H. PUBLIC COMMENT:
Christy Maita read a statement regarding even though there are citizens that live outside the City limits of lone, they are considered part of the community. They support the community of lone, their children are part of schools in town and also part of activities in lone.
Dave Johnson commented on the Backwash Water Sale Agreement between Amador Water Agency and US Mine Corporation, which he provided to Council.
Mr. Johnson commented on the proposed easement for UȘ Mine and current water usage.
Andy Aguilera everyone knows that the pipeline has been blocked off, but there are people who still think U.S. Mine is getting water, but they are not.
Dave Livingstone, Wildflower - Andy, you insult a lot of people when you refer to us as "new comers". How many of the new comers are paying for Police and Fire in this town.
Mitzi Windley - I remember in 2017, the City Manager at the time went to U.S.
Mine and gave them a proposal for $150,000, who said "forget it". At that time U.S.
Mine was paying for the water to irrigate Howard Park.
Larry Rhoades - When the grant owned Howard Park, Unimin had an easement and Owens-Illinois paid for all the water to Howard Park. A former Public Works Superintendent kept shutting off the hydrant which hammered the line. U.S. Mine abandoned the line because they were tired of fixing the pipe.
Marsha Edick - commented on the U.S. Mine easement from the last agenda and the votes of the two dissenting Councilmembers, which had nothing to do with any personal vendetta against Mr. Rhoades or U.S. Mine. I don't recall Councilmember Atlan even mentioning U.S. Mine or Mr. Rhoades when he elaborated in great detail as to why he voted no. I recall he said, lone would not benefit in any way by approving this and it could have severe repercussions if approved. Regardless, there have been attempts to shame the only two Councilmembers who truly have the best interest of the City at heart.
Larry Caputo relative to recusal criteria, Josh I believe you have received a letter from the FPPC which establishes precedents for what constitutes a conflict of interest. If you read that letter and share it with everyone here, he is well within his rights to not recuse himself based on that letter from the FPPC.
Justin Granados introduced the new WWTP mechanic, Jose Machado.

• Proclamation Honoring Ken Mackey for his 30 Years of Services to the City of lone as Fire Chief - City Clerk, Janice Traverso, presented Chief Mackey with his Proclamation. Chief Mackey was very appreciative and thanked the Council and public for the opportunity to serve the City of lone.
G. PUBLIC COMMENT:
Elmer Rhode:
• Mentioned the passing of Mr. Bill Thiry, Vice President of the lone Business and Community Association and the numerous activities he was involved in because of his love and dedication to the City of lone. On Saturday, March 28, 2026 there will be a Celebration of Life from 3:00 p.m. to 5:00 p.m. at the Preston Castle.
Dan Epperson, Supervisor District 2 - Amador County:
• Ione Michigan Bar Road is now open and will be rebuilding the road this summer. Buena Vista Road down to the County line will be done this summer.
• There will be a 250t Year Celebration on July 4, 2026 at Westover Field • Thanked the Fire Department and Police Department for their assistance in the vehicle rollover on West Marlette Street
• Kids Fishing Day at Camanche North Shore on April 18, 2026 Dave Johnson commented on an incident on Facebook where he accused the Mayor of purchasing alcohol on his recent League of California Cities conference.
After the meeting, he talked to the Mayor and he was accused of being a "liar". I did not mention alcohol on Facebook or during the meeting.
Marsha Edick:
• I found the article in the Ledger Dispatch February 20, 2026 edition by our Mayor, disturbing——it was riddled with false information and personal attacks. • The Mayor's read a statement asking Councilmembers to demonstrate a high standard of civility, professionalism and respect. At the last Council meeting, Councilmember LaFayne endured comments like, accusing her twice of having a tantrum, you could leave now, another notch in your belt (referring to the resignation of the Planner)-maybe this is why she not here tonight. • The new Protocol Manual added Chapter 10, which added civility and decorum. So much for the $6,000 or $7,000 we spent on the revisions-we should have stuck with what we had and saved that money—-perhaps we can a refund from White Brenner, LLC
• Asked how much did the PRA's cost that Mr. Johnson submitted. The cost was $1,500 for one document that was heavily redacted. This is why our attorney bills are so high.
• Hoping that the City will issue a statement at some point down the road on their feelings relating to the Ledger Dispatch article of February 20, 2026 by our Mayor.
Mitzi Windley commented:
• Everyone is accusing Jody Maita of his horrible letter. Jody Maita was only responding to Dominic Atlan's letter in the Ledger Dispatch two weeks prior. • Even if alcohol was not mentioned by Dave Johnson on Facebook or at the meeting, the insinuation was there.
Larry Rhoades-I have a letter from the FPPC dated February 24, 2015 that states in response to your request on advice on behalf of City Councilmember Dominic Atlan regarding the Conflict of Interest, the Commission does not act as a finder of fact. He accused my son, Stacy Rhoades of telling the lawyer to do the same thing to him and he did it 10 years ago.
Pat Adigdra, it is unfortunate that these incidents are still being brought up. We need to focus on the important things.
Andy Aguilera everyone I talked to liked the letter in the Ledger-Dispatch from our Mayor, Jody Maita, so keep up the good work Mayor.
Josh Varinsky commented that redacting invoices does take time and that is privilege information of the City, and is the privilege of the Council to waive. It is not careless redactions that we make, it is the private information of the City.

CITY OF IONE COUNCIL MEETING MINUTES
ACTION MINUTES
March 17, 2026
Mayor Maita called the Regular Meeting to order at 5:15 PM A. ROLL CALL:
Present: Jody Maita, Mayor
Stacy Rhoades, Vice Mayor
Absent:
Staff: George Lee, City Manager
Zach Varinsky, City Attorney
Janice Traverso, City Clerk
B. CLOSED SESSION:
Council convened to Closed Session at 5:15 p.m. to discuss the following:
1. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION
Government Code 54946.9(d)(1)
City of lone vs. Alison LaFayne, Individually and dba J. Bouldin West, LLC Amador County Superior Court: Case No. 25CV14642
2. CONFERENCE WITH REAL PROPERTY NEGOTIATORS
Government Code Section 54956.8
City Property: 17 E. Main Street, lone, CA
Agency Negotiator: George Lee, City Manager
Negotiating Parties: None at this time
Subject: Price and terms of payment
Public Comment:
Dave Johnson commented on a document signed by the Mayor, which states that oth parties under this agreement both parties agree that any dispute under thi greement may only be resolved through mediation. The parties will split the cos of the mediator and each party is responsible for their own fees. I don't know how this Council goes back and redoes the previous Agreement. Michael Rock stated that at the time, Alison did not owe any money, and it was dropped because of COVID.
Marsha Edick, the amount of attorney fees spent so far is $24,252.93, which is likely not the grand total. While the public is not entitled to know the specific of this litigation, it seems we are entitled to know details relating to the cost given this litigation is being funded by our tax payer dollars.
• What is the dollar authority has the Council given to the law firm to pursue this litigation? Has that dollar amount been exceeded yet or has the Council given carte blanche to the law firm to pursue this case regardless of the cost.
C. PLEDGE OF ALLEGIANCE - Mayor Maita led the Pledge of Allegiance.
D. REPORT OUT OF CLOSED SESSION:
Council reconvened to Open Session at 6:18 p.m. Mayor Maita reported that direction was given on both items:

F. PRESENTATIONS/ANNOUNCEMENTS: None
G. PUBLIC COMMENT:
Dave Johnson commented on the following:
• At the February 3, 2026 meeting Marsha Edick (on Zoom) asked to speak to the Warrants but was not allowed to. At the February 17, 2026 she was not allowed to speak at the meeting because there were not any invoices from White Brenner on the Warrants.
• There have been no updates on the Community Garden.
• There have been no updates on the Police Station-—is there a design plan, has it been sent out to bid, is there a move in date, and what are the challenges
• Picnic Hill--I know we have a grant and the project needed to be completed by December 31, 2025. We have not had any update and now we are in March.
Dave Livingstone, Wildflower--would like an update on Lupine Street and Honeysuckle Street, the roads are in poor condition and dangerous.
Dan Epperson, Board of Supervisor:
• The County had a deficit of three million dollars—all departments have taken a 5% pay cut along with a hiring freeze.
• Up-country lost thousands of trees, PG&E lines were down because of the recent storm.
• Sheriff's Department successfully rescued citizens stranded in the snow upcountry.
Paving roads - south end of Buena Vista Road first on the list. • Kids Fishing Day on April 18, 2026 at South Shore Camanche • Hunter Education Class on March 20, 2026.
• Shred Day on May 2, 2026 by IBCA at Kreth, Inc.
Larry Rhoades, I would like to address the comment about the cost of LaFayne's lawsuit. How much money have we spent on protecting a Councilmember, which he should not be in Closed Session and two former Councilmembers on the Lori McGraw case. I would like to know how much it cost to initially prosecute Ms.
McGraw. It was probably about two million dollars and they are worried about $500,000.
Marsha Edick commented that the first four months of the White Brenner, LLP contract the cost was supposed to be $33,000 plus whatever extra. However, the first two billings, the invoices totaled $80,530.60. Why did that not send up a red flag with the Council. The grand total paid to the White Brenner for the first fifteen months was $437,538.43. Time and time again, the warrants are approved by the majority. Where is the oversight. If you do not see the invoices, how can you attest to the authenticity to the invoice. Basically, you are blindly approving the warrants meeting after meeting without supporting documents.
Patricia Adjedra commented that invoices are reviewed by City staff and it is not in the purview of the City Council to review every single charge.
Andy Aguilera commented it is a shame that it has come to Councilmember LaFayne being sued for the money that she owes the City. The best thing to do is everyone should not say a word. The City is doing nothing wrong they just want to collect the money that is owed to them.
Josh Varinsky commented:
• Our firm is not oblivious to the posted articles that paint our firm as taking advantage of a small town-that could not be further from the truth and we take this job very seriously.
• When we took over for the City, the City was in the middle of a very serious Golf Course transaction. If that went to litigation, it would have been much more expensive.
• We feel the Police Station was a good outcome and was an incredible cost savings to the City.
• If we get a settlement agreement of $140,000 to the City, which is more behind the scenes, that is a great outcome to the City.
These are some of the things that go unnoticed. It is easy to put a narrative out there of throwing numbers, very easy to twist. We are here to help the City and take it very seriously.

Councilmember Atlan:

OF TONE
CITY OF JONE
IONE, CA 95640
DATE: APRIL 7TH, 2026
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: JESSE UPSHAW & JOSH VARINSKY
SUBJECT: DECLARING THE PROPERTY AT 17 E MAIN ST AS SURPLUS LAND ACTION:
Adopt Resolution 2026- , A Resolution of the City Council of the City of Ione Declaring 17 E Main St, lone, CA, 95640 as "Surplus Land", in Accordance with the California Surplus Land Act.
FISCAL IMPACT: To be determined by the sale of the property.
BACKGROUND/DISCUSSION:
The property was purchased in December 2021 for the purpose of developing the space into the new Police Station. After the purchase of the property, it was determined the amount to repair and reconstruct the building to California State and Federal Guidelines, would exceed one million dollars. The City of lone has considered other occupancy options, but has been unsuccessful in finding a true need and benefit to the City. After long consideration, it has been determined that for the City's highest benefit, the property should be sold.
Before the City can formally sell the property, it must follow the process required by the Surplus Land Act (Government Code § 54220 et seq.) enforced by the California Department of Housing and Community Development (HCD). Under the Surplus Land Act, certain housing developers and public agencies are allowed 60 days to express interest in the property. If no agreement is reached with any designated entities that express interest in the property, the City can then dispose of the property freely.
Upon approval of the attached resolution, City staff will circulate a Notice of Availability to HCD and the required entities, and allow for the proper time periods to receive responses and demonstrate compliance to HCD.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IONE
DECLARING THE PROPERTY AT 17 E. MAIN STREET AS SURPLUS LAND,
IN ACCORDANCE WITH THE CALIFORNIA SURPLUS LAND ACT
WHEREAS, pursuant to the California Surplus Land Act (California Government Code § 54220 et seq.), the City Council must declare property as either "surplus land" or "exempt surplus land" before the City can dispose of it. "Surplus land" is real property owned in fee simple that is not necessary for the City's use; and
WHEREAS; City staff have identified the City-owned property located at 17 E. Main Street (APN 004-102-006), further described in Exhibit A attached and incorporated hereto, as land owned in fee simple that is not necessary for the City's use. The property is not currently being used by the City and is not designated for any future City projects; and WHEREAS, pursuant to Government Code section 54221(b)(1) of the Surplus Land Act, the City Council must take formal action in a regular public meeting declaring that the land is "surplus land" and not necessary for the City's use prior to sale of the land; and WHEREAS, before disposing of the surplus property or participating in negotiations to dispose of the surplus property, the City will send a written notice of availability to certain designated entities and complete all other actions required under the Surplus Land Act; and WHEREAS, this Resolution has been reviewed with respect to the applicability of the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines. It has been determined that the adoption of this Resolution is exempt from CEQA pursuant to CEQA Guidelines section 15061(b)(3) (commonsense exemption) and CEQA Guidelines section 15312 (Surplus Government Property Sales). This resolution intends to comply with the Surplus Land Act and no development of the site is proposed. DATE: APRIL 7, 2025
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: GEORGE LEE, CITY MANAGER
JOSH VARINSKY, CITY ATTORNEY
SUBJECT: RESOLUTION TO AUTHORIZE GRANTING OF EASEMENTS TOCDCR
FOR ANTENNA TOWER AND SEWER PIPELINE RELATED TO
WOODARD BOTTOM RECYCLED WATER PROJECT
BACKGROUND/DISCUSSION:
This item was first brought to staff's attention in March 2025.
In the years before 2020, the California Department of Rehabilitation and Corrections (CDCR) and the City discussed the granting of easements for the following, in relation to the Woodard Bottom Recycled Water Project:
1. A tower and antenna on the City's tertiary treatment plant property.
2. A sewer pipeline in the City's right-of-way along Dave Brubeck Road The project relates to CDCR's planned wastewater disposal project at the Jackson Rancheria properties south of City limits. The pipeline facilities were built during this time before 2020, and the survey and engineering work for the easements was completed as well.
Former City Manager Michael Rock had executed the easement documents in 2023, which were sent to CDCR, but the documents were not accepted by CDCR because of Mr. Rock's departure soon thereafter.
CDCR contacted staff in March 2025 to finalize and memorialize the easement documents, which require a resolution of approval from the City Council.
This item was previously on the City Council agendas for July 10, 2025 and September 16, 2025.
Since this time staff requested and received additional information from CDCR about the original intent for this project and the implementing agreements that would follow construction. During and after construction of the project, an agreement was being discussed between the City and CDCR regarding further terms and conditions for wastewater application to the Castle Oaks Golf Course, and also use and operation of the pipeline. Regarding use and operation of the pipeline, terms to be included in an agreement between the City and CDCR include permit coordination, labor and repairs, emergency protocols, and payment to the City.
These items are for further discussion between the City and CDCR and a future agreement for consideration by the City Council. The City cannot commence permit coordination, pipeline operation, or maintenance on behalf of CDCR without a written agreement outlining such terms and conditions.
In addition, CDCR recently acknowledged increasing payment for use of the City's tertiary treatment plant to $174,555 per quarter pursuant to the 2007 triparty agreement between the City, CDCR, and ARSA. Given the continued cooperation of the parties regarding the tertiary plant and the future implementation agreement for the pipeline easement, City staff believes that recording of the easements is appropriate.
At this time, only the approval of the written easements is before the Council for approval, to memorialize the sewer improvements that have already been installed.

ORN
DATE: APRIL 7, 2026
TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: DEBBIE MACKEY, GRANT COORDINATOR
SUBJECT: ADOPTION OF RESOLUTION NO. 2026-07 APPROVING THE 2025
AMADOR COUNTY HAZARD MITIGATION PLAN (LMHP) AND
INCORPORATING IT BY REFERENCE INTO THE SAFETY ELEMENT
OF THE CITY'S GENERAL PLAN IN COMPLIANCE WITH ASSEMBLY
BILL 2140 (AB2140)
RECOMMENDED ACTION: City Council adopt the attached resolution approving the 2025 Amador County Hazard Mitigation Plan (LHMP) and incorporating it by reference into the Safety Element of the City's General Plan in compliance with Assembly Bill 2140 (AB 2140).
FISCAL IMPACT: There is no direct fiscal impact associated with adopting the 2025 Amador County Hazard Mitigation Plan or incorporating it into the Safety Element of the General Plan.
BACKGROUND: The 2025 Amador County Hazard Mitigation Plan is a multi-jurisdictional plan developed in accordance with federal requirements under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, the National Flood Insurance Act of 1968, and the National Dam Safety Program Act. The plan identifies natural hazards threatening Amador County and its jurisdictions, including the City, such as floods, wildfires, earthquakes, and severe weather. It outlines mitigation goals and actions to reduce long-term risks to people and property.
Assembly Bill 2140 (AB 2140), passed in 2006, provides an incentive for California counties and cities to adopt their FEMA-approved LHMPs into the Safety Element of their General Plan. This adoption makes jurisdictions eligible for additional state cost-share under CDAA for Public Assistance projects, potentially covering the full local share (up to 25%) if approved by the legislature post-disaster.
DISCUSSION: Adopting the 2025 Amador County Hazard Mitigation Plan demonstrates the City's commitment to hazard mitigation and community resilience. The plan includes jurisdiction-specific annexes tailored to the City's needs, focusing on actions to mitigate identified hazards.
Incorporating the plan by reference into the Safety Element of the General Plan ensures compliance with AB 2140, enhancing eligibility for state funding. This is optional but beneficial, as it could alleviate financial strain from future disasters without guaranteed funding.
Failure to adopt could result in loss of eligibility for FEMA HMA grants and CDAA incentives.

Dear Sgt. Matt Girton:
The Federal Emergency Management Agency (FEMA) has completed its review of the 2025 Amador County Hazard Mitigation Plan and has determined that the plan is eligible for final approval, pending its formal adoption by Amador County and all participating jurisdictions. Please refer to the enclosed list of jurisdictions currently considered Approvable Pending Adoption (APA).
Formal adoption documentation must be submitted to FEMA Region 9 by at least one participating jurisdiction within one calendar year from the date of this letter. If no adoption is received within that timeframe, the plan must be updated and resubmitted for review.
FEMA will issue formal approval of the plan upon receipt of the adoption documentation. Once approved, all other participating jurisdictions must adopt the plan within five calendar years of the approval date. Adoption of the plan is required to maintain eligibility for funding under FEMA's Hazard Mitigation Assistance (HMA) programs. All funding requests will be evaluated based on the specific eligibility criteria and requirements of the applicable HMA program.
Please note that while local hazard mitigation plans may include additional content to meet Element H: Additional State Requirements or other local objectives, FEMA's APA status does not constitute review or approval of any content exceeding FEMA's standard mitigation planning requirements.
If you have any questions regarding the planning or review processes, please contact the FEMA Region 9 Hazard Mitigation Planning Team at [email protected].

Assembly Bill 2140 (AB 2140) Fact Sheet
Information for Counties and Cities
What is AB 2140?
Passed in 2006, Assembly Bill No. 2140 (AB 2140) allows California counties and cities to be considered for additional state cost-share on eligible Public Assistance projects by adopting their current, FEMA-approved local hazard mitigation plans (LHMPs) into the Safety Element of their General Plan. This adoption, along with other requirements, makes the county or city eligible to be considered for part or all of its local-share costs on eligible Public Assistance projects to be provided by the state through the California Disaster Assistance Act (CDAA). For more information regarding Public Assistance, please visit Cal OES Public Assistance Division.
How Can AB 2140 Help Counties, Cities, and Your Citizens? For eligible Public Assistance projects, the typical local (non-federal) cost share is 25% of the total project cost. CDAA can allow the state to pay up to 18.75% of the non- federal share, that would otherwise fall upon the county or city, to pay for eligible Public Assistance projects once the legislature has passed a bill allowing additional state funding after a disaster occurs. Upon approval of the legislature, counties and cities that are AB 2140 compliant are also eligible to be considered for the remaining
6.25% local share to be funded by the state, essentially covering the entire local-share cost for eligible Public Assistance projects. Please note that funding is not guaranteed.
What Do You Need to Know?
• AB 2140 is not a requirement; it is an optional state incentive to help counties and cities become more resilient to natural hazards. Be sure to work with your planning department as the process proceeds.
• There are multiple steps that must be completed before Cal OES can issue a letter of AB 2140 compliance. These steps are listed in detail below in the section What Are the Steps to Become AB 2140 Compliant? • Be aware that adopting the LHMP via a formal resolution is a federal requirement for FEMA to officially "approve" the LHMP and does not make your jurisdiction automatically AB 2140 compliant. AB 2140 is a state incentive which also requires adopting your LHMP into the Safety Element of your General Plan.
However, both adoptions can take place at the same time using the same adoption resolution.
• AB 2140 compliance expires when the LHMP expires. You must re-adopt the LHMP itself AND adopt the LHMP into the Safety Element of your General Plan each time you update your LHMP in order to continue compliance. • For multi-jurisdiction hazard mitigation plans (MJHMPs), the county and each city in the MJHMP must adopt its own specific annex into its own General Plan

Safety Element. Annex jurisdictions are not covered under the county's adoption.
• Special districts are not eligible for AB 2140 compliance as they do not have General Plans.
• For additional information on General Plan and Safety Element requirements please contact the California Office of Planning and Research (OPR).
What Are the Steps to Become AB 2140 Compliant?
1. Complete and submit an LHMP to the Governor's Office of Emergency Services (Cal OES). A jurisdiction must have a current, FEMA-approved LHMP. a. Cal OES will provide an initial review and, if applicable, request required revisions based on the FEMA LHMP Guidance.
b. Once Cal OES has determined the plan has met all FEMA LHMP requirements, Cal OES will then forward the LHMP to FEMA for final review and approval.
c. For questions or assistance, please contact the Cal OES Local Mitigation Planning Unit at [email protected].
2. LHMP adoption AND adoption into the Safety Element of the General Plan • a. Adopt the LHMP via a formal resolution following your jurisdiction's typical procedure once FEMA has issued "approvable pending adoption" (APA) status. Once FEMA receives a signed adoption resolution, they can then issue an official "approval" notice for your LHMP.
i. A sample adoption resolution for your LHMP is provided in Appendix B of the FEMA LHMP Policy Guide.
b. At this time, you may also choose to adopt the LHMP into the Safety Element of your General Plan using the same resolution in order to meet a requirement of AB 2140 compliance (see step 3).
i. Within the Safety Element update adoption resolution, there must be language specific to adopting the LHMP into the Safety Element of the General Plan, and the resolution must be signed and approved before the LHMP expires. This adoption can occur at the same time the LHMP is adopted to comply with FEMA requirements, or it can occur after the LHMP is approved but before it expires after five years.
c. At any time during the life of an approved LHMP a jurisdiction may choose to adopt the LHMP into the Safety Element of their General Plan, however, when the LHMP expires, AB 2140 compliance will also expire.

3. Safety Element Language
a. The local agency must include language specific to the LHMP within the Safety Element of their General Plan and make the LHMP easily accessible in its entirety as a weblink, appendices, or attachment (see step 4).
b. Jurisdictions should follow their own internal procedures for Safety Element language, however, below is sample language that may be used:
i. "The Local Hazard Mitigation Plan (LHMP) for the [Add Jurisdiction Name] planning area was developed in accordance with the Disaster Mitigation Act of 2000 (DMA 2000) and followed FEMA's Local Hazard Mitigation Plan guidance. The LHMP incorporates a process where hazards are identified and profiled, the people and facilities at risk are analyzed, and mitigation actions are developed to reduce or eliminate hazard risk. The implementation of these mitigation actions, which include both short and long-term strategies, involve planning, policy changes, programs, projects, and other activities. (Add a web link or language directing to the LHMP attachment or appendix within the Safety Element. Discussed further in step #4 below.)"
4. LHMP Accessibility and Links
a. The current, approved LHMP must be easily accessible and available to the public viewing the Safety Element. This requirement can be met by linking the LHMP electronically to the General Plan Safety Element or by including the LHMP in its entirety as an attachment or appendix in the Safety Element and referencing its location with the plan. b. Web links should be monitored so that they are in working condition and bring the viewer to the most recent approved version of the LHMP.
5. E-mail the link to the updated General Plan Safety Element web page along with the signed adoption resolution(s) to the Cal OES AB 2140 inbox [email protected] for review and approval.

CALIFORNIA UNIFORM PUBLIC CONSTRUCTION
COST ACCOUNTING ACT
FREQUENTLY ASKED QUESTIONS (FAQs)
These FAQs have been compiled to assist agencies that are participating in the California Uniform Public Construction Cost Accounting Act (the Act), as contained in Public Contract Code (PCC) Section 22000, et seq. All references are to PCC, unless otherwise stated.
1. What is the Uniform Public Construction Cost Accounting Act? The Act is legislation that was enacted in 1983 to help promote "uniformity of the cost accounting standards and bidding procedures on construction work performed or contracted by public entities in the state" (Section 22001). The Act is a voluntary program available to all public entities in the State, but it applies only to those public agencies that have "opted in" to the provisions set forth by the Act using the processes outlined in the Act. The entirety of the Act is found at Sections 22000-22045.
2. What are some of the key provisions of the Act?
The Act allows for public project work in the amount of $75,000 or less to be performed by a public agency's force account using the public agency's own resources, or by negotiated contract, or by purchase order (Section 22032(a)). Public projects in the amount of $220,000 or less may use the informal or formal bidding procedures set forth in Section 22032(b), or (c) of the Act. Public projects at a cost of more than $220,000 must use formal bidding procedures to let the contract pursuant PCC Section 22032(c), except as otherwise provided by statute.
3. What are the benefits of the program?
• Increased force account limit for public agencies;
• Simplified bidding for projects that are $220,000 or less; • Reduced number of formal bids based on project size; and • Expedited contracting for projects under $220,000.
Many participating agencies appreciate the program because it has given them more leeway in the execution of public works projects under a certain dollar amount; sped up the award process; expedited project delivery; reduced the time, effort, and expense associated with bidding projects under $220,000; and simplified administration for those projects. Few agencies have experienced challenges with the accounting requirements and overhead provisions. Moreover, adjustments, when required, have been relatively simple; most required procedures were already in place, so there were few, if any, major changes to existing operations. The current Standard Accounting Codes Structure satisfies reporting requirements when used properly.
4. Is the Uniform Public Construction Cost Accounting Act mandatory for public agencies? No. The Act is a voluntary program requiring a public agency to "opt in" using the process outlined in the Act.
1|::: -
Revised August 22, 2025
5. How does a public agency become subject to the Act?
The governing body must elect by resolution to become subject to the Act and must file a copy of the approved resolution with the State Controller's Office (Section 22030). Sample documents are available at: http://www.soo.ca.gov/ard cuccac.html. Once an agency has opted into the Act, it will remain a part of the program.
6. May a public agency withdraw from the Act?
Yes. An agency may withdraw from the Act by filing with the State Controller's Office an approved resolution of the agency's election to withdraw that was made during a public meeting of the agency's governing body.
7. Must a participating agency "opt in" to the Act annually? No. Once a participating agency "opts in" to the Act, the agency remains subject to the Act until it "opts out" of the Act.
8. What is the California Uniform Construction Cost Accounting Commission? The Commission was created to administer the Act, per Section 22010. It consists of 14 members: 13 members appointed by the State Controller and the License "A" member of the Contractors' State License Board. Seven members represent the public sector (counties, cities, school districts, and special districts). Six members represent the private sector (public works contractors and unions). The Commission members receive no salary, but are eligible for reimbursement of their direct expenses related to the Commission.
9. What are the Uniform Public Construction Cost Accounting Procedures? These procedures are to be used for tracking costs for work performed by an Agency's own forces on a "project" as defined by the Act (Section 22002(c)). The procedures do not apply to operations or maintenance work, or any work that meets the criteria listed in Section 22002(d).
These procedures are intended to capture and record all direct and indirect labor, materials, equipment, subcontractors, and supervision costs, as well as the appropriate overhead costs for the public agency associated with each "project" it performs with its own forces: The procedures follow industry-standard accounting methods, and in many cases are not much different from those already in place at most agencies. Sample forms are available in the CUCCAC Cost Accounting Policies and Procedures Manual at http://www.sco.ca.gov/Files-ARD-Local/CUCCAC_Manual.pdf School districts may use the Standard Accounting Code Structure to comply with tracking requirements.
10. Are the cost accounting procedures applicable for agencies whose work forces perform only maintenance tasks as defined in the Act and that contract all of their public projects to third parties?
No. The cost accounting procedures are applicable only for agencies that perform public project work such as construction and alteration by force account or otherwise. As maintenance does not constitute a "project" under the Act, the cost accounting procedures do not apply.

Revised August 22, 2025
11. When are participating agencies required to advertise if they choose to maintain a list of qualified contractors?
At least once per calendar year, each Public Agency that has elected to become subject to the Act and intends to use the notice provisions outlined in Section 22034(a) must establish a new list or update its existing list of qualified contractors by mailing, faxing, or emailing written notice to all construction trade journals designated for that Agency under Section 22036. The notice must invite all licensed contractors to submit the name of their firms to the Agency for inclusion on the Agency's list of qualified bidders for the following twelve (12) months. Effective January 1, 2016, a participating agency can choose a specific date of their choice in which to renew its list of qualified contractors.
12. May an agency that chooses to maintain a list add a contractor to the list at any time during the year?
Yes.
13. What is meant by the term "qualified contractors" as used in section 22034(a)(1) of the Act?
Qualified contractors are contractors licensed by the State to perform the subject work.
The Commission has determined that nothing in the Act prohibits a participating agency from using additional objective pre-qualification standards in the formation and maintenance of their Qualified Contractors Lists if they so desire.
14. How can a contractor get on an agency's list of contractors? The California Uniform Public Construction Cost Accounting Commission's webpage has a list of agencies that are participating in the California Uniform Public Construction Cost Accounting Act (CUPCCAA). Please contact each agency directly to let them know you would like to be on their list of contractors. For a list of participating agencies, please see the "Participating Agency Lists" header at the following link:
https://www.sco.ca.gov/ard_cuccac.htm/
More detailed instructions for contractors can be found in Section 1.04.01 of the Cost Accounting Policies and Procedures Manual
15. Can a public agency disqualify or exclude certain contractors from the Qualified Contractors List required in Section 22034(a)(1)?
Agencies may disqualify contractors from Qualified Contractors Lists when the contractors fail to furnish information to meet the minimum criteria as established by the Commission.
16. For agencies that do not maintain an informal bidders list, are they allowed to choose who would get notifications of projects?
No. Section 22034(a)(2) provides for notifications to construction trade journals and exchanges in lieu of sending notifications to contractors on an informal bidders list. An agency may send notices to selected contractors provided it has also met the advertisement requirements of Section 22034(a).
3| 1: 9
Revised August 22, 2025
17. What is the difference between "qualifying contractors" under the Act and "prequalification of contractors" by school districts under Section 20101? Qualifying contractors is a process that allows contractors to register with a public agency for notification of public works opportunities. The prequalification process under Section 20101 is a more. complex process that requires a standardized questionnaire and evaluation of contractors using standard scoring criteria. The prequalification process is applicable under the Local Agency Public Construction Act, and does not apply to the Uniform Public Construction Cost Accounting Act.
18. Does a contractor have to be on an agency's contactor list in order to perform projects less than $75,000?
No, any public project less than the $75,000 informal bidding threshold can be performed by employees of the public agency, by negotiated contract, or by purchase order. An agency's list of contractors is only required to be alerted of projects that surpass the informal bidding threshold.
19. Must a public agency a) notify contractors about public projects if the contractors are believed to not have the skills, credentials, or experience to perform the work required for the public project; and b) consider bids submitted by contractors that the public agency believes do not have the skills, credentials, or experience to perform the work? a) Yes. If a contractor is on the Qualified Contractors List, the contractor must be notified by the agency of public projects for which he or she is licensed to perform (Section 22034(a)(1)).
b) All bids received must be considered, unless an agency makes appropriate legal findings that a contractor is not legally responsible or his or her bid is not responsive.
20. Does the Act allow flexibility in cases of emergency and when repair or replacements are necessary to permit the continued conduct of a public agency's operations or services? Yes. For the purposes of the Public Contract Code, an "emergency" is defined at Section 1102 as "a sudden, unexpected occurrence that poses a clear and imminent danger, requiring immediate action to prevent or mitigate the loss or impairment of life, health, property, or essential public services."
The Act sets forth in Section 22035(a) how a governing body should proceed in case of emergency repairs or replacements. This section states:
In cases of emergency when repair or replacements are necessary, the governing body may proceed at once to replace or repair any public facility without adopting plans, specifications, strain sheets, or working details, or giving notice for bids to let contracts. The work may be done by day labor under the direction of the governing body, by contractor, or by a combination of the two. Section 22050 et seq., provides the emergency contract procedures to be followed in these cases. 4|

21. Do the alternative bidding procedures apply only to public projects as defined in Section 22002(c)?
The alternative bidding procedures apply only to work that constitutes a "public project" as defined in Section 22002(c) and has a construction cost within the limits described in Section 22032. The alternative bidding procedures are not required for the purchase of goods or materials that are not part of a "public project." However, as outlined in Section 22003, a participating agency may also use the alternative bidding procedures when contracting for maintenance or other work that does not fall within the definition of a "public project" if it so chooses.
22. What will membership in the Act cost my agency?
Nothing. There are no membership fees or dues. However, the Commission does accept grants to assist it in carrying out its duties (Section 22015(c)).
23. What are the most common concerns addressed by the Act? These are:
• Cost accounting policies and procedures;
• Informal bidding procedures; and
• Accounting procedures review.
Cost accounting requirements for the Act follow those common to the construction industry. The informal bidding on public projects up to $220,000 is seen by agencies as an effective tool to expedite completion of small projects. While an accounting procedures review could potentially hold up a project for a minimum of 45 days pursuant to Section 22043(c)(1), these types of reviews have been rare in the Commission's history.
24. Must an agency calculate an overhead rate to apply the accounting procedures? No. Cities with populations of less than 75,000 must assume an overhead rate equal to 20% of the total costs of the public project, including the costs of material, equipment, and labor (Section 22017(b)(1)). Cities with a population of more than 75,000 may either calculate an actual overhead rate or assume an overhead rate of 30% of the total costs of a public project including the costs of materials, equipment, and labor (Section 22017(b)(2)).
25. When a public entity opts into the Act, does the Act supersede other contracting legal requirements such as statutory requirements for performance bonds, prevailing wages, and certificates of insurance, etc.?
No. The Act supersedes only the bidding procedures used once a public agency has opted into the Act and has notified the Controller. All other contracting requirements of the PCC remain applicable.
Revised August 22, 2025
26. Can a public agency claim to be to be exempt from following all of the requirements in Public Contract Code by claiming it only has to follow the language and procedures within the Act?
No. The Act is part of the Public Contract Code; therefore, if the Act is silent on a particular matter, then the Public Contract Code applies on that matter.
27. If public agencies are not following the advertising requirements in the Act, will the Commission address those agencies? Can a complaint be brought to the Commission? Yes. Recent legislative changes have expanded the Commission's authority to enforce provisions of the Act. The Commission may review complaints filed by interested parties when evidence is provided that:
• The participating agency performed work after rejecting all bids, claiming it could do the work less expensively (Section 22042(a)).
• The work performed exceeded the force account limits (Section 22032(a)). • The work was improperly classified as maintenance (Section 22042(c)). • The work has been split or separated into smaller work orders or projects (Section 22033).
• The work has exceeded the limits or otherwise not met the requirements set forth (Section 22032(b) and (c)).
• A public agency did not comply with the informal bidding procedures set forth at Section 22034 (Section 22042.5).
28. Section 20112 specifically requires school districts to advertise twice for a two-week period, while Section 22037 requires advertising once, 14 days in advance of the date of opening of bids. How do participating school districts reconcile this conflict? When the Act is in conflict with any other section in the Public Contract Code, the Act shall supersede. The Act requires advertising once, 14 days in advance of the date of opening of bids. Districts participating in the Act may choose to maximize their outreach by advertising twice.
29. May a public agency contract separately for like work at the same site at the same time using the under $75,000 Force Account method?
No. Section 22033 states:
It shall be unlawful to split or separate into smaller work orders or projects any project for the purpose of evading the provisions of this articie requiring work to be done by contract after competitive bidding.
Separating "like work" would be permitted only if the total of all the "like work" is less than $75,000. If the work is more than $75,000, it must be advertised and bid according to the provisions of the Act (i.e., bid informally if the total amount is less than $220,000; bid formally if the total amount exceeds $220,000).

30. May a public agency bid out two separate projects that occur at the same time and site, but are different types of work?
Yes. There is no violation if the work is competitively bid. If an agency wishes to use the •negotiated or informal bidding processes, it must apply the appropriate limits to each of the projects. Each project must be separate in scope. Projects may not be separated by trade to avoid bidding. If the total of all jobs is greater than $75,000 then the informal or formal bid limits apply.
31. May a public agency contract separately for like work performed at multiple sites at the same time using the under $75,000 limit?
Yes. A public agency may contract for like work at separate locations with unique addresses. If the cost of the work is more than $75,000 at any individual site, that work must be advertised and bid according to the provisions of the Act (i.e., bid informally, if the total amount is less than $220,000; bid formally, if the total amount exceeds $220,000).
32. Can an agency separately bid out for the materials and supplies on a project to avoid contractor markup and then bid out for the installation labor or perform installation with its own forces?
An agency may separately procure the materials and supplies for a project; however, all costs (materials, supplies, labor) of a project must be included in the project cost estimate to determine whether the project falis within the force account, informal bid, or formal bid thresholds.
In addition, if installation is performed by force account, an overhead rate must be applied to all direct costs of the project and included in the cost estimate. For example, if materials/supplies cost $50,000 to procure separately and the estimated labor cost to install is $25,000, the project could not be performed with force account, but would fall within the informal bid threshold because the total cost estimate is $75,000.
33. Must a value be assigned to the volunteer labor when the California Conservation Corps or another volunteer organization provides labor on a public project? No. Volunteer labor from volunteer organizations does not need to be included as a cost of a public project for bid limit purposes as long as no costs are associated with the volunteer labor.
34. By opting into the Act, does a public agency automatically bring all of its component divisions or departments into the Act?
Yes. When a public agency elects to become subject to the uniform construction cost accounting procedures, the entire legal entity is considered subject to the Act and no divisions or departments are exempt.
35. When a public agency opts into the Act, does it automatically bring all districts under control of its governing Board into the Act?
No. Special Districts, which are governed by a board of supervisors or city council, are subject only if a separate election is made for each special district.

36. PCC 22034 requires that participating agencies adopt an informal Bidding Ordinance.
What do schools and special districts that cannot adopt Ordinances do to comply? Agencies that do not have the ability to adopt Ordinances should discuss Section 22034 compliance with their legal counsel.
37. Are change orders allowed by the Act, and if so what is allowable? What if a change order goes over one of the allowed thresholds?
The Act does not address change orders. Please consult with your agency's legal counsel regarding any limitation on change orders that may apply to your agency.
38. Is there any training related to the Act? If so, where can I find a list of where the training is offered?
SCO has information regarding the Act on the SCO/CUCCAC website, including the current Cost Accounting and Procedures Manual. Often, commissioners are willing to provide training, answer questions, and/or give a presentation in order to assist agencies in getting the full benefits of participating in the Act.
39. The Act states that public projects of sixty thousand dollars ($60,000) or less may be performed by the employees of a public agency by force account, by negotiated contract, or by purchase order. However, the Department of Industrial Relations (DIR) states any project over $1,000 has to pay prevailing wages. How do the Act and DIR guidance work together?
The Act and DIR are completely separate and govern different aspects of public projects.
The Act focuses on bidding related to public projects and DiR deals with wages paid by contractors on public projects. However, they may relate in that if prevailing wages are not paid on a public project, that could potentially impact the total cost of a project which would require a different bidding process utilized under the Act.
