DATE: JULY 14, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JOSH VARINSKY, CITY ATTORNEY
SUBJECT: ACTION AND DIRECTION TO FILL THE CITY COUNCIL VACANCY
BY APPOINTMENT FOR THE REMAINDER OF THE TERM
RECOMMENDED ACTION:
It is recommended that the City Council fill the vacancy on the City Council by appointment as required by statute, and provide direction to staff regarding the appointment process and schedule.
BACKGROUND / DISCUSSION:
Former Councilmember Alison LaFayne notified the City Clerk of her resignation from the City Council effective July 7, 2026. As a result, her seat is vacant. The seat is scheduled to be voted on this coming election on November 3, 2026, for the following term.
Under the California Government Code, when a City Council seat becomes vacant during an existing term, the City Council must, within 60 days, either fill the vacancy by appointment or call a special election. (Gov. Code, § 36512.) Based on the resignation date, the deadline to fill the vacancy by appointment or call for a special election is September 5, 2026.
In this case, a special election is not the recommended option because of the statutory timing requirements and the proximity of the November 3, 2026, election. A special election to fill a vacancy must be held on the next established election date that is at least 114 days after the election is called. (Gov. Code, § 36512.) Accordingly, any special election to fill the vacancy would occur no earlier than the next regular election at which the seat is already scheduled to be filled.
City staff recommends that the City Council fill the Councilmember vacancy by appointment. An appointed Councilmember would serve the remainder of the current term. An applicant must reside within the City, be registered to vote, and otherwise be qualified to hold office. (Gov. Code, § 36502.)
If the City Council proceeds by appointment, the Council may establish an application period and an interview date for selecting applicants. The Council may also adopt another appointment process of its choosing. If directed, City staff will advertise the vacancy and solicit applications from eligible residents according to the timeline established by the City Council.
