarry which means we would only need to pay for delivery. This has not been confirmed. Staff will do our best, along with the help of the Arena Committee, to obtain sand for as little cost as possible but we ask Council to be prepared to spend up to ten thousand dollars for the sand if needed. Again, this has been suggested as a necessity to keep the Arena in prime operating order.

Agenda
Rate Study Needs
WEST YOST City of lone Wastewater Committee | November 6, 2024 City Adopted CIP (August 2024)
Project Element Estimated Project Cost
1 WWTP Headworks replacement $4,913,465
2 Upgrade of electrical services and equipment at the WWTP $1,273,444 3 COWRP rehabilitation of various unit processes and SCADA* $4,837,704 4 Required Permitting/Planning Studies $1,109,602
Total Estimated Cost $12,134,215
Notes:
• Element 3: Cost may be reduced by outside funding
• Refinement and amendments to the project list and costs are expected • City will continue to identify grants and other funding to reduce costs WEST YOST City of lone Wastewater Committee | November 6, 2024 Issues Related to Developing Rates
• Adopted CIP does not have a timeline associated with it • Unclear whether City wants to assume the entire CIP budget will be spent • Does not include studies/improvements related to the collection system • Does not include costs related to ongoing maintenance improvements (e.g. replacement of flow meters)
WEST YOST City of lone Wastewater Committee | November 6, 2024 Significant Work is Needed to Define a
"True" CIP
COWRE
• Complete COWRF condition assessment/CIP list (proposed for FY 24/25) • Complete negotiations with ARSA/CDCR regarding long-term agreement for COWRF use and associated cost share (ongoing)
WWTP
• Complete water balance and pond capacity analysis study (FY 24/25) • Complete studies related to the Cease and Desist Order to confirm what is needed related to ongoing percolation disposal (FY 25/26)
• Develop a planning document that details all condition and capacity related improvements (FY 26/27 and FY 27/28)
WEST YOST City of lone Wastewater Committee | November 6, 2024 Long-Term CIP Development and Rate
Adjustments
• Over the next 2 to 3 years the City will be developing a comprehensive plan for the WWTP and COWRF
• Capacity increases are likely needed to accommodate planned growth • Regulatory-driven improvements are also likely (e.g. percolation pond relocation) • The City will need a near term rate increase to fund the studies needed to define these projects
• Near-term rate increase also allows some known projects to move forward • However, a long-term (and bigger) rate increase is likely coming.

WEST YOST City of lone Wastewater Committee | November 6, 2024 Options for Near-Term Rate Study
• Use Adopted CIP
• Assume all projects in CIP to be completed over the next 3(+) years • Understand that some work may be funded in other ways, which just offsets costs of projects beyond the 3(+) year timeline
• Establish a yearly allocation budget for collection system improvements and maintenance • Yearly Allocation Approach
• Establish a yearly allocation budget for collection system improvements and maintenance • Establish a yearly allocation budget for treatment plant improvements and maintenance (informed by the CIP as well as other known needs)
WEST YOST City of lone Wastewater Committee | November 6, 2024 Iterative Approach
• City develops a base set of assumptions using one of the approaches described • Information provided to rate consultant to develop a suggested rate structure • City modifies assumptions, as needed, to keep rates within reasonable expectations
WEST YOST City of lone Wastewater Committee | November 6, 2024 Agenda
Additional Considerations
WEST YOST City of lone Wastewater Committee | November 6, 2024 WWTP
WEST YOST City of lone Wastewater Committee | November 6, 2024 Capacity Limited by Compliance Point in
Existing Permit
• Discussed with Regional Board at October 11 meeting
• Suggested potential modification to the Monitoring and Reporting Program to allow Pond 5 to be considered part of the treatment process
• Regional Board seemed supportive of this approach
• Did not raise the issue of Town Field runoff at the meeting (will be brought up later once issue is well defined through water balance) • Request for changes will be developed in early 2025
• need to focus on water balance and CDO for the remainder of 2024 WEST YOST City of lone Wastewater Committee | November 6, 2024 Request to Increase Capacity Limitations
through a New Permit
• Water Balance
• Should demonstrate more capacity than current permit allows • Treatment Capacity
• More capacity if Pond 5 is included in treatment
• Sampling in winter 24/25 is recommended to confirm pond treatment capacity • Once capacity is defined, City could consider other minor improvements to further increase capacity
• CDO issues also needs to be resolved
• A new permit is likely two years out (at a minimum)
