Background and Analysis:
At the March 25 City Council meeting, Councilmember Garcia requested a report regarding the status of the electrical infrastructure at City facilities, specifically the Dan Diaz Recreation Center and Irwindale City Hall/Police Department.
Dan Diaz Recreation Center - 16054 Calle De Paseo
The facility is served by a 1200-amp, 3-phase, 120/208-volt electrical service. • There are currently six (6) subpanels throughout the facility. • All subpanels are in good internal condition, with adequate conduit sizing and feeder wiring that comply with current NFPA 70 electrical code requirements. • The existing subpanels currently operate below their maximum allowable ampacity (power capacity), and most have sufficient capacity available for future expansion, if needed.
Irwindale City Hall / Police Department - 5050 N. Irwindale Avenue The facility is served by:
• One (1) 300-amp, single-phase, 120/240-volt service; and • One (1) 400-amp, 3-phase, 240-volt service dedicated to air handlers and heating equipment.
There are currently eight (8) subpanels within the facility. • One subpanel is dedicated to the City’s server equipment and has adequate capacity available for additional server racks, if needed.
• All subpanels are in good internal condition, and three (3) panels have available capacity for future expansion.
Staff are aware that some of the electrical panels are older and may no longer be in production.
However, compatible replacement breakers manufactured to fit the original equipment specifications remain available. Staff are also aware that several panel covers are not aesthetically pleasing; however, they remain safe and fully operable.

Background and Analysis:
The City of Irwindale updated its Zoning Code, which became effective on May 9, 2025. The purpose of the Zoning Code, as set forth in Chapter 17.01, is to protect and promote the public health, safety, peace, comfort, convenience, prosperity, and general welfare of the City and its residents through the establishment of land use regulations and zoning designations. At present, the Zoning Code does not expressly identify or regulate data processing centers, data centers, server farms, or similar facilities characterized by the operation of computer servers, network infrastructure, digital storage systems, and related equipment used for the processing, storage, transmission, and management of electronic data. As such, the City has determined that such uses are not adequately contemplated within the existing zoning framework.
Since the Zoning Code’s recent update, the City has recognized recent and ongoing discourse regarding the effects of data centers including: substantial and continuous electrical demand, often supported by diesel or gas-powered backup generation systems – consequently raising concerns over air quality.
Such facilities may also generate significant levels of noise, require significant water usage for cooling systems, and create pressure for related infrastructure and land use changes.
In recent years, local agencies throughout California have begun evaluating such effects. Neighboring cities, like the City of Monterey Park and El Monte, have similarly imposed moratoriums in order to review such effects, devise mitigation plans, and contemplate potential regulation for data center use.
If the City were to make similar studies and evaluate the impacts of data centers and draft regulations to mitigate such effects, additional time would be needed, and such interim ordinance would be necessary.
Staff recommends adopting an interim urgency moratorium on the processing and approval of applications for data centers, new construction of data centers, and the replacement or conversion of existing facilities into data centers in order to mitigate or avoid the potential adverse impacts of such uses by allowing the City staff an opportunity to study these potential impacts before they occur and to develop changes to the zoning code which will allow City’s goals and objectives to be met.
Analysis:
Government Code section 65858(a) provides that “[w]ithout following the procedures otherwise required prior to the adoption of a zoning ordinance, the legislative body of a county, city, including a charter city, or city and county, to protect the public safety, health, and welfare, may adopt as an urgency measure an interim ordinance prohibiting any uses that may be in conflict with a contemplated general plan, specific plan, or zoning proposal that the legislative body, planning commission or the planning department is considering or studying or intends to study within a reasonable time.”
Here, the proposal at issue is the review of regulations for data centers. In order to review and potentially update these regulations, it is necessary for the City to first study (1) the potential impacts data centers may have on the public safety, health, and welfare of the City; (2) the need for an increase in the annual development fee specified in any development agreement to mitigate impacts from data
centers; (3) and the regulations applicable to data centers and the need to further adopt additional appropriate regulations. City staff believes that a Temporary Moratorium is necessary to ensure that any data centers will be subject to potentially updated regulations. More importantly, without the Temporary Moratorium, processing and permitting the development of data centers with regulation would potentially impose the aforementioned negative effects of data centers.
If adopted, the Temporary Moratorium would read as follows: “During the effective period of this Ordinance, no application for a data center shall be processed or approved, no consideration of any application for a data center shall be made, and no replacement or conversion of an existing facility into a data center shall be approved.”
During the period of this Ordinance, including any extension period, the City shall study the effects of data centers and develop as necessary City regulations, rules, procedures and fees relating to the amelioration of any such effects, if deemed possible to ameliorate, in order to enable the City to adequately and appropriately preserve the public safety, health, and welfare of the communities in the City of Irwindale and mitigation for any related impacts.
If adopted, the Ordinance shall be effective for forty-five (45) days following the date of its adoption unless extended in accordance with the provisions set forth in Government Code Section 65858. Note, not later than ten (10) days prior to the expiration of this interim urgency Ordinance, the City Council shall issue a written report as required by applicable state law.
Staff is further recommending that this Ordinance be adopted as an urgency measure in accordance with Government Code sections 36934 and 36937. An urgency measure is authorized for the immediate preservation of the public peace, health or safety and shall take effect immediately upon a four-fifths vote of the City Council.
Here, enacting the Ordinance through the regular procedure (i.e. two readings and waiting thirty days for said ordinance to become effective) will be detrimental to the public peace, health or safety because, during that period, the processing and development of data centers would be done without the benefit of the implementation of proper use regulations. As a result, such a development will impose potential impacts to the community. It is therefore necessary that this Ordinance go into effect immediately upon adoption for the immediate preservation of the public peace, health or safety.
Environmental Impact:
Pursuant to Section 15001 of the California Environmental Quality Act ("CEQA") Guidelines, this interim urgency Ordinance is exempt from CEQA based on the following:
1. This Ordinance is not a project within the meaning of Sections 15060(c)(3) and 15378 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, either directly or indirectly.
2. Alternatively, this Ordinance is also exempt pursuant to Section 15061(b)(3) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, since the proposed ordinance involves a temporary moratorium on the processing of applications or approvals for any and all data centers and it can be seen with certainty that there is no possibility that the Ordinance may have a significant impact on the environment.

C. Under Chapter 17.02.050 of the Zoning Code, where a proposed use of land is not specifically listed in Article II (Zoning District Regulations), the use shall only be
01005.0001 2124579.2 5/22/2026
permitted upon certain findings and procedures made by the Community Development Director as prescribed therein.
D. A data processing center, data center, server farm, or similar use consisting primarily of a building or facility housing computer servers, network infrastructure, digital storage systems, and related equipment used for the processing, storage, transmission, and management of electronic data is not a land use expressly enumerated or adequately contemplated within the Zoning District Regulations of the Zoning Code.
E. Following review of public studies, it has been found that large data centers have high and continuous electricity demand, often supported by diesel or gas backup generation with associated air quality, greenhouse gas, and noise impacts; that they may place significant demands on local water supplies for cooling; and that they can drive related infrastructure and land use changes, all of which have been specifically identified as needing robust CEQA analysis.
F. The City of Irwindale does not have land use policies or standards in place to regulate the location and operation of data centers within the city-limits that would address compatibility with surrounding uses and safety, amongst other issues. An urgency ordinance would provide the City sufficient time to study the impacts of data centers and develop the necessary regulations to protect the public health, safety, and welfare.
G. The City’s current Zoning Code does not contain criteria specifically for data center facilities. The City has a significant interest in preserving the public safety, health, and welfare of the City. While this interim ordinance is in effect, the City intends to study and consider land use development policies and standards related to data centers that should be added to the City’s General Plan and Zoning Regulations.
H. The City believes it is necessary to conduct a comprehensive review of the existing regulations regarding data centers, explore best practices from other jurisdictions, and develop a framework consistent with applicable laws and regulations to address potential harmful impacts caused by the establishment, construction, and operation of data centers.
Regulations governing data centers provide certainty to the public and private property owners regarding the City’s overall expectations for developing and operating such land uses. Such regulations would also function to protect the public health, safety, and welfare of its residents, workers, and visitors. To prevent frustration of these studies and the implementation of new regulations, the public interest, health, safety, and welfare require enactment of this Ordinance. The absence of this Ordinance would impair the City’s ability to fully evaluate the impacts associated with such uses and to develop appropriate regulatory standards to address those impacts, as well as the orderly and effective implementation of contemplated data center regulations.
01005.0001 2124579.2 5/22/2026
I. The absence of this Ordinance would further render any delayed adoption or enforcement of such regulations to impede on the reasonable reliance interests of applicants who commenced or prepared for development.
J. Based on the foregoing, the City finds that that this Ordinance is necessary in order to protect the City from the potential effects and impacts of data center land uses and the accompanying impacts from energy use, noise, air quality, aesthetic impacts to the City, and other similar or related effects on property values and the quality of life in the City’s neighborhoods.
K. The City Council further finds that this moratorium is a matter of local and Citywide importance and is not directed towards any business that currently seeks build or operate a data center.
L. The City Council finds that this Ordinance is authorized by the City’s police powers. The City Council further finds that the length of the moratorium imposed by this Ordinance will not in any way deprive any person of rights granted by state or federal laws, because the moratorium is short in duration and essential to protect the public health, safety and welfare.
SECTION 3. MORATORIUM.
During the effective period of this Ordinance, including any extension period, no application for the use or development of a data center shall be processed or approved, no consideration of any application for a data center shall be made, and no replacement or conversion of existing warehouse or facility into a data center shall be made.
SECTION 4. DEFINITION AND INTERPRETATION.
As used herein use of “Data Center” shall mean a data processing center, server farm, or similar consisting primarily of a building or facility housing computer servers, network infrastructure, digital storage systems, and related equipment used for the processing, storage, transmission, and management of electronic data.
This Ordinance must be broadly construed to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Ordinance.
SECTION 5. URGENCY MEASURE.
Based on the findings set forth in Section 2 above and incorporated herein, the City Council declares that this Ordinance is necessary as an urgency measure to preserve and address existing and immediate threats to the public safety, health, and welfare. To enact the Ordinance after giving notice, holding a public hearing, and two (2) readings thereof, and thereafter wait thirty (30) days for said Ordinance to become effective, will be detrimental to the public safety, health, and welfare, in that during the
01005.0001 2124579.2 5/22/2026
interim period new applications for data centers may be processed, approved, or established without the benefit of conducting studies and the subsequent implementation of proper use regulations and, as a result, such a development will continue or intensify impacts to the community.
It is therefore necessary that this Ordinance go into effect immediately upon adoption. This Ordinance, therefore, is adopted pursuant to the provisions of Sections 36934, 36937, and 65858 of the California Government Code, shall be adopted by a fourfifths vote of the City Council, shall take effect immediately upon its adoption pursuant to Section 36937, subd. (b) of the California Government Code.
The City further reserves, and gives notice of, its right to extend the effects of this Urgency Ordinance by an additional 22 months and 15 days in the future, pursuant to Government Code Section 65858, subd. (b).
SECTION 6. REVIEW, STUDY, AND REPORT.
During the period of this Ordinance, including any extension period, the City shall study the effects of data centers and develop as necessary City regulations, rules, procedures and fees relating to the amelioration of any such effects, if deemed possible to ameliorate.
Pursuant to Government Code Section 65858, subd. (d), 10 days prior to the expiration of this Ordinance, the City will issue a written report describing the measures taken to alleviate, if possible, the conditions which led to the adoption of the ordinance.
SECTION 7. CEQA COMPLIANCE.
Pursuant to Section 15001 of the California Environmental Quality Act ("CEQA") Guidelines, this interim urgency Ordinance is exempt from CEQA based on the following:
A. This Ordinance is not a project within the meaning of Sections 15060(c)(3) and 15378 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, either directly or indirectly.
B. Alternatively, this Ordinance is also exempt pursuant to Section 15061(b)(3) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, since the proposed ordinance involves a temporary moratorium on the processing of applications or approvals for any and all data centers and it can be seen with certainty that there is no possibility that the Ordinance may have a significant impact on the environment.
Staff is directed to file a Notice of Exemption with the Los Angeles County Clerk’s office within five (5) working days of the adoption of this Ordinance.
01005.0001 2124579.2 5/22/2026
SECTION 8. SEVERABILITY.
The City Council hereby declares, if any provision, section, subsection, paragraph, sentence, phrase or word of this Ordinance is rendered or declared invalid or unconstitutional by any final action in a court of competent jurisdiction or by reason of any preemptive legislation, then the City Council would have independently adopted the remaining provisions, sections, subsections, paragraphs, sentences, phrases or words of this Ordinance and as such they shall remain in full force and effect.
SECTION 9. PUBLICATION.
The Chief Deputy City Clerk shall certify as to the passage and adoption of this Urgency Ordinance and shall cause the same to be published in a manner prescribed by law.
SECTION 10. TERMINATION OF ORDINANCE.
This Ordinance shall take effect immediately, pursuant to the authority conferred upon the City Council by Government Code sections 36934, 36937(b), and 65858. This Ordinance shall be of no further force and effect 45 days following the date of its adoption unless extended in accordance with the provisions set forth in Government Code Section 65858.
