3. PUBLIC MATTERS NOT ON THE AGENDA.

Discussion items only, no action will be taken. Any person may address the Council at this time on any subject within the jurisdiction of the City Council. Please note – there is a three (3) minute limit.

Sierra Grandbois, Jackson, spoke about an animal control incident. A loose dog attacked her neighbor’s cat on her property, which led her to call Animal Control. Animal Control advised that the City of Jackson is not in contract with Amador County and referred her to Jackson PD. She called PD, and was told that no one was available to respond. Ms. Grnadbois asked why the City stopped contracting with Amador County Animal Control. Chief Mynderup recalled that the City still has relationship with Animal Control, but he will look into it.

Sarah Tullus, 206 Broadway, Jackson, made a compliant against the City Manager. Ms. Tullus gave her recount of her recent experience with a sewer spill that City determined to be her responsibility. She said that the City Manager sent three Public Works employees to her place of employment for this sewer issue. She felt that it was unprofessional, embarrassing and had potentially jeopardized her employment and asked for an apology. Mayor Stimpson said we can’t respond here, but on behalf of the City, he apologized for any misunderstanding.

Sophie Starostina, Youth Program Supervisor for ACRA, spoke about a proposed winter camp program and requested funding support from the City. The program would be during the schools’ winter break, $180 per child. The program expected 20 children. ACRA asked the City to make a contribution of $3,600 to support the program. Councilmembers had questions about how this program would work with schools’ ELP. Attorney Nelson advised Council to refrain from discussion since it’s not on the agenda. Manager Kimball said that she would work with the Ms. Starostina and ACRA and report back to Council.

6. ADMINISTRATIVE REPORTS.

This section is to provide staff an opportunity to present oral status reports on issues. No legal action is expected to be taken by the Council.

Public Works Superintendent, Bree Wilder
He thanked the Fire Dept. for help with resolving the Westview flooding issues over the weekend. He also reported that Caltrans decided to go through a public process to close the already closed Pitt St.

Bridge. The process has been conducted. He also reported that there was a waterline leak in the backyard of 230 Hill St. It has been fixed. He then reported that the power pole at the lift station located at the high school was down for some reason. Fixing the fallen power pole led to changing out a new panel. Mr. Wilder informed the Council that he’s been responding to the concerns about the paving job on Vukovich Way. There was no broken waterline. The puddle was due to groundwater. Paving contractor had looked at it and did not think it would impact the life expectancy of the new pavement.

Police Chief, Chris Mynderup
Mynderup attended a POST executive training. He shared that JPD still has a couple of cases in court.

It appears that the jury verdicts on those cases were favorable. He wanted to commend the great work by officers Morrison, Harman, Detective Gray for the search warrants and investigations, which led to those favorable verdicts. On January 4 and 5, JPD will be attending a multi-agency active shooter training at Argonaut High.

Fire Chief, Dale Fishback
Reported that JFD was happy to help PW dept. He also commented that the emergency response system needs some improvement as during the last week’s heavy rain, the fire Dept. had to call Bree’s personal cell to get hold of someone.

City Attorney, Josh Nelson. No report.

City Manager, Yvonne Kimball. No report.

Councilmember Gonsalves
Could not make it to the theater opening but look forward to future shows. She predicted that she would visit the theater in the future.

Vice Mayor Simmons
Commented that the theater is a great attraction to city.

Mayor McLean
Attended tree lighting at Christmas Delights, then attended the theater opening. Regarding ACTC meeting, he said he found out that Caltrans has some metal sheds to dispose of. He suggested them to the city’s Homelessness Outreach. Also, Caltrans announced that signal lights will be installed on Hwy 88/49 at the cross walk by Mel’s.

These audio recordings provide an accurate and comprehensive backup of City Council deliberations and citizen discussion.
a. Receive, discuss and provide direction regarding (verbal) report from the Homeless Outreach Coordinator regarding the City’s response to homeless issues.

The Homeless Outreach Coordinator Christine Platt gave her monthly updates. She said that the clean-up organized by the Foothill Conservancy went well and was labor intensive. The camps behind the hospital have been cleaned up. She thanked CM Godde for his participation. The shower program continues to employ unhoused individuals. The city also was awarded with the HAPP round 2 grant, which will help to fund the outreach program and may purchase a storage shed. The grant has approximately $289,000 for two years.

The Building Department processed 21 total permits in December, 2 less than November. The total number of permits for this year is 294, up from 220 last year. The permit Valuation is $ 9,556,159 up from $ 4,255,325 last year. Total Fees collected $ 586,047.91 compared to last year’s $ 174,745.12 Solar permits are experiencing a rush due to the net metering changes coming in April including the 412. KW system for Cost Less Foods. Weather and winter are slowing construction in the city and the number of permits. The building department is taking the time to continue to work on department standards and policies, City projects and Code enforcement.

CODE ENFORCEMENT UPDATE:

Page 23 of 38 ends

Code Enforcement went and served several properties with notices of violation and building without a permit. Most properties are complying without further action. As a reminder always check with the building department before doing any remodels or repairs to the property.

PROJECTED:

The housing market, material costs and interest rates along with winter will slow down the building department.

Item 4h
Resolution No. 2023-01
A Resolution of the City Council of the City of Jackson to Authorize GeoCon Consultants Inc. to Perform Removal Action Workplan Revision Work for the Oro De Amador Property
WHEREAS, in 2006, the City of Jackson entered into a Voluntary Cleanup Agreement (Agreement) with the Department of Toxic Substance Control (DTSC) for the Oro De Amador property clean up and reuse project (Project). Under the Agreement, the City is required to perform a Removal Action Workplan (RAW); and
WHEREAS, the City engaged GeoCon Consultants Inc. in 2014 to conduct the RAW project and entered into the original agreement on October 19, 2014 for a fee of $49,590; and WHEREAS, the project experienced numerous reviews, delays, and updates which led to scope changes and cost increases; and
WHEREAS, the original agreement with GeoCon was extended in 2017 for an additional $5,000, then in 2021 for an additional $2,000. These fund increases were inadequate to complete the RAW in order to obtain DTSC approval; and
WHEREAS, in 2022, the City secured an Equitable Community Revitalization Grant (ECRG) in the amount of $320,000 to cover eligible costs for the Oro De Amador Project; and WHEREAS, Consultants’ expenses related to the Project including RAW are eligible for ECRG and the City continues to find GeoCon consultants competent and possess important background information for the RAW project.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Jackson as follows:

1. The City Manager is authorized to enter into an agreement with GeoCon Consultants for activities of the Oro De Amador cleanup/reuse project covered by the ECRG fund, specified in GeoCon proposal No. S9959-07-03AP. The scope of services set forth in the attached Exhibit.

2. The City Council authorizes the City Manager to further amend the agreement with GeoCon for the purpose of Oro De Amador property reuse and clean up under ECRG fund.

ORO DE AMADOR REMOVAL ACTION WORKPLAN REVISION

JACKSON, CALIFORNIA
Ms. Kimball,
Geocon Consultants, Inc. (Geocon) has prepared this proposal for environmental consulting services related to the Oro de Amador property (the Site) in Jackson, California. This proposal is presented as a change order request to our existing agreement with the City of Jackson (the City, the Client) dated August 30, 2021.

As you know, we are currently revising the Draft Final Removal Action Workplan (RAW) based on comments from the California Department of Toxic Substances Control (DTSC; July 7, 2022).

Our revision of the RAW, as well as DTSC’s review of the revised RAW, remedial design and California Environmental Quality Act (CEQA) analysis, are to be funded by an Equitable Community Revitalization Grant (ECRG; July 7, 2022) that the DTSC awarded to the City of Jackson. DTSC’s oversight of the cleanup plan is being performed pursuant to a Voluntary Cleanup Agreement (VCA; April 2015) with the City of Jackson.

In accordance with your request on November 22, 2022, this proposal includes a preliminary budget for assistance with advertising, hosting and presenting at a public meeting regarding the proposed cleanup and site development, which is presented as Task 4A. In addition, we divided Tasks 2 and 3 into subtasks 2A, 2B, 3A and 3B.

We understand that our proposal is scheduled for review by City Council in December 2022. In the interim, we are requesting your authorization of Tasks 2A and 3A so that we can continue with our current work on the project.

SCOPE OF SERVICES
Based on our experience with the Site and DTSC comments (July 2022), we have identified the following tasks to be performed under the ECRG in order to finalize the RAW and to assist the City with other site-related requirements:
• Task 1 – Preliminary Services: review and discussion of the Draft Final RAW with the City and DTSC;
• Tasks 2A and 2B – Revision of the RAW in accordance with DTSC comments including:

Page 29 of 38 ends

• Task 2A - Background Arsenic Concentration Determination and Statistical Evaluation, and • Task 2B - Revision of Risk Assessment, RAW, and Appendices; • Tasks 3A and 3B – Surface Water Monitoring including:
• Task 3A – 2022 Surface Water Monitoring, and
• Task 3B – 2023 Surface Water Monitoring;
• Tasks 4A and 4B - Assistance with Public Participation and Environmental Review including:
• Task 4A – Public Meeting, and
• Task 4B - Public Participation and CEQA Analysis; and • Task 5 – Remedial Design.

Following are descriptions of each task.

Task 1 – Preliminary Services
We outlined our preliminary services under the ECRG in our proposal dated July 26, 2021, which included a scoping meeting and consultation with the DTSC during RAW review. The fee estimate for these initial services was $2,000. Task 1 was previously authorized by the City.

Tasks 2A and 2B – Revision of the Removal Action Workplan Task 2A – Background Arsenic Concentration Determination and Statistical Evaluation We will revise the RAW according to the DTSC’s (July 2022) comments. The DTSC requires additional information to support a background arsenic concentration determination, which will require modification of the mineralogical evaluation, statistical evaluation, and human health risk assessment.

Development of a modified arsenic background threshold value (upper-end concentration) will also require revision of cleanup boundaries at the Site.

In addition to the substantial modifications the DTSC requires to support the background arsenic determination, Geocon proposes to collect twelve soil samples for total arsenic analysis and six soil samples for California Bioaccessibility Testing (CAB; DTSC Human Health Risk Note No. 6, September 2017) to further evaluate potential human health risk associated with the proposed recreational use of open space areas that are naturally mineralized and have elevated ambient (naturally occurring or “background”) arsenic concentrations in soil. The CAB results are intended to provide a supplemental line of evidence for use in the background arsenic study to support the planned recreational use of portions of the property.

Task 2B – Revision of Risk Assessment, RAW, and Appendices Based on the background arsenic determination and statistical evaluation described above, we will revise the risk assessment and RAW, and will also prepare the following required appendices to the RAW, which are intended to facilitate DTSC’s review and approval:
• Administrative Record List – summarizing the record documents for the Site;

Page 30 of 38 ends

• Dust Mitigation Plan - describing Best Management Practices (BMP) for minimizing generation of airborne dust (particulates) during soil-disturbing RAW removal action alternative construction activities (“RAW remedy”; i.e., construction of a clean soil cap over mine tailings containing arsenic at elevated concentrations); • Community Air Monitoring Plan – describing air monitoring to be performed during soildisturbing RAW remedy construction activities to demonstrate that dust mitigation BMPs are effective and that particulate levels downwind of the soil-disturbing activities do not exceed criteria established in the Community Air Monitoring Plan and are protective of community health and safety;
• Verification Sampling and Analysis Plan – describing procedures for soil sampling and analysis, if needed to verify the remediation boundaries; • Soil Management Plan – describing management of clean soil cap material and tailings in the event that future penetration of the cap occurs;
• Unanticipated Discovery Plan – describing actions to undertake in the event that historical or cultural materials are encountered during RAW remedy construction activities ; and • Monitoring and Reporting Plan – describing periodic monitoring of the clean soil cap to document its condition.

Tasks 3A and 3B – Surface Water Monitoring
Geocon proposes to perform surface water monitoring during the 2022-23 winter season to evaluate various constituent concentrations including site-related contaminants such as arsenic and cyanide in surface water at discharge and downstream locations. We anticipate that we will perform the monitoring during four storm events at up to four locations. We will analyze the surface water samples for field parameters including pH, electrical conductivity, temperature and turbidity and have the samples analyzed by a laboratory for total cyanide, total arsenic, total suspended solids (TSS) and oil and grease (O&G).

Tasks 4A and 4B – Assistance with Public Participation and CEQA Analysis Task 4A – Public Meeting
We will facilitate a public meeting in early 2023 to solicit public input on Site reuse to support the remedial design process for the Site.

Task 4B – Assistance with Public Participation and CEQA Analysis We will work with the City and DTSC to facilitate public participation and analysis of the RAW under the California Environmental Quality Act (CEQA). We will prepare a budget estimate for this task at the direction of the City once we obtain DTSC’s technical approval of the RAW.

Task 5 – Remedial Design
We will work with the City to develop a remedial design for the selected RAW remedy. The scope of this task has not yet been determined, but could include:

1. Preparation of a topographical survey to support the remedial design;

2. Development of specific remedial design details such as:

Page 31 of 38 ends

a. Clean cover (cap) design for ball fields;
b. Layout of clean utility zones within the soil cap;
c. Recommendations for selective capping of trail surfaces through areas of mining impact; d. Development of an operation and maintenance (O&M) plan for capped areas and any associated features (i.e., fencing, signage, etc.) per DTSC requirements based on the redevelopment design; and
e. Assistance with the development of land use covenants for areas where mine waste is to remain in place.

Based on the proposed delivery schedule for the RAW, we anticipate that the remedial design will be submitted to DTSC as a separate document (i.e., a Remedial Design and Implementation Plan [RDIP]).

An RDIP can typically be submitted after CEQA review has been performed for the RAW. We can prepare a budget estimate for this task at the direction of the City based on the City’s preferred approach to the remedial design process.

FEE AND SCHEDULE
We will perform our services on a time and expense basis according to the attached fee schedule. Our fee estimate is outlined below.

Task Estimated Fee
Task 1 – Preliminary Services (Geocon proposal dated July 26, 2021) .................................. $2,000 Task 2A – Background Arsenic Determination and Statistical Evaluation .......................... $14,670 Task 2B – Revision of the Risk Assessment, RAW and Appendices ................................... $43,636 Task 3A – Surface Water Monitoring, 2022 ........................................................................... $5,096 Task 3B – Surface Water Monitoring, 2023 ........................................................................... $5,096 Task 4A – Public Meeting ....................................................................................................... $5,790 Task 4B – Assistance with Public Participation and CEQA Analysis ................... CITY OF JACKSON
Council Meeting Memorandum
Monday, January 9, 2023 – 7:00 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Yvonne Kimball, City Manager
Date: January 6, 2023
Agenda Item #7d: Use Fund 246 balance to repair a portion of Main St. sewer line.

RECOMMENDATION:

That the City Council authorize usage of Fund 246 to investigate and conduct necessary repair to a portion of sewer line at Main St.

DISCUSSION:

In July 2021, the City entered into a settlement agreement with the Regional Board, Order R5- 2021-0503. Pursuant to the Order, City is to allocate $67,840 as a separate fund to help repair private sewer laterals. Originally, City Council has agreed to use the fund to continue a grant program for property owners that meet the low-and-moderate income requirements. The Council also authorized a list that contains qualified properties. The original list has been completed and the fund balance is $39,454.50. The fund needs to be exhausted by June 30, 2023.

Council could authorize to continue the income-based grant program until the fund is exhausted.

This option will take a long time to complete. Given the tight schedule, staff does not recommend this option.

Alternatively, Council could consider using the fund to improve a section of the sewer line on the northern end of Main St. This section of the sewer line has been a concern and it was suspected that the line under the road has caused a slight road failure. Since this section of the sewer line is believed to be a private lateral, hence has not been looked into by City. The fund 246 program is a good fit. Staff recommends this option. Should Council direct us to proceed, staff will begin with investigation immediately.
