STAFF REPORT
MEETING DATE: September 14, 2022
PRESENTER: Marci Reyes, City Clerk
SUBJECT: Remote City Council Meetings Under New Brown Act Requirements (AB 361)
RECOMMENDATION: Council by motion adopt resolution reauthorizing remote teleconference public meetings by the City Council and all boards, commissions, and standing committees of the City in accordance with Assembly Bill 361.

EXECUTIVE SUMMARY:

On September 16, 2021, Governor Gavin Newsom signed AB 361 into law. AB 361 amends the Brown Act to allow for remote public meetings without having to comply with standard provisions and restrictions for remote meetings under the Brown. AB 361 temporarily writes into the Brown Act some remote meeting requirements the City has already met and implemented under the Governor’s prior Executive Orders issued during the COVID-19 pandemic. AB 361 includes additional requirements in the form of an initial authorizing resolution (effective for up to 30 days) and subsequent resolutions to extend the use of remote meetings for additional periods of 30 days thereafter. The bill included an urgency provision making the law immediately effective upon signature by the Governor.

The City Council adopted the following resolutions authorizing remote meetings in accordance with AB 361:
 October 13, 2022 Res No. 21-78  April 13, 2022 Res No. 22-22  November 10, 2021 Res No. 21-85  May 11, 2022 Res No. 22-29  December 22, 2021 Res No. 21-91  June 22, 2022 Res No. 22-39  January 12, 2022 Res No. 22-02  July 13, 2022 Res No. 22-47  February 9, 2022 Res No. 22-07  August 10, 2022 Res No. 22-62  March 9, 2022 Res No. 22-15  August 24, 2022 Res No. 22-64  March 23, 2022 Res No. 22-20
If the City Council wishes to continue to utilize remote meetings under AB 361, the City Council needs to adopt a reauthorizing resolution such as that attached to this staff report.

STAFF REPORT
MEETING DATE: September 14, 2022
PRESENTER: Jerry Jones, City Engineer
SUBJECT: Council conduct a Public Hearing and adopt resolution authorizing the submission of an application for Community Development Block Grant funds for Fiscal Year 2023-2024 for the Plaza Veterans Park Restroom RECOMMENDATION: Council conduct Public Hearing and adopt resolution authorizing the submission of an application for Community Development Block Grant funds for Fiscal Year 2023-2024 for the Plaza Veterans Park Restroom Building.

EXECUTIVE SUMMARY:

The City of Kerman receives an annual allocation of Federal Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development (HUD) through an agreement with the County of Fresno (County). The City’s funding allocation for FY 2023-2024 is $140,000. Staff submitted an application for the replacement of the restroom building at Plaza Veterans Park to the County for eligibility approval. The County has determined that the proposed Project is eligible.

The County receives an annual allocation of CDBG funds from HUD and, through an agreement with local participating Cities, makes a portion of the CDBG funds available to each City. The City’s FY 2023-2024 funding allocation is $140,000. Projects for which CDBG funds can be used must benefit areas within the City with at least 51 percent low to moderate income households, senior citizens, or persons with disabilities.

The proposed Project is the replacement of the existing restroom building at Plaza Veterans Park with a prefabricated restroom building. The Project will also include the modification and/or replacement of the necessary utility services to serve the building and any required concrete flatwork. This Project is located within an eligible area, with over 73 percent of the area being low to moderate income households. A preliminary application for the proposed Project was submitted to the County for verification of project eligibility and the County has determined the Project to be eligible for funding.

A Public Hearing is required to be held to allow interested citizens the opportunity to comment on projects or activities submitted for CDBG funding. The Notice of Public Hearing was published in the Kerman News on August 31, 2022, and posted at City Hall.

FISCAL IMPACT:

The total estimated cost of the project is $170,200. The City’s FY 2023-2024 CDBG funding allocation is $140,000. The additional $30,200 is proposed to be funded from the General Fund.
