CITY COUNCIL MINUTES SEPTEMBER 24, 2025
REGULAR MEETING PAGE 5
MAYOR BURROLA In response to a question by Mayor Burrola, City Attorney Guerra advised that, procedurally, the Planning Commission is required to review and recommend taking action on the ordinance by the City Council. In this case, since the Council has already looked at the policy aspects of the ordinance, it is just a matter of going through the procedure to adopt the ordinance, which would require that the Planning Commission review the draft and make recommendations to the Council. For tonight, the only actions before the Council would be to decide whether it prefers to conduct the mailing and the windshield survey, though he expressed concern since the commission does not usually have the authority to create or authorize expenditures, since it is usually a Council decision.

FRED BARBOSA Fred Barbosa asked whether any resident properties would be grandfathered in and whether the rules would apply to all residents.

He stated that those properties that are grandfathered in may be challenged in court, to which City Attorney Guerra noted that the matter that Mr. Barbosa mentioned is not on the agenda tonight. The only matters for Council discussion are the two that are listed in the staff report, and the ordinance is not attached to the staff report.

Mr. Barbosa asked additional clarifying questions regarding a proposed ordinance, to which City Attorney Guerra reiterated that the ordinance is not on the agenda and is not being discussed tonight.

MAYOR PRO TEM Mayor Pro Tem Ortiz spoke against authorizing staff to conduct the ORTIZ windshield survey, partly since it would cost funding. He also asked whether the notices would be mailed to all addresses within the City.

COUNCILMEMBER Councilmember Ambriz thanked the Planning Commission but noted AMBRIZ that the Council has already considered policy issues and RV parking regulations. He added that it is unnecessary to conduct a survey or other information gathering since the issues have already been fully discussed by the Council. He then stated that the ordinance should be returned to Planning Commission for review and recommendation to the Council.

MAYOR BURROLA Mayor Burrola concurred that the matter should be returned to the Planning Commission for review.

MOTION A motion was made by Councilmember Ambriz, seconded by Mayor Pro Tem Ortiz, to remit the ordinance to the Planning Commission for review and recommendation to the City Council, and deny the preparation and mailing of a citywide notice and the windshield survey as outlined in the staff report. The motion was approved with Mayor Burrola in favor, and Councilmembers Breceda and Garcia opposed.
