17. COUNCIL BUSINESS

A. ORDINANCE PROHIBITING CAMPING ON PUBLIC PROPERTY

AND ENFORCEMENT OF PROHIBITION OF CAMPING AND

STORAGE

City Attorney Peter Thorson presented the Staff Report. Mr. Thorson referred to the recent U.S. Supreme Court case of the City of Grants Pass v. Johnson, which upheld ordinances of the City of Grants Pass that prohibited camping on public property and upheld the authority of the city to enforce those regulations.

This case overruled a 2019 9th Circuit case of Martin v . the City of Boise, in which the plaintiffs alleged the City’s ordinances were unconstitutionally targeted at the city's homeless population. Mr. Thorson described the City’s efforts to clean up dangerous and unhealthful encampments throughout the city, noting that the proposed ordinance would include civil penalties.

Alma Mendoza voiced concern that homeless individuals continuously enter onto her property and she and her family do not feel safe.

Further discussion followed.

A motion was made by Council Member Chris Barajas , seconded by Council Member Leslie Altamirano, to introduce Ordinance No. 2024-19, entitled:
