b. First reading of Ordinance No. 731 Amending City of Jackson Municipal Code Sections 8.28.020 and 8.28.030 of Chapter 8.28 of Title 8 of the Jackson Municipal Code Related to Encampments within the City Limits.
[Possible action: waive 1st reading and direct to proceed with 2nd reading.] City Attorney Josh Nelson provided a brief history on recent case law affecting encampments in public spaces. Under prior 9th Circuit case law, cities were prohibited from banning camping on public property which has recently been modified by the Grants Pass Supreme Court case noted in the draft ordinance, now granting cities the ability to ban camping in public places. This ordinance would allow Jackson to take advantage of that new case law, and should be considered another tool in the toolkit,
October 28, 2024 City Council Meeting Minutes
providing code and police another option for enforcement where appropriate. The City Manager and staff can consider how to property utilize this additional tool.
Mayor McLean opened the item for council discussion.

Mayor McLean inquired if Amador County has adopted anything similar. City Manager Simpson advised he can find out and met with Sheriff Redman last week to coordinate efforts.
Mayor McLean asked for public comments and received none. Mayor requests a motion.

Council Meeting Memorandum
Tuesday, November 12, 2024 – 6:30 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Carl Simpson, City Manager
Date: November 7, 2024
Agenda Item #6b: Update on Agreement with Restore Amador, L.L.C.
Recommendation
Council discretion.
Summary and Discussion
On June 24, 2024, Jamie and Patrick Macklin, owners of Restore Amador L.L.C., submitted a proposal in response to the City’s annual “RFP for Tourism and Business Promotion, Economic Development and Downtown Revitalization Programs” seeking support from TOT funds for property improvements to the original Amador County Courthouse, County Library and a patio at 204 Court Street which they recently purchased and plan to restore.
The Council approved a motion to allocate $25,000.00 to Restore Amador L.L.C., and directed staff to work with the Macklins on an agreement that would be brought back for further Council consideration. The Council key discussion points included the use of the parking lot, potential restrictions on building use to activities promoting tourism, and a possible return of funds to the City if the property is sold within a designated time frame. These specific conditions were to be further outlined in the agreement, which was to return to Council as an item on an upcoming consent calendar.
Staff has engaged in discussions with the owners, resulting in several revisions to the draft agreement. However, consensus on the terms has not yet been reached.
The owners have expressed interest in an arrangement more closely resembling a grant, rather than a contractual agreement or a loan. They have requested this opportunity to address the Council directly to present a similar proposal with revised terms.

Council Meeting Memorandum
Tuesday, November 12, 2024 – 6:30 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Carleen Kirkpatrick, Deputy City Clerk
Date: November 8, 2024
Agenda Item #6d: City Council Meeting – Meeting Time and/or Frequency Discussion RECOMMENDATION:
The Council is encouraged to carefully weigh the pros and cons of changing meeting times or frequency. The goal should be to find a balance between public access, Council efficiency and staff resources. Any proposed changes should prioritize transparency and community involvement in the decision-making process.
DISCUSSION:
The Council has been considering changing the schedule for regular City Council meetings over the past year. Here’s a breakdown of the issues involved and the considerations for changing the meeting times or frequency:
Current Meeting Schedule:
• Regular Meetings: Second and fourth Mondays of each month at 7:00 PM. • This schedule is established by Jackson Municipal Code section 2.04.020.
Considerations For Change
1. Public Access and Participation:
• Meetings are currently held in the evening, allowing many residents who work during the day to attend. Remote access is available for listening only, as remote participation is no longer permitted to prevent disruptions from "zoom-bombing", or cyber-harassment, which has negatively impacted other cities. • Shifting meetings to an earlier time might limit access for some residents, particularly those who work during the day. It might also make it harder for younger or working professionals to run for city council, as these positions are unpaid. Alternatively, the earlier start time may be welcomed by regular attendees with a preference to return home to their families earlier in the evening.
Item 6d
2. Meeting Frequency:
• 2024: 18 regular and 5 special meetings.
2023: 20 regular and 6 special meetings.
2022: 19 regular and 1 special meeting.
• 6 regular meetings were cancelled this year and 4 were cancelled last year. Meetings cancelled due to a lack of quorum or other untimely cancellations result in wasted staff time and resources.
• A proposal to reduce meetings to once per month or tri-weekly will save staff time and resources, which can in turn be utilized for other city projects. Without any cancellations, a tri-weekly meeting schedule would result in 17 regular meetings annually, 12 if held monthly, and 23 via the traditional twice per month schedule. • Special meetings can be called as necessary to address time-sensitive issues. • Expenditures are currently approved twice a month at the regular council meeting.
If regular meeting frequency is reduced, expenditures can be handled in the same fashion utilized by other cities with less frequent meetings. *Our Accounting Manager is connecting with those cities about their expenditure process in preparation for Council’s decision.
3. Meeting Duration and Efficiency:
• The average meeting length over the past year has been approximately 50 minutes. • Changing the start time to an earlier hour could help to offset slightly longer meetings that result from a reduction in frequency.
4. Local and Regional Comparisons:
• In Amador County, all cities—including Jackson, Amador City, Ione, Plymouth, and Sutter Creek—currently hold evening meetings (after 5 PM). • The Amador County Board of Supervisors and the Amador Water Agency hold daytime meetings.
• Other cities in California of a similar size to Jackson, such as Calistoga, Williams, Elverta, Bear Valley Springs, Keyes, Kensington, and Loomis, meet once per month (Calistoga currently meets tri-weekly).
Potential Impacts Of Changes
• Earlier Start Time:
o May better accommodate council and staff scheduling, allowing all attendees to get home to their families earlier in the evening.
o Should Council decide to meet less frequently, the earlier start time could help compensate for slightly lengthier meetings.
o It could alienate those from the public who cannot attend at an earlier time. • Reduced Frequency (once per month or tri-weekly):
o It would save staff time and reduce resource expenditure. o Less meetings may be more manageable for some working professionals. o The duration of individual meetings may be increased. o The accounting department would need to implement an expenditure approval process similar to other cities holding less frequent meetings in order to prevent untimely payments or late fees.
To enact any changes to the meeting schedule, the Council would need to introduce and enact an ordinance to amend the municipal code. This requires a formal process that involves public input and approval from the City Council.
