4. ADMINISTRATIVE REPORTS.

This section is to provide staff an opportunity to present oral status reports on issues. No legal action is expected to be taken by the Council.

Public Works Superintendent, Bree Wilder – Absent.

Interim Fire Chief, Dale Fishback – Fire truck #1 is fully in service/available for dispatch. The first wildland fire in the area was the end of last week above the top of the Electra Canyon; two pieces of Jackson equipment and 6 personnel responded. Great experience for some of the new staff. Pancake Breakfast is returning at the downtown fire department on the second Sunday in October, kicking off Fire Prevention Week. Second interview with Fire Chief candidate is Friday 6/28/24. Vice Mayor Simmons inquired about fire abatement near the radio tower on the Oro de Amador property. Fishback advised it is currently too hot and dry but if weather allows it may be scheduled. Fishback advised not to mow the property right now.

Police Chief, Chris Mynderup – Police Clerk interviews are complete- position offered and accepted by applicant Iesha Graham – currently in backgrounds, family has background in law enforcement. High heats seem to be impacting public behavior and there has been an increase in calls for service this month.

City Attorney, Josh Nelson – Provided an update on an initiative approved to be placed on the November ballot that would have fundamentally changed the way both the state and local governments raise taxes and charge fees, specifically changing standards for our water and sewer rates from recovering our reasonable cost to being the lowest possible cost. This language could have invited further litigation, given its ambiguity. The Legislature and others filed a litigation to remove the initiative from the ballot, arguing it was beyond the scope of voters to approve, and this is one that actually goes straight to the California Supreme Court which issued a decision last week removing the initiative from the November ballot, determining it would fundamentally change the way the government is structured in California such that it was beyond the ability of the voters to approve in a simple initiative. CalCities has great resources available to read on the item further.

City Manager, Carl P. Simpson – No report.

5. COUNCIL REPORTS.

This section is to provide Council members an opportunity to present reports on their activities and to request item be placed on future agendas.

Stimpson will continue to provide updates.

Vice Mayor Simmons – Attended ACRA meeting- PW Supt Wilder and City Manager meeting with ACRA Director Michael Rock soon to discuss partnering to fix up the Scout Hut.

Mayor McLean – Attended the Amador County Chamber of Commerce board meeting, the Amador County Transportation Commission and Transit meetings. Attending a ribbon cutting at the new Caliber Tires center on Hwy 49 this week.

6. DISCUSSION CALENDAR.

For the record: Action minutes provide the necessary documentation of City Council actions and audio recordings are retained for those desiring more detail on particular agenda item discussions. These audio recordings provide an accurate and comprehensive backup of City Council deliberations and citizen discussion.
a. Presentation from the U.S. Environmental Protection Agency regarding clean-up activities at the Argonaut Mine Superfund Site [John Hillenbrand, US EPA Project Manager].

John Hillenbrand presented on the topic. (The PowerPoint is available on the City Website under meeting minutes, for more details.) A public meeting will be held on Thursday 6/27/24 from 3PM-8PM in the Civic Center at City Hall to answer questions and provide the full-length presentation.

Mayor McLean opened the item for council discussion. Councilmember Stimpson inquired if the goal of the clean-up is to keep people safe and alive, what cost is placed on a human life? Hillenbrand advised clean-up versus risk reduction evaluation resulted in spending up to $2 million per person to reduce/remove risk of potential of someone getting cancer.

Mayor McLean asked for public comments. A member of the public inquired about methods for specific testing samples. Hillenbrand provided some detail and offered to meet with the resident after the meeting and advised of the public meeting later this week. He also provided his contact information.

Hillenbrand answered a question advising that the property owner controls the future of the property, except for activity that would affect specific contaminated areas that cannot be addressed. b. Review and possible award of FY 24/25 TOT Grants with recommendations from the Advisory Committee.

Councilmember Gonsalves introduced the proposals and advised the Amador County Chamber of Commerce could not be reviewed by the committee due to members of the committee having a conflict of interest. Vice Mayor Simmons also removed himself from the meeting during the chamber presentation and Council consideration for this reason.

Council considered the proposal and discussed potential stipulations to be added to the agreement prior to dispensing funds, and requested the updated agreement be returned to Council on a future consent calendar for final approval. City Manager Carl Simpson to connect with owners after receiving further input from Council and the City Attorney to discuss the terms of the updated agreement and potential stipulations to be considered. Mr. & Mrs. Macklin expressed gratitude to Council for the consideration of their proposal and agreed to discuss updated stipulations for the agreement.

June 24, 2024 City Council Meeting Minutes
c. Review and discuss public request for yield line/stop sign at Schober Ave./Allen St./Perry St.

Resident Anthony Stark (requested this item for discussion) was not present at the meeting.

Police Chief Mynderup presented information on the intersection on behalf of Public Works Superintendent Wilder. A couple complaints have been filed by the public about close calls at this intersection, which is currently a yielded intersection for traffic travelling west on Schober and turning left or right onto Perry Street and Allen Street. The City does not own a yield traffic stencil and would need to borrow one. Mynderup suggested replacing the yield sign with a stop sign. Mynderup recommends running this past our engineering firm, Weber-Ghio for a professional take on solutions.

Mayor McLean opened the item for council discussion. McLean advised there is an overgrown tree near the current yield signs that could be cut back to make the signs a bit more visible and agreed it is a difficult intersection to see around corners. Vice Mayor Simmons inquired about where stop signs might be placed and there was some difference of opinion on which direction of travel they would best be placed.

Mayor McLean asked for public comments. Debby Collins expressed that placing a stop sign on the uphill road would be tough for vehicles to resume power and continue up the road. McLean and Mynderup agreed it could be made into a three-way stop. One resident suggested making the downhill a one-way street. Council requested City Manager Simpson refer the item to our contract engineers for evaluation of the intersection and recommendation.

7. REGULAR MEETING ADJOURNMENT.

Mayor McLean adjourned the meeting at 7:47 p.m. to 6:30p.m. on July 8, 2024.

CITY OF JACKSON

STAFF REPORT
DATE: JULY 22, 2024
TO: CITY COUNCIL
FROM: CITY MANAGER
RE: ADOPT RESOLUTION #2024-18 APPROVING THE CITY’S

AMENDED CONFLICT OF INTEREST CODE

FORM MOTION
It is recommended that the City Council adopt Resolution No. 2024-18 approving the amended Conflict of Interest Code of the City of Jackson.

BACKGROUND
The Political Reform Act (the “Act”) requires all public agencies to adopt and maintain a Conflict of Interest Code containing the rules for disclosure of personal assets and the prohibition from making or participating in making governmental decisions that may affect any personal assets. The Conflict of Interest Code must specifically designate all agency positions that make or participate in the making of decisions and assign specific types of personal assets to be disclosed that may be affected by the exercise of powers and duties of that position.

The Act further requires that an agency regularly review and update its Code as necessary when directed by the code-reviewing body or when change is necessitated by changed circumstances (Sections 87306 and 87306.5).

Pursuant to the Act the City adopted a Conflict of Interest Code which was last amended and approved by the City Council on August 24, 2020. Review of the Code was done as directed by City Council as the City’s code-reviewing body and shows that it must be amended to include a new position.

Government Code section 87303 provides that no code or amendment to a code shall be effective until it has been approved by the code-reviewing body.

Attached is a redline version of the proposed amended Conflict of Interest Code showing the revisions made.

CONCLUSION
Adopt Resolution No. 2024-18 approving the amended Conflict of Interest Code of the City of Jackson as required under Government Code section 87303.

Attachment: Legislative (redlined) version of proposed amended Conflict of Interest Code.

This decrease is in large due to collection system staff pinpointing problem areas and either adding them to the hotspot maintenance program and/or adding them to the Capital Improvement Plan. Another benefiting factor is the CCTV and Cleaning Project which started toward the end of F/Y 17/18. Our annual SSO rate per 100 miles for F/Y 16/17 was 44.9 and in F/Y 23/24 it was 7.8. Public works expects this number to remain steady or even decrease next year.

Hotspots
Public works implemented a hotspot program at the beginning of fiscal year 17/18. This program has grown and evolved since then. The hotspot program includes sewer mains that have a past history of frequent SSOs and requires routine maintenance to be completed each quarter to prevent spills. Each hotspot location is CCTV’d to assess its current condition and cleaned on an as needed basis. During each CCTV assessment the crew identifies problems with the line documenting a description of the problem and the precise location. This documentation is then used to determine which sections of pipe need to be cleaned, which equipment is best suited to clean the pipe whether it is a root saw, a retriever tool, flushing, or the jetter, the information is also used to determine the method and extent of repair or replacement. Every SSO that occurs is assessed and considered for addition to the hotspot program. In FY 23/24 public works CCTV’d an average of 3,488LF and cleaned an average of 2,953LF each quarter of hotspot mains. The hotspot program currently consists of 25 hotspots and takes approximately 75+ man hours to complete each quarter.

CCTV/Cleaning Project
This project was put together in-house and contracted out toward the end of F/Y 17/18. This was a five-year project that consisted of cleaning and assessing all city sewer mains, manholes, and appurtenances. Staff feels this project reduced SSOs, located points of inflow or infiltration, increased the lifespan of the collection system, helped in prioritizing capital improvement projects, as well as, gave us much more information on our system to update our existing asset record system. The Project successfully completed the assessment and cleaning of 127,920LF(24.22 Miles) of main, 570 manholes, and 64 lampholes. Upon completion of each phase of the project the contractor was required to submit a digital report and video on each individual

Page 48 of 65 ends

6 segment(manhole to manhole) of main. The digital reports have been attached to our GIS mapping system so staff can have access to critical data in the field such as the type of pipe, size, length, slope, where and how many lateral connections are on the line, as well as, the condition of the pipe (including photos) when it was assessed. Furthermore, the data collected during the project is being used in the CIP. Staff intends to repeat the project beginning in FY 24/25.

Capital Improvements
The past two fiscal years the City and staff focused on the private lateral program, In F/Y 23/24 the City and staff shifted its focus back to capital improvement projects and completed two projects.

One project consisted of slip lining 2 different sections of main totaling approximately 475lf. The main section is 10” ductile that runs through the Middle Fork of Jackson Creek between the Pitt St. Bridge and the Broadway bridge. The other section addressed was where the main from Pitt St. connects to that same section in the creek.

These sections of main had a wide range of issues root intrusion, I/I, broken pipe, and private laterals that were not properly sealed at the connection to the City sewer main. This project also satisfies requirements stipulated in the R5-2017-0606 order.

Another project which was a part of the hotspot maintenance program went out to bid and was completed. The project consisted of bursting 340lf of 4” clay along a difficult to access easement off Pine St. and pulling in 4” HDPE; each lateral connection was dug up and reconnected. The line had a history of root intrusion which caused frequent spills prior to the hotspot program.

The City also completed an emergency project within an easement off of Circle Drive that was in the CIP for a future year. The easement was difficult to access and the line was part of the hotspot maintenance program as it had a history of root intrusion and spills. Inspections determined that routine cleaning was not enough to maintain the line and replacement was needed ASAP. The 120’ 4” clay line was burst and replaced with 4” HDPE.

As part of the new sewer rate study in progress and the FY24/25 budget adoption staff is making a push to increase the funding and efficiency of the capital improvement program as the hotspot program continues to grow and take more time to complete each quarter.

7 Private Lateral Program
The City implemented a private sewer lateral grant program in FY 19/20. This program is pursuant to an agreement made with the Regional Board (Order R5-2018-0517) to offset 50% of a previous fine. This program is available to Jackson citizens at or below the median income level to assist them with repairing or replacing their sewer lateral. The City feels this program is beneficial to both citizens and the City given that it may reduce inflow and infiltration, as well as backups and overflows from private laterals. The City completed the utilization of an existing Community Development Block Grant fund, as well as Order R5-2018-0517 funds and were able to replace/repair six private laterals in FY 21/22. Due to the success of this program the City chose to continue the program using funds from another stipulated order R5-2017-0606. In FY 22/23 the City was able to complete 4 private lateral projects and exhausted the funds. It is recommended that this program is considered for future CDBG funds. During FY23/24 two major private lateral spills occurred requiring the assistance of public works crew.

Regulation Changes
Last fiscal year SWRCB passed a revision to the general order dated 12-6-2022. This revision requires all collection systems to convert their OERP(Overflow Emergency Response Plan) to an SERP(Spill Emergency Response Plan) by June 2023. This revision changed some of our procedures including how we report sanitary sewer spills, the time frames in which spills are reported, and surface water sampling for spills that enter a waterway of the state. Early this fiscal year the new SERP was approved and accepted by City Council. The City began the revision of the lift station ERPs to align with the new regulations. The final drafts are completed and approved and training has been scheduled for early July.

Conclusion
Since the adoption of the SSMP in FY2016/17, the City continues to improve how it manages and operates its collection system fiscal year 23/24. Council and Management, and Staff are taking SSMP very seriously.

Improving the collection system condition has obviously become a priority. Council through the budget process allocates approximately $200,000 a year to implement capital improvement projects and other activities. The City implemented the hotspot program, conducted CCTV and cleaning activities, smoke tested suspected areas of I/I, completed capital improvement projects, and has developed a grant program to help the residents with repairing their sewer laterals. All these are progresses. With Council and management’s support, staff hope that spills and infiltration/inflow will continue to decline in the coming years.

To: Honorable Mayor and Members of the City Council
From: Daphne Parker, Pool Director
Carleen Kirkpatrick, Deputy City Clerk
Date: July 22nd, 2024
Agenda Item #3j: Request to Extend Jackson City Pool Season from August 11th to August 25th, 2024 for weekday lap swim and weekend lap & open recreation swim.

RECOMMENDATION:

For City Council to extend the Jackson City Pool season to August 25th, 2024 on weekends and lap swim on weekdays after the regularly scheduled closing date of August 11th, 2024.

DISCUSSION:

The Jackson City Pool is scheduled to be open from June 8th, 2024 to August 11th, 2024 for this summer season. Due to the ongoing success of the pool programs and public participation at the City Pool, Pool Director Daphne Parker has requested to extend the season end date of August 11th, 2024 on weekends and lap swim on weekdays through August 25th, 2024. This means the pool will be open Saturdays and Sundays on August 17, 18, 24, and 25th from 12PM-1PM for lap swim and from 1PM-5PM for open recreation swim, as well as lap swim from 12PM-1PM Monday through Friday between August 12th to August 25th, 2024.

The Jackson City Pool has maintained popularity again this summer, resulting in a successful swim season for the city. Pool Director Daphne Parker has continued to manage her team of lifeguards, showing excellent judgment and leadership, for a second year and can assure their continued availability to supervise the pool on weekends through August 25th. No scheduling conflicts exist with other clubs’ schedules, and City Public Works employees are available to provide pool maintenance support during the extended period. This extension will provide city residents and visitors two additional weekends to seek respite from the summer heat and two additional weeks of lap swim on weekdays, while also offering an extended employment opportunity for city lifeguards.

MEMORANDUM
TO: City Council
FROM: Matt Ospital, City Engineer
RE: Mattley Hillside Repair
DATE: July 22, 2024
DISCUSSION:

Public Works Superintendent and I meet on May 22, 2024 with a geohazard mitigation design build firm that operates throughout the US and Canada. The firm specializes in emergency landslide repairs, rockfall mitigation, and grouting using design/build and design/build/warranty contracting.

We discussed options for a permanent stabilization solution that has a natural aesthetic finish for the bank area below Mattley Street/above the Hwy 49 parking lot bathrooms. The consultant’s recommendation is to install a soil nail and reinforced shotcrete wall in the failure area (approximately 2,700 sf). The repaired area will be covered with welded wire mesh reinforcement and secured to horizontal and vertical reinforcing steel waler bars to steel plates attached to the protruding end of the soil nails. On top of that would be an 8” thick layer of reinforced shotcrete. The finished shotcrete facing will be a rough-gun finish. Total price $414K Optional finishes (additional cost):

1. apply a 2” architectural shotcrete layer (sculpted/stained finish, or natural geologic bedrock finish). See attached Figure 2 for examples. Total price $562k The firm’s engineering team will prepare final design drawings and calculations, prepared by a California licensed civil engineer as part of their design build package. The project’s duration is estimated to be 3 weeks, based on a work schedule of Monday through Saturday, 10 hours per day. The contractor would need 4 weeks notice to mob to the site.

RECOMMENDATION:

Utilizing SB1 funds, direct staff to solicit a design built geotechnical firm to make the necessary repairs to the hillside.

Also, recommend some drainage improvements along Mattley Street. Improvements to include a new asphalt dike along the existing guardrail to keep the drainage in the street and conveyed down to the highway preventing it from flowing over the bank down to the parking lot.

MEMORANDUM
TO: City Council
FROM: Matt Ospital, City Engineer
RE: Intersection of Schober & Perry – Proposed Striping DATE: July 22, 2024
DISCUSSION:

At the June 24th council meeting, a public request was made to modify the striping at the intersection of Schober and Perry Streets.

RECOMMENDATION:

Due to the steepness of Schober Street with vehicles traveling uphill approaching Perry St, it is my recommendation is to add two each: stop signs, stop bars, and “stop” legends on Perry (see attached exhibit). Vehicles traveling up Schober towards Perry will not have a stop sign and be allowed to yield and turn left or right.
