Issue: Approve the install and 1‐Year lease of eleven (11) Automatic License Plate Reader Cameras from Flock Group Inc.
City Manager's Recommendation:
Adopt Resolution No. 2024‐13‐3490 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IRWINDALE WAIVING FORMAL BIDDING REQUIREMENTS PURSUANT TO IRWINDALE MUNICIPAL CODE SECTION 3.44.080(C), APPROVING AND AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH FLOCK GROUP INC. FOR THE Sole source LEASE AND INSTALLATION OF ELEVEN (11) FLOCK AUTOMATIC LICENSE PLATE READER CAMERAS FOR THE IRWINDALE POLICE DEPARTMENT "

Background and Analysis:
During the City Council meeting on November 8, 2023, Chief Hofford presented a PowerPoint on Flock Cameras. The City Council tentatively approved a program to install automated license plate reader camera (ALPR) cameras using Flock Group Inc. (Flock Safety). The Irwindale Police Department has been using resources provided by Flock Safety since April 2022 and some success stories were shared with City Council during Chief Hofford’s presentation. The utilization of Flock Safety has been instrumental in resolving crimes and has led to successful prosecution of criminals on many occasions.
Flock Safety has become the preferred vendor for this technology by nearly every city in the San Gabriel Valley, including Azusa, Covina, West Covina, Monrovia, Arcadia, and Baldwin Park. City staff is recommending the City Council approve the installation of eleven (11) cameras throughout the City and allow the City Manager to enter into a 1‐year lease agreement with Flock Safety, which will also allow for continued access to information shared on their proprietary network.
Automated License Plate Reader (ALPR) technology has been used by police agencies to locate stolen vehicles and solve other crimes where an automobile has been used. ALPR technology has continued to evolve and become less cost‐prohibitive. Traditional ALPR systems included expensive fixed camera locations or mobile devices mounted in patrol cars. Irwindale PD has deployed mobile ALPRs in the past; however, these devices reached their end of life and are no longer in service.
The Flock Safety ALPR System will be a deployment of cameras in multiple areas, to provide greater coverage and more detailed information for law enforcement. The Flock lease proposed would include eleven (11) cameras spread throughout the City in high crime areas and ingress/egress areas for the City. Flock’s cameras capture date, time, location, license plate (state, partial, paper, and no plate attached), vehicle details (type and color).
There are several other differences between Flock and other ALPR companies. Most notably, they are the only manufacturer and service provider that leases ALPR services. The technology is also different because it captures motion, vehicle characteristics and not just license plates.
Due to the unique product and service provided by Flock Group Inc. and the manufacturer’s proprietary hardware and software components, this purchase may be considered a sole‐source purchase under Irwindale Municipal Code Section 3.44.080(C) since the product is only available from one source and additional bidding is not likely to result in a lower project price.
Fiscal Impact:
There will be no impact to the General Fund.
The total price for purchase and installation of the Flock cameras for the first year of the contract is $49,400. Funding for this expenditure will be paid using the Police Department’s Asset Forfeiture Contractual Services account number 16‐35‐370‐42300‐0000.

Issue: Approval of Lease of City's Water Production Rights for Fiscal Year 2023/2024 City Manager's Recommendation:
Approve the Valley County Water District proposal and lease of the City’s 285.38 acre‐feet of water production rights for FY 2023/2024; and

Background and Analysis:
The City of Irwindale (“City”) does not need its 285.38‐acre feet of water production rights for FY 2023/2024.
On February 8, 2024, staff issued a Notice to Bid to the following six water companies:
1. California Domestic Water Company 4. San Gabriel Valley Water Company
2. City of Azusa Light & Water 5. Valley County Water District
3. City of Arcadia 6. Valley View Mutual Water Co.
On March 4, 2024, staff received two bid proposals from the following water companies:
Water Companies Price Per AF Total Amount of Lease
Valley County Water District $916.00 $261,408.08
San Gabriel Valley Water Company $905.40 $258,383.05
Valley County Water District is offering to pay 91% of $1,006 per acre‐foot, which is the cost that the Main San Gabriel Basin Watermaster (“Watermaster”) charges for cyclic storage purchases to offset replacement water obligations for FY 2023/2024. Staff recommends City Council approve and authorize the City Manager to enter into a lease for the temporary assignment of the City’s water production rights with Valley County Water District with the option of two (2), one‐year extensions.
The Lease of Water Rights form was reviewed and approved by the City Attorney.
Adoption of this lease approves and sets forth the terms of the water production rights lease, and is exempt from the California Environmental Quality Act (“CEQA”) under Section 15061(b)(1) of the CEQA Guidelines, which provides that a project is exempt by CEQA if the project is exempt by Statute (see e.g. Article 18, commencing with Section 15260). Per Section 15282 (u) of the CEQA Guidelines, the lease of water rights is exempt as set forth in Section 1729 of the Water Code. Therefore, adoption of this lease is not subject to CEQA.
Fiscal Impact:
The one‐year lease of the City’s water production rights will result in $261,408.08 in revenues to the City’s General Fund.

Background and Analysis:
The City Council previously appropriated Asset Forfeiture Funds to supplement the Irwindale Police Department Budget, and state and federal law requires these funds to be utilized by the Police Department for law enforcement investigations and operations, training, and/or equipment related to official law enforcement duties. The Police Department is seeking approval for the purchase and outfitting of five (5) police patrol Dodge Durangos using Asset Forfeiture funds.
Irwindale Municipal Code section 3.44.080(F), provides that the City Council may dispense with formal bidding procedures when a purchase is beneficial to the interest of the city and is from a supplier who has been awarded a specific item or items in a contract resulting from a formal competitive bid process by another governmental agency within the State of California or by the federal government within the previous three hundred sixty‐five days (one year).
National Auto Fleet Group was awarded contract #091521‐NAF from Sourcewell (formerly known as NJPA), based off a formal bid procedure for a 2024 Dodge Durango Pursuit Rated vehicle. In NJPA’s summary of findings for the awarded Sourcewell/NJPA Contract, it found that National Auto Fleet Group has pricing within a competitive range, is a national dealer network representing fifteen car and truck manufacturers and has the ability to provide exceptional service. National Auto Fleet Group scored the best against three other bidders in the following categories – pricing, marketplace success, bidder’s ability to sell/service contracts nationally, bidder’s marketing plan, value added attributes and selection and variety of products and services. Wondries Fleet Group – a member of the National Auto Fleet Group, is offering the City of Irwindale the 2024 models at the national government multi‐year contract price. This waiver of formal bidding procedure and cost break is available for the City of Irwindale to utilize for the vehicles and outfitting the vehicles with safety lighting equipment, radio, computer, cameras and public safety supplies per Irwindale Municipal Code section 3.44.080(F).

At the January 11, 2024, Special Parks & Recreation Commission Meeting under future discussion requests, Chair Fraijo requested, with consensus from the commission, to dedicate the new Irwindale Park Trellis located north of the Irwindale Plaza in honor of Margaret Diaz, a life‐long resident who dedicated her life serving the Irwindale community alongside her husband Dan Diaz.
Margaret Diaz was born on February 22, 1939. For more than 40 years, Mrs. Diaz has been volunteering for various City events, such as the annual Easter Eggstraveganza and Halloween Spooktacular where she and her family coordinated and implemented the Easter egg hunt for children 9‐12 and Bingo, respectively. When M.I. Fiesta began, Mrs. Diaz took the lead by coordinating all the volunteers, setup, and implementation for Loteria. She instilled a legacy of volunteering within her family and she herself continued to volunteer up until the day she passed away on April 28, 2021.
The City Council approved a Facility and Street Naming Policy on September 27, 2017, that allows for the naming or renaming of City facilities and streets in a manner that is compatible with the community interest to enhance the values and heritage of the City of Irwindale. The policy outlines the qualifications for naming City Facilities, which is summarized as follows:
The facility must be under the control of the City; and The group, individual, or family the facility that is requested to be named or renamed after has provided a significant and substantial contribution of a service, cultural or historic nature to the City of Irwindale, as determined by the City Council; and The facility being considered to be named or renamed after the honoree should be the area in which the honoree made the most contribution and should have a correlation between the service provided by the honoree and the facility; and
No facility shall be named or renamed after an individual until at least one (1) year following the death of such individual.
The Irwindale Park Improvement Project Phase IV includes the construction of a new trellis north of the Irwindale Plaza. The Parks & Recreation Commission discussed the naming of the new trellis under New Business at its regularly scheduled February 7, 2024 meeting to ensure the criteria above is met and recommended the City Council approve the naming of the new Irwindale Park Trellis north of the Irwindale Plaza “The Margaret Diaz Pavilion” in honor of Margaret Diaz for her decades of volunteer work at the Dan Diaz Recreation Center and the many events held in the Irwindale Plaza and parks.

At the July 26, 2023 City Council Meeting, Council Member Larry G. Burrola requested the Parks and Recreation Commission provide direction to the city council on the future use of the Alfred F. Herrera Memorial Field for activities such as football practice rentals and non‐rentals.
On March 8, 2023, a resident rented the Alfred F. Herrera Memorial Field for youth football practice from March 8 through November 30, 2023. During the first few months, the rental was for one to two times a week. Beginning in July, the rental moved to four times a week, which caused issues with parking for Music in the Park and a concern with the use of the field for football practice disturbing and destroying the grass.
On August 2, 2023, this item was brought forth before the Parks & Recreation Commission for review of Irwindale Municipal Code Chapter 9.16 – Conduct in Public Parks and the rental of the Alfred F.
Herrera Memorial Field for youth football. A discussion was held among the commissioners and the community which resulted in the questions and potential updates and changes to IMC Section 9.16.20; however, there was consensus from the commission to bring this item back for follow‐up and discussion at another meeting.
This item was brought back to the commission at its regularly scheduled September 6, 2023 meeting for further discussion. The discussion held resulted in the following requests:
Ensure that City‐sponsored events have priority;
Multiple staff members such as the Recreation Manager, Public Services Director, and the City Manager all review and approve requests for the use of the fields in the parks; Month‐to‐month rentals versus season‐long rentals for sports rental requests; and Create a Rental Policy outlining the rental process.
Staff drafted a Facility and Open Space Rental Policy for the Dan Diaz Recreation Center and Irwindale Aquatics Center. The first draft was to be presented to the Parks & Recreation Commission at the December 6, 2023 meeting; however, the item was tabled and moved to the January 11, 2024 Special Meeting.
At the January 11, 2024 Special Parks & Recreation Commission meeting, staff introduced the first draft of the Facility & Open Space Rental Policy for the Dan Diaz Recreation Center, Irwindale Aquatics Center, and Irwindale parks (Rental Policy). Additionally, at this meeting a discussion was held on the Picnic Shelter constructed east of the Bus Turnabout as part of the Irwindale Park Improvement Project Phase III and the construction of a Picnic Trellis just north of the Irwindale Plaza as part of the Irwindale Park Improvement Project Phase IV. Both picnic shelters are not included as rental areas in Irwindale Park. As a result, the commission had the following comments, which are now reflected in the Rental Policy presented today before City Council and outlined below:
Clarified under List of Facilities for Rent: The Picnic Shelter east of the Bus Turnabout and the New Picnic Shelter Trellis north of the Irwindale Plaza are available to rent. The rental fee is identified under Picnic Shelter in the City of Irwindale Comprehensive Schedule of Fees & Charges; and
Added: Facility Uses Section to this policy; and
Added under Facility Uses: No Facility may be rented more than two times a week; and Clarified under Schedules, Changes, and Cancellation: For Irwindale Residents, all facility and open space rentals are available up to one week prior to a planned event as long as the application and payment are submitted one week prior to the event; and Added under Security Deposits and Payments: A staff member will be assigned to verify the condition of the rental at the end of the event; and
Added under Approval of Rentals: Any rental may be terminated for just cause; and Added under City‐sponsored Events/Operations: No rentals at the Dan Diaz Recreation Center, Irwindale Aquatics Center, Alfred F. Herrera Softball Field or at Irwindale Park will be approved or allowed during special events including but not limited to the Easter Eggstravaganza, Red, White and You BBQ, Halloween Spooktacular, Christmas Spectacular & Mayor's Tree Lighting Ceremony, etc; and
Added under City‐sponsored Events/Operations: Limited rentals will be allowed during Music in the Park and MariachiFest including but not limited to the Picnic Shelters and Picnic Areas; however, large attended rentals will not be approved during Music in the Park and MariachiFest.
At the February 7, 2024 regularly scheduled Parks & Recreation Commission Meeting, the Commission completed a final review of the Facility & Open Space Rental Policy for the Dan Diaz Recreation Center, Irwindale Aquatics Center, and Irwindale parks with the following changes and recommend approval to the City Council:
Added under Facility Uses: No Facility may be rented more than two times a week by the same person, organization, non‐profit, or business; and
Added under Security Deposits and Payments: The Security Deposit will be refunded by a City check to the Applicant, or head of household, stated on the application within 30 days upon inspection of the facility and open space area(s), confirmation that no property damage was made or prohibited activities occurred, and there is no additional clean up required as a result of the event; and
Added under Prohibited Activities: The Irwindale Police Department will be contacted if the applicant or anyone in the party uses a tent, jumper, trampoline, bounce house, or moonbounce.
Should the city council approve the naming and dedication of the picnic shelter north of the Irwindale Plaza in honor of Margaret Diaz, then the name of this shelter will be changed to “The Margaret Diaz Pavilion” in the Rental Policy.

Background and Analysis:
At the regularly scheduled meeting of February 28, 2024, Mayor Albert F. Ambriz, requested staff to agendize for council discuss a donation to the Irwindale Sister City Association.
In 2009, the City of Irwindale adopted Resolution 2009‐06‐2364, establishing a donation policy for the City of Irwindale to encourage non‐profit entities to participate in and promote events that are beneficial to the community or serve a public purpose within the mission of the City. The policy allows the City to adequately budget in advance for these types of requests, and provides a process and criteria for the council to follow when considering donation requests. The policy includes an application process, the establishment of a committee to consider the applications, criteria for approval of donations, and recipients’ use of funds. Additionally, this policy provides for the establishment of a donation fund through the budget process.
Per the City’s donation policy, the criteria to qualify for donation is as follows:
1. Applicant: The applicant must be recognized by the IRS as a not‐for‐profit organization and have a minimum of 20% Irwindale residents who actively participate in the organization.
2. Donation Criteria: The applicant must establish that it provides one of the following criteria:
Benefit the Community
Provide a public service or otherwise promote the public health, safety and welfare
3. Recipient’s Obligation to Report Use of Funds: The Association will need to provide a written explanation to the City within 60 days after receipt of the funds indicating how the donated funds benefited the City.
Should the City Council decide to make a donation to the Irwindale Sister City Association, the donation will need to meet the criteria in the Policy. The continuation of this show on the 10‐acre property requires approval from the Housing Authority Board to use the 10‐Acre Site.
It is in the best interest of the community to allow for the use of the 10‐ Acre Site because the City of Irwindale’s 4th of July events provides residents and community members the opportunity to safely celebrate 4th of July in the City Parks with their families and friends while ending the night with a Fireworks Display Spectacular. The City’s Investment Policy applies to all funds held by the City, Housing Authority, Successor Agency, and Reclamation Authority.
