Next year we may want to consider a larger space to allow for more participation. Potentially consider using the firehouse or other similar larger space. Keith Sweet (President of the Amador Pickleball Club) expressed gratitude to Council for previous funds for the storage shed at the courts. Tournaments are getting crowded at the courts (40+ people attended the last competition) and some left waiting in the parking lot. Requesting to install a fenced area to East of Pickleball courts for attendees and shed install. PW Supt Wilder suggested a 4-foot fence to block off the steep drop-off into the creek, there will still be a 5-foot setback from the fence to the drop-off. Wilder suggested Sweet obtain 3 bids. One company was not able to complete their bid. Bids presented in packet for Council consideration. Sweet requests approval of funds request to pay lowest bidder, Gideon Fence, Inc. to install the fence and gates at $7725, likely in February or March of 2025. Junior Pickleball program is gaining interest. Working on starting an elementary program next season for 3rd-6th graders, as well as an ACRA after school program for summer of 2025.

Mayor McLean opened the item for council discussion.

Page 6 of 64 ends

Mayor McLean inquired if ACRA is helping to pay for this project. Sweet replied they are not.

Councilmember Godde inquired if ACRA is charging $5 for Pickleball at Detert Park. Sweet advised they are charging at the Argonaut High School, not Detert Park. Godde asked what percentage Sweet is asking the City to pay, and Sweet responded 100%.

Vice Mayor Simmons asked if Sweet will return to ask them to concrete this area later. Sweet replied no and they already have funds to concrete under the shed.

Councilmember Godde thanked Keith Sweet for all of his contributions to the success of the Pickleball program.

Councilmember Gonsalves inquired if Public Works can install the fence and gates. City Manager Simpson advised he will follow up with PW Supt Wilder. Gonsalves inquired which city fund (TOT or Park-In-Lieu) has more funds. City Manager Simpson advised it can be paid by either or split between the two funds.

a. Presentation on Formation of the Amador County Tourism Marketing District [Kathleen Mahan, Amador Council of Tourism].

Kathleen Mahan (President of Amador Council of Tourism) presented benefits of forming the Amador County Tourism District and is currently seeking support of Amador County cities through signing the petition. Sutter Creek, Plymouth and Amador City have already signed and she is meeting with Ione on December 3rd. She plans to request it to be on the Amador County Board of Supervisors agenda for December 17, 2024. Short term rentals, hotels, motels, Airbnb’s, etc. will be charged a 2% assessment, expecting to provide approximately $200k to the district. County currently provides them with $101k, and they’ve spent $87k in marketing alone this year. The Amador Council of Tourism is currently run on volunteer basis only.

Council Meeting Memorandum
Monday, December 9, 2024 – 6:30 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Joanna Gin, City Attorney Representative
Date: November 27, 2024
Agenda Item #3h: Consent to the formation of the Amador County Tourism Marketing District pursuant to the Property and Business Improvement District Law of 1994 (Streets & Highways Code, § 36600 et seq.)
Recommendation
Consent to the formation of the Amador County Tourism Marketing District pursuant to the Property and Business Improvement District Law of 1994 and authorize the Mayor and City Manager to sign any documents to effectuate said consent.

Staff Report
At the November 25, 2024 City Council meeting, Kathleen Mahan, President of the Amador Council of Tourism (ACT), provided a presentation regarding the formation of the Amador County Tourism Marketing District (ACTMD). ACTMD would be formed as a property and business improvement district pursuant to the Property and Business Improvement District Law of 1994 (Streets & Highways Code, § 36600 et seq.). ACT proposes to initiate proceedings to form the ACTMD through the Board of Supervisors of Amador County at its December 17, 2024 Board meeting. However, Streets & Highways Code section 36620.5 provides that the county may not form a property and business improvement district within the territorial jurisdiction of the city without the city council’s consent. The proposed ACTMD will have a 5-year term, beginning January 1, 2025, or as soon as possible thereafter. ACT proposes to serve as the ACTMD’s Owner’s Association to manage ACTMD.

At the regular City Council meeting on October 28, 2024, Councilmember Bob Stimpson, a dedicated public servant, announced his resignation due to relocating outside the Jackson city limits. Councilmember Stimpson’s current term was set to run until December 2026, leaving approximately two years remaining until the next scheduled election.

Under State law, when a City Council seat becomes vacant, the Council has two options for filling the vacancy within sixty days:

1. Appointing a replacement to serve the unexpired term; or

2. Calling a special election to fill the remaining term.

Alternatively, state law allows the City to adopt an ordinance providing one of the following methods for filling a vacancy:

1. Special election;

2. Appointment, unless a petition for a special election is submitted by the public; or

3. Interim appointment, with the appointee serving until a special election is held.

Since the City has not adopted a specific ordinance addressing Council vacancies, the Council must choose between either appointing someone to serve for the remainder of the term (until the next election cycle) or calling a special election. As of today, no public petitions have been received requesting a special election.

In response to the vacancy, the City Council directed staff to seek qualified applicants interested in being appointed to the Council. On October 29, 2024, a vacancy notice was posted on the

Item 7a
City’s website and Facebook page, with a deadline for application submissions of November 18, 2024, at 4:00 p.m. The vacancy was also advertised in the Ledger Dispatch on October 18, 2024.

As of the deadline, four applications were received. One of the four applicants withdrew their application on November 11, 2024. The remaining three applications are now presented for the Council's review and consideration for possible appointment to fill the unexpired term ending December 2026.

To be eligible to serve on City Council, applicants must be a registered voter residing within Jackson, California city limits.

Additional Information for City Council Position
Reasons for wishing to serve on this body: I was born in Jackson, and I have lived in Amador County for most of my life. I desire to continue to serve the community I was fortunate enough to be raised in. City council has a large impact on the community and its future, and I believe my skillset would be an asset. I am also establishing a family here in the city, so I have a vested interest in maintaining and growing the city's suitability for families.

Qualifications: I currently serve as a planning commissioner for the Jackson City Planning Commission.

This position has allowed me to gain experience and knowledge of the development of the city, as well as adjacent knowledge of development in the county.

I also serve as the secretary of the CalHFA Homeowners Relief Corporation, a nonprofit corporation. This corporation has distributed hundreds of millions of dollars, alloca ted to California from the Federal American Rescue Plan act of 2021, to California homeowners struggling with financial hardships. This role has helped me understand the relationship between the federal and state governments, as well as how funding sources may be allocated and utilized. This is important because the city, on a smaller scale, operates much in the same way with certain funding sources.

I am also an attorney for the California Housing Finance Agency, specifically within the single-family division of the agency. My role is to help design and implement programs and loan products to help low to moderate income Californians achieve home ownership. This role has allowed me to understand housing needs within California and understand the role of government entities.

MEMORANDUM

CITY COUNCIL MEETING
MONDAY THE NINTH OF DECEMBER OF 2024
BRINGING BEFORE THE COUNCIL AND COMMUNITY:

THE JACKSON ARCHWAY PROJECT aka “THE ARCH”
PURPOSE:
• To revive a 2-decade old community revitalization project. • To make a statement of our city and community’s identity. • To bring about needed Main Street beautification, that will be the cornerstone for future projects.

VISION:
• Bring motivated, distinguished, community members who are willing to work together towards a common goal.
• Within that teamwork, the committee will work with the city and community to erect the arch in stages until completion.
• While it is too early to have a timeframe, the committee has a goal of one year. • The Arch will be privately funded through a fundraising dinner held on Main Street. • There is currently an account open at the Amador Community foundation to hold the funds securely called Beautification.

FOOTWORK:
• Currently, the committee has conducted two surveys. One with Matt Toma and Associates. The Arch will not infringe on private property. The second with Robin Peters of Delta engineering on site placement.
• The committee held a kickoff presentation in October which introduced the idea to the community.
• The committee members has worked many hours over several months gathering detailed information and held meetings and discussions, to bring this to council today.

CLOSING THOUGHTS
We are hopeful that this project, after many years, will finally come to fruition. The Arch is an opportunity for us to work together with the City’s support. It will be here for generations to come. We can give new life to our outdated main street. With the new energy that this project will bring, we can accomplish more projects to revitalize, rejuvenate, and restore our town!
THANK YOU TO ALL THOSE WHO HAVE SUPPORTED THE EFFORT OF THE ARCH.
