REGULAR MEETING PAGE 7
Mayor Pro Tem Ortiz noted that industrial buildings can be over 60 feet if located more than 250 feet away from a residential area and suggested that the height be lowered to 50 feet instead, to which Mr.

Pergakes noted that, though this was the Planning Commission's recommendation, it could be changed by the Council.

COUNCILMEMBER Councilmember Ambriz stated that he could understand why the AMBRIZ heights of buildings fronting the freeway could be higher, to which Mr.

Pergakes advised that there are properties that are being rezoned and that if a development comes in, they could utilize the zoning district category. However, properties that are zoned M2 would be subject to the action taken tonight.

Councilmember Ambriz stated that he is open to allowing buildings fronting freeways to be taller than 50 feet. He also requested that the conditions be re-worded to the authority's threshold of 10%, not to exceed 15,000 square feet, and that the City Council should have the ultimate authority in decision making, with the Planning Commission providing review and recommendation support.

NICK PERGAKES Nick Pergakes stated that the Kaiser Permanente building is about 60 feet high, and that it was used in the review and research for building heights.

DIRECTOR SIMPSON Director Simpson noted that staff did not wish to create non- conformities with buildings that have recently been approved, which is why 60 feet maximum heights in M2 zones was recommended and noted that discussions were held about allowing building heights to be higher when fronting the freeway.

MAYOR BURROLA Mayor Burrola asked about the outcome of the workshops that were held to discuss the matter, to which Director Simpson stated that it was recommended for building heights to be a maximum of 60 teet, and residents were very interested in creating a buffer zone between industrial buildings and residential neighborhoods.

Responding to a question by Mayor Burrola, Director Simpson advised that the update originally would have allowed administrative review and approval for projects up to 25,000 square feet in size, though that was later reduced to 15% or a maximum of 15,000 square feet.

DENA ZEPEDA Dena Zepeda stated that the residents wish to allow maximum building heights of 60 feet and that the Council should have final authority on all development projects. She also suggested that a butter between industrial bulldings and residential units be increased from 250 feet.
