Government Code 54956.9(d)(1)
City of lone vs. Alison LaFayne, Individually and dba J. Bouldin West, LLC Amador County Superior Court: Case No. 25CV1474

3. CONFERENCE WITH LABOR NEGOTIATORS
Government Code 54957.6
Agency designated representative: George Lee, City Manager Unrepresented Employee: Police Chief
Public Comment:
Dave Johnson commented:
• At the last meeting, Andy Aguilera commented that the City offered a $10,000 settlement with payments in it. I have never heard anything publicly about a settlement agreement. If that was a Closed Session item, how does Andy Aguilera know about it.
• I noticed the lead attorney that works in the attorney's office was in Closed Session and then stayed for the whole meeting. I hope we are not getting billed for the whole time she was here.
Marsha Edick commented:
• Thanked Mr. Johnson for addressing a lot of the things I was going to say. I find Mr. Aguilera's comments interesting, I would like to know how he got the information, assuming it is true.
• I am concerned about the City Attorney fees, we are up about $25,000 for the lawsuit against our Councilmember. Given it is our tax dollars, has a budget been established and if so, what is it.
• I also hope that we will not be billed doubly for both attorneys at the last meeting.
C. PLEDGE OF ALLEGIANCE - Mayor Maita led the Pledge of Allegiance.
D. REPORT OUT OF CLOSED SESSION:
Council reconvened to Open Session at 6:02 p.m. Mayor Maita reported that direction was given on the following:

PUBLIC COMMENT:
Christy White invited everyone to attend a meet and greet for Brendon Owen who is running for the California State Assembly for District 9. It will be held at the Castle Oaks Golf Course on April 10, 2026 from 6:00 p.m. to 9:00 p.m.
Patricia Angeja commented on a recent article published on March 24, 2026 in the Prison Reports, "Contaminated Water from California Prison Sickens Residents of Nearby Town" ', and a former article, "If You Want to Live, Don't Drink the Water. In April, 2025 Mule Creek State Prison spilled another 177,000 gallons of waste into Mule Creek. I am concerned because I do not want the money the City will be receiving from Mule Creek for improvements to the Tertiary Plant, alleviate them being accountable for any environmental hazards they have caused. We recently learned of a new childhood cancer patient in Jackson, and there is a donation page that can be found on Heart of Gold's Facebook and Instagram.
Larry Rhoades, read a portion of the Lori McGraw lawsuit against the City, "However, not only has Hanken's behavior allowed to continue, but the two other Councilmembers Atlan, Wratten and Meyer joined in with the survey of Ad Hoc Committee with Hanken also treated the plaintiff improperly and with the same level of disrespect as Hanken". Someone said they weren't in it, but they are. I don't understand how he is allowed in Closed Session to vote on this.
Patrice Prest gave an update on the Landscaping issues at Castle Oaks. Simmons Landscaping has a great cleaning up the front and the medians. There are problems with the irrigation—can't find valves and can't find irrigation in the frontage. I am requesting a meeting with staff and Chad Simmons how the irrigation can be fixed.
Dave Johnson commented on the following:
• Would like updates on the Community Garden and Protocol Manual • Additional payments from CDCR - The amount they were paying was $54,999 every six-month starting in 2019. In 2024, they were paying $27,000. As far as I can tell, there was no revenue from 2007 to 2019.
While it sounded good, it seems like we are just catching up. • Concerned about upgrades needed at the Police Station and hopefully, the Police Chief will address it tonight.
• Did you make the December 31, 2025 cutoff for Picnic Hill-not sure if we received the money or not.
Marsha Edick for everyone who did not arrive in time for the comments in Closed Session. I have a fax machine and I have allowed the people in the community to use it. The McGraw lawsuit is between two parties—Lori McGraw and the City of lone.
There are a whole host of people mentioned in the document, but only two parties to the lawsuit.

4. Update on the Improvements to Lupine Drive and Honeysuckle Drive - Oral Report - Mr. Thomas Borge, Axios Homes, Wildflower Subdivision has been working with the City Engineer in trying to clarify as to what actually happened, as well multiple geotechnical engineers. We have multiple reports that the settlement has stopped on those two roads.
We are looking for Council support to have the ability to do what we need to do to move this project along for the City and the homeowners. The ultimately payer will be the insurance company to fix the roads. We still have 10% retention from Mozingo Construction because the City never signed off the roads. We need to move this forward to make it right. Council has their full support in getting the roads fixed.

Employment Agreement for Police Chief, John Alfred
EMPLOYMENT AGREEMENT FOR THE POLICE CHIEF OF THE CITY OF IONE This Employment Agreement ("Agreement") is made and entered into by and between the City of lone (the "City") and John Alfred ("Chief"). This Agreement shall have an effective date of July 1, 2026 ("Effective Date").
RECITALS
WHEREAS, City desires to retain the services of John Alfred as Chief of Police of City, and Mr. Alfred desires to serve the City in that capacity; and
WHEREAS, City desires to continue Chief's employment on a full-time basis as Chief of Police of City; and
WHEREAS, both City and Chief desire to address certain issues related to wages, hours and other terms and conditions of Chief's employment by City in writing; and WHEREAS, all provisions of the existing Employment Agreement (dated July 1, 2023) between the parties shall continue in full force and effect through June 30, 2026, and at such time this Agreement shall supersede and take the place of that agreement.
NOW THEREFORE, in consideration for the mutual covenants contained herein, the parties hereto do agree as follows:
TERMS AND CONDITIONS
Section 1. Term:
The term of this Agreement shall be three (3) years, as of the Effective Date, unless terminated sooner as provided in this Agreement.
Pursuant to Section 2.08.060 of the City's Municipal Code, the Chief of Police is at at-will position and may be terminated at any time during the term of the Agreement for any reason or for no reason subject only to any conditions stated in Section 3 (Termination).
Section 2. Duties:
City hereby agrees to employ Chief to perform the functions and duties of the Chief of Police as specified in section 2.08.060 of the City's Municipal Code and by California Government Code sections 41601 et seq.
Section 3. Termination and Severance:
At-Will Employment. Notwithstanding the term of this Agreement, Chief is an at-will employee and may be terminated by the City, or Chief may resign, for any reason, or for no reason. If the City terminates Chief's employment without cause, it shall provide 10-days' written notice, subject to the appeal procedures of Section 2.08.060 of the City's Municipal Code. In the event Chief voluntarily resigns his position with City then Chief shall give sixty (60) days' written notice in advance, unless the Parties otherwise agree on a shorter period. Chief and City agree that should Chief be offered other employment during the three-year term of this Agreement, Chief, prior to accepting such offer of employment, shall advise the City Manager of his intent to accept the offer and provide the City the opportunity to meet with him to discuss the offer and other matters as might be desired by either Party.
Death or Disability. In the event that Chief dies, the employment relationship will terminate and City shall pay all compensation earned through the date of death to Chief's spouse, personal representative, or estate. In the event that Chief is mentally or physically disabled and becomes incapable of performing any of the essential functions of Chief's position, even with reasonable accommodation, either permanently or for a period exceeding the period of leave available to Chief under the Family Medical Leave Act or California Family Rights Act, or accrued sick leave, whichever is longer, then the parties agree that the disability of Chief would create an undue hardship for City due to the importance of City having a permanent Police Chief, which may result in the City terminating this Agreement.
Termination for Cause. City may terminate Chief's employment for "good cause," which includes, but is not limited to: conviction of any felony; conviction of misdemeanor arising directly out of the Chief's duties or any crime of moral turpitude; repeatedly failing to carry out policy decisions or lawful directions of the City Manager; repeatedly failing to comply with Chief's obligations under this Agreement; repeatedly failing to comply with policies, standards, and ordinances of the City that are lawfully adopted and not in conflict with this Agreement; deliberate falsification of City records; unauthorized use of City equipment, time, materials or facilities; a pattern of willful abandonment of duties as Chief of Police; or unlawful harassment. If the City terminates Chief's employment for cause, it will provide written notice and an opportunity for appeal under the procedures described in the City of lone Employee Handbook.
Severance. If this Agreement is terminated by City without cause because of the inability to reasonably accommodate a disability because of undue hardship, City agrees to pay Chief a lump sum cash severance payment equal to six (6) months of base salary, and will continue applicable benefit payments for six (6) months from the date of termination.
If this Agreement is terminated by City without cause, City agrees to pay Chief a lump sum cash severance payment equal to eighteen (18) months of base salary. If the unexpired term of this Agreement is fewer than eighteen (18) months, the lump sum cash severance payment shall be an amount equal to Chief's monthly salary multiplied by the number of months left on the expired term of the Agreement.
The City will have no obligation to pay the severance and continue Chief's benefits under this section if Chief is terminated for cause, in the event of the Chief's death, or upon the Chief's voluntary resignation.
In the event of termination of this Agreement, City agrees to work with Chief on the working of a mutually agreeable announcement of termination.
The parties hereby agree that the above "Severance" provisions of Section 3 shall be deemed effective immediately upon execution of this Agreement. For purposes of the above "Severance" provisions, the term of this Agreement shall be considered the date of its execution through expiration of this Agreement.
John Alfred George Lee, City Manager
Section 4. Salary:
City agrees to pay Chief for his services rendered pursuant hereto an annual base salary at Step Five (5) of the adopted salary schedule in the amount of $154,223.43, payable on the same schedule as other employees of the City are paid, subject to all withholdings for the payment of wages as may be required by law. The Parties agree that Chief will be deemed a full-time regular exempt employee.
Chief shall be entitled to longevity pay based on years of uninterrupted continuous employment with the City of lone as follows:
Effective the first pay period following ten (10) years' service - two and one-half percent (2.5%) of base pay.
Any further compensation increases shall be dependent on satisfactory performance reviews and be contingent on City's financial ability.

Chief shall receive the same PERS retirement plan provided to the lone Police Officers Association.

City will provide Chief with the use of a City of lone Automobile for use while on-duty and for travel to and from the Chief's residence to the City of lone. It is expected that the Chief of Police shall reside within twenty-five (25) miles of the City of lone and shall be available to respond to any emergency within 30 minutes or less so long as the Chief is not on previously scheduled time off.
Section 6. Retirement:
City has executed all necessary documents to enroll Chief in the Public Employees, Retirement System of the State of California ("PERS"). The Chief may participate in the City's deferred compensation program, and the City will contribute $300.00 per month on the Chief's behalf into the City's deferred compensation program.
Section 7. Paid Leaves:
City will provide Chief with time off with pay as provided in the City of lone Employee Handbook, such as vacation, administrative leave, and paid sick leave. The terms and conditions of these leaves, including accrual rates, and procedures for requesting and taking time off are governed by those policies.
Chief is considered a regular full-time exempt employee and a Department Head as those terms are used in the Employee Handbook.
Section 8. Performance Evaluation:
City Manager shall review and evaluate the performance of Chief annually. The City Manager shall provide Chief with a summary of written statement of the findings of the City.
Section 9. Indemnification and Bonding:
City shall defend, save harmless and indemnify Chief against any tort, professional liability claims and demands or other legal action, with the exclusion of any criminal charges or an action brought by either the California Attorney General or the City of lone or both, pursuant to Government Code section 12650 (False Claims Act), whether groundless or otherwise, arising out of an alleged act or omission occurring in the performance of Chief's duties as Chief of Police. City shall provide Chief with errors and omissions insurance.
Section 10. Other Terms and Conditions of Employment:
All provisions of the City of lone Employee Handbook relating to working conditions as they now exist or thereafter may be amended, except as set forth herein, shall also apply to Chief.
Except as expressly referenced in this Agreement, the provisions of City of lone and lone Police Officers Association MOU, do not apply to Chief's working conditions or term of employment.
Section 11. Notices:
Notices pursuant to this Agreement shall be given by deposit in the custody of the United States Postal Service, postage prepaid, addressed as follows:
