This section is to provide staff an opportunity to present oral status reports on issues. No legal action is expected to be taken by the Council.

Assistant Public Works Superintendent, Trevor Hoaas – Covering for PW Supt Wilder (due to family emergency). Bucket truck inspection done at Altech (manufacturer) and maintenance was completed, returned in time for Christmas set-up around town, including decorations on roadway bridges/around town. The new Delightful Bridge is decorated between City Hall and the National Hotel. Reservoir Replacement project going well and the engineering team worked out issues with the construction access road. Elizabeth Sewer Rehab began a couple weeks ago and should complete this week/next. Water leak near Walmart is corrected with help from Campbell Construction. This week started the fourth quarter sewer cleaning and CCTV hot spot paints.

Fire Chief, Ryan Pidgeon – Busy month, 181 calls for service in November, up from last year and on track to hit 2,200 call for service this year compared to 1,900 to 1,950 last year. Moving forward with refurbishment of two fire engines: #6332 refurbishment secured and will begin in Spring 2025 due to manufacturing issues/supply chain backlog. Attended the Amador County Hazard Mitigation Plan meeting- will be seeking input from each department to update the plan. There are good grant opportunities for hazard mitigation available.

Police Chief, Chris Mynderup – Christmas Delights went well with no law enforcement issues. 12/6/24 site visits were conducted at 3 homeless encampments that have become a nuisance in the city, located under the Hwy 49 bridge, Tyack Lane and at the Tailing Wheels dam at the Oro De Amador property. 16 individuals were contacted and issued trespass notices, educated on the new camping ordinance and directed to vacate each premises by 12/13/24. PD will be making routine checks of these areas to ensure compliance, and anyone remaining at these locations on 12/13/24 will be cited and/or arrested if they refuse to leave. He will be representing Jackson PD in the Sutter Creek Parade of Lights this Saturday.

Mayor McLean stated he has received a lot of positive feedback on Christmas Delights this year and expressed gratitude to Erika Simmons, the Economic Development Committee and Councilmember Gonsalves for their hard work on the Festival of Trees that received 1,200 public votes/participation.

Next year we may want to plan for a larger space to allow for more participation and additional trees due to the popularity.

City Attorney, Josh Nelson – No report.

City Manager, Carl P. Simpson – Attended Christmas Delights for the first time and volunteered with his wife.

December 9, 2024 City Council Meeting Minutes
APPOINTED OFFICIAL SEATING.

Swearing In and Seating of newly appointed Council Member.

Sierra McLean sworn in by Mayor McLean and took seat at the dais. b. Receive discuss and provide direction regarding (verbal) report from the Homeless Outreach Coordinator regarding the City’s response to homeless issues [Christine Platt].

Christine advised the application on the HAPP5 funding is due January 22, 2025. Amador County was awarded $488,274.00. Multiple agencies apply for a portion of this money. By comparison, Calaveras County received $233,000.00, Mariposa County $192,733.00, and Tuolumne County $360,454.00, indicative of the amount of work that needs to be put forward to help people who are unsheltered or seeking permanent housing. Christine shadowed the host team in Tuolumne County (outreach team), that works in conjunction with their police department, the Mathison Center nurses, Public Health, Probation, and Social Services. Their team does outreach to different areas within the county. The Lambert Community Center they have is run by nonprofit and community donations and behavioral health funds, and unhoused people can go there daily for food and to access computers and other resources. The enrichment center (a peer to peer community center), ran under Prop 63, is managed by Behavioral Health, offering food, showers, laundry services, and access to make appointment with other agencies like social services, etc. Tuolumne County also just opened a sanctioned campground, called “Camp Justice”, which offers 9 trailer spots for RV’s/travel trailers, and currently hosts 29 tents and a population of 50 people. It is a work in progress as they learn how to most effectively operate the camp. Strategically, every month they vacate the camp to allow for clean-up and to evaluate the structural integrity of the space to avoid creating a bigger mess.

In light of our recent “no camping in public spaces” ordinance, Jackson has expressed interest in learning about best practices utilized in other local police and cities for the unhoused. Modesto Police Department’s Senior Outreach Specialist advised when PD has contact with an unhoused individual there are Outreach Specialist on-call 24 hours a day who can be called out to provide resources and assist. In Tuolumne County, they offer alternative spaces for camping to the individuals who are being asked to move before moving forward with any enforcement action. It is important for Jackson and Amador County to consider providing alternative spaces for unhoused who are being asked to move from established encampments. It doesn’t make sense to require someone to move without offering them anywhere else to go. While Jackson may lack the resources to provide these spaces, we need to be putting more pressure on Amador County that has more people and resources to assist.

Mayor McLean opened the item for council discussion. Mayor McLean advised he has worked with Supervisor Goldenburg in Tuolumne County, who is very excited about some of the grant money they have received over the years to do this work. Christine advised they received $6.2 million dollars on the Encampment Resolution Fund because their agencies are all working together to find solutions. We are doing that here without that money. In Tuolumne, those funds are applied to fractions of current full time employees work- for example: a behavioral health worker that applies 10-12 hours of their work week to assisting unhoused- the grant money would pay for that time.

Mayor McLean inquired where the RV’s go in Tuolumne when they are forced to vacate the camps.

Christine advised there are rules and guidelines they have to follow to stay in the camps and it seems to be a work-in-progress there.

December 9, 2024 City Council Meeting Minutes
Mayor McLean thanked Chief Mynderup and advised that he received a nice compliment from Sheriff Redman on Jackson’s homeless enforcement efforts recently.

Mayor McLean asked for public comments and received none. c. Announcement and award to winning non-profit for the “Festival of Trees” contest [Erika Simmons, Economic Development Committee].

Erika Simmons of the Economic Development Committee provided an update on the Festival of Trees competition that received 1,269 public votes. The trees were purchased and donated by Duane and Julie Ven Huizen of Sunskid. The decorations were purchased and donated by local non-profits that competed. Trees were all donated to families in need throughout Amador County, identified by Interfaith Food Bank.

A Certificate of Recognition was provided to all 11 of the participating agencies and plaques, created and donated by Kevin Barnett of Gold Web Printing, were awarded to the top three contestants.

Erika reminded Council of the “Great Christmas Lights Show” competition, AKA citywide residential Christmas lights competition, which Council will be viewing on 12/16 and 12/17 to narrow down to the top 5 homes for public voting that begins on 12/18. Public will be able to view a map of the decorated homes on the City of Jackson website starting the evening of 12/18 and cast their vote between 12/18 and 12/29. Prizes will be awarded to the top 5 contestants near the end of the month.

Erika expressed her gratitude to the entire Economic Development Committee and everyone who helped during the Christmas Delights event and at the Festival of Trees. The EDC works very well together to make things happen. She introduced each of the members, present in the audience.

Page 8 of 53 ends

December 9, 2024 City Council Meeting Minutes
Mayor McLean thanked Erika for all of her hard work and dedication to the success of these competitions. There were additional nonprofits that were interested in participating so next year maybe we can plan for a larger space and more trees to accommodate more agencies interested in participating.

Council member Gonsalves thanked Erika for her hard work in putting this all together and everyone involved in the success of the competitions and Christmas Delights. The Festival of Trees idea came from and episode from the show “Virgin River” and it was a great success here in Jackson. d. Receive, discuss and provide direction regarding the Beautification Committee’s presentation on the Archway Project for Downtown Historic Jackson [Tracy Tonnesen & Stacey Landreth, Jackson Realty].

Tracy Tonnesen and Stacey Landreth of Jackson Realty presented the Archway concept for historic downtown main street, advising the expected cost could be $250,000.00 which is planned to be paid through private investors and/or fundraising.

A “Diner En Blanc” style dinner on downtown Main Street is being planned for hopefully Spring 2025 to raise funds, along with selling sponsored personalized bricks to be installed in downtown Jackson for many years to come.

Mayor McLean opened the item for council discussion. Councilmember Godde inquired if banners will still be allowed to go up in that location once the arch is up. Mayor McLean responded that the banners will still be visible behind the arch. Landreth advised they hang lower and possibly can be hung further over above the firehouse. Councilmember Sierra McLean inquired if the banners could be hung underneath the arch. Landreth advised the arch height requirements would not allow for banners below. Mayor McLean advised in addition to the arch, SB1 funds are being used to repair the Mattley Hillside, and the Economic Development Committee is focusing on beautifying another area near Chevron/Davenport on Caltrans property (all entering downtown Main Street). Tonneson encouraged that each of these projects are meant to support economic growth, drawing people downtown, and to improve Jackson’s image. Mayor McLean reminded everyone that the Economic Development Committee has helped to get new signs up around the City and with the new street art going up downtown, improving our downtown district as cheaply as possible is the goal.

Tonneson requested Council’s approval to move forward with the Archway project.

Mayor McLean asked for public comments and received none.

City Attorney Nelson advised general consensus is appropriate for this item.

Consensus was expressed by all five councilmembers in support of the Archway project moving forward as requested.
e. Consideration of bids and possible award to purchase two (2) Public Works trucks [Bree Wilder, PW Superintendent].

Page 9 of 53 ends

December 9, 2024 City Council Meeting Minutes
Assistant PW Supt Hoaas advised that Public Works did their due diligence in comparing Fords and Chevys, and the best deal for the price were with the Toyota pickups.

City Manager Carl Simpson advised the current vehicles would still be used by other public works staff. With more environmental restrictions coming down the line that may prohibit the City from purchasing gas vehicles in the future, now is a good time to move on purchasing these trucks.

Councilmember Godde inquired on use of these vehicles. PW Supt Hoaas advised the two trucks will be used by himself and PW Supt Wilder for inspections and getting around town, though not for any big scale jobs.

Councilmember Gonsalves requested that, due to the minimal $1000.00 difference in bids, Public Works check back in with Thompson’s Toyota before approving the purchase from Auburn since they regularly advertise in our community. Vice Mayor Simmons inquired if this was a sealed bid.

Hoaas advised it was not.

Mayor McLean asked for public comments and received none.

Mayor requests a motion.

Motion to award the bid for the purchase of two (2) Public Works trucks from Auburn Toyota on December 9, 2024, on the condition that they provide Thompson’s Toyota the opportunity to meet the deal first. Moved by Councilmember Gonsalves, seconded by Councilmember Godde, and carried by a 5 to 0 vote:

AYES: McLean, Simmons, Godde, Gonsalves, McLean
NOES: None
ABSENT: None
ABSTAIN: None

City of Jackson
Council Meeting Memorandum
Monday, January 13, 2025 – 6:30 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Carl Simpson, City Manager
Carleen Kirkpatrick, Deputy City Clerk
Date: January 3, 2025
Agenda Item #6c: City Council ~ Committee Assignments
Recommendation:

That the Mayor reviews the attached list of committee positions with the City Council and determines the 2025 committee assignments.

Summary and Discussion:

Each year the Mayor reviews and makes assignments to the numerous committees and liaison roles required of city council members. The attached list is a roster of all 2024 assignments detailing the current appointed members and meeting times of the various committees and organizations. With Councilmember Bob Stimpson’s departure from Council at the end of October 2024 (due to moving outside Jackson city limits), each of his committee assignments need to be filled by another council member.

It is recommended that the Mayor make appointments to be confirmed by the City Council at the January 27, 2025 meeting.

CITY OF JACKSON
Council Meeting Memorandum
Monday, January 13, 2025 – 6:30 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Carl Simpson, City Manager
Carleen Kirkpatrick, Deputy City Clerk
Date: December 19, 2024
Agenda Item #6d: Road Conditions on French Bar Rd, West of Hwy 49 Recommendation
Council discretion.

Summary and Discussion
On December 17, 2024, Mr. Paul Omaleki contacted the City to report poor road conditions along French Bar Road, west of Highway 49, beyond the residential area. Mr. Omaleki recently acquired 160 acres of land on French Bar Road and has expressed plans to construct a home on the property.

Mr. Omaleki reported significant issues with the road, including numerous potholes, extensive patchwork, and areas affected by repeated flooding. These conditions have been confirmed by City staff, who have observed the deteriorated sections of the road and noted damage to embankments caused by flooding in December 2022.

Mr. Omaleki is formally requesting that this section of French Bar Road be repaved to address these concerns.

(Upon request from Mayor McLean)
Date: January 9, 2025
Agenda Item #6e: City Council Meeting – Regular Meeting Time and/or Frequency Current Regular Meeting Schedule: Second and fourth Mondays of each month at 7:00 PM.

This schedule is established by Jackson Municipal Code section 2.04.020. ______________________________________________________________________________ RECOMMENDATION:

Transparency and community involvement should be central to any decisions.

DISCUSSION:

The Council last discussed regular meeting times and frequency on November 12, 2024. With the fifth Council seat now filled, this topic is being revisited. Below are the considerations for potential changes to meeting times or frequency:

1. Regular Meeting Time:
• The average meeting length over the past year has been approximately 50 minutes. • Changing the start time to an earlier hour could help to offset slightly longer meetings that result from the potential reduction in frequency.
• An earlier start may benefit Council and staff schedules, allowing attendees to return home to their families earlier in the evening, but may exclude members of the public who cannot attend at that time.

Time Options:
7:00 PM: Current start time (status quo).
6:30 PM: Trial start time used over the past year due to adjournment. 6:00 PM: Most common start time among comparable cities. 5:30 or 5:00 PM: Slightly earlier than other cities.

Daytime: Similar to the Amador County Board of Supervisors and the Amador Water Agency.

Item 6e

2. Meeting Frequency:
• Meetings cancelled due to a lack of quorum or other untimely cancellations result in wasted staff time and resources.
2024: 6 meetings cancelled, resulting in 18 regular meetings/year 2023: 4 meetings cancelled, resulting in 20 regular meetings/year 2022: 5 meetings cancelled, resulting in 19 regular meetings/year • Reducing frequency will save staff time/resources, to be utilized for other projects. • Special meetings can be scheduled for time-sensitive issues. • Expenditures may be approved by the City Manager between meetings. • Reduced meeting frequency may be more manageable for working professionals. • Other cities in California of a similar size to Jackson, such as Calistoga, Williams, Elverta, Bear Valley Springs, Keyes, Kensington, and Loomis, meet once per month (Calistoga currently meets tri-weekly).

Frequency Options:

Bi-monthly: 24 meetings/year (status quo).

Tri-weekly: 17 meetings/year.

Monthly: 12 meetings/year.

To enact any changes to the meeting schedule, the Council would need to introduce and enact an ordinance to amend the municipal code. This requires a formal process that involves public input and approval from the City Council.

CITY OF JACKSON
Council Meeting Memorandum
Monday, January 13, 2025 – 6:30 PM Regular Meeting
To: Honorable Mayor and Members of the City Council
From: Carl Simpson, City Manager
Carleen Kirkpatrick, Deputy City Clerk
Date: January 9, 2025
Agenda Item #6f: License Agreement with Restore Amador, LLC.

Recommendation
Staff recommends Council approve the proposed license agreement with Restore Amador, LLC.

Summary and Discussion
On June 24, 2024, Jaime and Patrick Macklin, owners of Restore Amador, LLC, submitted a proposal in response to the City’s annual “RFP for Tourism and Business Promotion, Economic Development and Downtown Revitalization Programs” seeking support from TOT funds for property improvements to the original Amador County Courthouse, parking lot and a patio at 204 Court Street which they recently purchased and plan to restore.

The Council approved a motion to allocate $25,000.00 to Restore Amador, LLC, and directed staff to work with the Macklins on an agreement that would be brought back for further Council consideration. The Council key discussion points included the use of the parking lot, potential restrictions on building use to activities promoting tourism, and a possible return of funds to the City if the property is sold within a designated time frame. These specific conditions were to be further outlined in the agreement and returned for final Council approval.

Staff engaged numerous discussion with several revisions to the draft agreement without reaching consensus. At the November 12, 2024 Council meeting, Patrick and Jaime Macklin expressed concerns about the City's use of the facility in perpetuity but had no issue with the repayment clause. The City Manager clarified further discussion was needed to ensure the terms of the agreement met grant requirements, with the City Attorney confirming the grant should have a public purpose and be formalized in a contract before moving forward. The draft presented for approval today changed the agreement term to five years, and if the Restore Amador, LLC sells the property within five years of the grant approval date, they will repay the prorated amount based on 60 months, instead of the full 100%. This agreement addresses and resolves the concerns of all parties involved and staff recommends Council approval.
