a. Resolution 2022- 23 Authorization of A Clean Water Revolving Fund grant application for sewer system improvement.

City Manager Kimball gave an introduction to grant consultant Fawn Mclaughlin. Kimball said the city became aware that the Clean Water Revolving Fund grant opportunities has been expanded and City could be eligible for 100% grant money to improve the sewer collection and treatment systems. Consultant McLaughlin who partners with the City Engineer WGA assisted the City to put the application together. Ms. McLaughlin explained that she has been working with State Water Board rep for a long time and was told that Jackson is eligible for 100% grant funding. This authorization is for the City to fill out the initial forms and provide a scope of work. Then the State will review and comment on the application. The first step is a Planning grant which is what the City is preparing for. The application is looking for about $2 million at this phase. The Planning grant will handle environmental work and some design. Then the project moves to the construction grant application. It will take a couple years before the City can proceed with construction. She added that she had success with the same grant for Mokelumne Hill Sanitation District.

Mayor asked Council for any questions. CM Simmons confirmed that the grant work would replace the sewer lines. PW Wilder said yes, the city has 23 miles of sewer collection pipes. Some will be replaced by this grant. CM Simmons also asked about city’s sewer camera work. Wilder

Page 5 of 47 ends

October 24, 2022 City Council Meeting Minutes
said the city has been doing it, and will continue. The camera work is also included in the grant.

CM Godde asked whether all the lift stations will be replaced. Wilder said not all, but those that are in need.

Manager Kimball added that this time is a grant rather than a loan like what the city had 6 years ago. Additionally, this time the grant is initiated as a proactive effort rather than to respond to violations at the sewer plant. She thanked the city staff for a thorough job in putting together a scope for the application.

Mayor opened public comments. Hearing none, he asked for a motion to approve Resolution 2022-23.

Motion to approve Resolution 2022-23 Authorization of a clean water state revolving fund grant application as presented. Moved by Councilmember Godde, seconded by Vice Mayor Gonsalves, and carried by a 4 to 0 vote:

b. School site consolidation discussion with Amador County Unified School District representatives relating to the impact on Jackson infrastructure and services. This was moved after c. in order to wait for school representatives to arrive.
c. Possible participation in the Sutter Pine Mobile Home Park / City of Jackson water consolidation feasibility study.

Manager Kimball explained that SPMH has on-going water quality issues that are difficult to resolve on its own. State Water Board has grant money to help small systems like SPMH to consolidate with larger systems like Jackson in order to solve drinking water quality violation. Both SPMH and the State Water Board approached the city to see if the city was interested in considering providing a water line to feed SPMH. City staff was apprehensive about the consolidation, and need council to hear from SPMH and the State in order to decide whether to proceed with a feasibility study which would be the first step in the possible consolidation process.

Mayor asked SPMH representative PJ Alviso to speak. Mr. Alviso said Kimball’s summary was correct. SPMH has a shallow well which causes water quality issues. The system has 20 connections and would like to consolidate with Jackson through a master meter and valve. Mr.

Alviso added that Jackson Valley Irrigation District did a consolidation project with Buena Vista community and he learned from JVID about the state program to help. He thinks this consolidation will be similar to JVID and Buena Vista.

Mayor asked State Water Board representative Brian Kidwell to speak. Mr. Kidwell concurred with what had been said. He added that the feasibility study would not obligate city or SPMH to do the project. The study will be paid for 100% by grant funding as a technical assistance program.

Mayor asked Council for questions.

Page 6 of 47 ends

October 24, 2022 City Council Meeting Minutes
CM Simmons confirmed that the study will be paid for by the state. He also confirmed that there is capacity for the consolidation. Mr. Kidwell said the feasibility study will confirm. Mr. Alviso said the park currently use about 2000 gallons of water a day, which the city should be able to handle.

City Water Foreman Trevor Hoaas agreed.

Mayor Stimpson asked whether this consolidation will need to add a lift station. Mr. Alviso said this will be a master meter installed at the end of city’s distribution system. Mr. Kidwell said this will be covered by the study. Simpson asked whether this will add fire hydrants. Mr. Kidwell said it’s possible. The feasibility study will study fire safety.

VM Gonsalves asked if city staff time can be covered by the study. Mr. Kidwell said not for preparation of the study.

Mayor asked for public comments. Hearing none, he asked for a motion from Council.

Motion to authorize city participation in the SPMP feasibility study. Moved by Councilmember Simmons, seconded by Councilmember Godde, and carried by a 4 to 0 vote:

AYES: Stimpson, Gonsalves, Godde, Simmons

Item b. School site consolidation discussion with Amador County Unified School District representatives relating to the impact on Jackson infrastructure and services.

Mayor invited School District representatives to give their presentation. Deputy Superintendent Jared Critchfield and Assistant Superintendent of Education Sean Snyder provided informative presentations. Mr. Critchfield explained the details of the consolidation plan. He also highlighted the needs and benefits of the consolidation plan, describing various facility projects and improvements. Mr. Critchfield said that the District is planning for a traffic study as part of CEQA process through the State Architects Board. Mr. Snyder spoke about the education benefits of the consolidation plan, including efficiency on staffing, (teaching) lessons collaboration and program expansion.

Upon completion of the presentations, Mayor Stimpson asked for council questions.

VM Gonsalves asked the District to be careful about the historical artifacts buried near the current bus yard by Jackson Elementary School.

CM Simmons asked how many students will be in the new classroom (after consolidation). Mr.

Critchfield said the room can fit 35 students, but the class size would be about 28 students.

Simmons also asked about the future of the agriculture program at the new consolidated high school. CM Gonsalves also said that she would like to see the trade classes going strong. Mr.

Critchfield and Mr. Snyder both said that the District has funding for those programs. They are called the “career education fund”. The Measure H would enhance the current culinary program

building.

VM Gonsalves asked whether the consolidated high school would be a closed campus. District responded yes.

Gonsalves also asked if the Measure H does not pass, would the consolidation be implemented? Both Mr. Critchfield and Mr. Snyder said yes.

Mayor Stimpson opened for public comments. Debby Collins, asked District to clarify the mitigation plan for traffic for the high school. Mr. Critchfield said there will be scheduling changes and some school entrance layout changes to avoid influx of traffic at once. More improvements may be suggested by the traffic study. The funding for potential improvements has not determined yet.

City Planner Farhad Mortazavi asked how the consolidation plan would impact City’s General Plan update process, especially the circulation element. Mr. Critchfield said their CEQA process will address that. He also confirmed that ACUSD is the lead agency for CEQA and will file before the State Architects Board.

Manager Kimball asked if Council has any direction to city staff. Mayor Stimpson said none and staff should wait for the CEQA and the traffic study. VM Gonsalves said she would like to see the District has an open communication with the city. Chief Mynderup added that he felt that the District and his Department communicate well.
d. Possible Award of 2022 Swimming Pool Resurfacing Project contract.

Manager Kimball asked Water Foreman Hoaas to introduce the item. Mr. Hoaas said that this was the second time the city issued a RFP for resurfacing the pool. City received two bids. The low bidder is Spray Tech Systems. Staff recommends awarding the bid to Spay Tech System. Mr. Hoaas added once contract is awarded, the Contractor needs to order parts right away and estimates to start work in April 2023.

Mayor asked council for questions. He said that he talked to Chet Moody who is a local contractor for pool work. Mr. Moody highly recommended Spray Tech. Councilmember Simmons agreed.

Mayor opened the public comments.

Polar Bear Swimming club representative Josh Cazadd spoke. He said the Polar Bears Board implores the city to move the construction schedule a few weeks later so that the weather is a bit warmer for them to use Sutter Creek’s pool which is not heated. He also said other agencies that use the pool would like the same. Mr. Cazadd felt that Polar Bears is a partner of city pool by contributing towards equipment purchase for everyone to use, so their scheduling needs should be given serious consideration.

CM Simmons and Mayor Stimpson both said that Polar Bears’ need is noted, but the contract needs to be awarded first. If the pool is not resurfaced, there will be no pool for anyone to use in the future.

CM Godde suggested that staff call Spray Tech and see if they could change schedule after the contract is awarded.

Page 8 of 47 ends

October 24, 2022 City Council Meeting Minutes
Manager Kimball responded to Mr. Cazadd’s comments and said that staff has been coordinating with all entities that use the pool. This work is necessary and apologize for scheduling inconvenience. She went on to say the challenges Mr. Hoaas and Mr. Wilder face when juggling all users of the city pool while making sure city’s summer programs were not interrupted.

PW Sup. Wilder added that the city also needs to coordinate the repair of a pool pump with the resurfacing work.

VM Gonsalves and Mayor Stimpson wanted to confirm that the project would be paid for by the parkin-lieu fees. Kimball said yes and the City Attorney okayed the usage. She added that ACRA Board was going to help, but the city attorney advised that ACRA’s park-in-lieu can not be used for this project. Council and Kimball commented the high cost of operating the swimming pool.

Motion to award the resurfacing contract to Spray Tech. in the amount of $172,525. Moved by Councilmember Simmons, seconded by Councilmember Godde, and carried by a 4 to 0 vote:

AYES: Stimpson, Gonsalves, Godde, Simmons

Jackson View subdivision is planning on obtaining 9 more building permits before the end of the year to finish out the subdivision. Solar, roofs, and HVAC permits still making up most of the permits. The tank replacement for the Chevron station is moving forward and is scheduled to be completed next month. The tank removal at Gold Country depot on HWY 49 is complete and pending a final report. The newly created permit tech position has been posted. Several applications have come in and will be reviewed and hopefully the position filled soon.

CITY OF JACKSON

MEMORANDUM
TO: Honorable Mayor and Members of the City Council
FROM: Yvonne Kimball, City Manager; Josh Nelson, City Attorney DATE: November 14, 2022
SUBJECT: Ordinance Adopting and Amending the 2022 California Building Standards Code and other Uniform Codes

RECOMMENDATION
That the City Council introduce Ordinance No.727, an ordinance amending Chapters 14.04 of the Jackson Municipal Code adopting and amending the 2022 California Building Standards Code and other Uniform Codes, conduct the first reading and schedule a public hearing for December 12, 2022 to consider its adoption.

DISCUSSION
Every three years, the various California and national building codes are revised to reflect the latest in building and fire safety standards. In 2022, the California Building Standards Commission approved the 2022 California Building Standards Code. In addition to various California-specific codes, it adopts and amends previous years’ International Building Code, 2021 International Residential Code, 2017 National Electrical Code, 2021 Uniform Mechanical Code, and the 2021 Uniform Plumbing Code. According to state law, the 2022 California Building Standards Code takes effect on January 1, 2023. Other codes being adopted by the City are the Uniform Housing Code, the Uniform Building Security Code, Uniform Swimming Pool, Spa and Hot Tub Code, the Uniform Code for the Abatement of Dangerous Buildings and the International Property Maintenance Code.

The draft ordinance will adopt the 2022 California Building Standards Code and make minor amendments to it. These amendments take into account the City’s unique climatic, geological and topographical conditions. A major amendment is the snow load requirements from of being 0 lb/ sqft based on the standards issued by the Society of American Engineers In addition, to the California Building Standards Code, this ordinance adopts a number of other “building codes.” Should Council waive the first hearing at this meeting, the adoption hearing is scheduled for December 12 council meeting. Once the City Council adopts the ordinance, the City’s amendments to the state codes will take effect on January 12, 2022. /attachments

grading activities as provided in this section.

Exempt grading shall conform to the following
requirements:
i. Excavation and/or placement of material
shall not exceed 500 cubic yards. Larger grading
projects may not be split or separated into smaller
projects for the purpose of exempting an otherwise
nonexempt grading project. All grading projects
require erosion control measures to be in place
during weather events. Failure to apply best
management practices may require the submission
of an erosion control plan and payment of costs at
the current hourly rate.
ii. Grading activities 51 to 500 yards may be
considered to be exempt. Exempt grading activities

11 April 15 and October 15 of the calendar year will
not require an erosion control or grading plan
however a site inspection will be conducted at the
current hourly rate to review the project. The intent
of this classification is to exempt grading related to
private horse arenas, private parking, utility
buildings 120 square feet or less without plumbing
or electrical, and roof structures 120 square feet or
less not intended for public use. Finish slopes will
not exceed 2 to 1 and cut and/or fill will not exceed
4 feet. Any future development requiring building
permits will require a geotechnical inspection
(compaction test). All grading conducted between
October 15 and April 15 will require plan submittal
and a valid grading permit.
iii. Any structure requiring a building permit
that is built on fill 12 or more inches in depth will
require a geotechnical investigation (compaction

Regional Water Quality Control Board;
viii. Top of cuts or toe of fills shall be at least 4
feet from all property lines and beyond drainage;
x. All fills shall be compacted to 90% relative
compaction when not building a permitted structure
on the fill. Compaction testing may not be required.

In this case compaction is the sole responsibility of
the property owner/contractor. The requirement for
compaction testing will be determined upon plan
submittal and/or during field inspections at the
discretion of the Chief Building Official. Future
development involving structures built on the
graded area requiring a permit will require
geotechnical investigation (compaction testing) and
compaction of 95%
xi. Materials such as wood debris, roots, stumps
and other deleterious and unsuitable material shall
not be buried within the fill; and

Declaration and Request for Payment
Declaration:

Whereas, for reasons not clear, Peek Street was not included in the City of Jackson’s Sewer Rehab program of 1978 and required an update of the old terra cotta sewer pipe prior to development of the lots at that location.

Whereas, Robert Rethford reached an agreement with the City of Jackson, on January 24, 1991, that as a condition of receiving a permit to build a residence at 215 Peek Street, he would install a new 6” line up to and fronting said property.

Whereas, the city of Jackson found that there would be a benefit to the City if a new line was installed and it was stipulated in the agreement that Robert Rethford would front the amount to install the line and the City would reimburse, upon development of the lots benefitting from the installation the amount of $2713 per lot.

Whereas, Robert Rethford has received payment on two lots, Amador County APN 020-0364-004 and 020-0364- 008 but comes forward stating he has not been paid for the remaining two lots, Amador County APN 020-0364-003 and APN 020-0344-016.

Request for payment:

At this time, the City of Jackson has allowed APN 020-0344-016 to be developed as a parking lot without consultation or consideration of Mr. Rethford’s recorded financial interest in the property. No payment for this lot has been received by Mr. Rethford. In addition, as regards APN 020-0364-003, permits have been issued, sewer fees have been collected and development has begun. Mr. Rethford has also not received payment for this lot. Mr. Rethford, having met his obligation as per the agreement that was signed January 24, 1991 and recorded in the Office of the County Recorder on July 29, 1992, respectfully requests that the City of Jackson meet its obligation and forward payment in the sum of $5426.

Copies of the recorded agreement and detailed maps have been attached.
