MAYOR PRO TEM In response to a question by Mayor Pro Tem Ortiz, Mrs. Patel advised ORTIZ that the property owner would pay for the construction and maintenance of the sewer for the duration of the Community Facilities District.
COUNCILMEMBER Councilmember Ambriz asked about the relation between the AMBRIZ Community Facilities District and Los Angeles County Sanitation, to which the consultant stated that discussions have been held to determine which portion the County would be responsible for.

on the side in order to widen the streets to the 20-foot right-of-way.
Once done, the contractor would repave the existing streets to tie into the existing roadway at the intersection. Director Chan added that he does not foresee any issues with residents moving in and out of the street.
Mayor Burrola also asked about the timeline for the project’s completion, to which Director Chan indicated that it would take a bit over a year, and added that staff would try to expedite the process.
Responding to an additional question by Mayor Burrola, Director Chan indicated that the existing building would be demolished and noted that the Council could decide whether it wants the site repaved.
FRED BARBOSA Fred Barbosa stated that the median improvements along Arrow Highway would make it very difficult to enter and exit the buildings, to which Director Chan advised that the original intent of the median was to keep motorists from turning right onto the property. However, the median was redesigned to restrict any left-hand turn movement into the property.
ITEM NO. 21C UPDATED RECREATIONAL VEHICLE ORDINANCE
UPDATED
RECREATIONAL
VEHICLE ORDINANCE
CITY MANAGER City Manager Miranda presented the staff report.
MIRANDA
MAYOR PRO TEM Mayor Pro Tem Ortiz asked about parking RVs within homeowners’ ORTIZ properties, to which Director Simpson advised that the updated Zoning Code requires the parking of any RV to maintain the front yard setback, which typically for residential streets is 20 feet. The site would also have to have a paved surface for the RV to be parked, and the parking area could not exceed 350 square feet of paved or improved surfaces. Parking in the side yard or on a secondary driveway would also have specific requirements, which staff from Community Development and Engineering would need to look into.
MAYOR BURROLA Mayor Burrola asked about parking RVs on a corner lot, to which Director Simpson advised that there is nothing in the Building or Engineering codes that explicitly require that they have a driveway. If somebody is running over the curb or gutter, then the issue could be brought to the City Manager and the City Council.
Mayor Burrola also asked about setback requirements, to which Director Simpson advised that residential properties typically have a 20-foot setback from the front yard property line, and that side yards have a five-foot setback. Mayor Burrola stated that he would like to see a diagram for a corner home.

REGULAR MEETING PAGE 7
MAYOR PRO TEM Mayor Pro Tem Ortiz suggested that the ordinance also include ORTIZ verbiage indicating that individuals that damage the public right of way or public sidewalk would be responsible for the repairs.
COUNCILMEMBER Councilmember Ambriz stated that a 20-foot setback from the AMBRIZ property line is excessive and suggested modifying the requirement.
BARRY BLANSET Barry Blanset agreed that a 20-foot setback is excessive. He also expressed his opinion that the ordinance would unfairly punish residents and suggested that the City find a location where residents can park their RV’s.
MARIA ALVAREZ Maria Alvarez spoke on the difficulty of moving RVs on smaller streets such as Calle de Paseo and suggested that the City simply requires yearly permits that could be sold to residents.
ROBERT MORAGO Robert Morago requested documentation showing that parking RVs on city streets is indeed a health and safety issue and concurred that RV parking permits should be sold to residents. He also questioned why the ordinance would limit the number of permits that residents could purchase per year and agreed that a 20-foot setback from the property line is excessive.
GARY STROBEHN Gary Strobehn indicated that the state has enacted a law that prohibits parking vehicles within 20 feet of crosswalks. He also stated that concrete documentation demonstrating the number of injuries or accidents caused by visibility impairment due to parked RV’s has yet to be presented. He then stated that the belief that RVs are unattractive in that they draw vandals and squatters is subjective and suggested that annual permits be issued to resident RV owners.
FRED BARBOSA Fred Barbosa suggested that the setback length for properties on Calle de Paseo be grandfathered in to match past requirements and requested that electrical extension cords be allowed to run from homes to parked RVs.
MAYOR PRO TEM Mayor Pro Tem Ortiz stated that the draft ordinance contains all the ORTIZ requirements that the Council wishes to enact.
COUNCILMEMBER Councilmember Ambriz agreed that an ordinance is needed by AMBRIZ disagreed with the 20-foot setback requirement. He stated that he would be amenable to approve of a 10- or 5-foot setback instead.
MAYOR BURROLA Mayor Burrola noted that this matter had been addressed twice in the past by the Council with no result. He acknowledged that he previously owned a toy hauler and a boat, and though they were sometimes parked on the streets, he also had the stored elsewhere since he did not like having them on the street. He acknowledged that some still have questions regarding the ordinance and suggested that the ordinance be tabled until answers could be provided, and asked

REGULAR MEETING PAGE 8
City Attorney Guerra about setback requirements, to which he responded by advising that setback requirements are spelled out in the zoning code and that, to the extent there is a requirement, it is a policy decision made by the Planning Commission and City Council, and not a state mandate.
DIRECTOR SIMPSON Director Simpson advised that the code contains fence height limitations, for example, to provide visual clearance. If a motorhome or RV is parked at the front of a home, there should still be visual clearance for other automobile drivers and not just the vehicle’s owner.
CITY ATTORNEY City Attorney Guerra clarified that the subject tonight pertains to GUERRA parking in the public right of way and that, should there be interest in discussing parking on private property, the matter would be discussed separately as part of the zoning process.
MAYOR BURROLA Responding to a question by Mayor Burrola, Director Simpson advised that she is not aware of a code that would require that RVs parked on the side of a house be gated. Mayor Burrola reiterated his desire to table this matter to the next meeting for further discussion.
CITY ATTORNEY City Attorney Guerra noted that parking RVs in private property would GUERRA be a separate discussion and asked whether the Council was comfortable with the ordinance presented tonight that addresses parking in public right of way, to which Mayor Burrola stated that he would prefer both matters addressed at the same time.
COUNCILMEMBER Councilmember Ambriz stated that he would support the request to AMBRIZ continue this matter if the topics discussed tonight are addressed at that time, to which City Manager Miranda advised that the comments made tonight would be incorporated and presented to the Council at its July 23 meeting.
MOTION A motion was made by Mayor Burrola, seconded by Councilmember Ambriz, to table this matter to the July 23 Council meeting. The motion was unanimously approved; Councilmembers Breceda and Garcia absent.

DIRECTOR SIMPSON Director Simpson presented the staff report.
COUNCILMEMBER Councilmember Ambriz questioned the need to conduct a noise AMBRIZ survey, to which Director Simpson responded by indicating that the survey could be conducted at the discretion of the Council and noted that the municipal code already addresses noise levels which could be enforced by Code Enforcement staff.
MAYOR PRO TEM Responding to a question by Mayor Pro Tem Ortiz, Director Simpson ORTIZ indicated that the Planning Commission recommended that, if an additional BESS facility is proposed, then staff, Los Angeles County Fire, and potential consultants should analyze the proximity between the proposed and existing BESS sites and consider whether any issues would arise.
Mayor Pro Tem Ortiz explained his understanding that it was previously determined that BESS sites should remain at least one mile away from each other, to which Councilmember Ambriz stated that the one-mile distance requirement relates to a BESS site and a substation, which Director Simpson and City Manager Miranda concurred with.
MAYOR BURROLA Mayor Burrola asked about the requirement to install facility lines underground except with written approval or otherwise granted by the City, to which Director Simpson advised that deviation from installing the lines underground would require a variance, which itself would require very specific findings to be made.
Mayor Burrola asked why a variance should be listed as an option, to which Director Simpson responded by indicating that it was included to offer the Council options. Mayor Burrola suggested removing that

option, to which Councilmember Ambriz asked City Attorney Guerra whether doing so would cause a legal issue, who responded that Mayor Burrola’s request could be added as a standard, like any other standard and that, if the applicant wished to deviate, they could apply for a variance.
Mayor Burrola stated that he was not comfortable with considering overhead lines, to which City Attorney Guerra advised that, in land use law, whenever there is a standard, a property owner may request a variance to deviate from the standard, which could be granted if the request met certain requirements. City Attorney Guerra suggested leaving the verbiage as-is.
