Melissa Ortelle stated that a non-heterosexual lifestyle is not a choice; rather, it is genetic. However, she stated that both she and her wife believe that it is not necessary to fly the Pride flag at City Hall, and that a proclamation or hosting Pride events during the month would be sufficient. She cautioned that flying the Pride flag would invite individuals from other religions and nationalities to request that their flags also be flown
Carmen Roman suggested that the City Attorney look into the request to fly a Pride flag at City Hall. She stated that flying the Pride flag would invite individuals to submit requests to fly the flags for Mexicans, Salvadoreans, Puerto Ricans, Asians, Dodgers, Raiders, etc. She threatened that, if the Council flies the Pride flag, she would request for "all flags to be flown."
Teresa Ortiz spoke on how the song "Somewhere over the Rainbow" by Israel Kamakawiwo'ole inspired her to speak and thanked city staff for the report and for allowing her the opportunity to bring hope to the community.
Megan Zepeda stated that it is unnecessary to fly the Pride flag, and that doing so would make the requestors privileged and not inclusive.
She also stated that she wants to fly a "Puerto Rican Left Handers Flag" which she is designing and indicated that she has a lot Black people and "halfies" in her family.
Councilmember Burrola stated his preference of option three in the staff report.
Mayor Pro Tern Ambriz said that the Irwindale community is inclusive and family-oriented, and expressed his support of option three. He also requested that a policy be developed to demonstrate the city's commitment to building a more inclusive community.
Councilmember Garcia agreed that the state and US flags should remain, and said that a proclamation should be presented on a specific date to thank all for being inclusive.
Mayor Ortiz spoke on the need to work and live in harmony and stop divisions. He suggested presenting a proclamation and utilizing colored lighting in front of City Hall and, once staff looks into option three, look into other ways to provide what the residents want. He said that doing so would honor those who live in fear and doubt, and would remind them that Irwindale cares.
A motion was made by Mayor Ortiz to direct staff to look into option three, prepare a proclamation to be presented in June, and illuminate City Hall in rainbow colors. The motion died due to a lack of a second.

DIRECTOR RODRIGUEZ Director Rodriguez presented the verbal update. She added that staff would first need to determine insurance costs, the types of waivers that would be needed, park rules, equipment and accessories needs, as well as staffing levels and funding. Mayor Ortiz asked whether an area at the end of Peppertree Lane could be used for the dog park, to which City Manager Miranda advised that the site belongs to the County of Los Angeles and noted that staff has reached out to County Supervisor Solis' office to inquire.
Mayor Ortiz concurred that staff should look into developing a pop-up dog park and added that he would also welcome a dog park at Santa Fe Darn.
Councilrnernber Burrola suggested for city staff to wait until staff from the County decide whether they will develop their own dog park.
Councilrnernber Garcia stated that he merely wanted city staff to reach out to county staff to determine whether a dog park would be developed at the Darn and added that he does not have any concrete information indicating that it would.

Construction Compliance Manager Carrillo presented the staff report.
Dena Zepeda complained about increased traffic in the area due to the Renaissance Faire operating at Santa Fe Dam and stated that United Rock is not conducting street sweeping as regularly as they are required to do.
Mayor Pro Tern Ambriz requested elaboration on the conditions that United Rock must follow, to which Mark Pachurra, United Rock Products General Manager, detailed current street sweeping operations and procedures. He advised that United Rock has two sweepers and rents three additional sweepers. United Rock is also preparing reports showing how often the sweepers clean the streets.
Mayor Ortiz noted that the street sweepers sometimes operate dry, which only serves to kick dust into the air. He stated that United Rock must ensure that the trucks continuously spray water as they operate, to which Mr. Pachurra agreed, and stated that the outside contractor that they hire to perform street sweeping seems to experience high employee turnover, which may indicate that newer hires are not always trained properly.
Mayor Ortiz reminded Mr. Pachurra about United Rock's commitment to constructing a traffic signal on Los Angeles Street near the pit entrance, to which Mr. Pachurra indicated that they have run into construction issues in its development, including the accidental severing of fiber optics and the need to relocate a curb, as well as inclement weather. Mayor Ortiz stated that there will likely be no additional extensions if the signal is not up. Mayor Ortiz also asked that street sweepers sray water on the paved roads leading into the pit in order to lessen the amount of dust in the air, to which Mr.
Pachurra advised that United Rock has a water truck that operates continuously during operations.
City Manager Miranda suggested potentially reassessing the amount of time that street sweeper trucks spend along Azusa Canyon Road since the current practice does not seem to be enough.
A motion was made by Mayor Pro Tern Ambriz, seconded by Councilmember Burrola, to allow United Rock Products, Inc., to continue the current hours of operation for transportation of excavated aggregates from the Olive Pit to United Rock Products Pit No. 2 (URP-2) until August 31, 2023. The motion was unanimously approved; Councilmember Breceda absent.

Mayor Pro Tern Ambriz requested that a recognition for "Teachers Month" be placed on the agenda for a future meeting, as well as a separate item to discuss potentially providing Renaissance Faire tickets to residents.

Mayor Pro Tern Ambriz requested that an item be placed on a future agenda to discuss potentially purchasing Renaissance Faire tickets for city residents.
Councilmember Breceda indicated that he partnered with a company to donate a certain amount of coconut water in exchange for Renaissance Faire tickets, but noted that Renaissance Faire personnel refused the offer.
Pat Gonzales stated that city residents ended up selling the Renaissance Faire tickets they had received for free and opposed the proposal to purchase tickets for residents since the funding could be used for better purposes.
Dena Zepeda disagreed that residents sold their tickets and stated that city residents are entitled to free tickets since they put up with smog and traffic. She also stated her belief that funding for the purchase of tickets would come from the Irwindale Community Foundation and not the city.
Linda Marez stated that the Foundation's funding could be better utilized elsewhere, expressed that the city does enough for its residents already, and those interested in attending the Renaissance Faire could purchase their own tickets.
In reply to a question by Councilmember Breceda, City Manager Miranda advised that the vast majority of funding provided to the Irwindale Community Foundation is supplied by Huy Fong Foods, which arranged with the city to submit payments to the Foundation instead of submitting them to the city as they were required to do per an agreement with the city to make payments in lieu of paying taxes.
City Manager Miranda added that he has spoken to a representative of the Renaissance Faire who indicated that donating tickets to city residents and county employees would be a conflict of interest, and that accepting the coconut water that Councilmember Breceda would constitute a breach of contract they have with a water provider.
Councilmember Garcia asked when Huy Fong is scheduled to make its final payment, to which City Manager Miranda advised that, after this summer, it had two more disbursements left to make.
Councilmember Garcia suggested encouraging other businesses to donate to the Foundation and asked whether the city receives sales tax from the sale of Faire tickets, to which City Manager Miranda advised that he would have to look into the question.
Mayor Pro Tern Ambriz stated that it is unknown whether Huy Fong would choose to voluntarily continue donating funds and stated that city representatives are speaking to local businesses in an effort to ensure that Foundation funding is not depleted.

Pledge Leader and
Youth Spotlight Program
Background and Analysis:
At the meeting of April 26, 2023, a request was made by Councilmember Burrola to invite Irwindale youth to lead the Pledge of Allegiance at City Council meetings, and to publicly commend them for the favorable recognition that they bring to the City of Irwindale.
Irwindale is fortunate to have an engaged youth community that brings notoriety to the City locally, regionally, statewide, and nationally through sports, academics, creative endeavors such as singing, dancing/cheer, and musical performing, and other notable accomplishments. To celebrate these individuals and groups, the City is proposing a Pledge Leader and Youth Spotlight opportunity.
In order to be eligible to participate, the youth must be a resident of the City of Irwindale, be between ages 5 through 18, and groups must either be City-sponsored, such as the Teen Club or Tiny/Teeny Tots, or have its principal and permanent meeting place within the City of Irwindale. Participants should demonstrate the ability to recite the Pledge of Allegiance.
Only the parent or guardian of the minor(s) or authorized group leader can fill out the application form. All participating group members must have the completed application form on file with the City Clerk's office prior to the meeting at which they will be recognized. The City of Irwindale reserves the right to extend the Pledge Leader opportunity to meetings of the Parks & Recreation and Planning Commissions should the number of applications exceed the number of regular City Council meetings scheduled.
Please note that participants will be selected on a first come first serve basis.
Regular meetings of the City Council are scheduled on the 2nd and 4th Wednesday of each month at 6:30 p.m. at the Irwindale City Council Chambers with occasional exceptions.
Fiscal Impact:
There is a fiscal impact of $400 for commemorative pins that will be given to the participants. This cost will be covered under the Operating Supplies budget of Administrative Services.

Staff is excited to relaunch the snack bar at the Irwindale Aquatics Center. For years, the snack bar wasn't just a place that sold food items, drinks, and candy, but was also a place of community. Relaunching the snack bar will give City staff the opportunity to provide some past classic food options, as well as introduce healthier options to patrons who utilize the City's parks, the Dan Diaz Recreation Center and/or the Aquatics Center during the summer season.
In addition to the relaunching of the snack bar, the City will be opening a small store to include the purchase of necessary items, such as swim suits, goggles, towels and sunblock, etc., to make patrons' time at the Aquatics Center safe and enjoyable. The Aquatics Center's policy requires that patrons wear proper swim attire in order to enter the facility. Many patrons are unaware of this policy, and in years past, staff would refer patrons to visit the "green house" across the street from the Center. This green house was owned and operated by Rosie Guerrero, who sold low cost swim suits to those who were unable to enter the Aquatics Center for the lack of having proper swim wear. Rosie was a staple to the City's community, and Staff would like to dedicate this small store in her name.
The Aquatics Center has incorporated a lot of fun and new classes throughout the past two years. One of the City's proudest programs is the Irwindale Swim Team, which is named "Irwindale Sharks," supported by its mascot Pebbles. Pebbles is a 6-foot shark that comes out to cheer on the City's swim team and congratulate swim lesson patrons during closing ceremonies. To keep with the theme of the City's mascot and swim team, Staff is requesting that the newly renovated snack bar and apparel store be named "Shark Shack and Rosie's Treasures".
The City of Irwindale Facility and Street Naming Policy, adopted in 2017, provides that City facilities may be named or renamed after a person or organization who has made substantial contributions to the advancement of recreational activities with the City of Irwindale. Both Rosie Guerrero and the Sharks have made significant and substantial contributions to recreation in Irwindale through the Aquatics Center. Additionally, when naming or renaming a facility in honor of an individual who has passed away, the naming/renaming shall not take place until at least one (1) year following the death of such individual. Rosie Guerrero passed away in December 2020, more than one year before dedicating the snack bar's store in her honor.
Fiscal Impact:
The fiscal impact will be approximately $800, which is the cost to purchase a neon sign with the name "Shark Shack and Rosie's Treasures." Sufficient funding is available in the Aquatics Operating Supplies Account (01-41-410-42200-0000).

Reason for Nomination (required):
Since Ms. Guerrero is no longer with us, the Parks & Recreation Commission along with the Aquatics Center staff would like to honor her by selling low cost swim suits to patrons who may not have or cannot afford swim wear required to enter the pool.
Additional Comments (additional information may be attached):
Rosie Guerrero was a lifelong resident who positively affected the lives of many Irwindale Residents and non-residents for many decades. She dedicated her life to service by making taquitos for community Fiestas, made & sold confetti eggs at City Events, & sold low cost swim suits to individuals.

1. The State's Health and Safety Code requires Cities and Counties to adopt the most recent editions of the State Building Standards related to building construction. Most recently, the State of California adopted the 2022 California Building, Electrical, Plumbing, Mechanical, Residential, Green Building Standards and Existing Building Codes.
2. Title 15 of the Irwindale Municipal Code (IMC) contains administrative and technical requirements for building construction. The City's current building code was last adopted in January 2023 by Ordinance 764.
3. On January 11, 2017, the City adopted Ordinance No. 709, and on January 8, 2020, the City adopted Ordinance No. 743, which set out provisions intended for use as Chapter 15.05 "Existing Building Code." However, Chapter 15.05 of the City's Municipal Code was already established through the adoption of Ordinance No. 697, adopted October 14, 2015, "EXPEDITED PERMITTING FOR SMALL RESIDENTIAL ROOFTOP SOLAR ENERGY SYSTEMS," and the provisions of Ordinance Nos. 709 and 7 43 were reclassified as Chapter 15.07 in the City's on line version of the Municipal Code. Therefore, staff recommends that the City Council repeal Ordinance Nos. 709 and 743 in their entirety and formally add Chapter 15.07 "Existing Building Code" to the Irwindale Municipal Code.
4. On November 15, 2022, the Los Angeles County Board of Supervisors added and set forth provisions and regulations for the enforcement of Title 33 - Existing Building Code and adopted by reference, the 2022 State of California Building, Electrical, Plumbing, Mechanical, Residential, Green Building Standards, and Existing Building Codes, with 2023 Los Angeles County Amendments. The Existing Building Code has been included as Part 10 of the California Building Standards Codes for the past three 01005.0006/875775.1 Page 2
code cycles; however, now it is identified as a main code that requires adoption by all California jurisdictions.
5. Similar to past practice, the City will adopt the California Building, Electrical, Plumbing, Mechanical, Residential, Green Building Standards, and Existing Building Codes with county amendments, by reference, to bring the City into compliance with the California Health and Safety Code.
6. Based on staff review of the new 2023 Los Angeles County Building Code and the County's amendments and the ongoing mining and reclamation operations in the City, the Public Works Department - Building Safety Division is proposing revisions to Appendix "J" (Grading Section) of the Los Angeles County Building Code.
7. The proposed City revisions to the 2023 County Building Code Appendix "J" are to carry over changes to the 2008 Building Code Appendix "J" that pertain to the administrative and technical standards for backfilling of open-pit mines using either inert debris fill or soil fill. This appendix will include the City's four technical guidelines and backfill settlement evaluation techniques that deal with mining and reclamation of open-pit mines as a mandated requirement for mining operations in the City and the technical bulletin that was prepared by the Irwindale Technical Advisory Committee as a supplement to the City's four technical guidelines.
8. On January 11, 2023, the City adopted Ordinance No. 764 which included the changes to Appendix "J" (Grading Section) of the Los Angeles County Building Code.
However, pursuant to Health and Safety Code Sections 17958.5, 17958.7, and 18941.5, revisions to Appendix "J" require separate findings (Topographical, Climatic and/or Geological type) which were not included in Ordinance No. 764. Therefore, staff recommends the City Council repeal Ordinance No. 764 in its entirety and adopt Ordinance No. 769 which includes the required findings for Appendix "J".
9. The proposed adoption of this ordinance is exempt under the provision of the California Environmental Quality Act pursuant to State Guidelines 15061 (B)(3) and 15378 (b)(c). Adoption of the proposed ordinances is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Adoption of the proposed ordinances does not have such potential insofar as the changes are mandated to be adopted by State law and any local changes are needed to assure proper measures are taken to address the City's local needs, especially to properly backfill open-pit mines to avoid seismic hazards when they are reclaimed.
10. Upon adoption of the 2023 Los Angeles County Building, Electrical, Plumbing, Mechanical, Residential, Green Building Standards, and Existing Building Codes with County and City Amendments, staff will send a letter to the California Building Standards Commission advising them with the City's newly adopted codes with County and City Amendments.

12. The City Council conducted the first reading of Ordinance No. 769 on April 26, 2023.
