4. ADMINISTRATIVE REPORTS.

This section is to provide staff an opportunity to present oral status reports on issues. No legal action is expected to be taken by the Council.

Public Works Superintendent, Bree Wilder – Provided an update on the Sutter Street Project, before the contractor can complete the paving in the Ace Hardware parking lot they have to test the pipe and a couple joints- another manhole has to be put in the highway to accomplish this- Vogan Toll is shut down right now and they should be crossing that within two weeks, will move on to the base and up top, then jump the highway and hopefully finish. Reservoir Project: 65% complete for plans/drawings, lead/copper samples (completed every three years) were 75% complete, LSL samples (Lead/Copper Service Inventory required by the state and EPA) now 50% complete- must finish by October 16th and the team is doing a good job to get that done. Water Polo starts September 3rd. Stop signs at Schober & Perry were completed. AC installation at the Scout Hut is complete. Tonight’s resolution on the roofing projects covers the upper and lower roofs at the Sewer Plant and the Pool office, repairing long time leaks.

Mayor McLean inquired on an update on the Mattley Hillside Project from City Engineer Matt Ospital.

Wilder advised he is trying to get better pictures to present of doing a bare shotcrete finish with a couple different colors- it blends well and does not look like straight concrete. Hope to present options soon.

Vice Mayor Simmons inquired about adding the “Busi” name to the parking sign at Mel & Faye’s.

Wilder advised that City Manager Simpson came up with a good idea to possibly move the current sign to the parking garage and City Hall and order a new sign for the Busi lot that incorporates the name.

The frame is not currently suitable to make any additions so this is a good potential alternative. They are looking into getting proposals.

Interim Fire Chief, Dale Fishback – Continuing to work on proposals for the purchase of a new Type 1 engine, will present to Council soon. Safety Walk tomorrow at Jackson Junior High with the Vice Principal for the annual evaluation of their systems. October 6th- Pancake Breakfast at Station 132, social media advertisements out now. In weekly communication with the incoming new Fire Chief Ryan Pidgeon, planned to start October 1, 2024.

Police Chief, Chris Mynderup – No report.

City Attorney Representative, Joanna Gin – No report.

b. Discuss and possibly approve stipulated Measure E Agreement with Restore Amador LLC for receipt of TOT Funds.

Tabled for future meeting when Restore Amador can attend. c. Discuss and possibly approve License Agreement with Amador Community Recreation Agengy (ACRA) for use of the Scout Hut for an after-school youth program.

Mayor McLean opened the item for council discussion.

City Manager Simpson advised a draft agreement has been prepared and there are additional concerns from Michael Rock/ACRA, not present tonight at the meeting. Concerns include compensation for use, paying for utilities and came up with a recommended lease amount of $1,130/month. This amount is based off of our normal charges for a Government agency to rent the Civic Center at $10/hour (ACRA would use the Scout Hut 5 days a week/5 hours a day/per month) and approximately $129/month for sewer and water fees, and utilities for power would be additional. Electricity charges are planned to be based on an average of the first three full months ACRA is in the building minus the average of the previous six months’ use prior, charging the difference.

CM Gonsalves inquired if ACRA is in agreement.

VM Simmons advised they are not. Simmons is on the ACRA board and ACRA only clears about $900 profit per month after expenses for running the program, so the $1,130 plus electricity would end up costing them money. He suggested having ACRA possibly pay for the upgrade to the AC unit in the Scout Hut as an alternative, which comes out of a different funding source that the kids program. PW Supt Wilder advised the cost of that project was $18,600, paid for by a Prop 68 grant which pays 75% of the project/City pays 25%. CM Gonsalves advised she would like to see ACRA cover the City’s 25% of that project, plus utilities. CM Godde advised this program may need to be looked at as the City Pool, that it is a service and not an income to the City. VM Simmons advised the Scout’s use the hut and do not pay anything- however, they do not make money off the hut either. ACRA could just cover the utilities. CM Gonsalves stated ACRA should have to pay for the use and/or the 25% match of the upgrade, plus utilities. CM Stimpson stated ACRA should have to pay their way- they receive a lot of money from all the incorporated cities, ask for more money, and mismanage the funds. The fact that ACRA did not show up tonight is bothersome. CM Gonsalves stated the City just wrote a check to ACRA for $32,000 as well. Mayor McLean stated he’s not seen ACRA’s budget for those funds. CM Stimpson stated he has seen ACRA’s budget when he worked for them and witnessed their mismanagement of funds firsthand.

Council expressed consensus to have staff continue to work out details of a possible agreement and bring it back for consideration at a future meeting.

Mayor McLean shared the following catches made by Debby Collins regarding this contract:
• Page 27, section 2- date should read June 30, 2025 rather than 2024. • Page 27, Section 3- What are the consequences for paying after the 5th (6th, 10th, 20th, etc.)?

Page 8 of 46 ends

August 26, 2024 City Council Meeting Minutes
• Page 29, Section 14- the addresses need to be listed.

Mayor McLean asked for public comments and received none.

City Manager Simpson requested clarification on CM Gonsalves 25% of matching funds to the grant.

PW Supt Wilder advised it is 20-25% City match. Simpson advised the grant may not allow the City to accept funds from another agency to cover that City match. However, there may be other upcoming projects that need to be completed at the Scout Hut that ACRA can contribute towards. CM Stimpson inquired if there are ADA requirements at the Scout Hut and Simpson advised there are but not in order for ACRA to occupy the building due to some hold harmless language our City Attorney included in the agreement, insulating the City from liability. At some point the City will likely need to meet ADA requirements, especially if we continue to rent it out in the future.

7. REGULAR MEETING ADJOURNMENT.

Mayor McLean adjourned the meeting at 6:55 p.m. to 6:30p.m. on September 9, 2024.

[The PowerPoint presentation is available to the public online at www.ci.jackson.ca.us, by clicking on “Government”, then “City Clerk & Records”, and scroll down to “City Council Agenda & Minutes”.]
Mayor McLean opened the item for council discussion.

Mayor McLean asked about the list of capital improvement projects tied to the rate increase.

Mark Hildebrand advised a detailed list of approximately 15 projects provided by staff are in the full report in the Council packet, including rehabilitation of sewer mains throughout the City, projects at the wastewater treatment plant, among others. Considering capital spending, you either classify a project as deterioration/aging infrastructure or a growth project, expanding the capacity of a system to accommodate growth. All of the projects here deal with aging infrastructure, providing the “TLC” they need. A proactive capital spending program is really important to keep rates low because fixing something before it breaks is magnitudes less expensive than after, which involves engaging emergency crews, quick contracts, and less competitive bids under duress.

September 9, 2024 City Council Meeting Minutes
Councilmember Gonsalves inquired how to include growth into the figures shown, considering potential development or expanding city limits.

Mark Hildebrand advised there are sewer capacity charges that are recovered from developers when they move in. Sometimes the sewer utility will need to front the costs to expand a system for incoming development to connect. This study did not include capacity charges of the sufficiency of that fund due to minimal growth happening in Jackson at this time. Capacity charges should be considered if you see a new development on the horizon in the future.

Councilmember Godde stated staying ahead of potential development (such as capacity of the wastewater treatment plant) can make Jackson more appealing to incoming developers.

Mark Hildebrand advised of two different methodologies for calculating capacity charges: 1. Buying approach. 2. Incremental approach. If you have enough capacity in your existing system to accommodate new growth, the money you get from the capacity charges reimburses existing ratepayers, so you have already paid for the infrastructure and when developers come in and pay their capacity charges the money goes straight into the sewer utility fund and helps keep rates down or pays for additional rehabilitation projects. The only time you have stress on the utility is when you do need to expand the infrastructure, creating a timing issue in terms of the cost to expand the infrastructure before development actually happens.

Councilmember Godde asked PW Supt Wilder his opinion on whether we are catching up on I&I issues compared to 4-5 years ago. Wilder advised it gets better every year and a lot of the CIPs are going to make lines better as well. The plant currently has capacity to accommodate 1,200-1,800 additional homes. Vice Mayor Simmons stated there are two possible development projects- Ven Huizen’s project on Tunnel Hill, and the next phase of Jackson View if they continue with the process. Wilder commended Interim WWTP Chief Lindsey for looking into the capacity for the Jackson View project a couple of years ago and completing the studies for it. VM Simmons asked about the correlation between the capacity to accommodate a certain number of single-family homes versus commercial operations.

Wilder advised capacity and connection fees for commercial are significantly higher and the number of homes the business would be equivalent to would vary based on the type of business- more details are available in the study.

VM Simmons inquired why the other cities water rates are so much higher than Jackson. Hildebrand advised that many of the other agencies have a hard time finding a place to put their treated water.

Mayor McLean asked for public comments.

Dalacie Blankenship, Finance Manager answered Councilmember Gonsalves’ question regarding the sewer participation fund. The balance is currently over $1.74 million, which are the participation costs that developers have already paid into and where we would start if increases become necessary.

Mayor requests a motion.

Motion to approve the posting of Proposition 218 Notice of Public Hearing regarding the Sewer Rates, dated September 11, 2024 as presented. Moved by Councilmember Stimpson, seconded by Councilmember Godde, and carried by a 5 to 0 vote:

AYES: McLean, Simmons, Godde, Gonsalves, Stimpson

EMPLOYMENT AGREEMENT
THIS AGREEMENT is between the City of Jackson, a municipal corporation (the “City”) and Ryan Pidgeon (the “Employee”). It is effective on October 1, 2024.

This Agreement is entered into on the basis of the following facts, among others:

A. Employee shall be duly appointed as the Fire Chief beginning October 1, 2024.

B. The City and Employee desire to set forth the terms of this employment relationship, including compensation and benefits, performance evaluations, and related matters.

BASED UPON THE FOREGOING, THE CITY AND EMPLOYEE AGREE AS FOLLOWS:

1. Employee Appointed. The City appoints and employs Employee as Fire Chief, and Employee accepts the appointment and employment effective October 1, 2024.

2. Duties of Employee. Employee shall perform the duties established for the Fire Chief by State law, the Jackson Municipal Code, the applicable job description, the direction of the City Manager, or as otherwise provided by law, ordinance, or regulation. a. Full Energy and Skill. Employee shall faithfully, diligently, and to the best of Employee's abilities, perform all duties that may be required under this Agreement.

Employee agrees that Employee has a duty of loyalty and a general fiduciary duty to the City.

Employee shall devote the whole of Employee's working time, skill, experience, knowledge, ability, labor, energy, attention, and best effort exclusively to the City’s business and affairs. b. No Conflict. Employee shall not engage in any employment, activity, consulting service, or other enterprise, for compensation or otherwise, which is actually or potentially in conflict with, inimical to, or which interferes with the performance of Employee’s duties. Further, Employee shall not, during the term of this Agreement, individually, as a partner, joint venture, officer or shareholder, invest or participate in any business venture conducting business in the corporate limits of the City of Jackson. c. Outside Activities. During the time that Employee is a full-time employee as set forth in Section 3, Employee shall not spend more than 40 hours per month in teaching, consulting, expert witness testimony, speaking, or other non-City connected business for which compensation is paid without express prior consent of the City Manager. Employee shall not spend more than 8 hours per month in teaching, consulting, expert witness testimony, speaking, or other non-City connected business for which compensation is paid without express prior consent of the City Manager. Employee will take personal leave (i.e., vacation time) for all outside activities of this nature.

3. Hours of Work. Employee is an exempt employee and is expected to engage in those hours of work that are necessary to fulfill the obligations of the Employee’s position.

Page 34 of 46 ends

Item 4i
82201.00000\42678885.2
Employee is expected to be available at all times and to be present at either fire stations or city hall facilities during normal business hours for at-least 5 days a week. It is recognized that Employee must devote a great deal of time to the business of the City outside of the City’s customary office hours, and to that end Employee’s schedule of work each day and week shall vary in accordance with the work required to be performed and in accordance with any specific direction provided by the City Manager. However, employee’s weekly salary shall not fluctuate even though hours of work may fluctuate week to week.

4. Term. The term of this Agreement shall be the Effective Date until terminated earlier by either party in accordance with the provisions set forth in Paragraph 8 or by the event of the death or permanent disability of Employee.

5. Annual Evaluation. Each year on or about October 1st, or at a time mutually agreed upon by the City and Employee, the City Manager shall conduct an evaluation of Employee’s performance and provide guidance and direction toward goals and objectives which Employee shall be tasked with implementing moving forward.

6. Compensation.
a. Salary. Employee shall receive the base annual salary of $93,600, payable in this Agreement on a pro-rata basis subject to all applicable payroll taxes and withholdings. b. Annual Salary Adjustments. At the City Manager’s sole discretion, subject to budget approval by the City Council, salary adjustments may be given to Employee at or around the time of the annual review and evaluation. Any increase must be in writing executed by the City Manager and Employee.

7. Regular Benefits and Allowances. City agrees to make available to Employee insurance coverage for vision, dental, and comprehensive medical insurance for Employee and their dependents, if any, similar to that which is provided for all other full-time miscellaneous executive management employees of City (i.e., City Manager and Department Heads). City shall agree to enroll Employee into the California Public Employee Retirement (“CalPERS”) and shall pay the CalPERS employer share subject to this section. Employee shall pay the CalPERS employee share.

8. Additional Benefits and Allowances. In addition to the benefits specified in Section 7, Employee shall receive the following additional benefits and allowances. a. Vacation; Sick Leave; Floating Holiday
i. Vacation. Employee shall accrue 11 vacation days per year on a pro-rated basis each pay period.
ii. Sick Leave. Employee shall be allowed to use paid sick leave and be absent from work because of personal illness/injury or the illness/injury of immediate family members (as identified in California Labor Code section 233) for such time as is reasonably necessary or during otherwise unpaid medical leaves provided by law. Sick leave includes

attendance at doctor’s appointments or related medical activities. Employee shall accrue sick leave at the rate of 8 hours per pay period/month. Accrued Sick Leave is not eligible for a cash-out at any time by Employee and any remaining accrued Sick Leave at time of Employee’s retirement will be governed by the rules and restrictions as detailed in the then-existing PERS contract.

9. Termination of Employment.
a. No Property Interest. Employee understands and agrees that Employee has no constitutionally-protected property or other interest in Employee’s employment as Fire Chief.

Employee understands and agrees that Employee works at the will and pleasure of the City Manager, and that Employee may be terminated, or asked to resign, at any time, with or without cause. Notice of termination shall be provided to Employee in writing. “Termination,” as used in this Agreement, shall also include (1) a request that the Employee resign; (2) a reduction in salary or other financial benefits in a significant amount which is inconsistent with a reduction in salary of other financial benefits for employees in the miscellaneous executive management unit; (3) a material reduction in the powers and authority (excluding placement on paid administrative leave); or (4) the elimination of Employee’s position.
b. Notice Required of Employee. Employee may voluntarily terminate the employment at any time by giving at-least sixty (60) days’ notice. c. Severance Pay. If Employee is asked to resign or is terminated, then subject to the requirements of this Section, Employee shall be eligible to receive a cash payment equivalent up to the sum of the Employee’s then-current monthly salary multiplied by three (3). Eligibility for such severance payment is expressly conditioned upon Employee’s execution of (i) a waiver and release of any and all Employee’s claims against City and its officials, officers, employees, and agents; and (ii) a covenant not to sue. All normal payroll taxes and withholdings as required by law shall be made with respect to any amounts paid under this section. d. Ineligibility for Severance Under Certain Conditions. If the termination of Employee is the result of gross mismanagement and/or an act or acts of moral turpitude, Employee shall not be paid any severance pay. In such an instance, Employee’s sole remedy shall be a judicial action in declaratory relief to determine whether there was substantial evidence of gross mismanagement and/or an act or acts of moral turpitude. If the court determines there was not substantial evidence, Employee shall only receive the severance pay provided in this subsection.

10. Statutory Requirements. This Agreement shall be deemed to incorporate by reference the provisions of Sections 53243 et seq. of the Government Code, as it may be amended or renumbered.

11. Payment of Expenses of Employment. The City shall pay the following usual and customary employment expenses.
a. The cost of any fidelity or other bonds required by law for the Fire Chief. b. Subject to Section 10 of this Agreement, the cost to defend and indemnify Employee in accordance with the requirements and limitations of the California Government Claims Act (Government Code § 810 et seq.), or otherwise. Notwithstanding the foregoing, City’s

ii. if the City pays for the criminal legal defense of Employee (which would be in its sole discretion, as it not generally required to pay for a criminal defense), Employee shall be required to fully reimburse City such amounts paid; and iii. if this Agreement is terminated, any cash settlement related to the termination that Employee may receive from the City shall be fully reimbursed to the City or void if not yet paid to Employee.

For this subsection, “abuse of office or position” means either (1) an abuse of public authority, including waste, fraud, and violation of the law under color of authority, or (2) a crime against public justice, including but not limited to a crime described in Title 7 (commencing with section 92) of Part 1 of the Penal Code.

Memorandum
To: Honorable Mayor and Members of City Council
From: Christopher Mynderup, Chief of Police
Date: September 20, 2024
Subject: Argonaut High School Downtown Rally
Recommendation:

That City Council approves the Special Event Application submitted by the Argonaut High School for their annual Big Game Downtown Rally. A current Certificate of Liability for this event has been filed with the City of Jackson.

Discussion:

This event will take place on Wednesday October 30, 2024, from the hours of 5:00 p.m. to 7:00 p.m. The location of this event will take place on the steps and street in front of the historic National Hotel. Prior to the event, there will be a parade of school related floats and marching band that will be escorted from the Busi Parking Lot, northbound Highway 49, to the intersection of Main Street. On Main Street, the parade will then travel southbound ending at the National Hotel. Once all floats have left the area, Main Street will be closed at the Water Street/Broadway intersection and on Main Street along the south prolongation of Court Street.

Historically the Police Department provides two police vehicles to escort the floats from the Busi Parking Lot to Main Street while two additional police vehicles are used to block all traffic lanes on Highway 49 as the parade exits the parking lot and crosses Highway 49. Once the portion of Main Street is closed for the rally, two officers will be needed to man the barricaded areas.

Conclusion:

This event promotes our cherished small-town atmosphere along with providing strong community support for our local high school’s football tradition. This event will create minimal impact to the City and vehicle/pedestrian traffic. It is anticipated that this event will only require the use of on-duty and reserve police staff, and volunteers.
