CITY OF JACKSON
Council Meeting Memorandum
Thursday, June 1, 2023 – 2:00 PM Special Meeting
To: Honorable Mayor and Members of the City Council
From: Yvonne Kimball, City Manager
Date: May 29, 2023
Agenda Item #3a: French Bar Bridge replacement project construction bid award RECOMMENDATION:

That the City Council award the contract to Westcon Construction Corporation in the amount of $4,539,972; and direct the City Engineer to immediately submit to Caltrans a request to modify the original Authorization to Proceed.

DISCUSSION:

At the May 22 council meeting, City Engineer Matt Ospital presented the construction bid response. The sole bid that the city received is 125% higher than the engineer’s estimate. With the addition of construction contingency and construction management, the total overrun cost is $1,924,965. This amount has not been currently allocated. The City needs to advance this amount.

Given this concern, staff had a meeting with Caltrans Local Assistance representatives last week.

The Caltrans representative explained that should the city choose to award the contract, there are three opportunities to receive additional funds by December.

We also discussed two other options:

A. Reject the bid and rebid. If we choose to do so now due to the poor response rate, the City would be in the same position a few months later concerning requesting additional fund from Caltrans.

B. Withdraw from the FHA program completely (in hopes of freeing up local money for other needed local projects). It was explained that the city has committed to the program and is obligated to go through the process and complete the project.

Neither of the above is recommended.

Awarding the contract to the lone bidder Westcon Construction appears to be the best option.

The City is in a favorable financial position, which enables the temporary coverage of the cost over-run. The City Engineer and Finance staff are committed to turning in paperwork as quickly

Item 3a
as possible to reduce waiting time for reimbursement. Should all go well, the cost overrun will be approved and all reimbursement payments from Caltrans should be received by February 2024.

In addition to using the general fund and other transportation fund moneys, water and sewer funds can also help with the temporary coverage of the cost.

Subject: RE: City of Jackson French Bar bridge construction cost overrun discussion follow-up Date: Friday, May 26, 2023 11:16:18 AM
Importance: High
Hi Yvonne,
We apologize for the delay. Yesterday was a hectic day, and we needed to cover other pressing issues. That being said, we do want to reiterate that federal funds are not guaranteed until the local agencies are able to justify the cost, and invoices are submitted for reimbursement. The authorization of federal funds is the initial procedure to ensure funds are encumbered (reserved for invoicing) by the State.

Please refer to excerpts below from the Local Assistance Procedures Manual (LAPM) in reference to additional cost to the project (post-award), or any future cost over-runs. We will proceed with a request to modify the E-76 (AMOD) accordingly once the City can provide us with the adequate documentation. The availability of federal funds will dictate how soon the funds may be authorized.

We anticipate funds will become available at any moment – most likely between now and November/December 2023.

LAPM Ch. 15 Advertise and Award Project:

Procedures
Where the lowest bid exceeds the engineer’s estimate by an unreasonable amount as defined by established agency procedures, or where competition is considered to be poor for the size, type, and location of project, bids may be rejected unless an award of contract is justified as being in the best interest of the public.

15.5 Contract Award
Warning: No project shall be advertised for bids, nor shall any project work (by contract or other than contract) be undertaken, and no materials shall be purchased on any federal-aid project, prior to issuance of Authorization to Proceed by Caltrans or the FHWA. Violation of this requirement shall result in the project ineligible for federal funding.

The contract award is a critical milestone for all federal-aid projects. At this point, the LPA must have a complete financial package assuring adequate funding for the project. The LPA must award federal-aid contracts on the basis of the lowest responsive and responsible bidder. It is the LPA’s responsibility to assure that all successful bidders are licensed contractors upon award of any contract incorporating state or federal-aid funds.

If the award amount is more, or significantly less than the amount estimated at the time of construction authorization, the Award Package submitted to the DLAE will be used to update the project agreements. The Authorization to Proceed (E-76) and state-issued Finance Letter will be revised to reflect updated project costs. If additional federal funds for the project’s construction phase are needed, the LPA must submit written approval from the MPO/RTPA (for STBG, CMAQ, etc.) or pertinent DLA Office (for HSIP, HBP, ATP etc.) as part of the Award

Page 5 of 44 ends

Package.

Note: Per 23 CFR 630.106(f)(2), the federal pro rata or lump sum share may be adjusted before or shortly after contract award to reflect any substantive change in the bids received as compared to the LPA’s estimated cost of the project (Preliminary Cost Estimate) at the time of construction authorization, provided that federal funds are available. FHWA has interpreted the term ‘shortly after contract award’ to be no more than 90 calendar days after the contract award date.

LAPG Ch. 16 Administer Construction Contracts:

Additional Funds
If contract claim defense and/or award costs will exceed the amount of federal funds authorized for the project, the LPA should contact the DLAE for assistance. For regionally programmed federal-aid funds (Regional Surface Transportation Program, Congestion Mitigation and Air Quality Improvement Program, etc.) the Regional Transportation Planning Agency (RTPA) or Metropolitan Planning Organization (MPO) must be involved in authorizing additional funds. For state discretionary funds, the Caltrans Division of Local Assistance (DLA) will make the determination.

Let us know if you need further assistance.

Hi, Jesus, and Rattan,
I appreciate our meeting yesterday regarding FB bridge construction funding. As we discussed, although no guarantee, you both were confident that additional funding to cover the cost-over run of approximately $2 million would be approved should the city choose to award the construction contract now (and fulfill other local assistance requirements).

There are three opportunities to
allocate additional fund we need by the end of 2023.

Page 6 of 44 ends

Please send me excerpts from the Local Assistance Manual that would help to persuade the council to award the contract despite the cost overrun issue. your help is very appreciated.

We plan to have a special meeting early next week to possibly award contract. Your timely response would be appreciated.

Yvonne Kimball

CITY OF JACKSON

MEMORANDUM
TO: City Council
FROM: Matt Ospital, City Engineer
Yvonne Kimball, City Manager
DATE: May 16, 2023
Agenda Item #7a: French Bar Road Bridge Replacement Project Background
French Bar Bridge Replacement project is a 100% funded federal highway administration grant project. City has a total of four FHA projects – Marcucci Lane bridge which was completed in 2016; French Bar bridge; South Ave. bridge; and Pitt Bridge.

French Bar project originally started in 2011 with the design, investigation and environmental phases. As of April 2023, $886,293 grant fund has incurred. Construction phase funding was approved earlier this year. A bid process took place in accordance to FHA and Caltrans local assistance guidelines.

The bid opening for the French Bar Road Bridge Replacement Project was conducted on May 9, 2023 at 10:00 a.m. The City received one bid for the project from Westcon Construction Corporation at $4,539,972.00 and it was reviewed for compliance with the project specifications. Attached is the bid summary broken down by bid item.

The bid prices were analyzed for reasonable conformance with the Engineer’s Estimate.

The bid received was approximately 125% higher than the Engineer’s Estimate. The current construction market conditions relating to labor and material supply chain disruptions, and the short window to complete the project this construction season; both provide substantial reasoning for bids coming in higher than the Engineer’s Estimate.

However, these increased bid prices provide a shortage of available construction funding from Caltrans/FHWA.

Recommendation:

Based upon the known urgency of this project and the analysis listed above, it is my opinion that this bid process presented reasonable prices for execution of this project in a financially effective manner. I hereby recommend the City conditionally award the Contract to Westcon Construction Corporation in the amount of $4,539,972.00 contingent

Page 8 of 44 ends

upon Caltrans/FHWA providing written assurances that additional construction funding will be available to the City prior to project reimbursement to the Contractor.

RECOMMENDATION:

That the City Council approve the special events application for Lions Club July 3 Fireworks and festivities as presented.

DISCUSSION:

On May 25th, 2023 city staff (Police Chief Chris Mynderup, Fire Chief Dale Fishback, PW Superintendent Bree Wilder, and Admin Assistant Carleen Kirkpatrick) met with Jeff Votaw of the Jackson Lions Club to review the application and plans for the July 3rd Fireworks Event at Detert Park/Aimee Field.

As you may recall, at the City Council Special Meeting on May 12th, 2023, Jeff Votaw made a request for Lions Club to operate the snack shack. Council agreed to allow Lions Club to operate the snack shack this year, with an alternative for the City to post an RFP inviting other interested organizations to run the snack shack. However, at last week’s meeting the Lions Club advised they would now prefer to oversee Amador Little League’s operation of the snack shack as originally submitted in the application. Police Chief Mynderup’s recommendation for approval of the application as originally submitted is attached.

The following is a debrief of the updates discussed at the May 25th meeting:

SNACK SHACK- Jackson Lions Club will oversee operations in the snack shack by Amador Little League.

NO ADDITIONAL OUTSIDE VENDORS ALLOWED. The only outside vendor Lions Club will oversee and allow at the event is a Jamba Juice pop-up. City Hall staff has been directed not to accept any permit applications or issue any business licenses specifically for the event date. Vendors will be turned away at the gate by Lions Club, with assistance by PD as needed.

NO PERSONAL BBQs & NO PARK BBQs UTILIZED- PW Supt. Bree Wilder will remove BBQs from the park for the event.

BANNER- Lions Club may or may not post a banner on the Detert Park fence for the event.

CITY POOL- Police Chief Mynderup & Fire Chief Fishback expressed no concern with the pool being open on July 3rd. They will be able to respond, if needed. Pool Director Daphne Parker expressed preference to keep the pool open on the day of the event and will have plenty of staff prepared to handle the potential increase in attendees.

SCHEDULE- Kids games will operate on Aimee Field at approximately 7PM, based upon when largest number of kids arrive/are present. Lasting for about 1 hour. Fireworks will occur later in the evening.

CLEAN UP- Jeff Votaw/Lions Club to determine.

ANNOUNCEMENTS- Admin Asst. Carleen Kirkpatrick will prepare and post announcements on the city website to notify the public of the event, restrictions, etc. (No illegal fireworks, no alcohol, NO OUTSIDE VENDORS, No BBQs). Announcements will be reviewed and approved by PW Supt. Bree Wilder and City Manager Yvonne Kimball prior to posting.
