ITEM NO. 19E APPROVE A FEE WAIVER FOR IRWINDALE LIONS CLUB
APPROVE A FEE
WAIVER FOR
IRWINDALE LIONS
CLUB
CARMEN ROMAN Carmen Roman opposed for any group to be permitted to use a city facility for as long as one year since others may also wish to use the facility. She suggested that, should the Council approve the request, that a caveat be included indicating that city functions would take priority over Lions Club meetings for the use of the facility. She spoke on an approved contract between the city and a sports organization for the use of a portion of the park for an extended period of time, which she opposed since she believes it takes away opportunities for residents to utilize it.
LINDA MAREZ Linda Marez spoke on the benefits the Lions Club provides to the city and stated that only a handful of individuals had a problem with the sports organization renting out the park field. She spoke in favor of approving the fee waiver for the length of time requested by the Lions Club.
COUNCILMEMBER Councilmember Ortiz stated that he did not see any issue in renting ORTIZ out the requested facility for the year. He stated that the club has met there for years and that he was not aware of the club displacing others from utilizing it. He noted that the Lions Club typically uses the facility at a time when no one else needs it.
MAYOR PRO TEM Responding to a question by Mayor Pro Tern Burrola, Assistant City BURROLA Manager Olivares advised that, of the six active members of the Lions Club, four are Irwindale residents.
Mayor Pro Tern Burrola concurred that there would be no problem with approving the fee waiver request. He further requested a quarterly report on the Lions Club' s plans to benefit the community.
RESOLUTION NO. A motion was made by Mayor Pro Tern Burrola to adopt:

MAYOR AMBRIZ Mayor Ambriz asked about the status of the draft rental agreement policy for the Dan Diaz Recreation Center and Open Space Areas, to which Director Rodriguez advised that the first draft was presented to the Parks & Recreation Commission at its January 11 meeting.
Commissioners made suggestions and the policy is being edited, after which it will be returned to the Commission for follow up at its February 7 meeting. Once finalized, the policy would be forwarded to the Council for approval, potentially in March.
DIRECTOR RODRIGUEZ Director Rodriguez noted that the Community Center already has a policy in place. As such, it was not included in the rental agreement policy. She added that the Community Center is not a subject under the purview of the Parks & Recreation Commission; rather, it would need to be addressed by the City Council.
MAYOR AMBRIZ Mayor Ambriz stated his preference for fee waiver requests to be approved for up to one quarter, and for subsequent requests to be considered separately.
ASSISTANT CITY Assistant City Manager Olivares advised that staff could assist in MANAGER OLIVARES relocating Lions Club meetings in the event that their meetings conflict with City events.

AGREEMENT NO. 02- 2016
ASSISTANT CITY Assistant City Manager Olivares presented the staff report.
MANAGER OLIVARES
GARY CLIFFORD Gary Clifford, with Athens Services, noted that Athens has built nearly 200k square feet during phase 1 of their project, which is significantly more than what was required for the phase per the development agreement, and asked for the Council to consider allowing Athens to develop a convenience store in a future phase of the project, at its discretion, rather than during phase 1, as currently required per the agreement.
CARMEN ROMAN Carmen Roman spoke in favor of moving the development of the convenience store to a later phase.
MOTION A motion was made by Councilmember Garcia, seconded by Councilmember Breceda, to direct the City Manager to work with Athens on the terms for the approval of the requested modification.
MAYOR PRO TEM Mayor Pro Tern Burrola noted that the staff report does not specify BURROLA under which phase the convenience store would be developed.

MAYOR PRO TEM Mayor Pro Tern Burrola stated that he did not mind for the BURROLA convenience store to be constructed in the next phase, though he did request to have this agreement in writing. He then asked whether the pump stations would be used to fuel Athens trucks or if they were for use by the public.
GARY CLIFFORD Mr. Clifford reiterated his request that the Council allow the construction of the convenience store during a future phase, at the discretion of Athens, and guaranteed its development. Regarding the pump stations, he advised that they would be for use by members of the public and would not be used to fuel Athens trucks.
MAYOR PRO TEM Mayor Pro Tem Burrola reiterated his request that the timeline for the BURROLA construction of the convenience store be put in writing. He then asked when the Material Recovery Facility (" MRF") would be completed, to which Anthony Bertrand, with Athens Services, indicated that the current construction schedule has the facility completion scheduled for the first quarter of 2025, and noted that phases 2 and 3 are not fully defined by design.
Responding to a comment by Mayor Pro Tern Burrola, Mr. Bertrand indicated that Athens is not intentionally delaying the development of the convenience store; rather, it is focusing on building the MRF in order to begin sorting and recycling and, in turn, provide revenue to the City. He added that Athens has spent two years trying to look at a good development partner for the store, but the efforts have not been fruitful and noted thatthe agreement currently stipulates that the MRF cannot be opened until the convenience store is developed in phase 1.
COUNCILMEMBER Councilmember Breceda stated that he understood Mayor Pro Tern BRECEDA Burrola' s concerns. However, he spoke in favor of directing the City Manager and staff work with Athens to identify a solution that would work in the interests of both parties and to avoid delaying the opening of the MRF.
COUNCILMEMBER Councilmember Ortiz noted Athens' progress but noted that the ORTIZ development agreement included the development of the MRF along with the fueling station and convenience store, all of which would supply funds to the City. He requested that an approximate timeline for the development of the convenience store be provided, which could be worked out with the City Manager.
ASSISTANT CITY Assistant City Manager Olivares added that staff would benefit from MANAGER OLIVARES learning the Council' s preference regarding which phase should include the construction of the convenience store.

COUNCILMEMBER Responding to a question by Councilmember Ortiz, Assistant City ORTIZ Manager Olivares expounded on the requirements of phase 1 as stipulated in the development agreement. She further noted that phase 2 does not identify the specific areas to be constructed.
GARY CLIFFORD Gary Clifford repeated Athens' request for the Council to allow Athens staff to work with the City Manager and staff to determine how to proceed with phases 2 and 3. He cautioned that, should Athens' costs continue to escalate, the tipping fee they charge will change, which could cause an adverse effect in the tonnage that is brought into the facility.
COUNCILMEMBER Responding to a comment by Councilmember Ortiz, Mr. Clifford ORTIZ asked that the Council have faith in Athens' commitment to finding a partner so that the convenience store could be built as soon as possible.
In response to an additional question by Councilmember Ortiz, Mr.
Clifford advised that the site of the convenience store is reserved exclusively for that purpose and that nothing else would be built there.
CITY MANAGER City Manager Miranda asked whether there is sufficient space for the MIRANDA convenience store in light of the increase in size of the facility to over 200k square feet, to which Mr. Clifford confirmed that there is.
MAYOR PRO TEM Mayor Pro Tern Burrola asked what phase 2 of the project would BURROLA include, to which Mr. Clifford advised that the development agreement purposely did not include specifics since it is a fluid project. He advised that Athens is not attempting to get out of developing any of the items included in the development agreement.
Mayor Pro Tern Burrola reiterated his request that a timeline for the development of the convenience store be put in writing and for the City Attorney to review it.
MOTION A motion was made by Councilmember Ortiz, seconded by Mayor Pro Tern Burrola, to table this matter until the Council, City Manager, and City Attorney have an opportunity to discuss it.
VICTOR DE LA CRUZ Victor De La Cruz, with Manat, Phelps, & Phillips, outside counsel to Athens, stated that the development agreement was always contemplated to be based off market conditions. He added that it was Athens' staffs understanding that the Council wished for as much as possible to be constructed as quickly as possible, which he stated Athens has achieved. He added that Athens does not wish to hold up the increase in the MRF square footage because of a requirement to the convenience store.

DENA ZEPEDA Dena Zepeda spoke in favor of moving the project forward.

1. 70 per ton. He encouraged the Council to approve Athens' request and noted that there is no timeline for phases 2 or 3 of the project since it is market driven.
CARMEN ROMAN Carmen Roman spoke in favor of moving the project forward.
CASEY MIRANDA Casey Miranda asked if Athens would allow an extra week so that Athens and the City could agree on terms for the project timeline.
VICTOR DE LA CRUZ Mr. De La Cruz again requested that the Council direct staff to work with Athens on an amendment to the development agreement. He stated that nothing will be finalized at this meeting, and that they are simply asking for direction to move forward to negotiate with the City Manager and City Attorney to agree on terms that would allow Athens the flexibility to develop the convenience store at a later phase.
MAYOR AMBRIZ Responding to a question by Mayor Ambriz, Councilmember Garcia stated that his motion includes direction to staff to work with Athens to modify the development agreement and include moving the development of the convenience store to a future phase.
