Background and Analysis:

The items on Exhibit A are for the most part antiquated, worn out, broken, or unsuitable for City use. The equipment described on this surplus list is merely occupying storage space and there are no items with potential marketable value. As such, the Purchasing Manager has reviewed the equipment listed on Exhibit A and is recommending disposal of the items through e-waste program, in lieu of the disposition of surplus supplies and requirements of as Irwindale Municipal Code Section 3.44.150.

IMC section 3.44.150 requires that items declared by the Purchasing Manager to be surplus be disposed of through a competitive bid process. The most efficient and cost effective method of securing competitive bids, given the value of the equipment is through a public auction service. Through this service, the City will receive the highest bid and the equipment will be sold in a single, efficient manner. After a reasonable effort to dispose of property through a competitive bid process, IMC section 3.44.150(C) next requires disposal of items for highest scrap value. Only after a reasonable effort to obtain scrap value may the items be destroyed or disposed of any other way.

However, the items on Exhibit A constitute e-waste, and e-waste equipment generally has nominal or no re-sale value. Additionally, the supplies and equipment on this list are no longer used or are obsolete for the city's use.

Therefore, staff recommends that the City Council adopt Resolution No. 2023-14-3392, declaring the items on Exhibit A as surplus and exempt from the requirements of IMC section 3.44.150 and authorizing the City Manager to immediately dispose of the items.

Fiscal Impact:

Equipment is of nominal or no value. The City does not anticipate receiving funds for the disposal of this equipment. There will be no surplus funds derived from this surplus and has no impact to the General Fund.

Background and Analysis:

The City's Finance Department Staff is required to present to the City Council the City of lrwindale's annual financial statements and results of the financial audit for the fiscal year ended June 30, 2022. The statements are referred to collectively as an Annual Comprehensive Financial Report (ACFR). The format and content requirements for ACFRs are set forth in guidelines developed by the Government Finance Officers Association of the United States and Canada (GFOA) and the California Society of Municipal Finance Officers (CSMFO).

The ACFR is comprised of three (3) major sections as follows:
~ The Introductory Section includes:
• The Letter of Transmittal
• A List Principal City Officials at fiscal year-end
• An Organization Chart at fiscal year-end
• A copy of the GFOA Award received for Excellence in Financial Reporting for the prior year's ACFR.
~ The Financial Section includes:
• The Independent Auditors' Report
• Management's Discussion and Analysis Report (MD&A)
• Financial Statements
• Notes to the Financial Statements
• Required Supplementary Information
~ The Statistical Section includes:
• Financial Trend information
• Revenue Trend Information
• Debt Capacity
• Demographic and Operating Information
The financial statements were audited by the independent public accounting firm of Lance, Soll & Lunghard, LLP, Certified Public Accountants, whose unmodified opinion is included within the financial section of the report. An unmodified opinion indicates that the financial statements present fairly the financial position of the City of Irwindale as of June 30, 2022, and the results of operations are in accordance with generally accepted accounting principles (GAAP).

The audited financial statements are for the City of Irwindale, which is the primary government, and for the component entities of the Irwindale Housing Authority, Irwindale Reclamation Authority, and the City of Irwindale as Successor Agency of the former Irwindale Community Redevelopment Agency.

As part of the audit, the auditors also reviewed and performed tests of the City's internal control procedures to determine if there are any deficiencies or instances of noncompliance. The results of these tests confirmed the City of Irwindale is in compliance with Page2
government auditing standards and no deficiencies were identified in the City's internal control structure.

Supplemental Audit Letters attached as part of the ACFR packet provide more detailed information regarding these results, and they include the following three supplemental Audit Letters:
~ The Audit Communication Letter
~ The Independent Auditors' Report on Internal Control over Financial Reporting and on Compliance and Other Matters based on an Audit of Financial Statements Performed in Accordance with Government Auditing Standards
~ The Independent Accountants' Report on Agreed-Upon Procedures Applied to Appropriations Limit Worksheets
The City of Irwindale ACFR for the fiscal year ended June 30, 2022, is available for review in the City Clerk's Office, the Irwindale Library, or the Finance Department. In addition, the ACFR is distributed to all City Council Members, various federal and state government agencies, rating agencies and financial institutions, and is also made available on the City of Irwindale website for interested citizens.

Fiscal Impact:

The Annual Comprehensive Financial Report summarizes the financial position of the City of Irwindale, and its component units, as of June 30, 2022. There is no fiscal impact to approve the financial statements.

To the Honorable Mayor and Members of the City Council
City of Irwindale, California
We have audited the financial statements of the governmental activities, each major fund, and the aggregate remaining fund information of the City of Irwindale, California (the City) for the year ended June 30, 2022. Professional standards require that we provide you with information about our responsibilities under generally accepted auditing standards, Government Auditing Standards, and the Uniform Guidance, as well as certain information related to the planned scope and timing of our audit. We have communicated such information in our letter to you dated May 6, 2022. Professional standards also require that we communicate to you the following information related to our audit.

Significant Audit Matters
Qualitative Aspects of Significant Accounting Practices Management is responsible for the selection and use of appropriate accounting policies. The significant accounting policies used by the City are described in Note 1 to the financial statements. As described in Note 4 to the financial statements, the City changed its accounting policies related to leases by adopting Statement of Governmental Accounting Standards (GASB Statement) No. 87, Leases. Accordingly, the cumulative effect of the accounting change as of the beginning of the year is reported in the Statement of Net Position. All significant transactions have been recognized in the financial statements in the proper period.

Accounting estimates are an integral part of the financial statements prepared by management and are based on management’s knowledge and experience about past and current events and assumptions about future events. Certain accounting estimates are particularly sensitive because of their significance to the financial statements and because of the possibility that future events affecting them may differ significantly from those expected. The most sensitive estimates affecting the City’s financial statements were management’s estimates of its net pension liability/asset and net other post-employment benefits asset based on actuarial valuation specialist assumptions. We evaluated the key factors and assumptions used to develop the net pension liability/asset and net other post-employment benefits asset in determining that they are reasonable in relation to the financial statements taken as a whole.

The financial statement disclosures are neutral, consistent, and clear.

Significant or Unusual Transactions
Management is responsible for the policies and practices used to account for significant or unusual transactions. No significant unusual transactions have occurred during fiscal year 2021-2022.

Difficulties Encountered in Performing the Audit
We encountered no significant difficulties in dealing with management in performing and completing our audit.

To the Honorable Mayor and Members of the City Council
City of Irwindale, California
Corrected and Uncorrected Misstatements
Professional standards require us to accumulate all known and likely misstatements identified during the audit, other than those that are trivial, and communicate them to the appropriate level of management. We are pleased to report that no such misstatements were identified during the course of our audit.

Disagreements with Management
For purposes of this letter, a disagreement with management is a financial accounting, reporting, or auditing matter, whether or not resolved to our satisfaction, that could be significant to the financial statements or the auditor’s report. We are pleased to report that no such disagreements arose during the course of our audit.

Management Representations
We have requested certain representations from management that are included in the management representation letter dated January 19, 2023.

Management Consultations with Other Independent Accountants In some cases, management may decide to consult with other accountants about auditing and accounting matters, similar to obtaining a “second opinion” on certain situations. If a consultation involves application of an accounting principle to the City’s financial statements or a determination of the type of auditor’s opinion that may be expressed on those statements, our professional standards require the consulting accountant to check with us to determine that the consultant has all the relevant facts. To our knowledge, there were no such consultations with other accountants.

Other Audit Findings or Issues
We generally discuss a variety of matters, including the significant events or transactions that occurred during the year, business conditions affecting the City and business plans and strategies that may affect the risks of material misstatements, the application of accounting principles and auditing standards, with management each year prior to retention as the City’s auditors. However, these discussions occurred in the normal course of our professional relationship and our responses were not a condition to our retention.

Other Matters
We applied certain limited procedures to the management’s discussion and analysis, the budgetary comparison schedules for the General Fund and major special revenue funds, and the required pension and other post-employment benefits schedules, as listed in the Annual Comprehensive Financial Report’s table of contents, which are required supplementary information (RSI) that supplements the basic financial statements. Our procedures consisted of inquiries of management regarding the methods of preparing the information and comparing the information for consistency with management’s responses to our inquiries, the basic financial statements, and other knowledge we obtained during our audit of the basic financial statements. We did not audit the RSI and do not express an opinion or provide any assurance on the RSI.

We were engaged to report on combining statements and individual nonmajor fund statements and schedules, which accompany the financial statements but are not RSI. With respect to this supplementary information, we made certain inquiries of management and evaluated the form, content, and methods of preparing the information to determine that the information complies with accounting principles generally accepted in the United States of America, the method of preparing it has not changed from the prior period, and the information is appropriate and complete in relation to our audit of the financial statements. We compared and reconciled the supplementary information to the underlying accounting records used to prepare the financial statements or to the financial statements themselves.

To the Honorable Mayor and Members of the City Council
City of Irwindale, California
We were not engaged to report on the introductory and statistical section, which accompany the financial statements but are not RSI. Such information has not been subjected to the auditing procedures applied in the audit of the basic financial statements, and accordingly, we do not express an opinion or provide any assurance on it.

The following new Governmental Accounting Standards Board (GASB) pronouncements were effective for fiscal year 2021-2022 audit:

GASB Statement No. 87, Leases.

GASB Statement No. 89, Accounting for Interest Cost Incurred before the End of a Construction Period.

GASB Statement No. 97, Certain Component Unit Criteria, and Accounting and Financial Reporting for Internal Revenue Code Section 457 Deferred Compensation Plans.

The following GASB pronouncements are effective in the following fiscal years’ audits and should be reviewed for proper implementation by management:

Fiscal year 2022-23
GASB Statement No. 91, Conduit Debt Obligations.

GASB Statement No. 94, Public-Private and Public-Public Partnerships and Availability Payment Arrangement.

GASB Statement No. 96, Subscription-Based Information Technology Arrangements.

Fiscal year 2022-24
GASB Statement No. 99, Omnibus 2022.

Very truly yours,
Brea, California

Lance, Soll & Lunghard, LLP 203 N. Brea Blvd., Suite 203 Brea,CA92821 Phone: 714.672.0022 INDEPENDENT AUDITORS’ REPORT ON INTERNAL CONTROL

OVER FINANCIAL REPORTING AND ON COMPLIANCE AND OTHER MATTERS

BASED ON AN AUDIT OF FINANCIAL STATEMENTS PERFORMED IN ACCORDANCE

WITH GOVERNMENT AUDITING STANDARDS
To the Honorable Mayor and Members of the City Council
City of Irwindale, California
We have audited, in accordance with the auditing standards generally accepted in the United States of America and the standards applicable to financial audits contained in Government Auditing Standards issued by the Comptroller General of the United States, the financial statements of the City of Irwindale (the City) for the year ended June 30, 2022, and the related notes to the financial statements, which collectively comprise the City’s basic financial statements, and have issued our report thereon dated January 19, 2023.

Report on Internal Control over Financial Reporting
In planning and performing our audit of the financial statements, we considered the City’s internal control over financial reporting (internal control) as a basis for designing audit procedures that are appropriate in the circumstances for the purpose of expressing our opinions on the financial statements, but not for the purpose of expressing an opinion on the effectiveness of the City’s internal control. Accordingly, we do not express an opinion on the effectiveness of the City’s internal control.

A deficiency in internal control exists when the design or operation of a control does not allow management or employees, in the normal course of performing their assigned functions, to prevent, or detect and correct, misstatements, on a timely basis. A material weakness is a deficiency, or a combination of deficiencies, in internal control, such that there is a reasonable possibility that a material misstatement of the City’s financial statements will not be prevented, or detected and corrected, on a timely basis. A significant deficiency is a deficiency, or a combination of deficiencies, in internal control that is less severe than a material weakness, yet important enough to merit attention by those charged with governance.

Our consideration of internal control was for the limited purpose described in the first paragraph of this section and was not designed to identify all deficiencies in internal control that might be material weaknesses or, significant deficiencies. Given these limitations, during our audit we did not identify any deficiencies in internal control that we consider to be material weaknesses. However, material weaknesses or significant deficiencies may exist that were not identified.

Report on Compliance and Other Matters
As part of obtaining reasonable assurance about whether the City’s financial statements are free from material misstatement, we performed tests of its compliance with certain provisions of laws, regulations, contracts, and grant agreements, noncompliance with which could have a direct and material effect on the financial statements. However, providing an opinion on compliance with those provisions was not an objective of our audit, and accordingly, we do not express such an opinion. The results of our tests disclosed no instances of noncompliance or other matters that are required to be reported under Government Auditing Standards.

To the Honorable Mayor and Members of the City Council
City of Irwindale, California
Purpose of this Report
The purpose of this report is solely to describe the scope of our testing of internal control and compliance and the results of that testing, and not to provide an opinion on the effectiveness of the City’s internal control or on compliance. This report is an integral part of an audit performed in accordance with Government Auditing Standards in considering the City’s internal control and compliance. Accordingly, this communication is not suitable for any other purpose.

PROCEDURES APPLIED TO APPROPRIATIONS LIMIT WORKSHEETS
To the Honorable Mayor and Members of the City Council
City of Irwindale, California
We have performed the procedures enumerated below on the accompanying Appropriations Limit Worksheet No. 6 (or other alternative computation) of the City of Irwindale, California (the “City”), for the year ended June 30, 2022. These procedures are the responsibility of the City, which were agreed to by the City and the League of California Cities (as presented in the publication entitled Agreed-Upon Procedures Applied to the Appropriations Limitation Prescribed by Article XIII-B of the California Constitution), were performed solely to assist the City in meeting the requirements of Section 1.5 of Article XIII-B of the California Constitution. The City's management is responsible for the Appropriations Limit Worksheet No. 6 (or other alternative computation).

The City has agreed to and acknowledged that the procedures performed are appropriate to meet the intended purpose of recomputing the Appropriations Limit Worksheet No. 6 (or other alternative computation). This report may not be suitable for any other purpose. The procedures performed may not address all the items of interest to a user of this report and may not meet the needs of all users of this report and, as such, users are responsible for determining whether the procedures performed are appropriate for their purposes.

The procedures performed and our findings were as follows:

1. We obtained the completed Worksheets No. 1 through No. 7 (or other alternative computations) and compared the limit and annual adjustment factors included in those worksheets to the limit and annual adjustment factors that were adopted by resolution of the City Council. We also compared the population and inflation options included in the aforementioned worksheets to those that were selected by a recorded vote of the City Council.

Finding: No exceptions were noted as a result of our procedures.

2. For the accompanying Appropriations Limit Worksheet No. 6, we multiplied line A, last year's limit, by line D, ratio of change and compared the resulting amount to line E, this year's limit.

Finding: No exceptions were noted as a result of our procedures.

3. We compared the current year information presented in the accompanying Appropriations Limit Worksheet No. 6 to the other worksheets described in No. 1 above.

Finding: No exceptions were noted as a result of our procedures.

4. We compared the prior year appropriations limit presented in the accompanying Appropriations Limit Worksheet No. 6 to the prior year appropriations limit adopted by the City Council for the prior year.

Finding: No exceptions were noted as a result of our procedures.

To the Honorable Mayor and Members of the City Council
City of Irwindale, California
We were engaged by the City to perform this agreed-upon procedures engagement and conducted our engagement in accordance with attestation standards established by the AICPA. We were not engaged to and did not conduct an examination or review engagement, the objective of which would be the expression of an opinion or conclusion, respectively, on the accompanying Appropriations Limit Worksheet No. 6 (or other alternative computation). What are the reasons for wanting to serve on the Irwindale community foundation? As long-time resident of Irwindale I have wanted to give back and server the community that has giving so much to me and my family. Being part of the Irwindale Community Foundation would allow me to serve the needs of my community and help support to enhance the quality of life for the Irwindale community now and in .the future.

Why do you feel that you would make a good Foundation Member? As a long time, Irwindale resident, I have had the opportunity to volunteer multiple years as a flag football coach at the Dan Diaz Recreation Center, which allowed me to get to know our youth and help mentor them to develop good sportsmanship and a competitive nature. Most recently I have had the opportunity to partner with the Kid Zone summer programs by donation ice cream, via my employer Dreyer's Ice Cream, in an effort to raise funds for future Kid Zone activities.

The past 17 years my employers Nestle I Dreyer's ice cream have exposed me to multiple fundraising functions and networking events which would help with reaching out to local businesses or organizations in an effort to allocate monetary donations for Irwindale Community Foundations.

Abilities, experiences, and interest which you believe would contribute to your participation in municipal non-profit organization.

In October 2022, then Mayor Burrola established an Ad Hoc Committee, including then Mayor Burrola and Mayor Pro Tern Ambriz, to discuss the display of military flags at the City's Veterans Monument (Project). On January 31, 2023, the Ad Hoc Committee held a meeting to solicit input from the community regarding the Project. The following comments were received:

Page 1 ends

1. Display of flags for the six (6) military branches (listed in order of precedence):

Army, Marine Corps, Navy, Air Force, Space Force, and Coast Guard.

2. Flag poles heights: approximately 20' - 25', with the height to be determined by the architect retained to design the Project to complement the existing Veterans Monument.

3. Layout and space between flags: approximately 3' between flags, with the space to be determined by the architect retained to design the Project. The desire is to provide adequate spacing between the flags and provide the greatest visibility of the flag display. Additionally, the flags may be displayed in a straight line, semicircle, triangle, or some other layout that would complement the existing Veterans Monument.

4. Landscaping and lighting: lighting will be used to illuminate the flags. Staff is recommending that the lighting fixtures tie into the existing electrical connection to ensure that all of the flags illuminate at the same time and for the same duration.

Minor updates to landscaping may be required and the palm trees located immediately behind the Veterans Monument may need to be removed.

Additionally, the Ad Hoc Committee also discussed the timing of the Project, with the desire to have the Project completed in time for this year's Veterans Day event, scheduled for Saturday, November 11, 2023.

Based on the Ad Hoc Committee's meeting, below are options for the City Council to consider:

1. Provide additional input on the Project.

2. Direct staff to proceed with obtaining quotes from architects to design the project, incorporating the comments received from the Ad Hoc Committee. Staff anticipates reporting back to the City Council in March to request an appropriation of funds to retain the Project architect.

3. Provide other direction to staff.

Honorable Mayor and Members of the City Council
Julian A. Miranda, City Manager
Issue: Regulation of Unmanned Aircraft Systems (UAS)/Drones City Manager's Recommendation:

Discuss and provide direction regarding regulation of Unmanned Aircraft Systems (UAS)/Drones
Administrative Action:

Prepared and Submitted by:

Adrian Guerra, City Attorney Electronically Approved
Reviewed by:

Theresa Olivares, Assistant City Manager

Approved by:

Julian A. Miranda, City Manager Electronically Approved DISCUSSION:

Previously, the City Council requested that the City Attorney provide guidance and information as to the City's authority to regulate unmanned aircraft systems ("UAS"), better known as "drones," within City boundaries.

Federal Regulation
The Federal Aviation Administration ("FAA") is authorized by federal law to regulate the use of "navigable airspace" to ensure the safety of aircraft and the efficient use of airspace. (49 U.S.C. § 40103(b)(1).) In plain language, the FAA has stated that it is "responsible for air safety from the ground up." This authorization includes the ability to regulate drones.

The FAA takes the position that federal drone law preempts all local regulation of drones while in the air. The current extent of federal preemption of local regulation of drone operations is very unclear. Although no court has definitively decided the issue, most local regulation of drones while in the air is likely preempted.

State Regulation
Because the FAA asserts that it preempts all local regulations, lawmakers are currently grappling over the best way to balance federal and local control over drones. The State of California has regulated drones in areas concerning trespass, privacy, and interference with emergency vehicles/response.

Civil Code section 1708.8 makes it an invasion of privacy to knowingly enter the land or airspace above the land of another person without permission in order to capture any type of visual image, sound recording, or other physical impression of a person engaging in a private, personal, or familial activity, if the invasion occurs in a manner that is offensive to a reasonable person, including through the use of a drone.

The Peeping Tom law, Penal Code section 647U)(1), makes it a misdemeanor to view someone with a camera, video recorder, or other instrumentality in the interior of any area (including a bedroom or bathroom) in which the person has a reasonable expectation of privacy, with the intent to invade the privacy of the person. This law explicitly extends to the use of an "unmanned aircraft system." Residents generally have a reasonable expectation of privacy while in their backyard, so long as the backyard is not visible from ground level (e.g., because of fences) or from neighboring homes or other vantages.

However, whether a specific resident has a reasonable expectation of privacy is based on the specific facts of the case.

Penal Code section 402 makes it a misdemeanor for a person to impede emergency personnel or military personnel in the performance of their duties in coping with an emergency, unless it is part of that person's employment duties to view the scene or the activities. This law includes in the definition of "person" any person who is operating a drone, regardless of their location.

Civil Code section 43.101 makes emergency responders, public entities, and public employees immune from liability for damage to an unmanned aircraft if such person or entity was providing emergency services and the unmanned aircraft was interfering with the emergency services.
01005.0001/855881.1
In addition to state law explicitly aimed at drone use, any state law prohibiting conduct that would endanger a person or property would also likely apply to conduct committed by using a drone. This may authorize law enforcement actions against drones and drone operators to prevent imminent loss of life, bodily injury, etc.

Finally, state civil trespass laws could also potentially apply to a trespass committed with a drone.

These provisions likely address the concerns that a city may have about privacy protections. Moreover, a local ordinance criminalizing an invasion of privacy would likely be preempted by the Penal Code.

Local Regulation
Cities have generally had very limited options for regulation of drones. The City may adopt regulations consistent with its police powers, which includes regulations aimed at promoting public health, public morals, and public safety, and includes land use regulations. Based on the Council's direction, Staff and the City Attorney's office have surveyed Southern California Cities1 that have adopted an ordinance regulating drones and they all appear to be similar in nature and include prohibitions on the following:
• Prohibits operation in a manner that interferes with first responders, manned aircraft, and shall always give way to the same. • Prohibits operation of drones beyond the natural visual line of sight of the person it.
• Prohibits operation other than during daylight hours, as defined. • Prohibits operation more than 400 feet above the earth's surface. • Prohibits operation closer than 25 feet to any individual, except the operator or the operator's helper( s).
• Prohibits any violation of state or federal regulations • Prohibits operation in a careless or reckless manner so as to endanger the life or property of another.
• Prohibits operation within a certain amount of distance between an airport, school, or special or government event.
• Some cities require persons who desire to operate a drone within the city to first obtain a permit through the City and register the drone. • Most exempt local government, emergency response, and/or military operation of drones from regulation.

It should be noted that that some of these regulations are likely preempted by, and/or conflict with, federal and state law and would likely be struck down if challenged in court.

In order to avoid a challenge to any regulation of drones, the best option for local 1 Staff was able to identify ordinances adopted by the cities of Los Alamitos, Yorba Linda, Calabasas, Hermosa Beach, Barstow, Beverly Hills, Los Angeles, and Pasadena 01005.0001/855881.1
regulation is through the City's power to regulate land use. In light of these limitations, the best way for the City to regulate drones is as follows:
(1) Do nothing and wait until the law is more settled in this area. Federal and state regulations, and existing City ordinances, will still apply including the above-mentioned areas of invasion of privacy, and trespass and interference with emergency vehicles/response.
(2) Enact regulations limiting the times and locations in the City where drones can take off and land, as authorized by the City's broad powers to regulate land use.
(a) Specifically, the City could limit the times and locations within the City where drones can take off and land, just as airplanes are limited as to where they can take off and land. Such regulations would place a practical limit on the areas in the City were drones can fly since commercial and hobby drones can only be flown within the unaided visual line of sight of the drone operator (unless the operator has a waiver). (14 C.F.R. § 107.31; Public Law No. 112-95 § 336(c)(2).) (3) Collaborate with and support local law enforcement, including the Irwindale Police Department, in the enforcement of existing state laws that are applicable to drones, including laws prohibiting trespassing and invasion of privacy interference with emergency vehicles/response.

It is therefore recommended that the City Council discuss, and provide direction regarding any regulation of UAS/Drones.

Background and Analysis:

Cities adopt a legislative Platform ("Platform") to efficiently administer responses to legislative proposals. The proposed Legislative Platform identifies issues deemed important to the City, and upon City Council approval will enable staff to proactively engage in the legislative process and respond to issues in a timely manner.

The Legislative Platform is a guide to process urgent requests in support, against or neutral position on legislative proposals. The proposed Legislative Platform is drafted using the guiding priorities of the City Council, as established in the City's Goals and Objectives. Once adopted, the Legislative Platform remains in effect for the duration of the legislative cycles. The City Council may add, remove, or modify items during the biannual Legislative Platform update.

Every two years, the City Manager's Office will submit an agenda report to the City Council regarding its proposed state and federal priorities, establishing the basis for the two upcoming legislative cycles. Legislative issues impacting the city that are not addressed in the Legislative Platform will be placed on an agenda for the City Council's direction.

Upon adoption of the Legislative Platform, the City Manager's Office will continue to exercise day-to-day oversight of legislative matters. In addition to coordinating formal action through the City Council, the City Manager (or designee) will administer the City's Legislative Platform by carrying out the following functions:
• Work with Department Heads/Managers to identify matters of legislative importance and develop positions on federal and state legislative proposals and general matters of legislative interest.
• Communicate important legislative matters to the City Council through periodic updates, and identify and coordinate positions for formal action by the City Council. • Review positions and analysis done by the League of California Cities, National League of Cities, the City's legislative advocate, and local government/professional associations in formulating positions. • Monitor and track key bills through the legislative process utilizing the City's advocacy services, legislative websites, and government/professional associations.
• Communicate the City's positions to federal, state, and county legislators. • Participate as needed in the drafting and amending of legislative proposals that significantly impact the City.
• Work with the League of California Cities, National League of Cities, legislative advocate, other cities and local government/professional associations on legislative matters of mutual concern.
• Participate and attend legislative briefings and meetings to actively engage and stay apprised of legislative trends and upcoming legislation.

Under the proposed Legislative Platform, responses to legislative proposals will be processed as follows:

1. Once a determination has been made that a legislative proposal may impact the City and is identified on the approved Legislative Platform, a letter outlining the City's positon (support/neutral/opposition) will be reviewed, approved and signed by the Mayor, Mayor Pro Tern in the absence of the Mayor, or City Manager (1) in absence of the Mayor and Mayor Pro Tern; or (2) when time is of the essence.

2. If a determination is made that a legislative proposal may impact the City and is not identified on the approved Legislative Platform, a letter outlining the City's position (support/neutral/opposition) will be prepared and presented for City Council review and approval.

Page2
a. The draft letter will be presented to the City Council at a public meeting for approval/revisions.
b. Upon approval, the letter may be signed by Mayor, Mayor Pro Tern in absence of Mayor, or City Manager (1) in absence of the Mayor and Mayor Pro Tern; or (2) when time is of the essence.

3. The final position letter will be forwarded to the bill's author, the League of California Cities, the City's legislative advocate; and other stakeholders as deemed appropriate.

4. A copy of the final letter will be distributed to the City Council.

Staff is therefore recommending that the City Council adopt the 2023 through 2024 Legislative Platform.

Fiscal Impact:

There is no fiscal impact associated with the adoption of a Legislative Platform.

Legislative Platform
2023-2024
The objective of the Legislative Platform for the City of Irwindale is to adopt official City positions on specific legislative issues at the start of the legislative session. The Legislative Platform's streamline approval process provides staff with clear direction on pertinent legislative issues.

The Legislative Platform is developed and maintained using the goals and objectives adopted by the Irwindale City Council, a review of legislative priorities from the League of California Cities, National League of Cities, input from the Council and staff, the City's legislative advocate, research of current law and pending legislation, as well as discussion with local legislative staff and the City's legal counsel.

Federal and state legislative proposals and policies consistent with the legislative priorities may be supported by the City. Those policies or proposals inconsistent with this platform may be opposed by the City.

For proposed legislation, either consistent with the City's legislative priorities or consistent with legislative positions the City has taken in the past; City staff shall be authorized to prepare position letters for the Mayor's signature. Items not addressed in the City's legislative priorities will require Council direction, and staff will submit a request to Council.

Legislative priorities may only address issues directly relevant to or impacting the provision of municipal services.

City departments are encouraged to monitor and be knowledgeable of any legislative issues related to their discipline. However, any requests for the City to take positions on a legislative matter must be directed to the City Manager's Office. City departments may not take positions on legislative issues without City Manager's Office review and approval.

The process for responding to legislative proposals is streamlined as follows:

1. Once a determination has been made that a legislative proposal may impact the City and is identified on the approved Legislative Platform, a letter outlining the City's positon (support/neutral/opposition) will be reviewed, approved and signed by the Mayor, Mayor Pro Tern in the absence of the Mayor, or City Manager ( 1) in absence of the Mayor and Mayor Pro Tern; or (2) when time is of the essence.

2. If a determination is made that a legislative proposal may impact the City and is not identified on the approved Legislative Platform, a letter outlining the City's position 2023-2024 Legislative Platform Page 2of14
(support/neutral/opposition) will be prepared and presented for City Council review and approval.
