WHEREAS, pursuant to Jackson Municipal Code section 10.04.040, the Jackson City Council may designate additional locations as “stop” intersections by Resolution.

WHEREAS, the Jackson City Engineer reviewed the matter and recommended (1) adding two each: stop signs, stop bars, and “stop” legends on Perry Street and (2) leaving Schober Street unaltered due to the steepness of Schober Street with vehicles traveling uphill approaching Perry Street; thus allowing vehicles traveling up Schober towards Perry to yield and turn left or right.

CITY OF JACKSON

MEMORANDUM
From:

BJ Wallace, Permit Technician
Matt Ospital, City Engineer
Date: August 29, 2024
Subject: Donatelli LLA, Parcel Map 2927
This Lot Line Adjustment was requested two years ago for a carport structure that was built in accordance with the City Building Code. There is 570 square feet of improvement that encroached into APN 020-020-040 (8.26 acre City parcel) that is subject to the 2015 Voluntary Clean Up Agreement between the City and DTSC.

The improvement conducted at 1210 Jackson Gate Road (APN 022-060-040) is described as follows:

The property owner has built a post and beam structure to park an RV and yard equipment over an existing storm drain pipe. The structure has piers at each post column. The storm drain pipe does not appear to have been impacted by the piers. A portion of the area under the structure cover is asphalt concrete paving and some road base cover. Ground disturbance was in native soil. No tailing material was observed by the Building Official.

DTSC Agreement paragraph 25 "California Law": states the Agreement shall be governed, performed, and interpreted under the laws of the State of California.

The requested adjustment would transfer 2,631 sf of City lands to Donatelli with them transferring 2,726 sf to the City. An existing utility easement would be abandoned and a drainage easement dedicated to the City (see Exhibit B).

Page 9 of 60 ends

Lot Line Adjustment is allowed pursuant to Government Code Section 66412( d) and is exempt from the Map Act. Conditions allowed on Lot Line Adjustments set forth in said Government Code are specific, and read as follows:
"An advisory agency or local agency shall not impose condition or exaction on its approval of a lot line adjustment except to conform to the local general plan, any applicable specific plan, any applicable coastal plan, and zoning and building ordinances, to require the prepayment of real property taxes prior to the approval of the lot line adjustment, or to facilitate the relocation of existing utilities, infrastructure, or easements."
Lot Line Adjustments are Class 5 Categorically Exempt pursuant to CEQA 15305(a) Minor Alterations in Land Use Limitations.

In Jackson, a Lot Line Adjustment is approved pursuant to Government Code 66412(d) and City Code Chapter 17.86 by the City Council. The lot line adjustment process is completed by recording deeds or parcel map which in turn results in the County Assessor assigning new APN s to the adjusted parcels.

City Planner has reviewed this LLA application and recommends LLA approval.

Recommendation
LLA be conditionally approved, City Engineer's conditions are attached (Exhibit A). Exhibit B from Toma shows the existing and proposed lot lines.

Council needs to approve the applicants LLA application. It's my understanding you will schedule this for City Council action. Proposed Draft Resolution of Approval is also attached.

Applicants' surveyor has prepared a draft Parcel Map that will come back to council for final approval, as the city is one of the owners involved in the adjustment.

Should you need further information just let us know.

CITY OF JACKSON

MEMORANDUM
TO: City Council
FROM: Matt Ospital, City Engineer
RE: SR 49 Street Lighting Project
DATE: September 4, 2024
The City of Jackson conducted the bid opening for the SR 49 Street Lighting Project at 10:00 AM on April 2, 2024. The City received three bids for the project as follows:

Base Bid Add. Alt. #1 Total

1. St. Francis Electric, LLC. $182,500.00 $78,000.00 $260,500.00

2. The Design Build, Inc. $186,786.60 $78,382.50 $265,169.10

3. Bear Electrical Solutions, Inc. $189,595.00 $87,595.00 $277,190.00 The Base Bid project consists of installing 4 new streetlights on the west side of SR 49 and PG&E upgrading 3 luminaires on the east side of SR 49. Additive Alternative #1 consists of installing 1 additional streetlight on the east side of SR 49, which requires boring underneath the Highway from the west side (see attached Exhibit ‘A’).

After reviewing the bids, it was determined that the project had a shortfall in funding for the Base Bid. This was due to PG&E costs to provide power and for the Caltrans Encroachment Permit requirement of working at night which includes having a standby CHP police presence on the project.

The City Engineer’s office communicated with Caltrans for the funding shortfall. In order for the City to receive any additional funding, the City Engineer was required to provide an updated benefit cost analysis for the project. On August 9, 2024, the City received approval from Caltrans for the updated benefit cost analysis, which will cover the cost of the Base Bid project.

Recommendation:

I hereby recommend the City approve the resolution awarding the construction contract to St.

Francis Electric, LLC. in the amount of $182,500.00 for the Base Bid.

2024 Sewer Financial Plan Introduction
3 SECTION 1. INTRODUCTION AND SUMMARY
The City of Jackson (City) has retained Hildebrand Consulting to conduct an update to the financial plan for the City’s Sewer Enterprise. This report describes in detail the assumptions, procedures, and results of the study, including conclusions and recommendations.

SEWER UTILITY BACKGROUND
The City of Jackson is located in Amador County located at the foot of the Sierra Nevada mountains. The City of Jackson’s sanitary sewer collection system serves a population of less than 5,000 in a service area of 3.51 square miles. The collection system consists of 25.64 miles of gravity sewers, and 591 manholes. The entire laterals are privately owned and maintained.

The gravity sewer lines range in size from 6 inches to 16 inches in diameter. The City also operates three lift stations and associated force mains of 1 mile. All wastewater is conveyed to and treated at the City’s Wastewater Treatment Plant.

STUDY BACKGROUND
The City’s last formal sewer rate study was conducted in 2018 (2018 Study1), which concluded that the sewer rates should be increased substantially (118 percent increase over 5 years).

According to the 2018 Study, these significant rate increases were largely due to the fact that the recommended (and adopted) rate increases from a 2014 rate study were replaced with lower rateincreases based on a 2016 rate study (which was prepared by the City in conjunction with a citizens group referred to as the Rate Payer Protection Alliance). According to the 2018 Study, the rates from the 2016 Study did not sufficiently fund both reserves and debt service obligations, and large rate increases were necessary to correct the inadequate rate revenue. 1 2018 Update to City of Jackson 2016 and 2014 Wastewater Rate Study, Stantec, May 29, 2018

City of Jackson
2024 Sewer Financial Plan Introduction
4 The last sewer rate increase based on the 2018 Sewer Rate Study was implemented on July 1, 2022.

STUDY OBJECTIVES
The purpose of this Study is to develop new 10-year projections of operating and capital expenses in order to create a financial plan, including a new 5-year rate schedule, which will generate sufficient revenue to meet the Sewer Enterprise’s financial and service obligations for ongoing operation and maintenance, debt service, and capital improvements while maintaining prudent reserves.

STUDY METHODOLOGY
This Study applied methodologies that are aligned with industry standard practices for rate setting as laid out in the AWWA M1 Manual, and applicable law, including the California Constitution Article XIII D, Section 6(b), commonly known as Proposition 218.

The Study began with a review of the Sewer Enterprises’ current financial dynamics and the latest available data for the utilities’ operations. A multi-year financial management plan was then developed to determine the level of annual rate revenue required to cover projected annual operating expenses, debt service (including coverage targets), and capital cost requirements while maintaining adequate reserves. This portion of the Study was conducted using MS Excel©-based financial planning models which were customized to reflect financial dynamics and latest available data for the City’s operations in order to develop a long-term financial management plan, inclusive of projected annual revenue requirements and corresponding annual rate adjustments.

While this Study did not include an update to the cost-of-service analysis (COSA), a comprehensive COSA was completed as part of the 2018 Study.

5 SECTION 2. SEWER ENTERPRISE FINANCIAL PLAN
This section presents the 2024 Financial Plan for the City’s Sewer Enterprise, including a description of the source data, assumptions, and City’s financial policies. The City has provided Sewer Enterprise actual spending data for FY 2022/23 and budgeted financial information for FY 2023/24, including recent actual operating costs, budgeted operating costs, and forecasted capital spending. City staff also assisted in confirming other assumptions and policies, such as reserve targets and escalation rates for operating costs (all of which are described in the following subsections).

The Sewer Enterprise’s rate revenue requirement is the amount of revenue needed from sewer rates to cover planned operating, maintenance, debt service, and capital program costs with consideration of other revenues and financial reserves.

FINANCIAL PLAN ASSUMPTIONS
The financial plan is an annual cash flow model. As a cash flow model, it differs from standard accounting income statements, and balance sheets. The financial plan models sources and uses of funds into, out of, and between the various funds and reserves of the sewer utility.

This update to the Sewer Enterprise financial plan reflects the FY 2023/24 budget and estimated financial conditions at the beginning of the fiscal year. The financial plan also reflects the Sewer Enterprise’s debt service obligations and capital improvement program, as identified by City staff, during the planning period that extends through FY 2028/29. The financial plan is based on the best available information and reasonable assumptions; future estimates have been reviewed with staff and are believed to be reasonable.

SEWER FUND BEGINNING FUND BALANCES
The financial plan model is based on the fund structure currently used by the City, which consists of a single Sewer Fund (Fund 560). The starting cash balance in the Sewer Fund at the beginning of FY 2022/23 was about $3.6 million.

Page 44 of 60 ends

City of Jackson
2024 Sewer Financial Plan Financial Plan
6 PROJECTED CUSTOMER GROWTH
This Study assumes that the annual growth rate will average 1.0 percent for the next 10 years.

RESERVE TARGETS
Target cash reserves for utilities are balances retained for specific cash flow needs. The target for reserves is an important component when developing a multi-year financial plan. Utilities rely on reserves for financial stability; credit rating agencies evaluate utilities in part on their adherence to formally adopted reserve targets; and lending agencies require utilities to maintain specific debt reserves for outstanding loans.

Since the City does not have a formal reserve policy for the Sewer Fund, this Study recommends the following reserve guidelines and proposes that the City adopt formal policies:

Operating Reserve – An operating reserve is maintained in order to meet the liquidity needs for the utility’s day-to-day operations. Such a reserve ensures continuity of service regardless of short-term changes in cash flow or sudden increases in operating costs. It is recommended that the Sewer Fund maintain a minimum cash reserves in an amount equal to 4 months of operating budget. Given the FY 2023/24 operation and maintenance (O&M) budget of $1.8 million, the suggested minimum Operating Reserve target is about $580,000.

Capital Reserve – A capital improvement and replacement fund balance policy is designed to meet the cash flow requirements of the annual capital budget, which can be inherently volatile. The purpose of the Capital Reserve is to both (1) create a “buffer” such that the reserve is drawn down during years of higher-than-average capital spending and (2) provides a source of funds in the event of catastrophic failure of sewer infrastructure. Based on input from City staff, this Study recommends that the Sewer Fund target a Capital Reserve of $2.8 million. This is roughly equal to the Sewer Fund’s average annual capital spending (about $1 million) and an additional $1.8 million based on Staff’s estimate of the cost to fix large critical infrastructure that may fail.

Page 45 of 60 ends

City of Jackson
2024 Sewer Financial Plan Financial Plan
7 The target levels of the policies above are consistent with 1) Hildebrand Consulting’s industry experience for similar systems and the findings of reserve studies conducted by the American Water Works Association (AWWA). It is recommended that the City adopt formal reserve policies for the Sewer Fund.

Debt Reserve – The Sewer Fund’s current debt obligation requires the City to maintain a reserve equal to one year of debt service (approximately $511,000 for the duration of the planning period).

CURRENT REVENUE
Rate revenue is the revenue generated from customers for sewer service. The City collects rate revenue from sewer customers based on a fixed monthly charge (assessed based on number of dwelling units for residential customers and per account for non-residential customers) and a variable rate applied to each hundred cubic feet (HCF2) of water use3.

The Sewer Enterprise Financial Plan starts with FY 2023/24 budgeted rate revenues. Estimated future sewer rate revenues include the small amount of customer growth (see Section 2.3) as well as the annual rate revenue adjustments proposed by this Study. Other than demand increases associated with customer growth, water usage (which drives variable rate revenue) is anticipated to remain constant. Budgeted and projected rate revenues (including proposed rate adjustments) are listed in Schedule 2.

In addition to rate revenue, the City receives interest revenue on investments. Future interest income was estimated based upon projected fund balances and an assumed interest rate of

0.8 percent, which is consistent with the City’s historical interest earnings relative to its total reserve levels.
2 One HCF is equal to 748 gallons of water
3 Water usage for residential accounts is based on winter water usage during the months of December through March since this period minimizes the amount of outdoor water usage.

8 Capacity charges paid by developers for new connections are considered restricted revenue and do not benefit Fund 560.

Budgeted sewer rate and interest earnings are depicted in Figure 1 below and listed in detail in Schedule 2.

Figure 1: Sewer Enterprise Revenue Categories (FY 2023/24 budget)

OPERATING AND DEBT EXPENSES
The Sewer Enterprise’s expenses include operating and maintenance expenses, debt service, and capital spending. Capital spending is addressed separately in Section 2.8. Future operating and maintenance expenses were projected based upon the budgeted expenditures from FY 2023/24 and adjusted for inflation (see Section 2.7). The two largest cost categories include employee costs and debt service. The sewer fund’s only debt obligation is a 2020 loan for about $12 million associated with wastewater treatment plant upgrades.

Major budgeted expense categories for FY 2023/24 are depicted in Figure 2.

COST ESCALATION ASSUMPTIONS
Annual cost escalation factors for the various types of expenses were developed based upon a review of historical inflation trends, published inflation forecasts, industry experience, and discussions with City staff. During the projection period, most operating expenses are projected to increase at 4.0 percent per year. As the exception, insurance is projected to increase at 5.0 percent per year. These inflation assumptions are consistent with long-term historical inflation rates and are reasonable for financial planning purposes.

Budgeted and projected operating and maintenance costs as well as debt service expenses are listed in detail in Schedule 1.

CAPITAL IMPROVEMENT PROGRAM
Figure 3 shows that from FY 2021/22 to FY 2023/24 the City has spent an average of about $213,000per year for capital projects to rehabilitate or improve the sewer system. The Salaries and

10 forecasted average from FY 2024/25 through FY 2028/29 is a considerable increase to $1.2 million per year. This increase in annual capital spending is intended to progressively increase the City’s re-investment in sewer system infrastructure. Table 1 provides a detailed list of projects that are planned through FY 2028/29. Capital spending beyond FY 2028/29 is assumed to be $1.1 million (in 2024 dollars) based on the average capital spending prior to that period.

12 PROPOSED SEWER RATE REVENUE ADJUSTMENTS
All of the above information was entered into a financial planning model to produce a 10-year projection of the sufficiency of current rate revenues to meet projected financial requirements and determine the level of rate revenue increases necessary in each year of the projection period.

Based on the previously discussed financial data, assumptions, policies, this Study proposes rate increases of 3 percent per year, which is enough to keep pace with inflation.

The numbers provided in Schedule 2 (cash flow proforma) are summarized graphically in Figure 4, which shows the Sewer Fund target reserves being met through-out the planning period.

This Report used methodologies that are aligned with industry standard practices for rate setting as promulgated by the AWWA, Water Environment Federation (WEF), and all applicable laws, including California’s Proposition 218. This Study has calculated, and is proposing, a 5-year schedule of sewer rates that increase at the projected rate of inflation (3 percent), which is designed to match projected cost inflation. The proposed annual adjustments to the rates will allow the City to continue to provide reliable sewer service to customers while meeting state mandates.

The first rate increase is proposed for November 1, 2024, while all subsequent rate increases will occur on July 1 for years 2025, 2026, 2027, and 2028. The City will need to adopt the rates in accordance with Proposition 218, which will require a detailed notice describing the proposed charges to be mailed to each affected property owner or customer at least 45 days prior to conducting a public hearing to adopt the rates.

CITY OF JACKSON

NOTICE OF PUBLIC HEARING

PROPOSED ADJUSTMENTS TO RATES FOR SEWER RATES
You are receiving this letter because you are either a City of Jackson (City) sewer customer or you own or rent property that is receiving sewer services from the City. The City is committed to providing safe and reliable sewer services and we have been making every effort to control expenses and keep sewer rates down. The City’s sanitary sewer collection system consists of 25.64 miles of gravity sewers, and 591 manholes and serves residential and commercial customers. The City also operates three lift stations and associated force mains of 1 mile. All wastewater is conveyed to and treated at the City’s Wastewater Treatment Plant. Over the next five years, the City has planned capital improvements to update the sewer infrastructure. In order to provide necessary funding for the sewer system, the City is proposing to implement new sewer rates as a series of annual adjustments beginning November 1, 2024, and each July 1 thereafter through July 1, 2028. The City’s 2024 Sewer Financial Plan report has concluded that continuous rate adjustments are necessary in order to keep pace with inflation, to pay for operating and maintenance expenses, to pay for debt service, build sewer fund reserves, and to cover an annual average increase for capital projects from $213,000 to $1.2 million for each fiscal year (FY) from FY 2024/25 through FY 2028/29 for sewer system infrastructure reinvestment. This letter is being provided as a notification of proposed sewer rate increases.

NOTICE IS HEREBY GIVEN that the City of Jackson will hold a Public Hearing on October 28, 2024, at 6:30 p.m. in the City Council Chambers, located at 33 Broadway, Jackson, CA, to consider the adoption of adjustments to sewer service rates applicable to the parcel for which you are shown as the record owner or customer of record. The rate adjustment proposed to be imposed on your parcel (or to you as a direct customer) and the basis upon which it was calculated is described in more detail below.

The purpose of the hearing is to consider all written protests against the rate adjustments. As the record owner or customer of record of a parcel identified to be subject to the imposition of the proposed rate adjustments, you may submit a written protest against the proposed rate adjustments. However, if the identified parcel has more than one record owner and/or customer of record, only one written protest will be counted. Each protest must (1) be in writing; (2) state that you are opposed to the specific rate adjustments 3) provide the location of the identified parcel (by assessor's parcel number or street address); and (4) include the original signature of the record owner or customer of record submitting the protest. Protests submitted by e-mail, facsimile, or other electronic means will not be accepted. Oral comments at the public hearing will not qualify as formal protests unless accompanied by a written protest. Written protests may be submitted by mail or hand-delivered to the City Clerk, City of Jackson, at 33 Broadway, Jackson, CA 95642, or in person at the public hearing, so long as they are received prior to the conclusion of the public hearing on October 28, 2024. Please identify on the front of the envelope for any protest, whether mailed or submitted in person to the City Clerk, that the enclosed letter is for the public hearing on the sewer rate adjustments.

If at the close of the public hearing, written protests against the proposed rate adjustment are not presented by a majority of the record owners or customers of record of the identified parcels upon which they are proposed to be imposed, the City Council may adopt the proposed adjustments to the sewer service rates. If Council approves the rate adjustments for five years, the first rate adjustment will occur on November 1, 2024, and then annually thereafter each July 1 up to and through July 1, 2028.

Proposed sewer rates consist of 1) monthly fixed charges, and 2) volumetric rates. The fixed charges cover the costs associated with the operation and maintenance of sewer collection and treatment, while the volumetric rates cover the variable costs of treatment and disposal of wastewater. The City collects rate revenue

from sewer customers based on a fixed monthly charge (assessed based on the number of dwelling units for residential customers and per account for non-residential customers) and a variable rate applied to each hundred cubic feet (HCF1
) of water use.

In accordance with Government Code section 53759, there is a 120-day statute of limitations for challenging any new, increased, or extended fee or charge for sewer service, beginning from the effective date of final passage, adoption, or approval of the resolution adopting the rates, whichever is later.

For further details regarding the basis and reasons for the proposed rate adjustments for sewer services, please see the sewer financial plan on our website ci.jackson.ca.us or contact Trevor Hoaas, Assistant Public Works Superintendent, at (209) 273-8780.
1 One HCF is equal to 748 gallons of water.
