APNS): 8532- 004- 022, 8532- 004- 026, AND 8532- 004- 025 MAYOR ORTIZ Mayor Ortiz questioned the timing of the EIR, to which Director Simpson discussed the staff report, and noted that the data is being compiled as a disclosure document to analyze any impacts related to the project. A mitigation and monitoring report will also be prepared.
Conditions of Approval will also be added to address construction; however, the construction is not being considered at this point. She also noted that the owner of the land intends to move forward with the project, and indicated that there will be a need for remediation.
COUNCILMEMBER In response to a question by Councilmember Garcia, City Attorney GARCIA Guerra advised that approving additional funding for testing would not obligate the City to approve the proposed facility. He advised that this agreement merely permits the City to retain a consultant to perform the environmental analysis, the applicant would still be required to go through the planning process.
Councilmember Garcia also asked whether drilling would be conducted to determine the site' s compaction rating, to which City Attorney Guerra advised that this agreement would not cover that. In terms of design, that would be a separate analysis, depending on where they drill.
Responding to an additional comment by Councilmember Garcia, City Attorney Guerra noted that the owner 1 developer would have to submit plans with regard to the project they would like to develop.
Once that is determined, a study could be performed to determine whether the building they propose would be supported based on the site conditions. The developer would also have to demonstrate that they could actually build it. He stated his assumption that the developer performed its due diligence before purchasing the property.
MAYOR PRO TEM Mayor Pro Tern Ambriz stated that the Council is aware of what exists AMBRIZ underneath the pad and expressed concern over potential liability if the developer disturbs the site contents, to which City Attorney CITY COUNCIL MINUTES DECEMBER 14, 2022

Guerra stated that whatever is built would need to be constructed according to the Building Code, and that the Building Official has to sign off on it. The EIR would determine remedies to correct impacts and prepare the site for development.
MAYOR PRO TEM Mayor Pro Tern Ambriz reiterated this concerns over the potential AMBRIZ affects to the environment and resulting liability for the city, to which City Manager Miranda advised that city staff will meet with geological support staff to determine remediation measures and the type of development that would be allowed.
Mayor Pro Tern Ambriz stated that the Council must ensure that the public is informed of what could occur.
COUNCILMEMBER Councilmember Breceda stated his surprise that the site has not been BRECEDA declared a superfund, and expressed his opinion that the site should probably remain as the Speedway.
COUNCILMEMBER In response to comments by Councilmember Burrola, City Attorney BURROLA Guerra noted that city staff will also need to work with county staff for certain services.
CITY MANAGER City Manager Miranda advised that the developer would be required MIRANDA to submit a plan to the city, which will then be scrutinized to ensure compliance with the Building Code.
MOTION A motion was made by Mayor Ortiz, seconded by Councilmember Burrola, to approve Amendment No. 1 to the Contract with LSA Associates, Inc. for the preparation of an initial Study and Environmental Impact Report to be prepared in association with a land use entitlement application for property located at 500 Speedway Drive, Irwindale, CA 91706. Director Hanna presented the report.
MOTION A motion was made by Councilmember Garcia to approve the request from United Rock Products, Inc. ( United) to extend the hours of operation for transportation of excavated aggregates from the Olive Pit to United Rock Products Pit No. 2 ( URP- 2) from December 31, 2022 until July 31, 2023. The extended hours of operation during this time period would be: Monday to Friday, 7 a. m. to 3 p. m., and Saturday, 7 a. m. to 5 p. m. ( only 2" d and 4th Saturday of each month.) MAYOR ORTIZ Mayor Ortiz noted that, in September, the Council gave United Rock an extension that would end this month, and noted that they are once again asking for another extension. However, United still has not provided an exact timeline for the installation of a traffic signal at Los Angeles Street, to which Director Hanna stated that, per United Rock's estimate, the construction of the signal should take place in February 2023, with a scheduled completion in June 2023.
Mayor Ortiz suggested providing United Rock an extension of three months, with the possibility of an additional three- month extension, depending on United Rock' s progress in constructing the traffic signal.
COUNCILMEMBER Councilmember Garcia repeated his motion.

MAYOR PRO TEM Mayor Pro Tern Ambriz concurred with Mayor Ortiz, and agreed that AMBRIZ United Rock is not moving forward quickly enough with regard to the installation of the traffic signal. He agreed that the extension be granted depending on United Rock' s progress on the traffic signal installation.
MARK PACHURA Mark Pachura, with United Rock Products, concurred that the threemonth extension mentioned by Mayor Ortiz is fair. He added that United Rock feels that the signal work will begin in February, and stated that United is amenable to returning after three months to request another extension.
COUNCILMEMBER In reply to a comment by Councilmember Burrola, Director Hanna BURROLA advised that the Engineering Department has not received any complaints about truck traffic at the subject site since September.
COUNCILMEMBER Councilmember Breceda agreed that a three- month extension is BRECEDA sufficient at this time and would allow United Rock the opportunity to make progress on the installation of the traffic signal.
COUNCILMEMBER Councilmember Garcia withdrew his motion.
