1. ADMINISTRATIVE REPORTS.
This section is to provide staff an opportunity to present oral status reports on issues. No legal action is expected to be taken by the Council.
Public Works Superintendent, Bree Wilder – The Civic Center is now complete. The TV monitor was damaged, possibly by the contractor’s lift, and he is following up. On September 6th the new pool filter will be installed using a crane. The sand/gravel/parts are ordered and ready for the new plumbing and it will be complete. There was a water leak on Buena Vista Drive over the weekend which was repaired by Public Works today. The sewer slip lining project bid opening is September 6th, for the Ace Hardware funds, to hopefully repair holes in the Pitt Street line under the highway and the line that runs down Broadway.
Interim Fire Chief, Dale Fishback – The Fire Department has agreed to participate in the Sutter Hospital evacuation drill scheduled for November. They will attend a couple planning meetings between now and then, as this is the first time the hospital is simulating physically moving patients from upstairs to the evacuation area outside. This drill was brought on by the evacuation at Barton Hospital a couple years ago during the Caldor Fire in the Tahoe area. Sutter Hospital is following the training model developed by Barton Hospital. Jackson Fire assisted with a fairly large structure fire at Eggiman Lane and Highway 88 last week where all went well and no one was injured. Fire Engineer Francis DiGirolamo is currently out with a non-work-related bicep injury that is being evaluated to determine how long he will be out.
August 28, 2023 City Council Meeting Minutes
Interim City Manager / Police Chief, Chris Mynderup – A job offer was made and accepted by police applicant Graciela Razo after passing backgrounds, and she is expected to start in the next couple weeks.
She lives in Woodbridge and is currently working for the City of Lodi.
City Attorney, Josh Nelson – No report.
5. COUNCIL REPORTS.
This section is to provide Council members an opportunity to present reports on their activities and to request item be placed on future agendas.
Councilmember Gonsalves – The Economic Development Committee meeting is this Wednesday 8/30/23 at 1:30pm and she will be unable to attend due to her full-time employment. Vice Chair Jason Mulford will be able to run the meeting in her absence. She announced she is retiring on 9/22/23 and will be more available after that time.
Councilmember Godde – Attended the grand opening of Jackson Fitness on 8/21/23 and was informed they already have over 400 members signed up prior to opening. Mayor McLean and Councilmember Gonsalves agreed the pool and racquetball courts were a big draw at the gym. Godde stated he also worked a couple hours volunteering for the Kennedy Mine.
Councilmember Stimpson – No report.
Vice Mayor Simmons – Attended the Victory Village meeting on Thursday and is hopeful their plans will come to fruition.
Mayor McLean – Attended the Jackson Fitness grand opening with Councilmember Godde for the ribbon cutting. Attended the Chamber of Commerce regular board meeting. Attended the Beautification Committee meeting and they are diligently working on plans for the gateway arch over Main Street. An account is setup for it through the Amador Community Foundation, and there are plans to conduct fundraisers and seek donations. The first bid on the archway was $100k and they are seeking additional bids. Vice Mayor Simmons inquired if the bid is local and Mayor McLean advised he believes it is. Councilmembers agreed the potential archway plans look very nice. Mayor McLean also spent the weekend at the Amador County Fairgrounds for the Top Cop fundraiser for veterans and first responders.
6. DISCUSSION CALENDAR.

These audio recordings provide an accurate and comprehensive backup of City Council deliberations and citizen discussion.
a. Discussion and possible approval of Oro de Amador Cattle Pasture Lease Agreement amendments and authorization to post an RFP.
August 28, 2023 City Council Meeting Minutes
Interim City Manager Chris Mynderup advised the previous leases on the pasture have been for one year and did not require the lessee to cut a firebreak. The amendments on the lease would extend it to two years (with an option to extend it up to one year) and require a firebreak to be cut around the parcel by the lessee during fire season. Vice Mayor Simmons inquired about the cost of the lease. Interim Fire Chief Fishback advised the current lease is approximately $6k per year. Vice Mayor Simmons asked how much it cost the Fire Department to create the firebreak. Chief Fishback advised it cost the department about $3800 and the lessee had already paid to cut the firebreak along the section near the Rollingwood property. Chief Fishback advised the lease amount is decided upon a bid system, and all the information regarding the requirements to cut the firebreak will be available to bidders before submitting their proposals. Vice Mayor Simmons expressed concerns about possibly no one being interested in the property. Chief Fishback advised it would be possible for someone to submit a bid of $1 with the lessee maintaining the property as required. Councilmember Godde stated his understanding it would be a two-year lease with the option to extend up to one more year. Councilmember Gonsalves inquired about what will happen with the lease if the City starts moving forward on the Oro de Amador park project. City Attorney Josh Nelson clarified that section 12 of the draft agreement gives either party the ability to terminate the lease for any reason with a 30-day notice. Councilmember Gonsalves inquired if the Fire Department would be comfortable inspecting the firebreak cut by the lessee each year. Chief Fishback confirmed they can inspect. Mayor Mclean inquired if DTSC had any further testing on the property and Councilmember Stimpson advised it is close to being wrapped up.
Mayor McLean asked for public comments and received none. Mayor requests a motion.
Motion to approve the Oro de Amador Cattle Pasture Lease Agreement amendments and authorization to post an RFP dated August 28, 2023 as presented. Moved by Councilmember Gonsalves, seconded by Councilmember Godde, and carried by a 5 to 0 vote:

b. Discussion and possible direction regarding Animal Related Services with Amador County [Jon Hopkins, General Services Director for Amador County].
Interim City Manager Chris Mynderup advised the City received a letter from Mr. Hopkins with Amador County on May 30th, 2023 regarding Animal Control Services, that due to pressures on Animal Control Services from the cities, they are requesting a monetary agreement from the City of Jackson based upon population in the amount of $171,750/year moving forward.
General Services Director Jon Hopkins and Director of Animal Control Kevin Jacobs offered to answer questions on behalf of Amador County. Councilmember Gonsalves inquired how the county came up with the amount requested in the agreement. Mr. Hopkins stated the figure is based on city population divided by the county budget for animal services. Gonsalves requested to see paperwork to back up the amount requested. Mr. Hopkins responded they have no backup other than the county budget and stated the city is more than welcome to handle their own animal services. Councilmember Stimpson asked if they brought any other data with them to back up the figure requested. Mr. Hopkins explained the
August 28, 2023 City Council Meeting Minutes
unincorporated area of Amador County has a population of about 22,000 people and the cities combined make up about 15,000 people. He stated the county budget for animal services divided by the population of each city was a more consistent way to determine cost than tracking every animal and service provided. Mayor McLean advised City accounting has provided documentation on payments the City makes per service and requested clarification on whether the $172k would be in addition to those amounts paid. Mr. Hopkins advised the agreement amount would replace paying for services individually moving forward. Councilmember Stimpson asked Police Chief/Interim City Manager Mynderup if he has conducted any research on the City taking over their own animal services.
Mynderup advised the last agreement with Amador County animal control was in 2004 and city was billed per call out per animal and the county provided documentation on each animal for transparency, explaining the costs. The amount the county is requesting in this agreement does not include any facts and figures to support the request. Jackson police records can provide how many dogs have been addressed by the city and how many the county were called on to assist, and these numbers do not add up to what the county is asking for. Mynderup met with police chiefs from Sutter Creek and Ione, and they agree the county should be compensated for animal control services but the amount requested is over the top. Jon Hopkins stated he provided data on how many animals were taken in from Jackson over a 10-year period, but those numbers do not represent all the animals that come through their door.
Those numbers also do not cover the total cost of ownership for the animals they take care of. Hopkins stated he is not advocating for the city to get into contract with the county and they would be more than happy to have the cities handle their own animal services. Hopkins stated the county has staffing issues and other issues that come along with how each of the cities handle their animal services. Mayor McLean asked if any services would change from the county if the city paid the $172k. Hopkins answered it would remain as it is now but encouraged that each city should consider talking more with the county about how services in each city should look before deciding. Councilmembers all agreed more time is needed to research this agreement before any decisions are made.
Mayor McLean asked for further public comments and received none. c. Discussion on Marilyn C Van Horn property and the U.S. Environmental Protection Agency as a potential site for a new City park.
Mayor McLean advised the cleanup of the superfund site between Argonaut Lane, Argonaut Drive, and Hoffman Road has been going on for 4-5 years, and he previously talked to property owner Marilyn Van Horn about possible sale of the property a couple years ago. She was not interested in selling at the time but the project manager on site advised him that the Van Horns would like to discuss this possibility now. Councilmember Stimpson advised he did not want to get involved with the property prior to the clean-up, not knowing all that may be involved. City Attorney Josh Nelson advised discussions regarding property value and purchase price can be discussed in a closed session, and Interim City Manager Mynderup and staff need direction on whether council is interested in exploring the option of potentially purchasing the property. Mayor McLean clarified he has made the connection as an initial point person to begin the conversation. Councilmember Gonsalves inquired whether the potential funding to develop a park in this location would come out of the park-in-lieu fund? Attorney Nelson advised it potentially could come out of park-in-lieu or park impact fees, depending on plans and uses of the park. Gonsalves asked if there has been any discussion started about what kind of park it could be and McLean responded there has not. Mayor McLean stated there may be grant money available for this project, and Councilmember Stimpson advised the park-in-lieu fund has shrunk dramatically over the past year. Council agreed to keep discussions going on this topic.

Mayor McLean asked for public comments and received none.
ITEM 3F. Authorization for City Manager to sign the Gascon Right of Entry for the French Bar Road Bridge Project.
*Vice Mayor Simmons excused himself from the meeting for this discussion item.
Larry White of Weber-Ghio & Associates advised there were several property owners along the French Bar Road that were impacted by the bridge project, and they were able to obtain rights of entry from nearly all of them with the exception of the Gascons. The Gascons hired an attorney to do the communications and due to potential litigation, this right of entry is being brought before council to approve before moving forward. City Attorney Nelson advised the right of entry also includes a waiver of any claims for entry onto the property prior to the date that it is signed. Larry White advised with the right of entry, property owners are asked if there is any compensation or reimbursement they would like to request in exchange. The Gascons have requested a little bit of grading on their property, some rock, a fence, and a concrete patio slab. Larry requested council approval for Interim City Manager Mynderup to sign the right of entry so they can move on with the next phase of the bridge project. City Attorney Nelson advised the property owners have already signed the document, so with council approval the project can resume immediately. Larry advised he has an appointment with the contractor at 8am tomorrow and this right of entry also allows them to restart work on the remainder of the project.
Councilmember Godde inquired about the cost to the city. Attorney Nelson responded there is no direct compensation from the City to the property owners, just the in-kind improvements. Larry advised it will be approximately $25k for dirt work, grading, and the arborist guidance on trees in the area they don’t want to adversely affect. Larry advised the decision on the right of entry would have been handled at staff level without the property owner’s involvement of an attorney.
Mayor McLean asked for public comments and received none. Mayor requests a motion.
Motion to authorize the City Manager to sign the Gascon Right of Entry for the French Bar Road Bridge Project dated August 28, 2023 as presented. Moved by Councilmember Gonsalves, seconded by Councilmember Stimpson, and carried by a 4 to 0 vote:

Council Meeting Memorandum
Monday, September 11, 2023 – 6:30 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Carleen Kirkpatrick, Deputy City Clerk
Date: September 1, 2023
Agenda Item #3g: Appointment of Economic Development Committee member Erika Simmons to the TOT/Measure E Annual Grant Review Advisory Committee
RECOMMENDATION:
The Economic Development Committee recommends the Council appoint EDC member Erika Simmons to the TOT/Measure E annual grant review advisory committee.
DISCUSSION:
On July 26, 2023, the Economic Development Committee held their first meeting and appointed a committee Chair and Vice Chair. In addition to establishing these roles, they were introduced to a list of approved topics for the committee to begin addressing regarding economic development in the community. One of the tasks assigned to the committee was to recommend appointment of one of their members to the TOT/Measure E annual grant review advisory committee.
The TOT advisory committee is tasked with approving annual TOT funding requests from businesses seeking funds supporting tourism, business promotion, economic development, and/or downtown revitalization. Currently, the committee consists of four members and has one vacancy. The four current members consist of Councilmember Connie Gonsalves, Stan Lukowicz, Paul Molinelli, Jr., and Atul Patel.
Economic Development Committee member Erika Simmons is the Director of the Amador Child Care Planning Council and the Coordinator for The Resource Connection for childcare resources. She has lived in Jackson for 49 years and is a member of the Board of Directors for the Amador County Chamber of Commerce. She has worked to recruit, train, and mentor childcare providers in Amador County for the past 16 years and is an advocate for educating the community on how childcare availability impacts the local economy.
The Economic Development Committee members are in agreement that Erika Simmons would be an excellent addition to the TOT/Measure E annual grant review advisory committee.

RESOLUTION NO. 2023-35
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF JACKSON
CONCURRING IN THE CALL FOR AN ELECTION ON THE QUESTION OF REESTABLISHING THE COUNTYWIDE ABANDONED VEHICLE ABATEMENT FEE WHEREAS, the Abandoned Vehicle Abatement Program is a State of California program whereby counties and incorporated communities can receive funding to help defray the costs of removing abandoned vehicles within their jurisdictions; and WHEREAS, in 1991 , the City of Jackson adopted a resolution supporting the establishment of the Amador County Abandoned Vehicle Abatement Authority and the County of Amador duly created the Authority and adopted a fee of $1.00 per vehicle registration to fund the abatement activities of the Authority; and
WHEREAS, Proposition 26, adopted by the voters of California in 2010, altered the definition of a fee and resulted in the classification certain, new fees as taxes subject to voter approval; and
WHEREAS, in November 2012, Amador County voters approved the renewal of the fee for an additional ten years, but the fee has since expired since the required 2/3rds majority of voters did not support the fee in November of 2022; and
WHEREAS, pursuant to Section 22710 (h) of the California Vehicle Code, in order for the voters to consider re-establishment of the fee, a majority of the cities containing a majority of the incorporated population within the County must adopt resolutions agreeing to the re-establishment of the Authority and the continued imposition of the $1.00 fee per vehicle registration upon approval of the voters; and
WHEREAS, the Abandoned Vehicle Abatement Authority is vital to keeping Amador County, including all of its incorporated cities, free of the nuisance of abandoned vehicles and the City of Jackson has determined that supporting a re-establishment of the Authority and the continued imposition of the fee will assist in the abatement of nuisance vehicles within the City of Jackson.

Agenda Item #6c: Facade Grant Increase Request by Economic Development Committee RECOMMENDATION:
The Economic Development Committee recommends the Council to increase the Façade Grant funding match from $1500 to $2,500.
DISCUSSION:
The newly appointed members of the Economic Development Committee held their second meeting on Wednesday, August 30, 2023. During this meeting they reviewed the list of Façade Grant recipients since the program inception in 2010. There have been 19 recipients of Façade Grant funds over the past thirteen years for a total of $34,518 matched funds. The current Façade Grant application has set the maximum amount of matching city contribution at $1500.
However, the previous Revitalization Committee and Council have often approved façade grant amounts exceeding that maximum.
The Economic Development Committee recognizes there has been minimal interest or application for Façade Grant funds over the past few years and wishes to reignite business interest in the program by increasing the maximum city match allowance to $2500. The committee would like to promote the façade grant with local businesses again in an effort to contribute to continued beautification efforts in the downtown historic district and citywide.

Agenda Item #6d: FEMA Update on Request for Public Assistance (Disaster #DR-4683-CA, California Sever Winter Storms, Flooding, Landslides, and Mudslides).
DISCUSSION:
The City of Jackson and its residents endured significant flood damages during the severe storm events last winter. FEMA declared the event a disaster on January 14, 2023, with a defined incident period spanning from December 27th, 2022 to January 31, 2023. Residents in the City were provided information by the City of Jackson and Amador County through combined outreach efforts on how to apply for individual assistance with FEMA. FEMA representatives were also available to assist residents with their applications at the Amador County building for multiple weeks following the storm, and the City and County circulated flyers with contact information for multiple other resources available to residents negatively impacted by the storms.
At that time, the City of Jackson also submitted a request for public assistance with FEMA for damages to city owned properties.
Over the past eight months, city staff have been diligently working with FEMA and CalOES representatives to gather and submit required documentation supporting our request for assistance. FEMA categorizes eligible work into seven separate categories (A to G, see attachment). Damages that fall within categories A and B have the potential to be reimbursed at 100%, while categories C through G are eligible for up to 75% reimbursement. At this time, all documentation has been submitted by the City of Jackson for Category A and B damages, which include completed citywide debris removal and emergency measures taken during the storm event incident period. The total reimbursement amount requested for these two categories is approximately $65-70k.
City damages in FEMA categories C through G include both completed work and incomplete work that need to be done to fully restore city owned properties to pre-disaster conditions. This includes damages to city roads, bridges, water control facilities, buildings, equipment, utilities, and parks/other recreation areas. The City of Jackson is not able to apply for assistance with roadways owned and managed by Caltrans or any other privately owned property within the city.
Public Works Superintendent Bree Wilder and Deputy City Clerk Carleen Kirkpatrick have conducted multiple site visits with FEMA inspectors over the past few months to evaluate damages claimed by the City. Some of the sites include Detert Park, sewer lines and manholes
Item 6d
(citywide), South Avenue bridge, Stark Lane bridge, other bridge abutments, mudslide locations, and a sinkhole near the library. The total amount the city will request from FEMA for each of these damages shall be determined as estimates and inspections are completed for each site.
To date, the City of Jackson has not received any FEMA funds for damages resulting from disaster #DR-4683-CA, but we hope for a full reimbursement of $65-70k for Category A and B damages soon. We will continue to work with FEMA and CalOES to complete financial assistance requests for damaged city owned properties that fall within Categories C through G.
Staff will continue to update Council as new information becomes available.

Agenda Item #6e: Oro de Amador Cattle Pasture Request for Proposals - Addendum #1 RECOMMENDATION:
Staff recommends Council to approve Addendum # 1 to the Oro de Amador Cattle Pasture Request for Proposals and to allow for an update to the Cattle Pasture Agreement.
DISCUSSION:
On September 8, 2023, Interim City Manager Chris Mynderup and Deputy City Clerk Carleen Kirkpatrick met with current Oro de Amador cattle pasture lessee Gib Gianandrea to answer questions regarding the current cattle pasture Request for Proposals due on November 3, 2023.
Mr. Gianandrea expressed his concerns and offered suggestions to improve the current bid requirements. Upon consideration of these ideas, staff agreed the following two changes should be included in the Request for Proposals:
1. Brands on cattle must currently be registered with the State of California, and a copy of the registration certificate shall be presented as part of the bid.
2. If the cattle pasture lease is ended prior to the end of the current two-year agreement, the City of Jackson may offer a new lease agreement for the remaining time period on the lease to the second-choice bidder from the initial request for proposal application period.
Incorporating these two additional requirements into our current Request for Proposals will allow the City to officially identify the brand for cattle to be in the pasture and eliminate the need to repost a Request for Proposals should the lease be ended by the City or the lessee for any reason prior to the end of the two-year lease agreement.
Mr. Gianandrea also advised that potential bidders may not know the cost of creating and maintaining a fire break each year. Staff agreed with this concern, as it was also mentioned by Council in a previous meeting, and agreed to notify bidders upon receipt of proposals that the firebreak has cost approximately $5k/year to cut in previous years.

The City acquired this property early 2000. Since then, the city has allowed cattle grazing of this property as cattle grazing activities are beneficial for property maintenance and prevention of wild land fire. For its long-term use, this property has been designated for recreation and other municipal purposes.

Agreement
NOW THEREFORE, with respect to the mutual covenants and considerations set forth herein, the Lessor and Lessee agree as follows:
1. This is a seasonal pasture lease and not a cattle care agreement as all duties for preparing the Property to take in cattle, all feed, water and care, and all cattle handling and management shall be provided by Lessee and none by Lessor.
2. The period of use shall be from January 1, 2024, until December 31, 2025. If, however, in the reasonable judgment of Lessor feed or water resources will not support cattle until December 31, 2025, Lessor shall coordinate with Lessee about removing some or all of the cattle early. There shall be every reasonable effort taken to leave 750 lbs. of residual dry material (RDM) on each acre of the Property. This Agreement may be extended by Lessor for an additional period until December 31, 2026 ( or such earlier date as provided above if insufficient water) in its sole option with thirty-days' written notice to Lessee prior to the expiration of the initial term.
3. The portion of the Property useful for grazing is 14 7 acres and based on ten acres per cow/calf pair, Lessee may turn out 14 head of cows with calves on the Property.
4. The cattle will bear the registered brand of ______ and Lessee will notify Lessor 48 hours prior to turn out. The rent shall be a total of$____ a year. (A copy of the current brand registration certificate is attached to this agreement, for reference.)
5. Lessor provides no guarantee as to feed, continued water supply, cattle gain, cattle death or cattle loss except that municipal water is available to hook up on site at this time. Lessee shall be responsible for water usage according to established utility rates and regulations. Lessee 4
