COUNCILMEMBER Councilmember Garcia stressed the need for Athens to thoroughly GARCIA educate residents on how to properly sort their waste to avoid fines.

He added that he is very uncomfortable with the fining mechanism currently in place since residents may get fined due to the actions of others. He asked whether Athens could look into providing locking mechanisms for the carts to avoid individuals from searching through them, or maybe issuing identification numbers to the carts.

DIRECTOR RODRIGUEZ Director Rodriguez noted that staff has worked with Athens to postpone fines. As such, households that are not sorting their waste appropriately are currently receiving notices of violations instead of fines. She also spoke on staff's efforts to gain voluntary compliance from all households and stated that discussions will be held with the City Manager before fines are issued.

JOSEPH TAPIA Joseph Tapia reported an individual that he witnessed searching from several residents' belongings recently.

Responding to a question by Mr. Tapia, Director Rodriguez advised that residents who observe individuals going through others' waste bins should immediately contact the Police Department and provide as much identifying information as they could.

ITEM 24A REQUEST BY MAYOR AMBRIZ FOR AN UPDATE ON THE

REQUEST BY MAYOR REMOVAL OF OAK TREES RELATED TO THE LIBRARY

AMBRIZ FOR AN PROJECT

UPDATE ON THE

REMOVAL OF OAK

TREES RELATED TO

THE LIBRARY

PROJECT
DIRECTOR RODRIGUEZ Director Rodriguez presented an update wherein she advised that city staff worked with the City Attorney' s Office and researched the requirements for the removal of oak trees in California. Research shows that County jurisdiction covers only unincorporated areas and not cities located within same. She further advised that the area reserved for the new Library does not fall under the definition of oak woodlands, and therefore, the City of Irwindale is allowed to remove the oak tree in question.

MAYOR PRO TEM Responding to questions by Mayor Pro Tem Burrola, Director BURROLA Rodriguez advised that the City has received a grant from Vilest Coast Arborists in 2015 to plant over 200 trees citywide, half of which were southern Live Oak trees. These trees were planted and are now in their infancy. Two oak trees are located near the Irwindale Park CITY COUNCIL MINUTES JANUARY 10, 2024

playground and another two mature oak trees are near the Library.

She added that she occasionally hires an arborist to determine the types of trees at the park as well as to report on their health and to indicate what type of maintenance they would need.

Mayor Pro Tem suggested that two oak trees be planted for each oak tree that is removed to make room for the new Library project.

COUNCILMEMBER Responding to a question by Councilmember Garcia, City Attorney GARCIA Guerra suggested that he recuse himself from participating in this item since he lives within 500 feet of the subject property.

JOSEPH TAPIA Joseph Tapia stated his belief that there are additional trees that are protected by state law.

ITEM NO. 24B REQUEST BY MAYOR PRO TEM BURROLA FOR AN UPDATE ON

REQUEST BY THE TREE TRIMMING SCHEDULE FOR CITY PARKS

MAYOR PRO TEM

BURROLA FOR AN

UPDATE ON THE

TREE TRIMMING

SCHEDULE FOR

CITY PARKS
DIRECTOR RODRIGUEZ Director Rodriguez presented the update and confirmed that the City has a tree trimming and inspection policy which was revised in 2015 with input from the California Joint Powers Insurance Authority and the City' s Risk Manager. The City contracted with West Coast Arborists for tree trimming services, and the company follows the policy. City staff also performs smaller tree trimming services. She added that West Coast Arborists provides an inspection report on all trees within designated areas every three years. Dead or diseased trees are removed. Staff could also contact West Coast Arborists and request maintenance on specific trees when needed. She concluded by indicating that trees have been maintained much more recently due to increased rain.

MAYOR PRO TEM Mayor Pro Tern Burrola stated that he brought this item up for BURROLA discussion since it does not appear that the trees at the park have been trimmed properly and requested that they be given closer attention, especially in light of the upcoming Library project.

DIRECTOR RODRIGUEZ Director Rodriguez advised that there are 684 palm trees citywide, with 405 varying types in Irwindale Park, 99 at the Skate Park, and 23 at El Nido Park. She indicated that she receives arborist reports on park trees every couple of years and, in light of the presence of patrons near the trees, staff maintains them regularly and keeps a log with maintenance details.
