Resolution No. 2023-41
Resolution of the City Council of the City of Jackson Awarding a Contract to Westcon Construction Corporation in an Amount Not to Exceed $165,932 for the French Bar Road Paving Project
WHEREAS, the City of Jackson, as part of the French Bar Road Bridge replacement project located on South Fork, Jackson Creek, will remove and replace the French Bar Road Bridge; and WHEREAS, the roadway on French Bar Road, from Broadway Street to where the French Bar Road Bridge replacement project paving ends is in poor condition and needs to be repaved; and WHEREAS, it would be in the City’s best interest and efficient to repave the French Bar Road now as part of the French Bar Road Bridge replacement project because contractor Westcon Construction Corporation’s (“Westcon’s”) paving subcontractor, George Reed Inc. is already mobilized onsite at French Bar Road, thereby reducing costs to the City; and WHEREAS, to repave French Bar Road, competitive proposals would not produce an advantage to the City, and the City Council of the City of Jackson finds that it is in the public interest that Westcon perform the necessary paving work on French Bar Road.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF JACKSON RESOLVES as follows:
Section 1. The above recitals are true and correct and incorporated as if fully set forth herein.
Section 2. The City Council hereby finds that it is in the public interest that Westcon perform the necessary paving work along French Bar Road , as described in Exhibit A attached hereto and incorporated herein by reference (“Project”), because:
a. Westcon’s paving subcontractor is already mobilized to the French Bar Road Bridge replacement project and could efficiently complete the Project, which will result in cost savings to the City; and b. City would not have to spend funds designing a separate project and going through the design process, and would realize cost savings by not having to assemble a new set of project plans/specifications and bid the work; and
c. Construction management costs would be incorporated into the French Bar Road Bridge replacement project because a full-time inspector is on-site inspecting all work; and d. Repaving would result in an improved road structural section along French Bar Road; without repaving, the roadway will continue to deteriorate; and e. Extending the roadway on French Bar Road will make the area will look like a completed project; without repaving, the City would otherwise have approximately 775 linear feet of paved roadway and 250 linear feet of unpaved roadway.
Section 3. The City Council hereby approves and awards a construction contract to Westcon Construction Corporation for the Project in the amount of $144,288.10 (“Contract”). The City Manager is hereby authorized and directed to execute the Contract, subject to City Attorney approval. The City Manager is hereby authorized to negotiate and execute contract change order(s) in an aggregate amount not to exceed $21,643.90. The City Attorney is hereby authorized to make clarifying and conforming changes to the Contract so long as the total not to exceed total dollar amount of $165,932.00 authorized herein does not change.
Section 4. Copies of the Contract are available and on file in the City Clerk’s office, and are incorporated herein by reference and made a part of this Resolution.
Section 5. If any section, subsection, sentence, clause, phrase or word of this Resolution is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution.
