URGENCY ORDINANCE NO. 785 TO ESTABLISH A TEMPORARY

APPLICATIONS OR APPROVALS FOR ANY AND ALL
BILLBOARDS
City Manager Miranda presented the report.
MAYOR AMBRIZ In response to a question by Mayor Ambriz, City Manager Miranda noted that, since Councilmember Ortiz is absent at tonight' s meeting, this matter would require a unanimous vote of the four
Councilmembers in attendance in order to proceed.
CARMEN ROMAN Carmen Roman asked whether the City could weigh in on billboard content and whether the City could still use the billboards located along the 605 freeway. She suggested that fees be collected in amounts equal to those of surrounding cities.
CITY ATTORNEY City Attorney Guerra indicated that the issues raised by Mrs. Roman GUERRA would be explored during the scope of the moratorium.
R. MONTGOMERY Richard Montgomery, representing Outfront Media, noted that his company has operated in Irwindale for 30 years. He stated that his company has applied to convert several static billboards to digital approximately 3. 5 years ago, and again in 2021, and paid thousands in fees at those times. He complained that the process has taken too long. He also objected to the concern to public safety caused by digital billboards and noted the income that digital billboards earn.
FRED BARBOSA Fred Barbosa asked whether the City is in conflict if it is charged with policing its own billboards, to which City Attorney Guerra stated that, if it were not for the City, there would be no authority to regulate the billboards.
CITY MANAGER City Manager Miranda noted that there are currently 42 billboards in MIRANDA Irwindale, with three active applications. Of those, 36 are static billboards.
CITY ATTORNEY City Attorney Guerra stated that staff is concerned that the 36 static GUERRA billboards could be converted to digital, and that staff wishes to study the concern to ensure that appropriate regulations are implemented.

REGULAR MEETING PAGE 5
R. MONTGOMERY Richard Montgomery stated that his company is willing to take down its 32 billboards as part of the ongoing conversion to digital displays.
DENA ZEPEDA Dena Zepeda expressed concern over "brain waves" and suggested that staff monitor " digital stuff."
COUNCILMEMBER Councilmember Garcia asked whether the ordinance could be GARCIA adopted while exempting the three applications currently underway, to which City Manager Miranda stated that he does not foresee any issues in fulfilling this request.
DIRECTOR SIMPSON Director Simpson clarified that there are two active applications at the Park at Live Oak site and are being processed individually.
COUNCILMEMBER Responding to a question by Councilmember Garcia, City Attorney GARCIA Guerra recommended changing the verbiage in the ordinance to reflect that the moratorium would not apply to the three active applications on file, nor would any fee increases apply, if that is what the Council would prefer.
MAYOR PRO TEM Mayor Pro Tern Burrola concurred with Councilmember Garcia and BURROLA asked why the applications have not been fully processed yet, to which Assistant Planner Martin Romero expressed his belief that the applicant is experiencing issues with CalTrans, among other potential issues.
Mayor Pro Tern Burrola requested additional information relating to the delayed applications to resolve the delay quickly.
CITY MANAGER In response to a question by City Manager Miranda, Mr. Montgomery MIRANDA indicated that the Kincaid side is owned by Outfront Media, and that Five Points owns the westside.
DIRECTOR SIMPSON Director Simpson added that, should the Council approve the moratorium except for the three active applications, staff would continue to process these applications.
