Julian A. Miranda, City Manager
Background and Analysis:

On June 24, 2024, the City of Irwindale ("City") received a letter from the County of Los Angeles Department of Public Works ("County") formally terminating the 60+ year contract for Building and Safety services ("B&S") with the City (Attachment “A”). On September 11, 2024, the City Council received a report from staff including options for staffing the B&S Division and approved a transition plan utilizing a combination of city staff and contract services at a combined estimated cost of $1,100,000.

To implement this transition plan, the City initiated the recruitment of a Permit Technician and Building Inspector, and released an RFP for an on-call, as needed B&S inspector and plan check services. There were no successful Building Inspector candidates yielded through the application process and staff is further evaluating the best path forward for recruiting an ideal candidate. The interviews for the Permit Technician is scheduled for January 7, 2025, and staff anticipate a start date shortly after.

The County’s contract for B&S services will terminate on December 31, 2024. Although staff have attempted to recruit the Permit Technician and Building Inspector positions, both remain vacant as of the date of this report. Additionally, the City does not have a plan checker in place. The initial transition included an RFP for as-needed services, with the intent of supplementing the City’s staff.

However, the vacancy in these positions has created an urgency for the City to enter into a one-year agreement for a consultant to provide B&S services. There is currently no need for this arrangement to include a Permit Technician or permitting software, as the County has committed to providing both a Permit Technician and permit software to the City through February 2025.

Section 3.44.080 (H) of the Irwindale Municipal Code states that the City Council can dispense with bidding when “when the city council determines by resolution it would be in the best interest of the city to dispense with bidding; provided, however, that the city council shall state the basis of its determination”. The County will no longer provide building and safety services to the City after December 31, 2024, and the City has a responsibility to enforce state regulations mandating specific requirements for buildings and Title 24. The proper use and enforcement of Title 24 will ensure healthy, safe, sustainable, and accessible buildings and grounds in the City of Irwindale. As a result, it is necessary for the City Council to take immediate action to ensure the continuity of building and safety services.

On November 8, 2024, staff issued a Request for Proposals (RFP) for As-Needed Building and Safety Division Plan Check and Inspection Services. Staff received three (3) proposals from qualified firms on December 3, 2024. Each proposal was evaluated based on technical competency, project understanding, experience, staff qualifications, and an assessment of existing contracts with other government agencies providing similar services. Following the evaluations, interviews were conducted with the top candidates.

Transtech Engineers, Inc. was determined as the most qualified firm to provide the required services. Staff

Page 126 of 167 ends

recommended that the City Council award the As-Needed Building and Safety Division Plan Check and Inspection Services contract to Transtech Engineers, Inc., as outlined in a separate agenda report. Staff is also recommending that the City Council approve a contract with Transtech Engineers, Inc. (Transtech) for a one-year term to provide B&S Services. In the event an ideal candidate for the Permit Technician position isn't found, Transtech has sufficient staffing to assist in this area as well. Additionally, the City expects to have the permit software implemented by February 2025. However, should there be delays, Transtech’s proposal also includes the use of their software that can interface with the City’s website.

During the one-year agreement, staff will re-evaluate the job description and the required experience for the Building Inspector position, continue with the recruitment for the Permit Technician, and fully implement the permitting software. As staff works on this implementation, assessments will be made to determine the viability of the transition and/or whether an alternative solution will be needed, and if required, staff will report back to the City Council for further directions.

The Agreement is being prepared by the City Attorney’s office and is subject to approval by the City Manager and subject to approval as to form by the City Attorney.

Fiscal Impact:

The City permanently pays for B&S services through the revenue earned from permit processing and plan check fees. Staff is not proposing to change the current budget at this time, since budget impacts are yet to be determined based on: 1) when Transtech Engineers, Inc. exactly begins providing B&S services, and 2) the number of permits issued in the remaining months of the FY 2024-2025. If warranted, staff may recommend adjusting the budget later in the fiscal year.

Item #6.F.

Date: December 19, 2024
To: Honorable Mayor and Members of the City Council
From: Julian A. Miranda, City Manager
Issue: Ratification of Total Contract Amount for and Approval of Amendment No. 2 to the Professional Services Agreement with Clean Coalition for Battery Energy Storage System (BESS) Consultation Services
City Manager's Recommendation:

Ratify the Total Contract Amount for, and Payments to, Clean Coalition for Battery Energy Storage System (BESS) Consultation Services.

Background and Analysis:

On November 8, 2024, the City Manager, on behalf of the City of Irwindale ("City"), entered into a Contract Services Agreement ("Agreement") with Clean Coalition ("Consultant") to conduct an inperson workshop providing information on battery energy storage systems (“BESS”) in the amount not to exceed $20,000. The Agreement was made pursuant to Resolution No. 2019-27-3111, Section 3, related to the City’s Purchasing Policy authorizing the City Manager to award contracts up to $30,000.

Page 132 of 167 ends

On November 13, 2024, the City of Irwindale Planning Division hosted a public workshop to provide information on battery energy storage systems (BESS). The presentation was made by Consultant, which is a nonprofit organization whose mission is to accelerate the transition to renewable energy and a modern grid through technical, policy, and project development expertise.

Speakers from the City and Consultant provided an overview of BESS technology and its anticipated impacts on host communities, presenting example projects, and responding to all stakeholders’ inquiries as they learned about this industry.

Due to the overwhelming amount of technical information received, both the City Council and the Planning Commission suggested having another public workshop offering additional opportunity for community engagement in the BESS industry discussions.

On December 11, 2024, Consultant’s agreement was amended to include a second in person workshop, for an additional amount of $9,900, bringing the contract total to $29,900 ($20,000 + $9,900) to provide another in-depth presentation on BESS including illustrations tailored to the City of Irwindale and its boundaries and responding to both City Council and community’s inquiries on this subject.

On December 18, 2024, Amendment No. 2 to the Consultant’s agreement was made to include three (3) additional meeting attendance to provide consultation, including but not limited to making a presentation, responding to inquiries, and advising the City on comments made by other third-parties about BESS or related projects. The cost for this contract amendment is not to exceed $12,500, which brings the total contract amount to $42,400 ($29,900 + $12,500), exceeding City Manager’s administrative amount.

Irwindale Municipal Code (IMC) 3.44.020 Definition of “Services” exempts professional or other contractual services for which the procedure for procurement is specifically provided by law or approved city procedures or are in their nature unique and not subject to competition. The City has adopted a Purchasing Policy, which sets forth the procurement process for Professional Services. City staff have complied with Irwindale Purchasing Policy Section 5 Professional Consultant Selection requirements such that the contract is exempt from the centralized purchasing requirements of IMC Chapter 3.44, per IMC sections 3.44.060 and 3.44.080(D).

Staff requests that the City Council ratify the total fee amount of $29,900 previously approved by the City Manager and approve Amendment No. 2 for an additional $12,500 needed for the next three (3) virtual meetings' attendance, bringing the contract total to $42,400.

The Agreement is being prepared by the City Attorney’s office and is subject to approval by the City Manager and subject to approval as to form by the City Attorney.

Fiscal Impact:

Fiscal Year 2024-2025 Adopted Budget includes sufficient funding to cover this contract. No additional funding is being requested.

CITY NEEDS".

The approved expenditure plan appropriated funding as identified in Exhibit "A" of Resolution No. 2024-108-3585. During the purchasing process, some cost overruns and cost savings were realized, resulting in a need for the Council to reallocate these funds. Staff recommend the reallocation of ARPA funds as listed on Exhibit "A" of Resolution No. 2024-113-3590.

Fiscal Impact:

Although the City has already received $345,914 in ARPA funds from the federal government, the City Council’s appropriation and reallocation of these funds will have no net fiscal impact on the City. With these ARPA funds guaranteed to be obligated by the deadline of December 31, 2024, and expended by the deadline of December 31, 2026, the City will be in compliance with the Treasury Department’s Final Rule requirements and avoid having to return these funds to the federal government.

From: Julian A. Miranda, City Manager
Issue: Consideration of Proposed Personnel Adjustment
City Manager's Recommendation:

Authorize the proposed personnel adjustment as outlined in this report by adopting Resolution No. 2024-114-3591 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF IRWINDALE REPEALING AND REPLACING RESOLUTION NO. 2024-90-3567, AND ESTABLISHING THE NUMBER OF POSITIONS, SCHEDULE OF CLASSES, AND COMPENSATION FOR CITY EMPLOYEES." Background and Analysis:

Personnel Request
With the recent promotion of the Police Records Clerk/Dispatcher to the Communications and Records Supervisor position, staff proposes defunding the vacant Police Records Clerk/Dispatcher position and funding a Police Records Clerk position.

The Police Records Clerk classification differs from the Police Records Clerk/Dispatcher classification in that the latter includes additional duties such as covering dispatch shifts for short periods. However, with the approval of an additional full-time Police Dispatcher/Clerk position in Fiscal Year 2023-24, and the Communications and Records Supervisor’s ability to fill dispatch shifts as needed, there is no longer a requirement for the Police Records Clerk position to assist with dispatch duties. As a result, the position can now focus on supporting the Records unit within the Police Department.

Compensation Resolution 2024-114-3591
Article VIII, Section 803 of the City Charter authorizes the City Council to establish, by resolution, a classification plan, salaries, and other forms of compensation for all City employees.

The City's Compensation Resolution is updated periodically as a result of personnel adjustments and/or compensation adjustments. It was most recently updated November 13, 2024, through the City Council's adoption of Resolution No. 2024-90-3567.

Proposed Resolution No. 2024-114-3591 sets forth the current compensation ranges, position titles, and number of positions for all City classifications. This resolution meets the requirements for a publicly available pay schedule as required by CalPERS. (2 C.C.R. §570.5.) The list of classifications in the exhibit to Resolution No. 2024-114-3591 reflects the personnel request outlined in this report.

Fiscal Impact:

Defunding the Police Records Clerk/Dispatcher position and funding a Police Records Clerk position results in an annual cost savings of approximately $22,000 to the general fund.

The adoption of Resolution No. 2024-114-3591 authorizes the Finance Director to amend the Fiscal Year 2024-2025 Adopted Budget to include the changes as stated in this report.

In the event that this Resolution conflicts with the benefits granted or the restrictions imposed pursuant to any Memoranda of Understanding negotiated with these Recognized Employee Organizations, the applicable Memoranda of Understanding shall govern as to that particular employee bargaining unit.

SECTION 7. Salary and Wage Schedules.

The City Council hereby approves the number of positions, list of class titles, and compensation for all City job classifications reflected in Exhibit A, effective December 19, 2024.

If any employee is receiving compensation above the highest step of the salary range stated in this resolution for his/her position, the employee’s present rate shall be continued as an approved additional step rate for the class (“Y-rated”), until the highest step is greater than the Yrate. Except as provided herein or an applicable MOU, no non Y-rated employee may be adjusted to a Y-rate upon reclassification or promotional appointment, and the Y-rate shall no longer be in effect after the termination of the employment in that class of the incumbent(s) on whose behalf the Y-rate is authorized. Nothing in this resolution shall prohibit any Y-rated employee from receiving a cost-of-living adjustment that other employees within the employee’s applicable bargaining group may receive pursuant to an applicable Tentative Agreement or MOU.
