Police Chief, Chris Mynderup
Reported a few events: PD has been engaging in community events, such as the Halloween open houses in Jackson and in the County. PD attended the Big Rally, participated in the Community Harvest festival. Chief wanted to give a shout-out to his officers for their participation in those community events. There was a traffic collision that caused a fatality Saturday night near Scottsdale Rd.. The incident was under investigation
Fire Chief, Dale Fishback
Reported that JFD’s Fire Marshal partner from AFPD is preparing for some interagency trainings. The Fire marshal has been conducting necessary residential and commercial inspections for City. JFD conducted a fire drill at Argonaut High School. JFD’s one water tender has been advertised as surplus equipment and hopefully can receive some good bids. The Dept. is making sure that Studebaker is in good condition for Christmas Delights.
City Attorney, Josh Nelson. No report.
City Manager, Yvonne Kimball
Reported that a few important projects have progressed to the public comments period. Sutter Creek Extension design is under CEQA review and public comments. The joint Housing Element update will be having workshops throughout the County.
She also reported that Public Works Department is getting ready for Christmas Delights, decorating the city and (anxiously) waiting for the Christmas tree to arrive this week.

6. COUNCIL REPORTS.
This section is to provide Council members an opportunity to present reports on their activities and to request item be placed on future agendas.
Councilmember Godde
Attended a Council of Tourism Halloween gathering at Baker’s St. West. It was a neat building. He also talked to a couple of Sutter Creek council members regarding their tree lighting night on the same night at Jackson’s. The CMs did not know about the scheduling ahead of the time.
Councilmember Simmons
Attended an ACRA meeting.
Councilmember McLean
Attended ACTC meeting. The City’s creek walk project did not rank high enough to get funding, but he asked ACTC manager and the consultants to meet with Caltrans to review the application in January and see about reapplying. He also attended HJBA meeting. PW Sup. Wilder was there. It was a good meeting with a lot of attendees. He was excited.
Vice Mayor Gonsalves
Met with AWA folks along with Mayor and City staff. AWA wanted to explore the potential of sewer treatment, but needed to bring back more information to City. VM also reported that she did not appreciate what Sutter Creek did regarding their date of tree lighting. She emailed SC five council members and the City Manager. She then said that the AFPA meeting was canceled. The group is working on fire break on Raggio Rd. She has made Chief Fishback aware.
7. DISCUSSION CALENDAR.

These audio recordings provide an accurate and comprehensive backup of City Council deliberations and citizen discussion.
a. Receive, discuss and provide direction regarding (verbal) report from the Homeless Outreach Coordinator regarding the City’s response to homeless issues.
The Homeless Outreach Coordinator Christine Platt gave her monthly updates. She said last Thursday’s Mission Blvd encampment clean up was a success. Many agencies came to help. She also reported that she has been having successes in placing unhoused into shelters. She has been working with someone who was developmentally delayed and had some mental health needs. She commented on the lack of affordable rental properties will continue to be very challenging. she was afraid that the high costs in housing would force more people to live on the streets.

11.14.2022 Meeting Minutes. Page 4
CM Simmons said that he heard that County hired a Housing Coordinator under a grant. Ms. Platt responded that the County position would focus on placing folks referred by the Social Services into existing shelter and housing programs whereas she has much broader outreach work to do. b. (Introduce) Ordinance # 727 Amending Chapter 14.04 of the Jackson Municipal Code, Adopting and Amending the 2022 California Building Standards Code and other Uniform Codes.[waive the first hearing, and direct to procced with an adoption hearing] Manager Kimball gave an overview. She explained that every three years, California updates the building codes. The City adopted the 2019 Building Codes in January 2020. Now it’s time to consider and adopt the 2022 codes. The ordinance once adopted, will adopt the 2022 Building Code and a few other associated codes, such as the codes for swimming pool, spa and hot tub, the Property Maintenance Code.
Vice Mayor Gonsalves asked council for questions. Hearing none. She opened the public hearing.
Peyton Pushies, Building Inspector, called in and said that all four cities and Amador County plan to implement the new codes January 1, 2023. One notable amendment to the current building code is the elimination of the current snow-load requirement. He added that this should make things easier to get structures built.

The Building Department processed 23 total permits in November, 4 less than October. The total number of permits for this year is 273, up from 220 last year. The permit Valuation is $ 8,628,249 up from $ 4,255,325 last year. Total Fees
collected $ 576,671.64 compared to last year’s $ 174,745.12 (NOTE These numbers are skewed from the timing of Jackson View permits)
Jackson View Partners is finished framing 4 houses on Goldstone Ave. The EPA received an encroachment permit for installing a guardrail on Argonaut Ln, A barn and new single-family dwelling on Alpine are in plan review, solar HVAC and reroofs still make up the bulk of the permits.
CODE ENFORCEMENT UPDATE:
Code Enforcement is fielding several complaints about substandard housing, building without a permit and trash and debris. Most cases have had voluntary compliance and have not needed further action.
PROJECTED:
The housing market, material costs and interest rates along with winter will slow down the building department somewhat. This time will be spent training the new permit tech and updating policies and procedures for the department. The permit tech position selection is ongoing with the second round of interviews this week.

Date: December 12th, 2022
Agenda Item #4j: Reso 2022-27 Authorization of TOT fund to pay for recent paving of Vukovich Way
Recommendation:
That the City Council authorize using TOT fund to pay for Vukovich Way paving in the amount of $96,678.
Summary and Discussion:
Council directed the paving of Vukovich Way, primarily to support economic development activities. The paving work has been completed. The construction cost totaled $96,678. George Reed Construction performed the work satisfactorily. Since this was not a budgeted item, no funding source has been determined prior to work. The associated engineering fees have been absorbed by the General Fund. Staff had recommended (and continue to recommend) using TOT to pay for the construction cost. Use of the TOT fund requires City Council authorization.
Attached is a resolution acknowledging adding the paving expense to the FY 22/23 Budget and authorizing using the TOT fund to pay for construction cost.

Ordinance Adopting and Amending the 2022 California Building Standards Code and other Uniform Codes
RECOMMENDATION
That the City Council adopt Ordinance No.727, an ordinance amending Chapters 14.04 of the Jackson Municipal Code adopting and amending the 2022 California Building Standards Code and other Uniform Codes.
DISCUSSION
This ordinance was introduced at the November 14 council meeting. It essentially adopts the 2022 California building Codes and a series of related codes by reference with minor amendments. No public comment was received since first reading.
Staff recommends Council adopt Ordinance 727. Ordinance 727 becomes effective after a 30- day appeal period. Additional public notification will be provided.
As background information, every three years, the various California and national building codes are revised to reflect the latest in building and fire safety standards. In 2022, the California Building Standards Commission approved the 2022 California Building Standards Code. In addition to various California-specific codes, it adopts and amends previous years’ International Building Code, 2021 International Residential Code, 2017 National Electrical Code, 2021 Uniform Mechanical Code, and the 2021 Uniform Plumbing Code. According to state law, the 2022 California Building Standards Code takes effect on January 1, 2023. Other codes being adopted by the City are the Uniform Housing Code, the Uniform Building Security Code, Uniform Swimming Pool, Spa and Hot Tub Code, the Uniform Code for the Abatement of Dangerous Buildings and the International Property Maintenance Code.
The 2022 Building Codes become effective statewide January 2023. All Amador County jurisdictions are collaborating adoption of the 2022 Building Codes at the same time. /attachment:

Council Meeting Memorandum
Monday, December 12th, 2022 – 7:00 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Yvonne Kimball, City Manager
Date: December 12th, 2022
Agenda Item #4l: Authorization to submit comments on DTSC Argonaut storm drainage project and consideration of funding to support partnership Recommendation:
That the City Council authorize submit comments to support one-drainage-pipe option as outlined in attached Engineer memo
Summary and Discussion:
At the September 26, 2022 Council Meeting, staff provided an update on the Argonaut Mine Drainage project. As a part of the Argonaut Mine clean-up/ remediation process, following the completion of the dam repair and stabilization in 2018, DTSC plans to construct a drainage pipe to channel the stormwater that otherwise would have been held by the original dam structure.
Once constructed, this stormwater drainage pipe will become City’s responsibility to maintain.
City staff recommended that to combine the new pipe with the existing pipe in the same location.
Council fully supports this recommendation.
Since then, DTSC and City staff have had several meetings to discuss details. It has been tentatively agreed that this combination-pipe option would be beneficial to both DTSC and the City. DTSC has issued its Remedial Action Plan for public review and comment. This review and comment period started on December 2 and will end on January 10, 2023. As a procedural move, the City needs to provide comments to DTSC’s original design which stipulates a new pipe that is separate from city’s existing one, in which City recommends the desired combination option. It is requested that City contributes up to $252,000 for the change of design. It is anticipated that City’s recommendation would be accepted by DTSC.
Council has directed to proceed with staff’s recommendation at the 9.26.2022 meeting. Enclosed is a copy of the City’s official comments. Council needs to be prepared to authorize fund once DTSC accepts city’s recommendation. Staff will bring the funding authorization item back when necessary.

RE: Contract Agreement No. 19-T4726
Draft Remedial Action Plan
Argonaut Mine Tailings Site, Jackson, California
Dear Mr. Reimanis,
As part of the 30-day public comment period, the City of Jackson has reviewed the Argonaut Mine Tailings Site Final Feasibility Study/Remedial Action Plan (RAP) for Stormwater Management dated November 2022. The report presents the remedial action alternatives evaluated for the site, recommends a remedial alternative, and presents the general tasks required to implement the alternative. The RAP recommends proceeding with Alternative 3 – Optimized Stormwater Inlet Elevation and Improve Downstream Stormwater Infrastructure.
Alternative 3 will construct a drainage system that conveys the 100-year peak stormwater runoff from Argonaut Dam to Jackson Creek. The construction will entail building a mechanically stabilized earth retaining wall near the intersection of Vogan Toll Road and Sutter Street with a new reinforced concrete pipe extending from the wall to Jackson Creek. Alternative 3 has two primary benefits: reducing the flood risk associated with the future EPA modifications to the Argonaut Mine watershed and the reduction of leaching of contaminants into surface and groundwater.
After reviewing the plans titled “Argonaut Dam Stormwater System”, the City is not opposed to Alternative 3, however we are against the proposed alignment for Alignment
3. The City currently has an existing storm drainage system in Sutter Street that also channels water underneath SR 49 and into Jackson Creek downstream through the outlet located below the Amador County Library Building. Additionally, in discussion with DTSC, the proposed Alternative 3 drainage system once constructed will become the responsibility of the City from an ownership and O&M standpoint. If this is the case, the City is against having two separate drainage facilities (existing City pipeline and the proposed) within Sutter Street.
Mayor: Robert Stimpson • Vice Mayor: Connie Gonsalves • Councilmembers: Steve McLean • Matt Riebe • Chad Simmons City Manager: Yvonne Kimball • City Attorney: Joshua Nelson
2 The City is proposing an alternate design where the new drainage system consolidates the existing pipe where possible; in another word, the new drainage would be constructed in the same alignment with the existing City drainage facility and the existing pipe be removed / reconstructed along with the new proposed drainage system.
This would combine the runoff from Argonaut Dam and the existing street runoff that is currently in the City drainage system. See attached exhibit showing the recommended alignment of the combined systems.
The City is willing to contribute funds up to $253,000 for the design change to help offset any additional costs from the originally designed Alternative 3. Should you have any questions, contact me at (209) 754-1824. We look forward to working with you on this project.

Argonaut Mine Phase II Stormwater Drainage System Construction Available for Review
Jackson, California
Public Comment Period: December 2, 2022 – January 10, 2023 The California Department of Toxic Substances Control (DTSC) is sending this Community Update to inform you about of a draft Feasibility Study/Remedial Action Plan (FS/RAP) for Argonaut Mine Tailings site, along Argonaut Lane in Jackson, California, 95642 In 2018, DTSC completed a retrofit intended to reduce the risk of failure of the Eastwood Multi-Arch Dam. In Phase II of this project, DTSC will install a larger stormwater pipe system downstream of the dam to provide capacity for a 100-year storm, safely conveying water to Jackson Creek. Should a more severe storm occur, stormwater will be detained in the basin behind the berm road on top of the dam.
The Eastwood Multi-Arch Dam is located at the very south-eastern corner of the Site. In a 2015 U.S.
EPA Office of Research and Development Report, engineers detailed the effects of a Dam failure.
They concluded that if this Dam failed, during wet winter months, a 15-foot-high wall of mud and tailings would flood downtown Jackson with damages as high as $100 million as well as a possible loss of life.
DTSC will accept public comments for the draft FS/RAP for Phase II of the Argonaut Mine Concrete Dam (Dam) retrofit beginning December 2, 2022 – January 10, 2023. Please send all written comments to Andrew Reimanis, Project Manager at 8800 Cal Center Drive, Sacramento, California 95826; or call (916) 255-4976 or [email protected]. All comments must be received by January 10, 2023.
A virtual public meeting and hearing will be held via Zoom on Tuesday, December 20, 2022, starting at 6 pm. The meeting will include a presentation and question-and-answer session, followed by the public hearing. Public comments will be taken at the hearing and DTSC will respond to these comments in writing. To register, go to https://tinyurl.com/5y45tmde.
