ITEM NO. 20I SECOND READING OF ORDINANCE NO. 799 – BILLBOARDS
SECOND READING OF
ORDINANCE NO. 799 –
BILLBOARDS
MAYOR BURROLA In response to a couple of questions by Mayor Burrola, Senior Planner Jones advised that the proposed ordinance would allow billboards that exceed 75’ in height on certain conditions that include obstructions and freeway elevation and with City Manager approval.
Requests that exceed the 75’ in height would be subject to zone variance procedures.
COUNCILMEMBER Councilmember Ambriz asked whether the Council would have final AMBRIZ authority to approve or disapprove billboards based on height requirements, to which Senior Planner Jones advised that some may be approved by the City Manager based on specific criteria, but those that do not meet the criteria would require the zone variance process, which would be addressed first by the Planning Commission and then by the City Council.
MARK KUDLER Mark Kudler, President of Bulletin Displays, stated that some of the billboards his company has developed exceeded height requirements of other cities due to the structures’ architecture and recommended that the Council allow the City Manager to approve billboards with heights that exceed height requirements due to the structures’ architecture.
COUNCILMEMBER Councilmember Ambriz asked for City Attorney Guerra’s input, to AMBRIZ which he advised that approving Mr. Kudler’s request or not would be up to the Council’s discretion. However, changing the proposed ordinance at this point would require further discussions regarding the definition of “architecture” in this context as well as doing a first reading of the revised ordinance followed by a second reading.
MAYOR BURROLA Mayor Burrola requested that the proposed ordinance be revised to incorporate the suggestion made by Mr. Kudler, preparing a notice for a public hearing, and return the ordinance to the Council for a first reading.

MAYOR BURROLA Mayor Burrola stated that this issue has been discussed many times over the years and that a lack of Council action may endanger others.
COUNCILMEMBER Councilmember Breceda reiterated that the ordinance is too BRECEDA aggressive as presented and that the parking of RVs has never been a problem. He stated that he was not aware of any RVs being involved or causing accidents within the City. He suggested that the City prosecute those that are improperly living in RVs or dumping into storm drains rather than enacting the ordinance that would affect all residents.
