Discussion items only, no action will be taken. Any person may address the Council at this time on any subject within the jurisdiction of the City Council. Please note – there is a three (3) minute limit.

Residents of Jackson View Subdivision (Chris Carmine, Jeff Black, Jeanne Wilson, Kathy Winnie, Greg Paulson, & Jackie Friday) expressed safety concerns within their community due to unfinished actions on Thomas Drive, Emerald Drive, and Goldstone Drive, causing trip hazards to elderly and disabled residents, guests/family, delivery drivers, landscapers, and potentially emergency responders. They provided multiple examples of minor to severe injuries that have already occurred. They advised of a few residents unable to safely traverse sidewalks to access their mailboxes that choose to drive from two or three houses away to avoid injury. Developers are not expected to complete the streets until all homes on both sides are completed, which does not provide a clear expected completion date. They would like council to review the Subdivision Approval Agreement (Sept. 14, 2015) for a modification block that would allow for a timelier completion of the streets.

Mayor McLean inquired if the developer has been contacted and residents advised they have with no success. Residents advised there are approximately 15 homes remaining to be built, with about 5 homes being completed each year, resulting in an estimated 3 years until all construction is complete before the developers agree to complete the streets. April 24, 2023 City Council Meeting Minutes
Public Works Superintendent, Bree Wilder – The line is good for the sewer on Main Street. Public Works is continuing to investigate the problem with water coming up under the road on Vukovich Way when it rains. Wilder and City Engineer Ospital have had core samples taken to assist with determining the cause. Councilmember Stimpson inquired about the warranty and Wilder advised the core samples are to help figure out the substructure and cause. They have determined the leak is not related to any water line. Vice Mayor Simmons inquired about the city street sweeper and Wilder advised it is expected in June or July. Mayor McLean asked for clarification if the leak is due to some kind of natural occurring water and Wilder advised there is some kind of water channel under the road.

Police Chief, Chris Mynderup – This week is National Crime Victims’ Rights Week. Acknowledgement was given to Amador County District Attorney Victim Witness Services and Operation Care.

Wednesday and Thursday, CHP’s “Every 15 Minutes” program begins, educating local teens of the dangers of distracted and drunk driving. Wednesday they will be at Argonaut High School where they will conduct a mock crash site, land a helicopter, and have other activities. One kid will be removed from class every 15 minutes, sending the message about how many people we lose in the US due to distracted driving. Thursday will be at Amador High School with an assembly, picnic, a first responders booth, and food trucks. Saturday, PD will be assisting with road safety as the Wagon Train comes to town, visiting Main Street, the Senior Center, and ending at Laughton Ranch. Sunday, the Wagon Train will return for the parade and scheduled events downtown. Mayor McLean asked how many wagons and Debby Collins advised the total wagons will be eight.

Interim Fire Chief, Dale Fishback – A fire broke out in one of the homeless encampments on the Oro De Amador property owned by the city and burnt debris will need to be removed. The new Fire Engineer has been hired. For “Every 15 Minutes”, Fire will be simulating a full emergency scenario for students in hopes of personalizing the full impacts and dangers of distracted/drunk driving. Councilmember Stimpson inquired about the location for kids taken out of class in that program and Chief Fishback confirmed they are taken to a staging location for the full impact to classmates and families, with no cell phone or outside contact. Fire assisted with the clean-up day at the Cemetery, raking, cutting down trees, etc.

Councilmember Gonsalves inquired about the fire in the encampment if the conditions had been drier, how many encampments are currently in that area, and the frequency with which they are being encouraged to move on. Chief Fishback advised the Homeless Outreach Coordinator Christine Platt can address this question at the next council meeting. Police Chief Mynderup advised there are currently about eight individuals at this camp, with about four or five camps. Vice Mayor Simmons asked if the individual responsible for the fire will be prosecuted or charged. Mynderup advised the fire was accidental due to a candle that was left burning in his tent, and the only losses were his own possessions.

Public Comment: Lana Vukovich advised the dumpsters at the surgery center have been broken into again, and Aces Waste Management advised this is occurring often. Police Chief Mynderup advised they are doing what they can to address these concerns.

City Attorney, Joanna Gin – Nothing to report.

City Manager, Yvonne Kimball – Reported a few items:

PW Supt. Wilder, Admin Asst. Kirkpatrick, City Engineer Ospital, and herself met with Caltrans last week regarding creek dredging along South Avenue and other Caltrans rights-of-way. Caltrans is

willing to go through the process but expects it to take six years. Kimball advised Caltrans that six years is unacceptable. A follow up meeting is planned for this June. There is a possibility for a city partnership to potentially speed up the process. Kimball added that advised Senator Alvarado-Gil’s aid Dana Jorgenson was present during our meeting with Caltrans . PW Supt. Wilder took the Caltrans Public Information Officer on a couple site visits following the meeting. Councilmember Stimpson advised not to expect it to move much quicker due to EPA and other agency concerns. Councilmember Gonsalves stated the delays should all be bypassed due to the FEMA emergency. Mayor McLean encouraged continued pressure on Caltrans with concerns for next winter’s flooding possibilities. He encouraged staff to involve Senator Alvarado- Gil who lives in our county., .

PW Supt. Wilder is working with City Engineer Ospital and DTSC for a water drain replacement under Hwy 49 in July, which is a good example of partnership between the city, other state agencies, and local property owners.

Design Review Committee met last Friday for paint on 1 Main Street and building permits and signage at 30 Main Street. Both items were approved unanimously. 1 Main Street will be painted the same colors the old courthouse was recently painted.

PW Supt. Wilder and Admin Asst. Kirkpatrick are continuing to work on submissions to FEMA for assistance due to flood damage.

City Manager Kimball began the International City & County Manager Association’s Leadership Academy. She is a credentialed city manager through this organization and after 15 years is committed to continued learning.

Today, Kimball attended Shirley Dajnowski surprise 100th birthday party. Councilmember Gonsalves wished Ms. Dajnowski well. Chief Mynderup advised of Ms. Hernandez who is turning 107 years old as well. Kimball advised the city also recently sent a card to resident Paul Jones.

e. Introduction and first reading of Ordinance No. 729 amending City of Jackson Municipal Code sections regarding cemetery prices, eligibility requirements for the Cemetery Committee and the Design Review Committee. [Directed at the March 13 meeting.] City Manager Kimball introduced the ordinance, explaining the fees and expanding membership came at the request of the Cemetery Committee. It can be difficult to get enough interest from volunteers to join the Cemetery Committee and the Design Review Committee, and preference for the committee will still go to Jackson residents. The proposed ordinance addresses the DRC eligibility as well.

Mayor McLean asked for public comments and received none. Mayor McLean opened the item for council discussion. Councilmember Gonsalves provided some history on the formulation of the Design Review Committee from the Revitalization Committee back in 2007/2008. She added that she was glad to hear earlier that DRC has been meeting and advising on design matters. She indicated that DRC needs to stay active. Mayor requests a motion.

f. Authorization of additional Sewer Lateral projects under Fund 246 sewer lateral improvement.

City Manager Kimball explained that in January, Council authorized to use this fund to look into sewer under Main St. Fund 246 was established under an agreement the city had with the Regional Board for two supplemental projects. About $69k was approved for the sewer lateral project, and approximately $20k was spent last year. The rest of the money was moved to solve the sewer problem on Main Street, which wasn’t as bad as expected, so city recommends applying the remaining approximately $33k for a couple other private sewer lateral projects.

Page 9 of 56 ends

April 24, 2023 City Council Meeting Minutes
PW Supt. Wilder provided information on both projects. The highest priority project starts at 10299 Amador Street, serving about five homes. The second project starts at 10235 Amador Street, serving two duplexes.

Mayor McLean opened council discussion. He asked how old the lines are and Wilder advised they are approximately 80 years old. Councilmember Stimpson asked if most lines can be repaired through bursting and Wilder confirmed. Councilmember Godde asked City Manager Kimball if these homes were discussed during the CDBG program and Kimball advised she will check the original list but does not believe so. Godde advised a neighbor of his just missed the income cap to have their sewer repaired during the previous program and has had to pay out of pocket. He inquired why these homes will be getting their sewer line repaired while she still had to pay for hers. Kimball advised these funds were expected to be used for Main Street but since the money was not used, they are using the remainder to serve the largest number of residents possible before expiration on June 30th this year. There is not enough time to run an income-based program before the deadline. General funds may be considered for a future income-based program to assist with another private sewer later program in the future.

Councilmember Gonsalves asked PW Supt. Wilder if the lateral lines on the map are very accurate and he confirmed, providing additional technical details. He advised this project will take care of 9 people’s homes as opposed to one or two projects. Councilmember Gonsalves advised that the owner of 10285 Amador) has two homes on the property and is a bit concerned about the ground being torn up. Wilder advised the work will not be completed in her yard at all, but 10-15 feet behind her fence. Wilder was able to provide some information to a couple homeowners, advising there will be no cost and they were receptive to the work being done. Councilmember Gonsalves asked if the program is income based and Wilder advised this project is not.

Mayor McLean asked for public comments and received none. Mayor requests a motion.

Motion to approve authorization of additional Sewer Lateral projects under Fund 246 sewer lateral improvement dated April 24, 2023 as presented. Moved by Stimpson, seconded by Simmons, and carried by a 5 to 0 vote:

CITY OF JACKSON
Council Meeting Memorandum
Monday, May 8th, 2023 – 7:00PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Yvonne Kimball, City Manager
Date: May 3, 2023
Subject: Second reading of Ordinance No. 729 Amending City of Jackson Municipal Code Sections regarding cemetery prices and the eligibility requirements of the Cemetery Committee and the Design Review Committee.

RECOMMENDATION:

Conduct second hearing and adopt Ordinance No. 729.

DISCUSSION:

The Cemetery Committee is a council advisory committee. It requested that cemetery prices are governed by the Municipal Code based on information from the 1970’s and 1980’s. It was recommended that the fees be removed from the JMC sections so that City Council can adopt the fees through resolutions, like other fees.

Facing the challenge of finding enough committee members, the Committee has recommended to expand the eligibility requirements to non-city residents with a preference given to residents. Staff has recommended to do the same for the Design Review Committee since the same challenge applies.

Consequently, Ordinance No. 729 is drafted. In summary, this Ordinance proposes to:

1. Amend JMC sections 2.36.030 and 2.23.160 to provide that the cemetery plot prices and the opening and closing prices for graves shall be determined by resolution by the city council.

2. Amend JMC section 2.37.025 to expand the eligibility requirements to allow for the appointment of non-residents of the City while providing a preference to residents.

3. Add Section 2.18 to clarify the eligibility requirements, appointment process, and powers and authorities and other regulations applicable to the Design Review Committee.

Page 29 of 56 ends

Item 3g
The City held a public hearing on April 24th, 2023 and the second reading is on May 8th, 2023, at which time all interested persons will have the opportunity to appear and be heard on the matter of adjusting the cemetery prices and eligibility requirements of the Cemetery Committee and the Design Review Committee. The City has published notice of the public hearings pursuant to California Government Code Section 6066 and ensured any and all other legal prerequisites relating to the adoption of this Ordinance have occurred.

Resolution No. 2023-15
A Resolution of the City Council of the City of Jackson Adopting a List of Projects and Approving the Use of SB1: The Road Repair and Accountability Act Funding for City Street Projects for FY2023-24
WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017; and
WHEREAS, the City of Jackson must include a list of all projects proposed to receive funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB1, in the City’s budget which must include a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement; and
WHEREAS, the City of Jackson, will receive an estimated $106,018 in RMRA funding in Fiscal Year 2023/24 from SB1; and
WHEREAS, the City of Jackson has been using a Pavement Management System to develop its Capital Improvement Program project list, and SB1 funding will help provide funding for the most high-priority and cost-effective projects that also meet the community’s priorities for transportation investment; and
WHEREAS, future funding from SB1 will help the City of Jackson maintain and rehabilitate roadways; and
WHEREAS, the City Council repeals the previously adopted Resolution No. 2022-09 Approving the Use of SB1 funds and replaces it with this Resolution.

NOW, THEREFORE, BE IT RESOLVED that City Council of the City of Jackson does hereby approve the following:

The 2022-23 Road Maintenance and Rehabilitation Account revenues will be carried over to Fiscal Year budget 2023-24 to fund the Mattley Street Hillside Repair Project. Estimated costs were $272,000 but due to construction costs, city engineer suggests adding 15% contingency cost, which brings project cost to $312,800 and will last approximately 50 to 80 years. The site is located in Jackson at the intersection Hwy 49/88 and Main Street (the City parking lot across the street from the firehouse). The bank has access at the top (Mattley St.) and the bottom (parking lot). The City Engineer is proposing use of mesh and soil nails to stabilize the bank that supports Mattley Street. This is to prevent Mattley Street from collapsing down the hill onto Hwy 49. Estimated Completion Schedule: FY 2023-24. The estimated useful life is 20 years.

Point of Interest Project at 149 Main St. AKA the hanging of a large banner (that is considered art) on an existing wall on Main St.

PROCESS - OUTCOME - PONDERINGS
The idea of involving the City of Jackson in a public/private partnership on this project was the brainchild of the property owner. The property owner is providing a space for a point of interest. A local businessman has provided the artwork/sign at his cost. The City was offered participation in the project financially and physically and acknowledged as a partner by the placement of the City logo into the project.

This request was received positively by the City Council and a grant was awarded. A partnership was formed. The project could move forward. The City has its logo on the Point of Interest/banner/sign and would presumably hang the sign/banner/Point of Interest and issue a grant check to the property owner for participation in the project.

Then the issues began to surface:

TIMELINE:

I waited two weeks for an agreement. I waited three weeks for a Design Review Committee to meet and acknowledge this project-even though that is specifically NOT what the Design Review Committee is supposed to be doing.

I waited another week for answers from City staff as to when the City might be able to hang the sign/banner/Point Of Interest. I received one non answer from public works, stating they would pick up the sign and hang it when they could get to it. A week went by after that and no one ever showed up.

Finally, after nearly a month, the sign/banner/Point Of Interest was hung by the property owner with no help from the City whatsoever.

LICENSE AGREEMENT:

The last word on the matter at the Council meeting was offered by the City Attorney saying there must be some kind of agreement put in place. Everyone nodded in agreement. I wonder if any of the council understood that there would be a four-page contract drawn up with dual access and dual hold harmless agreements, unrealistic timelines and ownership of the banner/sign.

The license agreement the City sent to the Property owner showed no disposition for a partnership and left no room for negotiation. I wonder if anyone of the Council would sign such an agreement? The agreement is attached for your viewing pleasure. It calls into question a lot of issues for me. Why does the City need to own this banner/Point of Interest? Why the need for unlimited access to the property owner’s property? More importantly, why are tax payer dollars wasted on crafting a document like this, just to hang a banner/sign? Exactly how much did this document cost the City of Jackson in legal fees? WHO BOUGHT AND PAID FOR THE PREVIOUS SIGN:

The actual answer is: Stanley Lukowicz and Kam Merzlak partnered together to get the sign/banner built and paid for. The City Public Works Crew hung that sign within a few days of the request.

Page 37 of 56 ends

Item 6b
Ownership of that sign/banner was never in question until it was erroneously stated that the City of Jackson bought and paid for that sign in a staff report for the design review committee.

When I mentioned this, I was told to attend the meeting and set the record straight myself.

The problem with propagating misinformation, is that it becomes the record and someday fact.

PARTNERSHIP WITH THE CITY
How does one partner with the City? How does the City accommodate their partners? What does a public private partnership look like?
If we can understand some of the answers to the above questions, perhaps projects in the future that involve a public private partnership might blossom into collaborations.

CITY OF JACKSON
Council Meeting Memorandum
Monday, May 8, 2023 – 7:00 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Yvonne Kimball, City Manager
Date: May 1, 2023
Agenda Item #6c: Discussion and direction regarding the inactive Revitalization Committee RECOMMENDATION:

That the City Council rebrand the inactive Revitalization Committee into a broader purposed Economic Development Committee.

DISCUSSION:

In 2008, City Council appointed a standing committee: Revitalization Committee. The Committee has not been active for longer than 6 years.

Based on the information that still exists on the website, the Committee was formed following an economic development workshop that year. The mission of the Committee is “to organize a group of persons interested in revitalizing the City of Jackson; recruiting and retaining new businesses and industries; sustaining a growing economy; thus enriching the lives and experiences of Jackson property owners, merchants, residents and tourists.” The Committee had a total of eleven (11) members, including two council members. The Committee appeared to have met monthly. The members were:

Council members: Connie Gonsalves & Wayne Garibaldi
Merchants: Duane LaMoureaux
Property owners: Kelle Davenport & Stanley Lukowicz
JBCA Members: Aaron May
Resident: Richard Hoffman
Members at large: Gary Little, Mark Hirschel & Sally Bligh County Liaison: John Plasse
Some members have moved away or retired, which could be one of the reasons the Committee is no longer active.

Page 43 of 56 ends

Item 6c
The Committee was involved in or responsible for city’s façade grant, Jackson Business Planner Guidebook, and downtown parking issues. These issues were and still are relevant. The Committee also had quite detailed operating guidelines (attached).

Moving forward, Council needs to decide what to do with the Committee. Here are a few options for Council consideration:

1. Dissolve the committee.

2. Reinstate the committee.

3. Rebrand JRC into an Economic Development Committee.

Staff recommends Option 3 – rebrand JRC into an Economic Development (ED) Committee.

This would broaden the JRC scope but still fit its original mission. Moreover, an ED Committee is appropriate or may be necessary to accomplish Council’s strategic goals.

Council has identified “economic development” as one of the strategic goals. In recent years, Council has discussed several initiatives under the ED umbrella including Mayor McLean’s Arch on Main, and SR 49 right-of-way corner beautification. Councilmember (former Mayor) Stimpson initiated a sister city program in 2019; the program can be enhanced and become a more robust economic development program. Council also touched upon looking into the one-way traffic option and additional parking for Main St. which can be a very appropriate discussion subject for the Economic Development Committee. Additionally, on-going city programs such as the façade grant, special events, business inquiries, updating the 2008 Business Planner document, and reviewing statewide economic development information, can also use attention from an Economic Development committee.

Rebranding the inactive JRC into an active Economic Development Committee meets another of Council’s strategic goals – (effective) governance. An engaged community is a healthy place.

Jackson has a history of involving citizens and businesses to get jobs done. A standing committee with meaningful tasks and backed by adequate support is a good way to continue our tradition.

Once formed, with the assistance of the Admin Assistant, City Manager/I can be the initial staff person to organize and support the committee meetings. Now that we have a strong team of community development, including helpful consultants and staff, supporting the mission of an economic development committee should be a bit easier.

Should the Council proceed, staff will begin recruitment for the Committee. Council should give some parameters regarding membership make-up. Staff recommends involving Chamber of Commerce, Council of Tourism, and the new JHBA.

CITY OF JACKSON
Council Meeting Memorandum
Monday, May 8, 2023 – 7:00 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Yvonne Kimball, City Manager
Date: May 1, 2023
Agenda Item #6d: Logo policy
RECOMMENDATION:

That the City Council adopt a Resolution to establish a city logo use policy.

DISCUSSION:

From time to time, staff receive requests or inquiries regarding using city’s logo, insignia or other city owned graphic properties. The City does not have a spoken policy on this matter, except that a few years ago Council directed staff to draft and implement a license agreement to protect the use of the murals belonging to the city. While staff continues to use the license agreement on some occasions, a more consistent process is recommended.

This policy is an effort to establish uniform guidelines and articulate the City’s desire to protect city owned properties, including the city logo. It is city staff’s intent to establish a commonsense policy and procedure. It is not our intent to focus on enforcement or perceived violations.

We recommend that City Council adopt the enabling resolution to establish city logo uses.
