F. PUBLIC COMMENT:

Oral Custer thanked the City Council and wished everyone in attendance a very pleasant and prosperous New Year. Mr. Custer also read a poem about certain things he would like to see less of and certain things he would like to see more of in 2026.

Larry Rhoades commented on the ACTC Traffic Mitigation Fee Annual Report on the Consent Calendar. A long time ago, the City did not collect $500,000 on the Castle Oaks Development, and the Council and ACTC did nothing about it. The same thing happened in Sutter Creek with the proposed Gold Rush Development.

ACTC did not collect $1,500,000 in fees and it was the same developer as Castle Oaks.

Marsha Edick commented on the election of Vice Mayor and Mayor at the December 16, 2025 meeting. There must have been some conversation or meeting of the minds among the majority for you to know that I better come prepared with a speech. I thought that maybe it is just normal procedure for the Vice Mayor to become Mayor the next year. That was not the case because Jack Mitchell was the Vice Mayor, but Councilmember LaFayne become the Mayor.

Dan Epperson, District 2 Supervisor Updates:
• Fog stripping on Highway 88 - waiting for an answer from CalTrans • Michigan Bar Road-contacted Supervisor on the condition of the road • Jim Shoemaker, Congressional candidate will be at Church & Main on January 9, 2026 at 10:00 a.m.
• ARSA Dam - it is safe and secure and now storing water in the reservoir. • Established a Fish & Wildlife Commission starting in January, 2026 Dave Johnson:
• Congratulated Jody Maita on Mayor for 2026.
• Addressed his recently filed Public Records Requests:
-Did receive a response on the appraisal for the new Police Station site -Received an extension from the City on City Attorney Invoices Jim Scully presented pictures to the Council on a City tree that fell in 2017 and that the City Manager at the time refused to remove the tree. Since that time, the tree has weakened the levy and losing bank. I recommend that next time the dozier is in the Creek, cleanup start at Five Mile Drive to protect your assets.

Patricia Angetja:
• Congratulated Jody Maita on becoming Mayor
• The City of Sutter Creek also appointed the Vice Mayor to Mayor for 2026 • Thanked the Resource Connection and their resources they provide Mitzi Windley:
• In the past, usually the Vice Mayor goes to Mayor
• Pretty sure the new Police Department site was appraised at $910,000 Patrice Prest commented that the cleanup on the Castle Oaks entrance has started and already looking good

Councilmember LaFayne:
• In 2025 I did not receive updates from the City Manager, which is part of the Protocol Manual. Would like this on a future agenda. • Meeting with three Councilmembers before a Council meeting is a Daisy Chain Meetings and is a violation of the Brown Act, and would like it stopped.
• Would like an update on the reimbursements from the AWA Grant • I share the same concern as a member of the public that Mr. Maita was already chosen as Mayor.

Mayor Maita:
• Announced that we lost Richard Gold, a life long volunteer for the City-him nd his family have been icons in this City for a long tim Thank you to the Creek Committee for the work they did during the yea which I believe is the reason we did not flood this year.
