GASOLINE SERVICE STATIONS FOR AN ADDITIONAL PERIOD OF
ONE (1) YEAR
Staff Report presented by Joe Perez, Community Development Director. Mr. Perez provided background of this item, stating that a t the July 1, 2021 City Council meeting, the Council discussed a concern with the oversaturation of gasoline service station uses in the City and that the current zoning regulations do not adequately address the oversaturation, use compatibility and other potential impacts from gasoline service station uses. Mr. Perez reported that on August 5, 2021, the City Council imposed a temporary moratorium on the approval of any new gas stations. On September 2, 2021, the City Council extended the moratorium, which is set to expire on August 4, 2022. He noted that extra time is necessary to thoroughly research and evaluate land use regulations and standards for gasoline service station land uses. Tonight, the Council is being asked to extend the moratorium to August 4, 2023. The extension will allow time to finish preparation and adoption of a zoning code amendment to establish appropriate development standards and processing requirements for gasoline service stations.
Council Member Brian Berkson suggested that the final draft ord inance include new types of technology including alternative fuels.
Further discussion followed regarding the timeline of the moratorium.
City Attorney Peter Thorson clarified how state law governs interim urgency ordinances.
Council Member Brian Berkson questioned why was this brought forward at a special meeting instead of at a regular meeting.
Joe Perez, Community Development Director responded with the timing of the interim urgency ordinance.
Mayor Chris Barajas opened the public hearing and called for any public comments.
There being no further comments, the public hearing was closed.
