Carmen Roman complained that machinery was parked in a handicap parking stall, stated that it was "unconstitutional" for the Council to pass laws, requested additional time so that she can read an email she sent to staff, and requested an audit of the affidavits submitted to the city as part of the Resident ID program.
City Manager Miranda advised that the Council has just approved the revision of the Resident ID affidavits to allow relatives of residents to fill out the affidavits.
Veronica Barbosa complained that the Housing Authority would not convene for a meeting tonight, and alleged that the city has harmed seniors by not complying with federal, state, and county laws for seniors and the homeless. She alleged that the applicant ranking list used for Las Casitas Senior Apartments contained errors and conflicts of interest.
Gary Breceda stated that his father, Raymond Breceda, has been abused by Rosalva Solaria Breceda, and requested criminal prosecution for Mrs. Breceda's filing of a falsified quitclaim deed to his father's property.
Ralph Galvan, representing the Valley County Water Board, invited all to an upcoming "Water Awareness Day Celebration" to be held on May5.

Anthony Naranjo stated that this issue was brought up by residents, and not by the Council. He stated his concern with residents hanging clothes on fences of adjacent properties or street-facing properties instead of clotheslines.
Director Simpson stated that the Community Development
Department received a question several months ago regarding clothing hung to dry on a shared wall or fence. Staff researched the Municipal Code and found no provisions that address the concern.
Staff conducted additional research of nearby cities, and the results are included in the staff report.
An online individual identified as "Megz" stated that she refused to dry her clothes in a clothes dryer, complained about the time limit set for individuals to speak at public meetings, made a vague threat for a lawsuit, requested that she be removed from the city's Resident ID Program insurers, and stated that the city should eliminate the program altogether.
Robert Escovedo stated that he has an issue with clothes hanging on fences, and not clothes hung on a clothesline. He spoke on the difficulties he has experienced speaking to his neighbors regarding his concerns.
Mayor Pro Tern Ambriz stated that clothes hung on clotheslines are fine, but clothes hung on fences, trees, and shrubbery, or in the front yard, should be considered a public nuisance.
Responding to a question by Councilmember Burrola, Senior Code Enforcement Officer Tyler advised that Code Enforcement Officer Silva spoke to residents that hung their clothes on their neighbors' fence. He added that the resident is aware that the complaint is a civil issue.
Councilmember Burrola noted that he receives complaints about trees overhanging on properties and stated that it is up to the property owners to be good neighbors and stated his opposition to enacting any additional prohibitions.
Responding to a question by Councilmember Burrola, Senior Code Enforcement Officer Tyler indicated that the Municipal Code does not authorize him to issue fines for hanging clothes in inappropriate areas.
Director Simpson added that these concerns are civil issues between property owners. Code Enforcement Officers make house visits as a courtesy but cannot compel anyone since there is no Municipal Code section they could cite.

Dena Zepeda spoke on her good experiences with Code
Enforcement. She added that if she wanted to hang clothes on her tree, she would do so.
Councilmember Breceda stated that hanging clothes in the back yard is fine, but it becomes a public nuisance when hanging in the front yard.
Councilmember Garcia made a motion to receive and file the report.
Carmen Roman complained that her neighbor's tree hangs over her patio and creates a mess. She asked that the tree be cut down. She also suggested that neighbors that take their disputes to civil court be fined.
Councilmember Burrola worried that enacting more regulations would cause more issues.
Mayor Pro Tern Ambriz stated that hanging clothes out to dry on another's property is a nuisance and spoke in favor clearly identifying nuisances in the Municipal Code so that Code Enforcement Officers have something they can work with when following up on residential complaints.
Responding to a comment by Mayor Ortiz, Director Simpson advised that, though the Municipal Code does not address this situation, Code Enforcement Officers visit residents as a courtesy when complaints are received. However, if the action taken by the resident does not violate the Municipal Code, the Code Enforcement Officers are unable to issue citations.
Mayor Ortiz concurred that these types of disputes should be settled neighbor-to-neighbor. He then asked City Attorney Guerra for input, to which he advised that any violation of the Municipal Code is deemed a nuisance. He suggested that the Council consider limiting hanging clothes in areas that are not visible to the public right of way, which seems to be the standard across most cities. Additionally, that any clothes being hung remain within the boundaries of the property without affecting a neighboring property. He stated that these would be the most that he would recommend implementing.
Mayor Pro Tern Ambriz felt that this matter should not just be received and filed and spoke in support of taking action. He recommended directing staff to prepare a report and take action at a future meeting to identify what constitutes a public nuisance.

Director Simpson indicated that Community Development staff could conduct further research and added that the Council should call staff if they have specific items that they would consider to be public nuisances. She added that additional information could be presented to the Council and noted that the Municipal Code contains a section identifying public nuisances.
City Attorney Guerra quoted Section 8.08.010 of the Irwindale Municipal Code and noted that the Code covers public nuisances.
Mayor Pro Tern Ambriz stated that the referenced Municipal Code section is sufficient for Code Enforcement to take appropriate action.
He concurred that the report should be received and filed.
Councilmember Breceda seconded Councilmember Garcia's motion.
Upon roll call, Councilmember Garcia's motion to receive and file the report was unanimously approved.
AGENDA FORMATTING OPTIONS
Chief Deputy City Clerk Nieto made a PowerPoint presentation and introduced the staff report.
Responding to a question by Mayor Ortiz, Chief Deputy City Clerk Nieto advised that the proposed formatting recommendations would consolidate agenda items and reduce the number of records created as a follow-up to actions taken at the meetings. She also noted that the change would also allow individuals to speak regarding matters of any of the convening agencies toward the beginning of the meeting, rather than having to wait until the end, for example, if they wished to speak on Housing Authority matters.
Dena Zepeda complained and stated her belief that the change would further limit her ability to speak at public meetings.
Megan Zepeda asked whether the Councilmembers would still receive pay for convening as other agencies and stated that individuals should still be allowed to speak on each item on the agenda.
Councilmember Burrola noted that individuals are occasionally confused about whether they are permitted to speak on certain matters due to the agencies convening at different times, and stated that the proposed change would likely eliminate this confusion.

Mayor Ortiz stated his belief that the agenda is fine the way it is currently being prepared, though he acknowledged that moving Spontaneous Communications after the Consent Calendar has caused a little confusion.
Mayor Pro Tern Ambriz expressed his opinion that only having one Spontaneous Communications would reduce the number of times that individuals may speak during a meeting. He agreed that the agenda should be left as-is.
A motion was made by Mayor Ortiz, seconded by Mayor Pro Tern Ambriz, to receive and file the report. The motion was unanimously approved.
DISCUSS POTENTIAL CHANGES TO THE INSTALLATION OF
DEDICATION PAVERS
Assistant City Manager Olivares made a PowerPoint presentation and introduced the staff report.
Responding to a question by Councilmember Garcia, Assistant City Manager Olivares advised that the current policy does not specify that a minimum amount of paver applications must be submitted before processing them. She noted that the quantity of paver applications has subsided from when the service was initially launched, and stated that the Council may, at its discretion, instruct staff to hold off on submitting applications until a certain number has been received.
Dena Zepeda stated that, due to the great price, most individuals will want to order large pavers, and asked whether there are sufficient for everybody.
Suzanne Gomez suggested potentially expanding the site of the Memorial Garden to accommodate more large pavers.
Mayor Pro Tern Ambriz stated that he liked the costs of the pavers and spoke in favor of updating the policy.
A motion was made by Mayor Pro Tern Ambriz, seconded by Councilmember Breceda, to amend the policy. The motion was unanimously approved.

Dena Zepeda asked whether residents will be provided free tickets to the Renaissance Pleasure Faire and requested to keep the old trash bins that Athens Services is scheduled to pick up.
City Manager Miranda indicated that free tickets were not offered but that staff would follow up. He added that the waste bins should be placed curbside for Athens Services to pick them up.
REQUEST BY COUNCILMEMBER BURROLA FOR DISCUSSION
CITY ATTORNEY FEES
Councilmember Burrola requested that the City Attorney fees be discussed in Closed Session at the next meeting.
Responding to a question by Councilmember Burrola, City Attorney Guerra clarified that a majority of the Council may vote to add an item to the agenda for the meeting that is already underway if it involves an emergency situation. However, in order to add a non-emergency item to the agenda for a meeting that is already underway, a 4/5 affirmative vote by the Council must be reached.
City Attorney Guerra noted a potential conflict of interest with this item and exited the Council Chambers at 8:52 p.m.
A motion was made by Councilmember Burrola, seconded by Councilmember Breceda, to add City Attorney Fees to the Closed Session portion of the next meeting's agenda. The motion was unanimously approved.
Mayor Ortiz noted overgrown vegetation at the property fronting Seaboard Envelope Company's building on Cypress Street and asked whether truck or trailer parking is permitted on the site, to which City Manager Miranda advised that Code Enforcement staff has contacted representatives of the company, who have confirmed that they are working on beautifying the area and cleaning debris.
Responding to a follow-up question by Mayor Ortiz, Code Enforcement Officer Tyler indicated that the site hosts multiple businesses, and that trucks visit the site to pick up and deliver merchandise. Staff will follow up with the businesses so that they remove the excess parked truck trailers.

Resolution Approving the Donation to the IEF
Background and Analysis:
The Irwindale Educational Foundation (IEF) is hosting its fundraiser to raise funds for educational scholarships to qualified Irwindale residents and employees and family members of businesses located within the city limits that are members of good standing of Irwindale Chamber of Commerce. On May 3, 2023, the City received a request for the use of one of the billboard displays in the City during the 2023/2024 fiscal year.
The City in past years has been supportive of this charitable organization and, in fact, has approved the use of one of the Clear Channel Communications' billboard faces that the City receives the right to use along the 210 and 605 Freeways for one month (estimated value of between $6,500 to $15,000 depending on the billboard) . The IEF uses the billboard to acknowledge sponsors of the event and to market the Foundation.
The education benefits provided by IEF serves an important public purpose insofar as it helps qualified individuals attain higher education, and thus become more informed and productive members of the community and, assisting members of the Irwindale community attain greater education levels tends to increase their earning potential, creating a likely economic benefit to Irwindale businesses, and consequently City revenues.
Fiscal Impact:
There is no loss of revenues to the City since the Agreement with Clear Channel or CBS Outdoor Inc. allows for City use of the billboard for specified periods of time.

Background and Analysis:
On April 27, 2023, the City received a claim for damages from claimant James Daly.
Claimant Daly alleges that a damaged roadway caused damage to the front driver's side suspension, including control arm, serpentine belt, thrust arm , stabilizer bar, and rear wheel rim of his vehicle. This occurred in the number one lane of Live Oak Avenue west bound east of the intersection with Myrtle Avenue and Peck Road.
The claim was reviewed by the City's claims adjuster, Carl Warren & Co., who has recommended the rejection of the claim on the basis that the damage was caused by an isolated pothole due to inclement weather, and the City did not have notice of the condition. Accordingly, staff is recommending that the City Council reject the claim and direct staff to send a standard letter of rejection. Alternatively, the City Council may direct the City Manager to negotiate resolution of the claim.
Fiscal Impact:

Background and Analysis:
The City of Irwindale ("City") receives banking services from Bank of the West ("BOW).
BOW has been the City's provider since March 1991. Banking industries are subject to constantly changing regulations, technologies, and market conditions. As a result, municipalities must provide regular due diligence of these service providers. Part of ongoing due diligence includes regular competition for the procurement of services.
A competitive procurement process plays a vital role in helping to preserve the integrity of the public finance functions and maintaining citizens' confidence. Industry's best practices recommend that municipal agencies, when feasible, undertake a full-scale competitive process by actively seeking participation of qualified banks, including BOW, to offer their market competitive rates, negotiate preferable terms and conditions and/or service enhancements, and allowing cities to take advantage of technology enhancements, service changes, or evolution in the market.
On February 9, 2023, a Request for Proposals (RFP) for Banking Services was released. Staff received proposals from three qualified banks on March 16, 2023. The proposals were evaluated by all the team members of City's Finance Department ("Review Committee") with emphasis on understanding city's needs, scope of services, technological resources, financial strength, products offered, and fees proposed.
All three banks were invited for oral interviews with the Review Committee. Detailed questions were asked by the panel to assess the experience, resources and qualifications of the individuals assigned to City's accounts, with an understanding of relevant experience managing similar account relationships, quality of conversion plan, integration with existing city resources, implementation planning, and customer service support.
Based on the results of the evaluation, the Review Committee recommended Wells Fargo Bank ("WFB") be retained to provide banking services for the City of Irwindale. WFB met all the required specifications in the RFP and received the highest final score while offering the highest earnings credit rate that can be used to offset banking analysis fees.
Review
Final Committee's
Banks Score Ranking
Bank of the West 140 3
Chase 188 2
Wells Fargo Bank 229 1
WFB has 170-year history of serving local communities. They are a leading national bank ranked fourth in assets by Federal Deposit Insurance Corporation (FDIC) in 2022.
They have over 5,500 government relationship accounts, provide $22.5 billion in
commitments to California government customers, and hold $29 billion in deposits. Their headquarter is in San Francisco, California, with over 5,200 branches (2021) including locations in Baldwin Park, Duarte, West Covina, and Azusa.
Therefore, City staff recommends that the City Council authorize staff to terminate the current agreement with Bank of the West and execute a new agreement with Wells Fargo Bank for a term of five years.
Fiscal Impact:
There is no additional cost to the city since the city currently pays banking service fees to Bank of the West, which have been accounted for in the City's current budget.

Background and Analysis:
The project for Traffic Signal Modifications at Arrow Highway and Vincent Avenue ("Project") is identified in the City's Capital Improvement Program. It includes installation of new left turn phasing for east/west/north/southbound directions, removal and replacement of outdated signal poles and equipment, and providing ADA accessibility and compliance.
On April 12, 2023, City Council approved the plans for an Interim Design for Traffic Signal Modifications at Arrow Highway and Vincent Avenue and authorized staff to solicit bids for construction of this project.
The intersection of Arrow Highway and Vincent Avenue is under shared jurisdiction between and among the City of Irwindale (50%), the City of Azusa (25%), and the County of Los Angeles (25%). Azusa and Los Angeles County have agreed to fund their respective portions of this interim Project provided Irwindale will perform the contract administration, construction, construction inspection and engineering, materials testing and construction surveying for the entire Project
On November 20, 2022, the City of Azusa executed their Cooperative Agreement for this Project. The Agreement between Los Angeles County and City of Irwindale needs to be executed before construction can begin. Attached is the LA County/City of Irwindale Agreement for execution. Section 4a of the agreement specifies that "the final accounting of the TOTAL COST OF PROJECT shall allocate said total cost among IRWINDALE, AZUSA and the COUNTY based on percentage of the PROJECT to be completed within the jurisdictional boundaries of IRWINDALE, AZUSA and the COUNTY: 50 percent IRWINDALE, 25 percent AZUSA, 25 percent COUNTY''.
Staff requested a construction estimate from our Traffic Signal Maintenance contractor, the City of Santa Fe Springs Traffic Signal Maintenance Division, for implementation of the interim traffic signal modifications. Based on the construction estimate of $177,000, staff is recommending to move forward with construction utilizing the City's existing extraordinary traffic signal maintenance contract with Santa Fe Springs to implement the interim design.
This Project is categorically exempt from CEQA as it consists of replacement or reconstruction of existing facilities, pursuant to Section 15302(c) of CCR, Title 14, Division 6, Chapter 3 "Guidelines for Implementation of the California Environmental Quality Act".
Fiscal Impact:
The City's share of this Project is currently estimated to be $88,500. Funds in the amount of $59,421.90 will be allocated from Athens Services' Development Agreement contribution for the Athens Maintenance Yard on Vincent Ave and the remaining $29,078.10 from the General Fund. Both are budgeted in the Capital Projects Fund 48 (Account Number 48-80-800-45300- 8306).

d. During construction of the PROJECT, IRWINDALE shall furnish an inspector or other representative to perform the functions of an inspector.
The COUNTY may also furnish, at no cost to IRWINDALE, an inspector or other representative to inspect construction of PROJECT. Said inspectors shall cooperate and consult with each other, but the orders of IRWINDALE's inspector to the contractors or any other person in charge of construction shall prevail and be final.
e. This AGREEMENT may be cancelled, amended, or modified only by mutual written consent of IRWINDALE and the COUNTY. Amendments and modification of a nonmaterial nature (i.e., having no financial effect on either party) may be made by the mutual written consent of the parties' Director of Public Works or their delegates.

Background and Analysis:
On April 12, 2023, the City Council recommended amendments to the Dedication Plaque and Paver Policy ("Policy"). The amendments are as follows:
01005.0001/888440.1 Page 1
1. The applicant's fee for engraving the paver is $18 per paver. The limited line and character count will remain as identified in the Policy.
2. The City will pay for the on-site set up fee.
3. The application acceptance period has been amended to allow for applications to be accepted throughout the year, with engraving of the paver to occur once per calendar year. The engraving will occur in April/May, for those applications received by March 31 st.
Following the April 121h City Council meeting, staff received a couple of comments from community members regarding the pricing of the pavers and is proposing three different prices for the three different paver sizes. The community members did not suggest specific pricing. As a result of the comments received , staff is providing this information to the Council for consideration as part of Amendment No. 2 to the City of Irwindale Dedication Plaque and Paver Policy. The table below identifies the current pricing structure and a proposed pricing structure.
Paver Price Presented New Proposed
Paver Size Current Price to CC on 4/12 Paver Price
5"x5" $33.71 $18.00 $15.00
6"x8" $39.15 $18.00 $20.00
8"x11 " $64.16 $18.00 $25.00
Pending approval of Amendment No. 2, the three applicants who have submitted a paver application and paid the fees under the previous policy will be reimbursed, as appropriate.
Staff recommends that the City Council adopt Resolution No. 2023-34-3412, approving Amendment No. 2 to the Dedication Plaque and Paver Policy, and finding that the dedication pavers and plaques installed on City property and all costs incurred by the City associated therewith serve an important public purpose insofar as the dedication pavers and plaques commemorate and support the civic involvement of individuals, groups, and associations, and fosters the City's commitment to honor the memories of individuals, groups, associations, or events within the community.
Fiscal Impact:
The City will incur an on-site set up fee of $325.00 per year and funds are available in the current adopted budget to cover this fee.

Background and Analysis:
At the regular City Council meeting of April 26, 2023, the City Council directed staff to bring forward for consideration, a policy that would recognize various months and days or weeks of awareness or remembrance to demonstrate the City's commitment to building a more inclusive community.
The City of Irwindale continues to be a community in which all members can thrive.
Proclamations, Certificates of Recognition, City Tile Plaques and themed lighting provide avenues through which the City may acknowledge, reflect upon and encourage action related to the experiences and contributions of individuals from a diverse range of backgrounds and professions. These recognitions may be presented by the City Council at its meetings, or presented at other community events.
Procedure for City Recognitions
In order to facilitate requests from the Irwindale community, members of the public and various organizations and causes, staff is proposing an administrative policy entitled, "Procedure for City Recognitions". This policy will outline the process through which members of the public may request recognition(s) by the City of Irwindale.
This policy will include a listing of the proclamations that the City Council has historically presented, identify the various types of recognitions that can be requested, and the process by which a recognition can be requested. The list of proclamations identified in the policy serves solely as a baseline, may be amended as the need arises, and does not preclude additional recognitions or celebrations.
Staff recommends the City Council discuss this item, provide direction to staff, if deemed necessary, and adopt Resolution No. 2023-40-3418, thereby approving an administrative policy related to City Recognitions.
Fiscal Impact:
A cost of approximately $35.00 per plaque will be incurred for the engraving of the plates affixed to the City Tile Plaques.
