3. PUBLIC MATTERS NOT ON THE AGENDA.

Discussion items only, no action will be taken. Any person may address the Council at this time on any subject within the jurisdiction of the City Council. Please note - there is a three (3) minute limit. • Paul Jones- Offered prayers.
• Dwayne Keckley, President of American Legion Post 108 motorcycle riders- He said he discussed the Veteran's Parade special event permit with the Police Chief. He requested funding from the City to fund the event. He said the Legion usually spends about $6,000 each year to put on this event and I would like to ask if the City Council can help with the porta-potties and Ledger advertising costs. Mayor Stimpson responded that it sounds that the request is about $1,200 and that he feels that the Council would probably be able to help with that. Mayor directed the request to be added to the next meeting agenda.
• Vice-Mayor Gonsalves stated that she and Chief of Police Mynderup and I have been in correspondence regarding a camper that has been on City property a long time. VM Gonsalves asked Attorney Nelson and PD Chief Mynderup, if there is any type of ordinance that the City can impose on the public property for no more than 72 hr. parking? Attorney Nelson responded that he's looked at anti-camping ordinances and the 9h Circuit came down with the Boise decision, which prohibits us from banning those. We did a modified ban at certain important infrastructure areas, last year. Chief Mynderup responded, the City has the72-hr. ordinance, but sometimes PD tries to help individuals out. At this time, the Dept. is trying to help this individual out by getting his van out of there. Chief Mynderup gave more details of the individual and his situation and said that the city can impose the 72-hr. ordinance if the Council chooses. The individual is a citizen of the County. Attorney Nelson suggested to avoid un-agenda discussion, this issue can be added to a future agenda.
• John Georgette, Jackson resident, said he's here regarding the Pitt St. bridge. He referred to Cal- Trans inspection reports. (Mr. Georgette brought copies to the Mayor and Council Members). He continued, that at the November 20, 2021, Council Meeting, the Council was requesting the City Engineer to bring back some options to fix the bridge. Mayor Stimpson stated that the City Engineer is looking to see if they can keep the same look of the Pitt St. Bridge. Council directed to add this to future agenda for discussion.
• Atul Patel, the owner of Holiday Inn Express in Jackson. He said, his hotel collects a lot of TOT funds for the City. A few years ago, he had requested the City to consider repaving Shopping Dr. which is adjacent to our property and it's also common access for DMV and the Jackson Cinema.

He continued, that he just purchased another property on the circle, and will develop it into 6-8 multi-family properties, which will bring more residents and more revenue to the City. He urged the City to pave Shopping Dr. and take care of all city streets as it creates a nice environment for everyone.

5. ADMINISTRATIVE REPORTS.

Public Works Superintendent, Bree Wilder
• GIS for cemetery that Trevor was working on. It is on our City website and people can do a search by name and can find plots for the people who are buried there.

Cameras for Petkovich Park have been installed. We have cameras pointing up toward City Hall, Hwy 88, the park, and Main St.
• We have been doing a lot of preparations at the Cemetery for the upcoming 100th anniversary of the Argonaut Mine Disaster Day, which is coming up on 8.26.2022.

I'm working on getting a quote from a pest control company to deal with the squirrel issues in the cemetery and at Detert Park. Vice Mayor Gonsalves, mentioned that the Council received a letter from a citizen, to alert us to the ground squirrel problem at the cemetery and asked Bree to keep the citizen informed.
• I spent a lot of time working on the sewer grant and combined with the WWTP. We are trying to get funds together and replace some sewer lines out there.

Interim Fire Chief, Dale Fishback
• Things have been relatively quiet for the last few weeks. • We still have our engine 6331 out on a strike team, it should be returning to us tomorrow. They have been out 15 days now, working 12hr night shifts.
• CM Simmons talked to Jim Guidi recently, who stated that he was concerned about the tower where we usually burn. CM Simmons asked the Fire Chief if we are going to be able to burn this year.

Chief Fishback replied, we aren't going to look at that until October. I'll have Jesse go take a look at it, but we haven't seen it as a threat.

Police Chief, Chris Mynderup
• 8/10 attended an 8 hr training on Senate bill 2, which is the new certification/de-certification that Jackson City Council Agenda Monday, August 22, 2022
begins for police officers on 1/1/2023. All brand-new officers will have to be certified by post and they will need to be certified by their probation period, which in Jackson is 18 months. Officers can be de-certified for serious misconduct, which is defined as dishonesty, abuse of power, physical abuse, sexual assault, demonstrating bias, acts that violate the law sufficiently egregious or repeated, participation in a law enforcement gang, failure to cooperate with an investigation with police misconduct and failure to intercede. This will go into effect 1/1/2023 and we will have 10 days to report any conduct that is defined above. I'll keep you apprised at how this new system works.

Last week we sent 2 reserved officers to their 2-year post mandated perishable skills training. Topics can include hazardous materials handling, CPR/First Aid, driving skills, firearms, domestic violence updates, tactical communication, and defensive tactics. They successfully completed that that those officers are with their post mandates.
• We had a meeting with Linda Gonzales regarding the Argonaut Mine Disaster Centennial Event activities are planned in the City and we will providing traffic and crowd control for the ceremonies planned at the cemeteries and the Main St. Amphitheater. We are aware of the bells that will be ringing this Saturday evening and hopefully the City will get lots of notice out to the residents.

City Manager, Yvonne Kimball
• Regarding the Argonaut Mine Disaster activities, Public Works told City Council that they are coordinating in the ceremonies and City staff has been working to promote the event. City has also published the press release for the event on the city website. • City Hall is going to be closed on Friday, September 9", Monday 12"h and maybe Tuesday 13, due to moving back to our original facility. The phones and emails will not be available. The public can use the drop box..
• A citizen, Chet Moody, has reached out to me. He has sent me a heartfelt letter to express something that happened 39 years ago, in 1983. He has requested that we include the letter in the meeting minutes. I had agreed to make mention of it in the meeting tonight.

City Attorney, Josh Nelson
• The Legislature's deadline to pass bills for this legislative cycle is the end of this month, so September/October we will have an idea of what bills of interest are moving forward and I will report this to the Council.

6. COUNCIL REPORTS.

This section is to provide Council members an opportunity to present reports on their activities and to request items be placed on future agendas.

Council member, Simmons
• I have no report.

Council member, McLean
• I attended a Chamber of Commerce event at the Kennedy Mine. • I attended the Amador/Tuolumne Community Action Agency meeting. • I missed the Chamber of Commerce Board Meeting, as I was up north at other meetings.

Council member, Godde
• 8/10 1 attended the Jackson Cemetery meeting. The meeting was basically talking about preparing for the 100' year anniversary of the Argonaut Mine Disaster. I wanted everyone to know that this 4 Jackson City Council Agenda Monday, August 22, 2022
Saturday, August 27 is going to be our next clean-up, starting at 8am, at the Jackson cemetery.

Also, the headstones for the unmarked graves have been ordered. • I attended the Chamber of Commerce meeting. They discussed different ways for them to improve Chamber involvement in the County, like possible SBA financial forums, help restaurants with Health Dept. compliance and such. The next Chamber Mixer will be at the College Connect Building, which is across the street from the bowling alley on Sutter Hill.

Vice Mayor, Gonsalves
• I attended to the activities with the Fire Safe Council and included Fire Chief Fishback and Captain Greathouse on some projects that the Fire Safe Council is doing, which will encompass some of the Jackson properties for another fuel break that will help with the Kennedy Field break that we have done before and watching out for proper Jackson. I've shared all that correspondence with the Chief today and hopefully that this is something the department can be of assistance with or at least be aware of. The Fire Safe Council, with the fire wise communities, extends to the Running Gold subdivision. It will encompass about 8 acres and it was supposed to be a $100,000 grant thru PGE, but it wound up being a $25,000 grant, so the project was scaled back to approximately 8 acres and Jackson will definitely benefit from it.

Mayor, Robert Stimpson
• No report.

7. DISCUSSION CALENDAR.
a. Possible adoption of Ordinance 726 Adding Chapter 17.28 to Title 17 of the Municipal Code Relating to an Expedited, Streamlined Permitting Process for Electric Vehicle Charging Stations (possible adoption of ordinance; first hearing on August 8, 2022) City Manager Kimball stated that this is the 2nd hearing and recommended adoption of this mandated ordinance.

Mayor Stimpson asked for any public comment. Hearing none.

Mayor asked for a motion.

b. Adoption of the FY 2022/23 Budget
1) Resolution 2022-16 City Council Setting an Appropriation limit for FY 22/23 Resolution 2022-17 Approving the City Operation Budget and Capital Improvement Jackson City Council Agenda Monday, August 22. 2022
Budget for FY22/23
3) Resolution 2022-18 Authorizing Positions for FY 22/23 City Manager Kimball gave an introduction. Some highlights: we will continue to see a surplus in the General Fund. Public Safety is always going to be a priority. Both the PD and FD are both getting new ehicles, which are funded by special funds or grant funds. Under the general fund, the insurances kee oing up and some are doubled. We can balance the general fund Staffing costs also included a few new positions: Permit Technician for Building Dept., PT Administrative Assistant and 1FT Firefighter (under the measure M fund). There'll be a 5% COLA increase for employees on January 1, 2023.

Utility fund- the sewer fund is doing well. The sewer rates are a 3-year cycle which will expire 6/30/2023. The City will need to consider a new rate study and modify the rate.

The water fund is not as solvent, as we had hoped for. Many reasons led to it, including the drought and an AWA rate change.

Moving on to the pool fund, no matter who is doing the managing, the pool fund is not self-sufficient, which requires a General Fund subsidy.

Regarding the special funds, Kimball said the City has a lot of grant funded projects. Grants require a lot of work by staff. City Manager Kimball is thankful for the City Council, Citizens who attend the meetings and give their input and to all the City of Jackson staff.

Mayor Stimpson asked for any public comment, in person or online. None heard or seen, the Mayor asked for a Motion.
