Monday, December 13, 2021 - 7:00 PM Regular Meeting
To: Honorable Mayor and Members of City Council
From: Chris Mynderup, Chief of Police
Date: January 5, 2022
Subject: Ann Harkey Memorial
Recommendation:
That City Council approves the Special Event Application submitted by Mr. Ron Harkey for a memorial service to his wife, Ann Harkey. A current Certificate of Liability for this event has been filed with the City of Jackson.
Discussion:
This Memorial Service is to honor and reflect on the life of Mrs. Ann Harkey who tragically lost her life on November 3rd, 2021. This service will take place on Saturday February 19th, 2022, from the hours of 12:00 p.m. to 5:00 p.m. The location of this event will take place on Wallace Street. Wallace Street will be barricaded off at the following intersections: Wallace and Lowe Street, Wallace at Folger, and Wallace at Buffington. The barricades will be moved for residents living on Wallace, as needed, for entrance and exits to/from their houses.
Conclusion:
This memorial service is for, as her husband Ron stated, “to remember a woman who many loved.” This event will have little to no impact on the city.

Argonaut Mine Superfund Site
EPA to Start Soil Cleanup at a Portion of the Argonaut Mine U. S . E nv i ro n m e nt a l Pro te c t i o n Ag e n c y • Pacific Southwest Region • D e ce m b e r 2 0 2 1 Overview
The 90-acre Argonaut Mine Superfund site’s tailings area is where mine tailings were historically disposed. Years of mining increased risk by contaminating the site’s soil with arsenic, lead and mercury. EPA is cleaning up a large portion of the tailings area to minimize contact to high levels of metal contaminants.
Upcoming Tailings Clean-up
EPA will clean up a large area of contamination next to Argonaut Lane between Pioneer Street and Westview Drive. Much of this area is east of Argonaut Lane and is marked by orange and white soil surrounded by a chain link fence. Some of the contamination is also found on the west side of Argonaut Lane.
• January and February 2022: Tree removal starts around Tailings Areas 3 and 4, a small part of the mining process area and next to the Tailings Area 1 near Hoffman Avenue (see map below). Tree removal is needed to access the area for cleanup.
• April through Summer 2022: The project will
pause after tree removal and resume in April 2022 to
remove contaminated soil and replace it with clean
soil. Work will continue through the summer.
• 2023 and beyond: Additional cleanup and work to
build a drainage channel will continue.
Work to Date
EPA has investigated and cleaned up the Argonaut Mine
since 2013 in areas bordered by Argonaut Lane, Hoffman
Avenue and Highway 49 (see map). This work has mostly
involved soil and water sampling to understand where
contamination is. EPA has also done a series of small
cleanups at the mine’s headframe, residential areas and the junior high school.

Council Meeting Memorandum
Monday, January 10, 2022 – 7:00 PM Regular Meeting
To: The Honorable Mayor and Members of the City Council Date: January 6, 2021
From: City Manager, Yvonne Kimball
Agenda Item #7c: Oro de Amador Property Cattle Lease
Recommendation:
That the City Council award the lease to the highest bidder in terms of dollar amount.
Discussion:
The Oro de Amador property was used for mining historically. City obtained ownership in early 2000 and designated its intended use as regional recreation. While the City is working on remediation actions, cattle grazing activity is still allowed to continue. City manages this use through a lease. City invites bids from private individuals or firms and awards the lease agreement to the bidder that offers the highest bid. Jim Laughton has been holding the lease since 2018.
Current lease would have expired December 31, 2021. In anticipation of its expiration, City had originally advertised the lease in October 2021. Two individuals responded, both commented that the city’s posting needed clarifications. Staff considered those comments. As a result, staff revised the posting materials and re-advertised in December.
This time, three individuals responded. Here is the bid information:
Bid A. $6,257.50 annually
Bid B. $4,501 annually
Bid C. $5,219.97 annually
Lease term: original term: February 11, 2022, to January 31, 2023; possible extension: through December 31, 2023.
Based on the posted selection criteria, staff recommends council award the lease to the highest bid (in terms of dollars per year): Bidder A. Council also has options to decline all bids, award the bid to bidder B or C or rebid this again.

This Cattle Pasture Agreement (“Agreement”) is entered into by and between the City of Jackson (“Lessor”), a California municipal corporation, and ________________________ (“Lessee”), on this _____ day of ________________, 2022, for the lease of certain real property known as the Oro de Amador property, situated immediately northeast of Jackson and accessed from New York Ranch Road, as depicted in the map attached as Exhibit “A” (the “Property”).
The City acquired this property early 2000. Since then, the city has allowed cattle grazing on this property, which has been beneficial for property maintenance and wild land fire prevention.
For its long-term use, this property has been designated for recreation and other municipal purposes. Design and construction of sports complexes and other municipal structures are expected to occur in the next few years. In the interim and on a short-term basis, City continues to lease the property for cattle grazing at its discretion.
Agreement
NOW THEREFORE, with respect to the mutual covenants and considerations set forth herein, the Lessor and Lessee agree as follows:
1. This is a seasonal pasture lease and not a cattle care agreement as all duties for preparing the Property to take in cattle, all feed, water and care, and all cattle handling and management shall be provided by Lessee and none by Lessor.
2. The period of use shall be from February 11, 2022, until January 31, 2023. If, however, in the reasonable judgment of Lessor feed or water resources will not support cattle until January 31, 2023, Lessor shall coordinate with Lessee about removing some or all the cattle early. There shall be every reasonable effort taken to leave 750 lbs. of residual dry material (RDM) on each acre of the Property. This Agreement may be extended by Lessor for an additional period until December 31, 2023 (or such earlier date as provided above if insufficient water) in its sole option with thirty-days’ written notice to Lessee prior to the expiration of the initial term.
3. The portion of the Property useful for grazing is 147 acres and based on ten acres per cow/calf pair, Lessee may turn out 14 head of cows with calves on the Property.
4. The cattle will bear the registered brand of ___________________ and Lessee will notify Lessor 48 hours prior to turn out. The rent shall be a total of $_____________ a year.
5. Lessor provides no guarantee as to feed, continued water supply, cattle gain, cattle death, or cattle loss except that municipal water is available to hook up on site at this time. Lessee shall be responsible for water usage according to established utility rates and regulations. Lessee shall timely remove any dead animals from the Property. Lessees defend, indemnify, and hold
6 Lessor fully harmless as to any liability associated with this lease, including but not limited to injury or loss on or off the Property due to escaping cattle.
6. Lessee shall maintain an insurance policy insuring against all liabilities with the City of Jackson an expressly named additional insured. Lessee assumes all risk associated with the running of these cattle, which extends to Lessee, his employees, helpers, family and guests.
Lessee expressly agrees to assume risks associated with the Property, specifically including wire, trash, mining equipment, old structures, pits, the dam, and tailing chemicals such as mercury and arsenic. Lessee shall examine the Property and accept possession in its present condition relying on its own inspection and not any representations by Lessor or its agents. Lessee agrees to keep the Property orderly, clean and maintained. Lessee further agrees to remove from the Property at the conclusion of this lease anything placed on the Property.
7. Lessee shall not turn out cattle until all fences and gates are fully maintained and secured to constitute legal fences that can turn cattle.
8. Lessee shall be responsible to create and maintain a minimum of 20 feet wide (or a double dozer line) firebreak along the eastern boundary adjacent to the Rollingwood Estates.
9. Lessee understands that the Property is adjacent to town, housing, public roads, tourist sites and is therefore subject to unauthorized public access, and Lessee acknowledges the necessity of keeping an ongoing vigilant fence maintenance effort.
10. Lessee shall, at all times, fully comply with all laws and regulations governing the operations of his/her ranching enterprise and as would apply to the grazing of cattle on the Property.
11. Lessor shall have the right to enter and inspect the Property at all times.
12. This lease may be terminated anytime by either party by giving no less than 30 days’ notice.
13. Lessee shall not assign this lease or encumber the Property in any respect.
14. Lessee agrees to pay Lessor all costs, expenses, and attorney’s fees if it becomes necessary to enforce any component of this lease or take any default action or to remove Lessee or recover possession of the Property.
15. Lessee agrees not to allow any hunting or the discharge of firearms on the Property.
IN WITNESS THEREOF, the Lessee and Lessor hereto have accepted, made, and executed this Agreement upon the terms, conditions and provisions above stated on the day and year first written above.

Agenda Item #7d: Main St. Merchants Meeting
Recommendation:
That the City Council provide directions regarding the meeting.
Discussion:
Following 2021’s after-Thanksgiving Main St. events, I was approached by merchants on Main to host a meeting in the new year. I would like to entertain the invitation. I came up with an agenda for the meeting.
I would like to seek your directions on this meeting. A few things I’d like your input on:
a. Your vision of Main St.;
b. Your expectation of city’s role in Main St. development; c. Your thoughts of the attached agenda, including all details, such as time, location and topics;
d. Who to invite? I would like to invite all businesses on Main St. I would recommend focus on properties/ businesses that have a frontage on Main St. I will likely walk down the streets and deliver the meeting notice in person. e. Appoint one or two council members to attend the meeting.
Originally, I have thought to bring up the subject of forming an association. But upon further consideration, I decided to leave this subject for a later date as the “Association” subject can be an involved discussion.
Attached is the draft agenda.
