9. DISCUSSION CALENDAR.
a. Receive, discuss and provide direction regarding (verbal) report from the Homeless Outreach Coordinator regarding the City’s response to homeless issues. b. Review of City Council Committee Assignments.
c. Receive, discuss, and possibly approve the new City Manager Contract Agreement. d. Receive and acknowledge a report regarding the inspection of certain occupancies required to have annual inspections performed pursuant to Sections 13146.2 and 13146.3 of the California Health and Safety Code [Dale Fishback, Interim Fire Chief].

Summary and Discussion:

Agenda Item# 9d: The City of Jackson Acknowledging Receipt of a Report made by the Fire Chief of the Jackson Fire Department regarding the Inspection of certain occupancies required to have Annual Inspections performed pursuant to Sections 13146.2 and 13146.3 of the California Health and Safety Code.
Recommendation
That City Council acknowledge the receipt of the report by the Fire Chief of the Jackson Fire Department regarding the inspection of certain occupancies that are required by the California State Fire Marshal’s Office to be inspected annually (SB 1205 requirement).
Summary and Discussion
The California State Fire Marshal’s Office, under current law, requires that certain occupancies be inspected annually by the local fire department pursuant to California Health and Safety Code Sections 13146.2 and 13146.3. These occupancies include hotels/motels, multi-family residences with 3 or more units, and K-12 public and private schools to enforce current building and fire safety standards.
SB 1205 was initiated after several multi-family apartment fatality fires occurred in 2016 and 2017, including the December 2, 2016, “Ghost Ship Warehouse” fire that killed 36 people. A bay area news group collected eight years of data from 12 bay area fire departments and found that many schools and apartments were not being inspected annually as required by law. In 2018, State Senator Jerry Hill (San Mateo) introduced SB1205, a bill that would require every city or county fire department, or district required to perform the State Mandated inspections, to report inspections annually. Senate Bill 1205 (Hill) was signed into law on September 27, 2018, adding Section 13146.4 to the Health and Safety Code. SB 1205 requires that the administrative body (City Council in our case) formally acknowledge the inspection report.
In Jackson and other departments in the County, Chiefs and/or designated personnel began to introduce the report to our respective governing bodies in 2022. This is the second time this report is being formally acknowledged by Council. The intent is to continue every year.

Fire Department employees were part of the effort to accomplish the required inspections and were able to implement a pre plan program. These pre-plans will be uploaded onto our “Iamresponding” app, which can be accessed on department personnel smartphones and iPads.
