REGULATION OF DRONES IN OTHER CALIFORNIA CITIES

SYSTEMS ( UAS) 1

DRONES IN OTHER

CALIFORNIA CITIES
CITY COUNCIL MINUTES MARCH S, 2023
REGULAR MEETING PAGE 6
CITY ATTORNEY City Attorney Guerra presented the staff report.

GUERRA
COUNCILMEMBER Councilmember Breceda stated that Mr. Hartman commented on this BRECEDA matter at the previous meeting, and that he noted that the FAA already has strict requirements regarding drone operations. He questioned the need for this report.

CITY ATTORNEY City Attorney Guerra noted that the report simply included samples of GUERRA ordinances adopted by other cities relating to drones and indicated that the Council could choose the provisions that they would like to include in their own ordinance.

MAYOR ORTIZ Mayor Ortiz stated that some cities have implemented ordinances to protect the privacy of residents, which is the same objective he is attempting to accomplish.

ROBERT HARTMAN Robert Hartman stated that he read through all the ordinances in the staff report and noted that each provision is already covered under FAA regulations.

MAYOR PRO TEM Mayor Pro Tern Ambriz suggested adopting an ordinance that adopts AMBRIZ FAA and state regulations, while simultaneously protecting residents' privacy, and disagreed with Mr. Hartman that the provisions of the ordinances are covered by FAA regulations. He further stated that the cities of Calabasas, Chula Vista, Lake Forest, Oxnard, and Yorba Linda have ordinances that seem to achieve the results that Irwindale is interested in and stressed the need to develop a local ordinance regarding the proper usage of drones.

COUNCILMEMBER Councilmember Burrola stated that the listed cities adopted BURROLA ordinances for a reason and requested that a report be prepared detailing the options available to the city.

MAYOR ORTIZ Mayor Ortiz stated that the ordinance would be adopted in order to protect residents from a nuisance, and noted that the ordinance from Barstow seems to include provisions that could be applied to Irwindale. He stressed that the only drones that should be permitted to be operated would be for emergency personnel or for commercial uses, if operated with a permit. However, individuals that wish to fly recreational drones would have to find alternative locations other than in residential areas.

CITY ATTORNEY City Attorney Guerra stated his understanding that the Council would GUERRA like for him to prepare an ordinance based on a compilation of the ordinances from Calabasas, Chula Vista, Lake Forest, Oxnard, Yorba Linda, and Barstow, and to potentially allow drone usage for emergency personnel and commercial drones, if by permit. He added that, although he would prepare the ordinance as directed, he is concerned that it would be preempted by federal law.

MAYOR ORTIZ Mayor Ortiz also requested that the ordinance include a declaration that the city abides by FAA regulations, but that the intent of the ordinance is to protect residents' privacy.

COUNCILMEMBER Councilmember Breceda stated that he is in favor of the security of BRECEDA the residents but questioned the need to prohibit recreational drones that individuals enjoy as a hobby. He stated that he cannot support the request to prepare an ordinance prohibiting recreational drones at this time.

CITY MANAGER City Manager Miranda noted that city staff owns and operates a drone MIRANDA for various city functions, and that the Council should consider this fact when considering the adoption of the ordinance.

MAYOR ORTIZ Mayor Ortiz suggested that the ordinance also reflect that the drone operated for governmental purposes would be permissible.

COUNCILMEMBER Councilmember Breceda opposed restricting the ability of individuals BRECEDA to operate recreational drones as a hobby.

MAYOR ORTIZ Mayor Ortiz stated that the City Attorney has received direction from the Council on the matter.

ROBERT HARTMAN Robert Hartman stated that the city would be in violation of FAA regulations if it operates a drone for any type of commercial uses, including publishing photos.

PUBLIC HEARING

REGARDING

PROPOSED

INCREASES TO

EXISTING SOLID

WASTE RATES
DIRECTOR RODRIGUEZ Director Rodriguez presented the staff report.

CITY COUNCIL MINUTES MARCH 8, 2023
REGULAR MEETING PAGE 9
OPEN At 9: 16 p. m., Mayor Ortiz opened the public hearing.

PUBLIC HEARING
ROBERT DIAZ Robert Diaz spoke in opposition to the proposed increases to existing solid waste rates, suggested negotiating 5- year agreements with haulers, stated his belief that the city would be paying for trash pickup, and asked whether the city has received $ 1 million from Athens.

DIRECTOR RODRIGUEZ Responding to comments and questions by Robert Diaz, Director Rodriguez advised that neither the city nor residents are paying for trash services, and that Athens is incurring all costs of the service.

Staff recommends moving forward with base service for residents to try for one month, after which city and Athens personnel would meet with residents to determine whether additional services are required.

She added that automatically providing every household a 4t" bin would cause parking issues. Additionally, the $ 1 million that Mr. Diaz referenced relates to the MRF project, which is separate from this issue.

Responding to a question by Director Rodriguez, Chief Deputy City Clerk Nieto advised that 45 formal, written protests have been received.

MAYOR ORTIZ Mayor Ortiz noted that this amount is much lower than the amount necessary to meet the cancellation threshold.

CLOSE There being no additional speakers, Mayor Ortiz closed the public PUBLIC HEARING hearing at 9: 27 p. m.

COUNCILMEMBER Councilmember Burrola wondered whether Athens could help BURROLA alleviate street parking issues by picking up each of the three different bins on separate days. He also asked about the costs of the service.

DIRECTOR RODRIGUEZ Director Rodriguez noted that picking up one bin per day for three days would cause the need for residents to remember which bin to leave at the curb for each of those days. She reiterated that the base service is free and that neither the city nor the residents would pay for it, nor have they paid for the services since 2019. This proposal would provide these no -cost services until 2032.

MAYOR PRO TEM Mayor Pro Tern Ambriz reiterated details included in the staff report AMBRIZ and discussed the various benefits residents have already received from the city's partnership with Athens.

RESOLUTION NO. A motion was made by Mayor Pro Tern Ambriz to adopt Resolution 2023- 21- 3399 No. 2023- 21- 3399, entitled:

COUNCILMEMBER Councilmember Breceda concurred and noted that all city residents BRECEDA and businesses had the opportunity to submit a formal protest, but the city only received 45 such protests. He agreed that contracts should be made " bulletproof," but stated that he was comfortable with the proposal as -is.

COUNCILMEMBER Councilmember Burrola asked about the status of the litigation from BURROLA the City of Oakland with regard to Proposition 218, which Director Rodriguez elaborated on.

COUNCILMEMBER Councilmember Breceda asked whether additional time could be BRECEDA given to this matter, to which Director Rodriguez indicated that staff needs to know Council' s direction before instructing Athens to proceed with the service implementation and stated that CalRecycle could fine the city if it does not have its organic waste program in place by January 1, 2024,
MAYOR ORTIZ Mayor Ortiz stated that the city would benefit from the approval of the proposed resolution since it would increase revenues.

COUNCILMEMBER Councilmember Breceda seconded Mayor Pro Tern Ambriz' s motion.

BRECEDA
COUNCILMEMBER Councilmember Burrola stated his preference in waiting to determine BURROLA whether Athens could pick up each of the three bins on different days before he votes on the matter, to which Director Rodriguez explained that, under the proposal, the blue and green bins would be emptied first, followed by the trash bin later on.

REOPEN At 9: 52 p. m., Mayor Ortiz reopened the public hearing.

PUBLIC HEARING
ELIZABETH RAMIREZ Elizabeth Ramirez with Athens Services, stated that Athens would look into the request. However, the challenge in pickup up bins on multiple days would be its negative effect on efficiency and additional costs. She added that the request could be discussed and negotiated, through it is not a service that Athens typically provides.

MAYOR PRO TEM Mayor Pro Tern Ambriz stated that he maintained his motion as he AMBRIZ does not feel that the matter should be delayed.
