G. PUBLIC COMMENT:

Janice Traverso, City Clerk read an e-mail into the record regarding the Grand Jury Report from Pam Plamondon. The Grand Jury was established to provide independent oversight of local government. Its purpose is to identify concerns, evaluate public agencies, and recommend improvements that protect the public's trust. Whether every recommendation is mandatory is beside the point. The findings should not be minimized or bushed aside as "just recommendations". The response from this council matters just as much as the findings themselves. When legitimate concerns raised by an independent body are dismissed without meaningful discussion, it sends a message that transparency and accountability are optional. They are not.

Each of you took an oath to serve the people of lone. That duty includes listening to constructive criticism-acknowledging weaknesses when they exist, and demonstrating a commitment to improving how our city operates.

Tonight, I am asking for more than words. I am asking for action.

I ask this Council and the City Manager to publicly explain your response to each of the Grand Jury's findings. If you disagree with a finding, explain why and provide the facts that support your position. If you agree with a recommendation, tell the public what specific steps will be taken, who is responsible, and when those actions will be completed.

The citizens of lone should not have to guess whether these issues are being addressed. They deserve transparency. They deserve accountability. And they deserve leadership that welcomes oversight instead of dismissing it.

The Grand Jury's report should be viewed as an opportunity to strengthen this City, not as an attack to be ignored. Great leaders do not fear accountability-they embrace it because they understand that public trust is earned through openness, honesty, and action.

Bonnie Evans, CFD-2005-2 - 1A3:
• The City Council was elected by the people to oversee City matters and the CFD situation. While you did that, you were supposed to be representing us so when the City Manager brings something to table you are supposed to be negotiating not only for the City but for the people you represent. • In June Mr. Lee said there was no emergency but it was time to build up the CFD coffers. At that time, he presented two charts, Option A said it was a 4% raise but in reality it was a 19% raise. Option B gave our CFD a zero raise.
• The Council could have negotiated with Mr. Lee to meet some of his demands and could have negotiated for the people to take us in mind as well. • Based on the way it was presented it that it was an either or and not an continuum you went with his plan.
• I am asking you when someone presents a proposal that is going to cost people money, listen carefully and negotiate with the City Manager to meet his demands but remember you are representing the citizens as well.

Ronnie Gold thanked the City Council for allowing the lone Community 4-H Group the use of the barn at Howard Park. I would also like to invite everyone to the Amador County Fair. All of the children will have their animals up for auction.

Andy Aguilera: I attended the music at the Amphitheater over the weekend and thanked Sam Fabilia for the revenue we are received from the Arena and the Amphitheater. When the City receives a report from the Grand Jury, the City Attorney oversees the response, which costs the City money. Everybody who works for the City are doing a good job.

Patricia Andeja: I have lived here since 2018 and am here today asking for support in the upcoming election on November 3, 2026 to represent the lone, Camanche and Buena Vista area as School Board Trustee. In May, 2022 I wrote an article in the Ledger Dispatch detailing the appalling conditions of the campus of lone Elementary Anna Catelli:

Spoke in support of the Softball Fields at Howard Park.

Reminded everyone that we are all neighbors. We are not always going to agree on everything but hope for my kids, myself and all of us is that we get more respect in this room. I think at the end of the day we for the most part want the same thing—we want to be heard, we want to have transparency and we want to live in a community that we can all be proud of.

Stacy Mitchell:
• Thanked the Council for the Town Hall Meeting-it went very well. • In 2023 we had another Grand Jury Report regarding above ground propane tank. According to our current Ordinance, propane tanks are prohibited in Ione.

In 2026 Grand Jury Report we were written up for the Audits that are not completed. You cannot hold the current Council responsible.

Dave Johnson:
• Commented on the personal attacks from a member of the Planning Commission and violation of the Protocol Manual.

I called the office of White Brenner's Office to let them know that if you did not get the meetings under control, the only recourse we have is call the Grand Jury.

Oral Custer: I think that the City Council, Police Department and City Staff are doing a great job.

David Barnes: Visiting other Cities, I have noticed other Cities have lighted crosswalks. It may be a Caltrans issue, but I would appreciate the City looking into lighted crosswalks to make downtown a little safer.

Mayor Jody Maita commented that we cannot have citizens contacting our City Attorney.

There is an appeal option where the landowner believes the annual amount was levied in error. Prior to posting of the agenda, the appeal was subsequently withdrawn on July 16, 2026 by email correspondence to the City Clerk. OF IONE Agenda Item #L. 1.

CITY OF IONE
IONE, CA 95640)
DATE: SEPTEMBER 1, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JOSH VARINSKY, CITY ATTORNEY
SUBJECT: ORDINANCE TO ESTABLISH RULES FOR E-BIKES, E-SCOOTERS,

AND E-SKATEBOARDS
RECOMMENDED ACTION:

It is recommended that the City Council conduct the public hearing, waive further reading, and adopt an ordinance adding Chapter 10.40, E-Bikes, E-Scooters, and E-Skateboards, to the lone Municipal Code.

BACKGROUND / DISCUSSION:

This ordinance was first discussed and received feedback at the City Council meeting of July 7, 2026.

There has been an increase in the use of electric bicycles, electric scooters, and electric skateboards (collectively referred to herein as "devices") within the City of lone ("City"). Although the California Vehicle Code generally regulates the operation of these devices, the City may adopt local regulations that do not conflict with state law.

State law defines and regulates these devices, including requirements related to equipment, age restrictions, license requirements, helmet use, speed limits, and traffic movements.' The City may not establish local regulations for the same or substantially similar conduct already regulated by the Vehicle Code, and citations for such conduct must be issued under the applicable Vehicle Code provision. (Veh. Code, § 21100(n)(1).) Accordingly, the Ordinance relies on the Vehicle Code for applicable enforcement while also identifying the relevant state law requirements to provide notice and guidance to local users. The rules of the road remain applicable to these devices.

The Ordinance also addresses conduct not already fully addressed by state law. These provisions are intended to further reduce unsafe operation of devices and to protect pedestrians. The provisions for additional local enforcement include:
• Prohibiting the operation of devices on sidewalks within the City; ' See Veh. Code, §§ 21200-21214.7 [e-bikes], 21220-21235 [e-scooters], 21290-21296 [e-skateboards]. • Allowing the Police Chief to post signs on particular paths, trails, parks, or other City- owned property to prohibit operation of the devices.
• Prohibiting the operation of devices within any designated area of a city special event, city- permitted festivals, street fair, or emergency operation area. • Establishing rules for parking of the devices.
• Prohibiting reckless operation of devices; and
• Prohibiting group rides of 3 or more people that endanger the public.

Violations punishable as City infractions are subject to fines of $50 for a first violation, $100 for a second violation, and $250 for each additional violation. Minors found in violation may also be required to attend a bicycle safety course provided by the Police Department. Any person issued a citation or penalty under Chapter 10.40 is entitled to an administrative hearing under the lone Municipal Code.

REVISIONS SINCE THE JULY 7, 2026 COUNCIL MEETING
Comments from Councilmembers and the public were raised at the prior Council meeting. Those comments are summarized below with responses, including explanation of the changes to the proposed ordinance since the first meeting.
• Clarification regarding the minimum ages for each device. • RESPONSE: This is governed by the Vehicle Code.
• Clarification regarding the age requirements for wearing helmets. • RESPONSE: This is governed by the Vehicle Code.
• The scope of the sidewalk prohibition.
• RESPONSE: Some of state law governs here also. E-scooters are not allowed on sidewalks under state law. The City can establish the scope of the sidewalk prohibition on e-bikes and e-skateboards. The ordinance proposes a ban on riding on sidewalks for all devices.
• The rules for parking on sidewalks and City property. • RESPONSE: This has been clarified to allow for parking in designated parking areas; upright on a curb in a manner that does not obstruct pedestrian traffic; or upright against City fences, poles, or trees.
• What constitutes an illegal group ride versus a lawful group ride? • RESPONSE: The group ride prohibition only applies to at least 3 riders riding 'in a manner that demonstrates willful or wanton disregard for the safety or persons or property,..." Devices riding together in a lawful, safe manner would not be cited.

Further detail was also added regarding impoundment of devices. Seizure and impoundment of the devices can occur when they are being operated recklessly or in a way that presents a danger to the public. The City would have to establish the storage and recovery fees by separate resolution.
